THE GENERAL EDUCATION LAW OF 4 AUGUST 1970 PROVIDES IN ITS EXPLANATORY STATEMENT THE CREATION OF GUIDANCE SERVICES AT ALL LEVELS OF EDUCATION TO INTENSIFY THE EDUCATION OF THE EDUCATION SYSTEM. FOR THIS PURPOSE, ARTICLE 9.4 OF THE SAME LAW PROVIDES THAT THE EDUCATIONAL AND PROFESSIONAL ORIENTATION SHOULD BE A CONTINUOUS SERVICE THROUGHOUT THE EDUCATIONAL PROCESS, WHICH, IN THE LIGHT OF THE PERSONAL CIRCUMSTANCES OF THE STUDENTS, FACILITATE DECISION-MAKING IN A CONSCIOUS AND RESPONSIBLE WAY.

MOREOVER, ARTICLES 125 AND 127 RECOGNIZE THE RIGHT THAT STUDENTS HAVE IN EDUCATIONAL AND PROFESSIONAL ORIENTATION FOR THE CHOICE OF STUDIES AND WORK ACTIVITIES THAT ENSURE THEIR EFFECTIVE INCORPORATION INTO THE WORLD OF STUDY AND WORK.

THEREFORE, THE ORIENTATION IN THE NEW LAW IS CONCEIVED AS AN ESSENTIAL ACTIVITY OF THE EDUCATIONAL PROCESS, WHICH, INTERESTED IN THE INTEGRAL DEVELOPMENT OF THE STUDENT, INDIVIDUALLY AND SOCIALLY CONSIDERED, HELPS HIM IN THE KNOWLEDGE, ACCEPTANCE AND DIRECTION OF HIMSELF TO ACHIEVE THE BALANCED DEVELOPMENT OF HIS PERSONALITY AND HIS INCORPORATION INTO COMMUNITY LIFE.

ALTHOUGH GUIDANCE IS A COOPERATIVE TASK FOR ALL THOSE INVOLVED IN EDUCATION, PARENTS AND TEACHERS ARE UNIQUELY IMPORTANT FOR THEIR PERSONAL AND ONGOING RELATIONSHIP WITH STUDENTS, AND IT WILL BE EFFECTIVE IF THEY TEACHERS, WITH SUPPORT, IN THEIR CASE, OF PERSONNEL SPECIALIZED IN THE TASKS OF DIAGNOSIS AND THE ELABORATION OF RECOVERY PROGRAMS, BECOMES AWARE OF THEIR ROLE AND ACCOMMODATES THEIR TEACHING-DIDACTIC TO THE REQUIREMENTS DERIVED FROM THE STUDY DONE IN COLLABORATION WITH THE TECHNICAL STAFF.

THE COMPLEMENTARY PROVISIONS OF THE GENERAL EDUCATION ACT HAVE BEEN BASED ON THE NEED FOR SCHOOL, PERSONAL AND PROFESSIONAL GUIDANCE, BASED ON DATA TO BE REFLECTED IN THE STUDENT ' S PERSONAL FILE, AS A NECESSARY STEP TO ACHIEVE AN EFFECTIVE EDUCATION, WITH NO TECHNICAL AND ADMINISTRATIVE CHANNELS HAVING BEEN ESTABLISHED SO FAR.

ALL OF THIS MAKES IT NECESSARY TO SET UP SCHOOL GUIDANCE SERVICES WHICH ASSUME THE FUNCTIONS WHICH ARE PROVIDED BY THE GENERAL LAW ON EDUCATION AND THE ACCOMPANYING PROVISIONS ON GUIDANCE.

IN ITS VIRTUE, PRIOR TO THE REPORT OF THE NATIONAL COUNCIL OF EDUCATION, THIS MINISTRY HAS PROVIDED THE FOLLOWING:

FIRST.-TO THE EFFECTS PROVIDED FOR IN ARTICLES 9, 4; 125 AND 127 OF THE GENERAL LAW OF EDUCATION, A SCHOOL AND VOCATIONAL GUIDANCE SERVICE SHALL BE ESTABLISHED ON AN EXPERIMENTAL BASIS IN THE PROVINCES DETERMINING THE DIRECTION GENERAL OF BASIC EDUCATION, WITH THE ORGANISATION AND FUNCTIONS COVERED BY THIS PROVISION.

SECOND. THE SERVICES INDICATED IN THE PRECEDING PARAGRAPH WILL DEPEND, AT THE CENTRAL LEVEL, ON THE GENERAL DIRECTION OF BASIC EDUCATION.

THIRD. IN PROVINCES, THESE SERVICES WILL BE ADMINISTRATIVELY DEPENDENT ON THE PROVINCIAL DELEGATION OF THE MINISTRY OF EDUCATION AND SCIENCE AND FUNCTIONALLY FROM THE TECHNICAL EDUCATION INSPECTION SERVICE.

IN THE PROVINCES IN WHICH SUCH SERVICES ARE ESTABLISHED, THERE SHALL BE AN INSPECTOR WHO DIRECTS, SUPERVISES AND COORDINATES THE ACTIVITIES OF THOSE DEPARTMENTS.

FOURTH. THE GUIDANCE SERVICES THAT ARE CREATED WILL, IN THE FIELD OF THEIR COMPETENCE, DEVELOP THE FOLLOWING FUNCTIONS:

-DIRECTING OR PERFORMING, WHERE APPROPRIATE, THE TASKS OF SCHOOL, PERSONAL AND VOCATIONAL GUIDANCE OF THE STUDENTS, ESPECIALLY IN THE CRITICAL MOMENTS OF THEIR SCHOOLING AND OF THEIR PSYCHO-BIOLOGICAL MATURITY.

-ADVISING AND ASSISTING TEACHERS OF BASIC GENERAL EDUCATION IN THEIR ROLE AS TUTOR.

-INFORM PARENTS, TEACHERS AND STUDENTS OF THE POSSIBILITIES OF STUDY AND PROFESSIONAL PERSPECTIVES IN THE PROVINCIAL AND NATIONAL AREAS.

-PROPOSE RESEARCH PAPERS ON SCHOOL LEARNING PROCESSES IN DIFFERENT CULTURAL AREAS.

-COOPERATE IN THE NATIONAL INSTITUTE OF SPECIAL EDUCATION IN THE LOCATION AND DIAGNOSIS OF STUDENTS IN NEED OF SPECIAL EDUCATION.

QUINTO. -1. THE SCHOOL AND VOCATIONAL GUIDANCE SERVICES WILL HAVE SPECIALIST TECHNICAL STAFF, WHO WILL BE APPOINTED ON TEMPORARY SECONDMENT BY THE DIRECTORATE-GENERAL OF STAFF ON A PROPOSAL FROM THE DIRECTORATE-GENERAL FOR BASIC EDUCATION. OFFICIALS OF THE BODY OF BASIC GENERAL EDUCATION TEACHERS WHO MEET THESE CONDITIONS:

A) ANY OF THE FOLLOWING QUALIFICATIONS:

-DEGREE IN PHILOSOPHY AND LETTERS, SECTION PSYCHOLOGY.

-GRADUATE IN PHILOSOPHY AND LETTERS, SECTION OF PEDAGOGY.

-GRADUATE IN ANY FACULTY OR TECHNICAL SCHOOL AND GRADUATE IN SCHOOL PSYCHOLOGY.

B) CREDIT A MINIMUM OF THREE YEARS ' EXPERIENCE BETWEEN TEACHING IN BASIC GENERAL EDUCATION AND GUIDING ACTIVITIES AT ANY LEVEL.

2. WHERE THERE IS NO TECHNICAL STAFF SPECIALISING IN THE BODY OF TEACHERS OF BASIC GENERAL EDUCATION WHO FULFILS THE CONDITIONS SET OUT IN THE PRECEDING PARAGRAPH, THE PERSON WHO IS IN POSSESSION OF THEM SHALL BE RECRUITED. SIXTH. THE SELECTION OF SPECIALIZED TECHNICAL PERSONNEL, WHETHER IT IS A PROPOSAL FOR A COMMISSION OF SERVICE OR A CONTRACT, SHALL BE MADE BY MEANS OF A PUBLIC PROVINCIAL CONTEST, CONVENED AND RESOLVED BY A COMMISSION CONSTITUTED FOR THE PURPOSE, COMPOSED OF THE PROVINCIAL DELEGATE FOR EDUCATION AND SCIENCE, THE HEAD OF THE PROVINCE ' S TECHNICAL INSPECTION SERVICE, THE COORDINATING TECHNICAL INSPECTOR, THE HEAD OF THE PERSONNEL UNIT OF THE RESPECTIVE DELEGATION, WHO WILL ACT AS SECRETARY, AND A PROFESSOR OF THE BODY OF TEACHERS OF BASIC GENERAL EDUCATION MEETING THE CONDITIONS OF PARAGRAPH 5., 1, APPOINTED BY THE DELEGATE ON A PROPOSAL FOR INSPECTION.

SEVENTH. THE HEADQUARTERS OF THE SCHOOL AND VOCATIONAL GUIDANCE SERVICES SHALL BE DETERMINED BY THE PROVINCIAL DELEGATE, WHO IS HEARD BY THE TECHNICAL EDUCATION INSPECTION SERVICE.

EIGHTH. AT THE END OF THE SCHOOL YEAR, EACH SCHOOL ORIENTATION SERVICE WILL REPORT TO THE GENERAL DIRECTORATE OF BASIC EDUCATION DETAILING THE ACTIVITIES CARRIED OUT AND EVALUATING THE EXPERIENCE.

NINTH. -AGENCIES AND ENTITIES THAT ARE CARRYING OUT ACTIVITIES SIMILAR TO THOSE ENTRUSTED TO THE SCHOOL AND VOCATIONAL GUIDANCE SERVICES IN THIS ORDER MAY REQUEST THE DECLARATION OF COLLABORATING ENTITIES, AGREEMENT WITH THE CONDITIONS THAT THE MINISTRY OF EDUCATION AND SCIENCE DETERMINES.

TENTH.-THE GENERAL DIRECTIONS OF BASIC EDUCATION AND PERSONNEL, WITHIN THE SCOPE OF THEIR RESPECTIVE COMPETENCES, ARE AUTHORIZED TO ISSUE THE RELEVANT INSTRUCTIONS THAT ARE DEVELOPED IN THIS PROVISION.
