The entry into force of Royal Decree 453/2012, of 5 March, for which the basic organic structure of the Ministry of Justice is developed and amended by Royal Decree 1887/2011 of 30 December 2011 establishing the the basic organic structure of the ministerial departments, has meant the internal reorganization of the Ministry of Justice.

This reorganization, as well as the functional and location changes that have occurred in department records, since the approval of Order JUS/4245/2004, of December 15, creating registration offices The Ministry of Justice advises to modify the current structure of the registry offices of the Department, granting each of them the character of general or auxiliary, depending on their physical location and for the sake of greater efficiency and efficiency in its operation, as well as greater territorial proximity to the citizen.

Thus, this order establishes a new management of the registry offices of the Ministry of Justice, deleting the auxiliary records of the General Directorate of the Registers and the Notary and the Directorate General of Relations with the Administration of Justice, and creating auxiliary registry offices within the Territorial Management of Justice, as set out in Article 5 of Royal Decree 453/2012, as well as in the Delegated Offices of Ceuta and Melilla. In addition, the public service hours of the general registration office and the auxiliary register offices are incorporated into the article, and a reference is made to the electronic register of the Ministry of Justice.

Royal Decree 772/1999, of 7 May, which regulates the submission of applications, written and communications to the General Administration of the State, the issue of copies of documents and the return of originals and the Article 11 provides that the registration offices, both general and ancillary, have the consideration of an administrative body, because they have assigned functions with legal effects vis-à-vis third parties, requires that its creation, modification and deletion be carried out by means of a ministerial, Article 67 (1) (b) of Law 6/1997 of 14 April of the Organization and the Functioning of the General Administration of the State.

In its virtue, with the prior approval of the Ministry of Finance and Public Administrations, I have:

Article 1. Office of general registration of the Ministry of Justice.

According to the provisions of Article 12.1 of Royal Decree 772/1999 of 7 May 1999, which regulates the submission of applications, written and communications to the General Administration of the State, the issue of copies of documents and return of originals and the regime of the registry offices, will have the consideration of the office of general registration of the Ministry of Justice the office of registration located in the street of the Stock Exchange, 8, of Madrid.

Article 2. Auxiliary registration offices and Electronic Registry of the Ministry of Justice.

1. In accordance with the provisions of Article 12.2 and 3 of Royal Decree 772/1999 of 7 May 1999, the Office of the Registry of the Ministry of Justice shall be considered to be the office of the Ministry of Justice of the Ministry of Justice. of the State-Directorate of the Legal Service of the State, located in Calle Ayala, 5, of Madrid.

2. In accordance with the provisions of Article 12 of Royal Decree 772/1999 of 7 May 1999, auxiliary registration offices are set up in the Territorial Management of the Ministry of Justice referred to in Article 5 of Royal Decree 453/2012, 5 of March, for which the basic organic structure of the Ministry of Justice is developed, except in the Territorial Management of Central Organs. In addition, auxiliary registration offices are created in the Delegated Offices of Ceuta and Melilla, respectively dependent on the Territorial Management of Andalusia in Seville and Malaga.

3. The electronic register of the Ministry of Justice, for the receipt and referral of applications, letters and communications which are submitted and issued by electronic means, in the field of procedures and actions determined in their legislation regulatory, is governed by the provisions of Order JUS/30 00/2009 of 29 October.

Article 3. Nature.

The registry offices of the Ministry of Justice referred to in the preceding articles shall be considered to be an administrative body in accordance with the provisions of Article 5.2 of Law 6/1997 of 14 April 1997. Organization and Operation of the General Administration of the State and in Article 11 of Royal Decree 772/1999 of 7 May 1999 regulating the submission of applications, written and communications to the General Administration of the State, the issue of copies of documents and the return of originals and the arrangements for registration offices.

Article 4. Functions and schedule.

1. Both the office of general registration and the auxiliary register offices shall carry out the duties provided for in Article 13 of Royal Decree 772/1999 of 7 May 1999 regulating the submission of applications, letters and communications before the General Administration of the State, the issue of copies of documents and the return of originals and the regime of the registry offices. However, the function of constancy and certification in the cases of litigation, discrepancies or doubts about the receipt or referral of requests, writing and communications corresponds to the department's general registration office.

2. The Ministry of Justice's office of general registration will have uninterrupted hours of 9 to 17:30 hours, Monday to Friday, and 9 to 14 hours on Saturdays and on 24 and 31 December. During the period from 16 June to 15 September, the timetable will be from 8 to 15 hours from Monday to Friday and from 9 to 14 hours on Saturdays. In the event that the work schedule approved by the Undersecretary of the Ministry of Justice determines another timetable, appropriate publicity shall be given to the new timetable in the portal and the electronic headquarters of the Ministry of Justice.

3. The hours of the auxiliary registration offices will be from 9 to 14 hours, from Monday to Friday.

4. The dissemination of the relationship of the registry offices that are regulated in this Order will be carried out through the portal and the electronic headquarters of the Ministry of Justice.

Article 5. Dependency on the auxiliary log offices and interconnection with the general register.

The auxiliary register offices will depend on the Office of General Registration of the Ministry of Justice, and there will be, among them, the full interconnection and integration referred to in Article 12.4 of Royal Decree 772/1999, of May 7.

Additional disposition first. No increase in public spending.

The application of this Order will not increase public spending.

Additional provision second. Development and execution faculties.

The holder of the Deputy Secretary of Justice is empowered to make any necessary decisions for the development and execution of this Order.

Additional provision third. Deletion of log offices.

The auxiliary registration offices of the General Directorate of Records and Notaries and the Directorate-General for Relations with the Administration of Justice, created by Order JUS/4245/2004, of 15 of 15, are deleted. December.

Repeal provision.

Order JUS/4245/2004 of 15 December 2004 establishing auxiliary register offices in the Ministry of Justice is hereby repealed, as well as any other provision of equal or lower rank which is in opposition to the provisions of the Order.

Final disposition. Entry into force.

This Order shall enter into force on the day following that of its publication in the "Official State Gazette".
