THE IMPORTANCE OF THE ADVERTISING PHENOMENON ADVISES THE UPDATING OF THE EXTRACTION AND FUNCTIONING OF THE NATIONAL ADVERTISING INSTITUTE, IN ORDER TO ACHIEVE OPTIMUM FULFILMENT OF THE FUNCTIONS THAT IT CORRESPONDS TO AND WHICH, BASICALLY, THEY ARE THE SAME ONES EXERCISED BY THE INSTITUTE OF THE SAME NAME, DEPENDENT, PREVIOUSLY, OF THE MINISTRY OF CULTURE.

THE OPPORTUNITY OF THE ROYAL DECREE HAS ITS FOUNDATION IN ARTICLE SEVENTH OF THE ROYAL DECREE FIVE HUNDRED AND SIXTY-FIVE HUNDRED AND SEVENTY-NINE, OF SIXTEEN OF MARCH.

THEREFORE, ON THE PROPOSAL OF THE MINISTER OF THE PRESIDENCY AND WITH THE AGREEMENT OF THE MINISTRY OF FINANCE AND AFTER DELIBERATION OF THE COUNCIL OF MINISTERS AT ITS MEETING OF THE DAY THREE OF OCTOBER OF A THOUSAND NINE HUNDRED AND EIGHTY, I HAVE:

ARTICLE FIRST. -NATURE.

ONE. THE NATIONAL ADVERTISING INSTITUTE IS AN AUTONOMOUS ADMINISTRATIVE BODY ATTACHED TO THE PRESIDENCY OF THE GOVERNMENT, THROUGH THE SECRETARIAT OF THE STATE FOR INFORMATION.

TWO. THE NATIONAL ADVERTISING INSTITUTE IS GOVERNED BY THE PROVISIONS OF THE LAW OF THE LEGAL REGIME OF THE AUTONOMOUS STATE ENTITIES OF TWENTY-SIX DECEMBER THOUSAND NINE HUNDRED AND FIFTY-EIGHT, FOR WHICH THEY COMPLEMENT AND DEVELOP THIS, BY THE THE LAW SIXTY-ONE-THOUSAND NINE HUNDRED AND SIXTY-FOUR, OF ELEVEN OF JUNE, AND THOSE CONTAINED IN THIS ROYAL DECREE.

ARTICLE SECOND. -FUNCTIONS AND COMPETENCIES.

THE NATIONAL INSTITUTE OF ADVERTISING, FOR RESEARCH AND ADVERTISING, EXERCISES THE FUNCTIONS AND COMPETENCES THAT IT HAS LEGALLY OR REGULATIVELY ATTRIBUTED TO IT.

ARE GOVERNING BODIES OF THE NATIONAL ADVERTISING INSTITUTE:

ONE: THE PATRONATO.

TWO: THE COMMISSION PERMANENT.

THREE: THE DIRECTOR OF THE AGENCY.

FOUR: THE SECRETARY GENERAL.

ARTICLE FOURTH. -PATRONATO.

ONE. THE EMPLOYER SHALL BE CONSTITUTED:

PRESIDENT: THE SECRETARY OF STATE FOR INFORMATION.

VICE-PRESIDENT FIRST: THE SECRETARY-GENERAL OF THE SECRETARY OF STATE FOR INFORMATION.

VICE PRESIDENT SECOND: THE DEPUTY DIRECTOR GENERAL OF COMPANIES AND SOCIAL COMMUNICATION ACTIVITIES.

VOCALS:

-THE DIRECTOR OF THE INSTITUTE.

-TABLE REPRESENTATIVES APPOINTED BY THE ASSOCIATION OF ADVERTISING GRADUATES.

-TWO REPRESENTATIVES APPOINTED BY THE ADVERTISING MEDIA ASSOCIATION.

-TWO REPRESENTATIVES OF THE SPANISH ASSOCIATION OF ADVERTISERS.

-TWO REPRESENTATIVES OF THE ADVERTISING COMPANIES FEDERATION.

-A REPRESENTATIVE OF THE ASSOCIATION OF FOREIGN ADVERTISING COMPANIES.

-A REPRESENTATIVE OF EACH OF THE PROFESSIONAL ASSOCIATIONS OF PUBLIC RELATIONS, FEDERATION OF ASSOCIATIONS OF RADIO AND TELEVISION AND FEDERATION OF THE PRESS.

-A REPRESENTATIVE OF THE MINISTRIES OF CULTURE, FINANCE, UNIVERSITIES AND RESEARCH, PUBLIC WORKS AND TOWN PLANNING, HEALTH AND SOCIAL SECURITY, ECONOMICS AND COMMERCE AND EDUCATION.

-A REPRESENTATIVE OF THE SPANISH PUBLIC BROADCASTER.

-FIVE PRESTIGIOUS PROFESSIONALS, APPOINTED BY THE MINISTER OF THE PRESIDENCY ON A PROPOSAL FROM THE SECRETARY OF STATE FOR INFORMATION.

HE WILL ACT AS SECRETARY OF THE BOARD OF TRUSTEES, WITH VOICE BUT NO VOTE, THE SECRETARY GENERAL OF THE NATIONAL INSTITUTE OF PUBLICITY.

TWO. THE DUTIES OF THE EMPLOYER SHALL BE:

A) TAKE THE UPPER MANAGEMENT OF THE BODY.

B) APPROVE THE BODY ' S ANNUAL ACTION PLAN.

C) APPROVE ANNUAL MEMORY ON THE MANAGEMENT OF THE BODY.

D) APPROVE THE BODY ' S BUDGET PROJECTS.

ARTICLE FIFTH. -PERMANENT COMMISSION.

ONE. THE STANDING COMMITTEE, CHAIRED BY THE SECRETARY-GENERAL OF THE SECRETARIAT OF STATE FOR INFORMATION, WHO MAY DELEGATE THE PRESIDENCY TO THE DEPUTY DIRECTOR-GENERAL OF ENTERPRISES AND SOCIAL COMMUNICATION ACTIVITIES, SHALL BE COMPOSED OF:

-A REPRESENTATIVE OF THE ASSOCIATION OF ADVERTISING GRADUATES.

-A REPORTER FOR THE FEDERATION OF ADVERTISING AGENCIES.

-REPRESENTATIVES OF THE MINISTRIES OF FINANCE, HEALTH AND SOCIAL SECURITY, ECONOMICS AND COMMERCE, UNIVERSITIES AND RESEARCH AND EDUCATION.

-THE REPRESENTATIVE OF THE SPANISH PUBLIC BROADCASTER.

-THE DIRECTOR OF THE INSTITUTE.

HE WILL ACT AS SECRETARY, WITH VOICE BUT NO VOTE, THE SECRETARY-GENERAL OF THE BODY.

TWO. THE TASKS OF THE STANDING COMMITTEE SHALL BE:

A) TO DECIDE IN PARTICULAR ON THE PLANS OF STUDY AND PROGRAMS OF THE INSTITUTE, IN THE FUNCTIONS THAT ARE ATTRIBUTED TO IT.

B) TO RAISE PROPOSALS TO THE BOARD OF TRUSTEES REGARDING THE MODIFICATIONS THAT THE PRACTICE ADVISES TO INTRODUCE IN THE STRUCTURE OF THE ORGANISM.

C) RULE THE DRAFT BUDGET FOR SUBMISSION TO THE BOARD OF TRUSTEES FOR APPROVAL.

D) RESOLVE IN THE COMPETITIONS, NATIONAL AWARDS AND COMPETITIONS CALLED BY THE INSTITUTE FOR THE PROMOTION OF ADVERTISING, PROVIDED THAT IN ITS CONVOCATION NO DIFFERENT JURY IS FORESEEN TO DISCERN THE PRIZES.

E) TO PERFORM ALL FUNCTIONS DELEGATED BY THE BOARD OF TRUSTEES.

THREE. THE STANDING COMMITTEE SHALL MEET EVERY TWO MONTHS, ON AN ORDINARY BASIS, AND ON AN EXTRAORDINARY BASIS AS MANY TIMES AS ITS CHAIRMAN. AT THE REQUEST OF THE DIRECTOR OF THE INSTITUTE, THE HEADS OF THE INSTITUTE ' S CABINETS MAY ATTEND THESE MEETINGS TO REPORT ON THEIR SPECIFIC ACTIVITIES AND PLANS.

ARTICLE SIXTH. -DIRECTOR.

ONE. THE DIRECTOR OF THE NATIONAL PUBLICITY INSTITUTE SHALL BE APPOINTED BY THE MINISTER OF THE PRESIDENCY ON A PROPOSAL FROM THE SECRETARY OF STATE FOR INFORMATION.

TWO. THE DIRECTOR OF THE NATIONAL PUBLICITY INSTITUTE SHALL BE RESPONSIBLE:

(A) TO EXERCISE AND DEVELOP ALL MANAGEMENT FUNCTIONS WHICH ARE NOT EXPRESSLY ENTRUSTED TO THE EMPLOYER OR THE STANDING COMMITTEE, AS WELL AS THE EXECUTION OF THEIR AGREEMENTS.

B) ASSUME THE ORGANIZATION OF EXPENSES AND PAYMENTS OF THE AGENCY, AS DETERMINED IN CHAPTER V OF THE LAW OF TWENTY-SIX OF DECEMBER OF ONE THOUSAND NINE HUNDRED AND FIFTY-EIGHT.

C) MONITOR THE ANNUAL MEMORY RELATING TO THE ACTIVITIES OF THE BODY.

D) ASSUME THE ADMINISTRATIVE DIRECTION OF THE AGENCY.

E) GRANT, ON BEHALF OF THE NATIONAL INSTITUTE OF PUBLICITY, PUBLIC AND PRIVATE CONTRACTS WHICH REQUIRE THE DEVELOPMENT OF THEIR DUTIES UP TO THE MAXIMUM AMOUNT OF 10 MILLION PESETAS.

F) EXERCISE IN PERSONNEL MATTERS THE POWERS CONFERRED ON THE DIRECTORS OF AUTONOMOUS BODIES BY THEIR RESPECTIVE STAFF REGULATIONS.

G) DESIGNATE COLLABORATORS IN THE ACTIVITIES OF ANY GENDER THAT ORGANIZE AND DEVELOP THE INSTITUTE.

H) GRANT THE JUSTIFIED DOCUMENTS OF THE CARRYING OUT OF WORKS OR STUDIES OF ADVERTISING SPECIALIZATION.

I) TO HOLD THE REPRESENTATIVE OF THE INSTITUTE IN ALL THOSE BODIES IN WHICH IT HAS BEEN ESTABLISHED WITH A NATO CHARACTER AND, IN GENERAL, IN ALL THE ACTS AND ACTIVITIES MUST BE PRESENT OR HAVE BEEN URGED TO PARTICIPATE ORGANISM.

ARTICLE SEVENTH. -GENERAL SECRETARY.

ONE. THE SECRETARY-GENERAL OF THE NATIONAL INSTITUTE OF PUBLICITY SHALL BE APPOINTED BY THE SECRETARY OF STATE FOR INFORMATION, ON A PROPOSAL FROM THE DIRECTOR, AMONG CAREER OFFICIALS OF THE AGENCY OR THE STATE CIVIL ADMINISTRATION.

TWO. THEY ARE THE PURPOSES OF THE SECRETARY-GENERAL:

(A) CARRY OUT THE SECRETARIAT OF THE BOARD OF TRUSTEES AND THE STANDING COMMITTEE.

(B) AUXILIARY TO THE DIRECTOR IN ALL MATTERS RELATING TO THE FUNCTIONING OF THE BODY, EXERCISING THE FUNCTIONS DELEGATED TO IT.

C) PREPARE THE PRELIMINARY DRAFT BUDGET.

D) DRAW UP, ACCORDING TO THE DIRECTOR 'S GUIDELINES, THE INSTITUTE' S ANNUAL ACTIVITY.

E) EXERCISING THE LEADERSHIP OF THE ADMINISTRATIVE SERVICES.

ARTICLE EIGHTH. -ECONOMIC RESOURCES.

THE FINANCE OF THE NATIONAL ADVERTISING INSTITUTE SHALL BE COMPOSED OF:

A) THE GRANTS TO BE ENTERED ANNUALLY IN THE BUDGETS.

B) DONATIONS, LEGACIES, GRANTS AND ANY OTHER FINANCIAL ASSISTANCE YOU CAN OBTAIN AND THAT YOU VALIDLY ACCEPT.

C) OWN GOODS, BUILDINGS AND TECHNICAL FACILITIES.

D) ANY OTHER RESOURCES THAT THE INSTITUTE RECEIVES FOR ITS LEGITIMATE TITLE; AMONG THEM THE SALE OF OWN OR NON-COMMISSION EDITIONS, SUBSCRIPTIONS TO PUBLICATIONS OF THE INSTITUTE, AND SO ON.

ARTICLE NINTH. -OPERATIONS ON CREDIT.

THE NATIONAL INSTITUTE OF PUBLICITY MAY ARRANGE CREDIT OPERATIONS FOR THE PURPOSE OF CARRYING OUT ITS PURPOSES, IN ACCORDANCE WITH ARTICLE 12 OF THE LAW OF THE LEGAL REGIME OF AUTONOMOUS STATE ENTITIES.

FINAL PROVISIONS

FIRST.-THE MINISTER OF THE PRESIDENCY OF THE GOVERNMENT, WITH THE PRIOR REPORT OF THE MINISTRY OF FINANCE, WILL DICTATE THE COMPLEMENTARY RULES THAT WILL REQUIRE THE DEVELOPMENT AND FULFILLMENT OF THE PROVISIONS OF THIS ROYAL DECREE.

SECOND. SUBSEQUENT, UNTIL THE RULES PROVIDED FOR IN THE PREVIOUS PROVISION ARE DICTATED, THE ORDER OF ONE OF JULY OF ONE THOUSAND NINE HUNDRED AND SEVENTY FIVE, ESTABLISHING THE ORGANIC STRUCTURE OF THE NATIONAL INSTITUTE OF ADVERTISEMENT.

REPEAL PROVISION

THE ROYAL DECREE IS REPEALED THREE HUNDRED AND SEVENTY-NINE HUNDRED AND SEVENTY-EIGHT, OF TEN FEBRUARY, AND ALL THOSE OF EQUAL OR LOWER RANK THAT OPPOSE THE PROVISIONS OF THIS PROVISION.
