The new basic organic structure of the ministerial departments has been established by the Royal Decree 1823/2011 of 21 December, which restructured the ministerial departments, and the Royal Decree 1887/2011, of 30 of December, for which the basic organic structure of the ministerial departments is established. Subsequently, these provisions have been developed by the corresponding real decrees of the organic structure of each department.

In particular, Royal Decree 344/2012, of 10 February, has developed the basic organic structure of the Ministry of Industry, Energy and Tourism, and Royal Decree 257/2012, of 27 January, has developed the basic organic structure of the Ministry of Education, Culture and Sport.

The new departmental structure involves the creation and disappearance of different higher and managerial bodies, as well as the allocation of new names and functions to existing ones, which advises to carry out the work of names which are attributed to the various higher bodies and managers of the ministerial departments in different regulations in force, in order to adapt them to the existing structures and denominations, updating them The rules of application are in the form of strengthening and guaranteeing legal certainty.

This adjustment to the new structures and denominations is particularly necessary in the case of the collegiate bodies, given that the doubts that may arise as regards their actual composition, may cause difficulties in terms of their convocation and normal operation.

The restructurings mentioned above make it necessary to make the necessary adjustments to the Royal Decree 1652/2004 of 9 July, approving the regulation governing the compulsory investment for the advance financing of the Films and films for television, European and Spanish films and films, in which Article 10 sets up an Inter-Ministerial Monitoring Committee attached to the Ministry of Industry, Energy and Tourism.

This royal decree, in turn, changes the royal decree mentioned above, thus updating the references to the higher bodies or directors of the other ministerial departments mentioned in the decree.

In its virtue, on the proposal of the Ministers of Industry, Energy and Tourism and of Education, Culture and Sport, with the prior approval of the Minister of Finance and Public Administrations, after deliberation of the Council of Ministers at its meeting of the day November 23, 2012

DISCLAIMER:

Single article. Amendment of Royal Decree 1652/2004 of 9 July approving the Regulation governing the compulsory investment for the advance financing of film and film films and films for television, European and Spanish.

One. The entries made in the second provision of Royal Decree 1652/2004 of 9 July and in Articles 1.1, 10.1 and 10.2 of the Regulation, which is approved for the 'Ministry of Industry, Tourism and Trade', are replaced by to the "Ministry of Industry, Energy and Tourism".

The statements made in Articles 2.4 and 8.3 of the Regulation to the "Directorate-General for the Development of the Information Society" are hereby replaced by references to the "General Subdirectorate of Contents of the Information Society".

The mention made in Article 7.1 of the Regulation to the "Ministry of Culture" is replaced by a reference to the "Ministry of Education, Culture and Sport".

Two. Article 10 (3) of the Regulation, which is adopted, is worded as follows:

" 3. The Commission shall be composed of:

a) The President, who will be the Secretary of State for Telecommunications and the Information Society of the Ministry of Industry, Energy and Tourism.

(b) The Vice-President, who shall be the Secretary of State for Communication of the Ministry of the Presidency. The vice president shall replace the president in the event of absence.

c) Seven vowels, who will be the Chief of Staff of the Secretary of State for Telecommunications and Information Society, the Deputy Director General of Contents of the Information Society of the Ministry of Industry, Energy and Tourism, the Deputy Director-General for the Promotion of Film and Audiovisual Industry of the autonomous body Institute of Cinematography and Audiovisual Arts, a representative of the Ministry of the Presidency, two officials appointed by the Deputy Director General of Contents of the Information Society, from among the members of the Sub-Directorate-General, one of whom shall perform the duties of the Secretary of the Commission, and an official appointed by the Director-General of the Institute of Cinematography and Audiovisual Arts of the Ministry of Education, Culture and Sport.

Where for justified reasons these vowels are not able to attend the meetings of the Commission, they shall be replaced by other officials belonging to the same management or body and the same rank as the members. In the case of vowels who are part of the Commission on the basis of their position, the alternate shall be appointed by his immediate superior. In the case of vowels appointed by the head of a higher or managerial body, it shall be the same who shall appoint his alternate. '

Single additional provision. No increase in public spending.

The provisions of this royal decree may not lead to an increase in public expenditure. The collegiate bodies referred to in this royal decree will be taken care of with the personal, technical and budgetary resources assigned to the higher or managerial body in which they are integrated.

Single final disposal. Entry into force.

This royal decree will enter into force on the day following that of its publication in the "Official Gazette of the State".
