The changes operated by Royal Decree 1887/2011 of 30 December, establishing the basic organic structure of the ministerial departments and Royal Decree 342/2012 of 10 February, for which the Basic organic structure of the Ministry of Foreign Affairs and Cooperation, requires the adaptation of the Statute of the Spanish Agency of International Cooperation for Development to accommodate in its governing bodies the Secretary General of International Cooperation for Development, which assists the Secretary of State International and Latin American cooperation in the formulation, direction, implementation, monitoring and evaluation of the international cooperation policy for the development and coordination of cultural action abroad.

On the other hand, Article 10 (2) (l) of the Royal Decree 342/2012 of 10 February 2012 provides that the Secretary-General for International Cooperation for Development shall be responsible for the relationship with the Consultative bodies and the coordination of Spanish cooperation; the preparation of the cases and the implementation of the agreements of the Sectoral Conference on Development Cooperation, of which the Secretariat and its support bodies are to exercise; the accountability of the activities and results of the Spanish cooperation to the General Cortes and the Spanish society; and the development of communication policy in this field. "

This forecast advises the modification of the regulatory norms of the advisory and coordination bodies of the development cooperation established in article 21 of Law 23/1998, of July 7, of Cooperation International for Development, to make room for them as a member of the General Secretariat of International Cooperation for Development. It is also appropriate to amend the regulatory regulations of the Water and Sanitation Cooperation Fund and the Office of the Fund for the Promotion of Development with the same subject matter as regards the composition of its committees. executives.

In relation to these two Funds, it is advisable to place the Office of the Cooperation Fund for Water and Sanitation in the Directorate of Cooperation with Latin America and the Caribbean, as it is in that region in which the Fund develops exclusively its activity. Similarly, the Office of the Fund for the Promotion of Development, which, in accordance with the additional provision of Law 36/2010, of 22 October, of the Fund for the Promotion of Development, must administer, with the rank of Management, the same, is integrated into the Directorate for Multilateral, Horizontal and Financial Cooperation under the responsibility of its Director.

In its virtue, at the initiative of the Minister for Foreign Affairs and Cooperation, on a proposal from the Minister of Finance and Public Administrations and after deliberation by the Council of Ministers at its meeting on 11 October 2012,

DISPONGO:

Article first. Amendment of the Statute of the Spanish Agency for International Cooperation for Development, approved by Royal Decree 1403/2007 of 26 October.

The Statute of the Spanish Agency for International Cooperation for Development, approved by Royal Decree 1403/2007 of 26 October, is amended as follows:

One. Article 10 (1) is worded as follows:

" 1. They are the governing bodies of the Spanish Agency for International Development Cooperation:

i. The Presidency. The President shall be replaced in cases of absence, vacancy or illness by the Vice President of the Governing Council.

ii. The Governing Council. "

Two. The title of Article 11 is worded as follows:

" 11. The Presidency. "

Three. Article 11 (2) (c) shall be deleted.

Four. Article 11 (3) is deleted.

Five. Article 12 (2) is worded as follows:

" 2. The Governing Council shall be composed of the following members:

a) President: President of the Spanish Agency for International Cooperation for Development.

b) Vice-President: Secretary-General for International Development Cooperation, which will replace the President in cases of absence, vacancy or illness.

c) Vocals:

The Director of the Spanish Agency for International Development Cooperation.

Two Directors-General of the Ministry of Foreign Affairs and Cooperation, freely appointed by the Minister.

Two officials from the Ministry of Foreign Affairs and Cooperation, appointed freely by the Minister, with the rank of Deputy Director General or equivalent.

On behalf of other Ministries, with a minimum rank of Director General, the Rector Board will integrate four people:

The Director General Macroeconomic Analysis and International Economics of the Ministry of Economy and Competitiveness.

The Director General of Trade and Investment in the Ministry of Economy and Competitiveness.

Six. Article 12 (8) (l) shall be deleted.

Seven. Article 13 is worded as follows:

" 1. A Standing Committee is hereby set up within the Governing Council to decide on the matters to which it is attached.

2. The Standing Committee shall carry out the duties entrusted to it by the Governing Council, with the exception of those referred to in Article 12 (8) (a) up to (n). The agreements of the Permanent Commission will be effective and will produce effects from the moment they are adopted. The Governing Council will ratify these agreements, and may revoke them when there are extraordinary causes to advise.

3. The President, the Vice-President of the Governing Council and the Director of the Agency shall be part of the Commission. The Secretary-General of the Agency shall act as the Secretary of that Commission, with a voice but without a vote.

4. The Standing Committee shall meet at least bimonthly. "

Eight. Article 16 is worded as follows:

" The Advisory Board of the Spanish Agency for International Cooperation for Development is hereby established as an advisory body.

It will consist of twelve people, all of whom are recognized for their experience and knowledge in fields related to international cooperation and development. His appointment and dismissal will be carried out by the President of the Rector Council, for which he will listen to the proposals of his members.

The Presidency will be held by the President of the Agency, who will be replaced in cases of absence, vacancy or illness by the Vice President of the Governing Council.

The Advisory Board shall meet at least annually.

Your members will not be paid, but, if appropriate, they will be entitled to compensation for travel expenses, stays and transfers that give them their dedication to the Council, according to Royal Decree 462/2002 of 24 May, on compensation for the service. "

Nine. Article 17 is worded as follows:

" Article 17. Basic structure.

1. The Agency shall have the basic administrative structure contained in this Section.

2. Under the hierarchical dependency of the Agency Director there will be in Spain:

The Directorate for Cooperation with Latin America and the Caribbean;

The Directorate for Cooperation with Africa and Asia;

The Multilateral, Horizontal, and Financial Cooperation Direction;

The Cultural and Scientific Relations Directorate;

The General Secretariat;

The Office of Humanitarian Action.

3. It is the responsibility of the Directorate for Cooperation with Latin America and the Caribbean to promote, manage and implement the public policies of international cooperation for development aimed at the fight against poverty and the achievement of a sustainable human development in the countries of Latin America and the Caribbean, without prejudice to the competences of other ministerial departments.

This Directorate will manage, implement and manage the Water and Sanitation Cooperation Fund created by the additional sexagesth provision of Law 51/2007 of December 26, of General State Budgets. for 2008, performing the functions established regulentarily.

The address holder will direct and coordinate the following departments:

a) The Department of Cooperation with Central America, Mexico and the Caribbean;

4. It is the responsibility of the Directorate for Cooperation with Africa and Asia to promote, manage and implement the public policies of international cooperation for development aimed at the fight against poverty and the achievement of human development. sustainable in the Arab, African and Asian countries, without prejudice to the competences of other ministerial departments.

The address holder will direct and coordinate the following departments:

a) The Department of Cooperation with Sub-Saharan Africa;

5. The Management of Multilateral, Horizontal and Financial Cooperation is the responsibility of the Office of the Fund for the Promotion of Development and the Administration of the Fund, in accordance with the terms laid down in Law 36/2010 of 22 October 2010. The address holder will direct and coordinate the following departments:

a) The Department of Sectoral Cooperation;

b) The Department of Non-Governmental Development Organizations;

c) The Multilateral Cooperation Department;

d) The Department of the FONPRODE Office and Financial Cooperation.

6. It is the responsibility of the Directorate of Cultural and Scientific Relations to promote, manage and implement the public policies of cultural cooperation for development; the management of the cultural services of the AECID; cooperation in the field (i) the training of human capital; university and scientific cooperation for development; international relations and conventions in the cultural and scientific fields; the powers conferred on the Ministry of Foreign Affairs and Cooperation for the promotion and development of cultural and scientific relations with others countries and the coordination of external cultural action, without prejudice to the competences of other ministerial departments.

The address holder will direct and coordinate the following departments:

a) Department of Cultural Cooperation and Promotion;

b) Department of University and Scientific Cooperation;

c) Department of Coordination of Cultural and Scientific Relations.

7. It is up to the General Secretariat to perform the functions related to the management and administration of human resources, including the training of human resources, the management of the economic and financial, computer, logistical and material resources, as well as the procurement, organisation and production of regulations, advice, quality in management, inspection, archiving and registration, in close coordination with the competent units of the Ministry of Foreign Affairs and Cooperation, with the aim of provide the necessary support to the bodies and units of the Agency for compliance of their functions.

The head of the General Secretariat will direct and coordinate the following departments:

a) The Department of Human Resources, Conciliation and General Services;

b) The Department of Economic, Financial and Budgetary Management;

c) The Information Systems and Technologies Department.

8. The Office of Humanitarian Action is responsible for the management and implementation of the official humanitarian action, in accordance with the Director Plan, and the coordination of the capacities of the General Administration of the State with those of the Autonomous Government and (a) local, consistent with the strategy adopted in this field by the United Nations and the European Union. The head of the Office of Humanitarian Action will lead and coordinate the Emergency and Post-conflict Department.

9. It also depends on the Director of the Agency, the Technical Cabinet, which is responsible for carrying out the advisory and immediate assistance activities entrusted to it by the Agency, as well as for communication, awareness raising and education for the development. The Planning, Effectiveness and Quality Unit is integrated into the Technical Cabinet, which corresponds to the functions of operational programming, monitoring and analysis for the improvement of the quality of the aid.

10. It is assigned to the Management of the Agency the Delegated Intervention, without prejudice to its functional and organic dependence on the General Intervention of the State Administration,

11. The external structure of the Agency, consisting of the Technical Cooperation Offices, the Training Centres and the Cultural Centres, depends on the Head of the Agency. Annex I to this Statute lists the Technical Cooperation Offices, the Training Centres and the Operational Cultural Centres at the date of approval of this Statute.

12. The Minister for Foreign Affairs and Cooperation shall, on a proposal from the Agency's Governing Council, and in the framework of the Management Contract, be responsible for the approval of the Minister for Finance and Public Administration. the creation, modification or deletion of the Agency's bodies abroad, by ministerial order. The approval of these ministerial orders shall entail the automatic updating of Annex I to this Statute.

13. The Director of the Agency may delegate to the heads of the Directorates, the General Secretariat and the Office of Humanitarian Action the direction, coordination and dialogue with the structure of the centres abroad. In the exercise of the powers delegated to them, they may send, in their respective fields and on behalf of the Agency's Directorate, formal communications and instructions to the coordinators of the Technical Cooperation Offices. and to the directors of the Training and Cultural Centres.

14. In order to strengthen coordination and teamwork between the different areas and units of the Agency, the Director may set up working groups responsible for a particular task, of a temporary or permanent nature, composed of persons of different units, with the purpose and functions that they decide to grant to them and under the responsibility of a person who is part of the management staff of the AECID. The decision on the establishment of each working group, its composition, tasks entrusted to it and the responsibility of the task force shall be solely the responsibility of the Director of the Agency. "

Ten. Article 18 is worded as follows:

" Article 18. Supply of the heads of management bodies.

In the cases of vacancy, absence or illness of the head of the Directorate of the Agency, the Directorates or the General Secretariat, and in default of appointment of the alternate as provided for in Article 17 of the Law 30/1992, of 26 November, of the Legal Regime of the Public Administrations and of the Common Administrative Procedure, will be the responsibility of the governing bodies dependent on it in the order in which they appear in the respective ones structure set out in this Statute. '

Article 2. Amendment of Royal Decree 22/2000 of 14 January regulating the composition, powers, organisation and functions of the Interterritorial Development Cooperation Commission.

g) A representative, with a category of at least Director General, of the following Ministries: Foreign Affairs and Cooperation; Finance and Public Administrations, Justice; Interior; Promotion; Education, Culture and Sport; Employment and Social Security; Agriculture, Food and Environment; Economy and Competitiveness; and Health, Social Services and Equality.

h) The holder of the General Secretariat for Development Policies of the General Secretariat for International Cooperation for Development.

i) A representative of each of the Autonomous Communities and the cities of Ceuta and Melilla, which must be a member of the Consejeria or equivalent body that in each one of those manages the matters related to the development cooperation, with a rank not less than that of a director general.

(j) Nineteen representatives of local authorities who manage funds conceptualised in their respective budgets as official development assistance, or of supra-specific bodies in which they expressly delegate, in The European Union is a European Union. b) Six vowels representing non-governmental development organizations: the person holding the Presidency of the Coordinator of Non-Governmental Organizations for Development and five on a proposal for the same Coordinator.

c) Eight on behalf of the social partners in cooperation, as well as private institutions and bodies operating in the field of development cooperation, to be distributed as follows:

1) Two by designation of the most representative trade union organizations at the state level.

2) Two on behalf of the business organisations appointed by the Spanish Confederation of Business Organisations/Spanish Confederation of Small and Medium-sized Enterprises.

3) One on behalf of the social economy organizations by designation of the Spanish Business Confederation of the Social Economy.

4) Two on behalf of the universities, on a proposal from the University Coordination Council.

5) One on behalf and on the proposal of human rights associations.

d) Six experts on a proposal from the President of the Council, after consulting the plenary session. In any case, it will be ensured that the experts comply with the principle of parity between men and women.

5. The person holding the Presidency may invite representatives of the ministries and experts deemed appropriate in the light of the matters to be dealt with, with a voice but without a vote, to attend the meetings.

6. The Deputy Director-General for Development Policies shall exercise the Secretariat of the Council, with a voice but without a vote.

7. The system of supply of persons who are members of the Council shall be the general rule provided for in Article 24 (3) of Law No 30/1992 of 26 November 1992 on the Legal Regime of Public Administrations and the Common Administrative Procedure with the Following specialties:

(a) With regard to persons representing the General Administration of the State, they may be supplied by the person who appoints the titular person, at least 48 hours in advance of the session, from among the persons of the organ the holder of which is to be supplied.

j) The holder of the Directorate-General for Migration of the Ministry of Employment and Social Security.

k) The head of the Directorate-General for International Legal Cooperation and Relations with Confessions of the Ministry of Justice.

l) A representative, with a category of director general, appointed by the holder of each of the following ministries: Defence; Finance and Public Administrations; Interior; Promotion; Education, Culture and Sport; Employment and Social Security; Industry, Energy and Tourism; Agriculture, Food and Environment; Presidency and Health, Social Services and Equality.

m) The holder of the General Secretariat for Development Policies of the General Secretariat for International Cooperation for Development, who will act as voice and vote secretary. "

Article 5. Amendment of Royal Decree 1460/2009 of 28 September on the organisation and operation of the Water and Sanitation Cooperation Fund.

e) Exercise the functions of the Secretariat and the Head of the Department of the Water and Sanitation Cooperation Fund. "

Three. Article 7 (1) is worded as follows:

" 1. For the advice of the Office of the Cooperation Fund for Water and Sanitation, an Advisory Council shall be attached to the Ministry of Foreign Affairs and Cooperation through the Secretariat of State for International Cooperation and for Ibero-America, which will meet at least once a year, chaired by the Secretary of State for International Cooperation and Latin America. The Advisory Board will be made up of prestigious, Spanish and Ibero-American personalities in the field of water and water resources. Its operation shall be subject to the rules governing the collective bodies, as laid down in Chapter II of Title II of Law No 30/1992 of 26 November 1992, of the Legal Regime of Public Administrations and of the Rules of Procedure Common Administrative.

Will also form part of this Advisory Board of representatives of the Spanish actors related to development cooperation in the water sector, especially those related to foundations, organizations, etc. development government, operators and managers of water and sanitation services, business organisations and specialised companies and universities. The Advisory Board shall be composed of a maximum of 40 members.

Article 6. Amendment of the Regulation of the Development Promotion Fund, approved by Royal Decree 845/2011 of 17 June.

The Regulation of the Development Promotion Fund, approved by Royal Decree 845/2011, is amended as follows:

" 3. The Executive Committee of the FONPRODE shall have the following composition:

a) Presidency: The Secretary of State for International Cooperation and for Latin America, which may be replaced by the First Vice President in cases of vacancy, absence, illness or other legal cause.

b) First Vice Presidency: The Secretary-General for International Development Cooperation.

c) Second Vice-Presidency: The Director of the Spanish Agency for International Development Cooperation.

d) Vocals, all of them with voice and vote:

1. The Director-General for Foreign Policy and Multilateral, Global and Security Affairs at the Ministry of Foreign Affairs and Cooperation.

2. The Director of Multilateral, Horizontal and Financial Cooperation of the Spanish Agency for International Development Cooperation

3. Two directors of the Spanish Agency for International Cooperation for Development, appointed by the Presidency of the Agency.

4. The Director General of International Economic Relations of the Ministry of Foreign Affairs and Cooperation.

5. The Director of the Cabinet of the General Secretariat for International Cooperation for Development of the Ministry of Foreign Affairs and Cooperation.

6. A representative, with a minimum rank of Director General, of the Cabinet of the Presidency of the Government appointed by its Director.

7. A representative, with a minimum rank of Director General, of the Ministry of Finance and Public Administrations designated by its holder.

8. A representative, with a minimum rank of Director General, of the Ministry of Education, Culture and Sport, designated by its holder.

9. A representative, with a minimum rank of Director General, of the Ministry of Economy and Competitiveness Secretary of the Ministry of Commerce, designated by its holder.

10. A representative, with a minimum rank of Director General, of the Secretariat of State for Research, Development and Innovation, of the Ministry of Economy and Competitiveness, appointed by its holder.

11. The Director General of Macroeconomic Analysis and International Economics of the Ministry of Economy and Competitiveness.

12. A representative, with the minimum rank of Director General of the Ministry of Agriculture, Food and Environment, appointed by its holder.

13. º A representative, with a minimum rank of Director General, of the Ministry of Health, Social Services and Equality, designated by its holder.

14. º A representative, with a minimum rank of Deputy Director General, of the Official Credit Institute, designated by the said Institute in accordance with its internal procedures.

15. º The person who holds the Department of the FONPRODE Office and Financial Cooperation, who will act as Secretary. "

Item seventh. Amendment of the Regulation of the Instituto Cervantes, approved by Royal Decree 1526/1999 of 1 October.

The Regulation of the Cervantes Institute, approved by Royal Decree 1526/1999 of 1 October, as amended by Royal Decree 775/2012 of 4 May 2012 (BOE of 5 May 2012), in its Article 21.4, to which the following is added, is amended. wording: "These management posts will be covered under employment status, by means of high management contracts".

Additional disposition first. Removal of management bodies

The following governing bodies are deleted:

The Directorate for Cooperation with Africa, Asia and Eastern Europe.

The Directorate of Sectoral, Gender, and ONGD Cooperation.

The Office of the Development Promotion Fund.

The Department of Cooperation with the Mediterranean and the Arab World.

The Department of Sectoral and Gender Cooperation.

The Department of Asia and Eastern Europe.

The references of the legal order to these organs will be understood, respectively, to the Directorate of Cooperation with Africa and Asia, to the Directorate of Multilateral Cooperation, Horizontal and Financial, to the Department of the Office of the FONPRODE and Financial Cooperation, the Department of Cooperation with the Arab World and Asia and the Department of Sectoral Cooperation.

Additional provision second. No increase in public spending.

The application of this royal decree will be made without an increase in the operating costs of the respective management bodies and will not increase public expenditure.

Single transient arrangement. Units and jobs with lower organic level than Department.

The units and jobs with lower organic level to the Department that are affected by the organic modifications established in this Royal Decree will be subsisting. They shall also be paid from the same budgetary appropriations until the relations of the posts adapted to those amendments are approved and the effective distribution of the budget appropriations is produced.

Final disposition first. Powers of development.

The person holding the Ministry of Foreign Affairs and Cooperation is empowered to, after the necessary formalities have been completed, dictate how many rules and measures are necessary for the development and implementation of the provisions in the present royal decree.

Final disposition second. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".
