* * * I have the honour to communicate that in connection with the proclamation of the Martial Law by the Council of State of the People's Republic of Poland, on the basis of Article 33, paragraph 2, of the Constitution of Poland, a temporary derogation or limitation of the application of the provisions of Articles 9.12, paragraph 1, and 2.14, paragraph 5; 19, paragraph 2, 21 and 22 of the Convention, with the scope strictly required by the requirements of the situation. The Decree of the State Council on the Martial Law and other Decrees concerning the same question, of 12 December 1981, were approved by the Diet/Seym/of the People's Republic of Poland, on 25 January 1982. *

* * The temporary limitation of some civil rights has been established by the national supreme interest. It has been motivated by the demands to avoid civil war, economic anarchy and destabilization of the state and social structures. The objective of the measures taken has been to neutralize an exceptionally dangerous situation that threatened the life of the nation and create the conditions for effective protection of the sovereignty and independence of Poland. *

i would like to stress that these limitations are being accompanied by efforts to create the conditions for a stabilisation, with a view to promoting national harmony and the continuation of a process of national and social renewal and national reconstruction. DECLARATION AND RESERVATIONS

Declaration that the Convention is also applicable to the Land of Berlin.

In order to meet the requirements of Article 4 of the International Convention on the Elimination of All Forms of Racial Discrimination the Kingdom of Belgium will be careful to adapt its legislation to the obligations assumed on entering into part of the said Convention.

The Kingdom of Belgium wishes, however, to stress the importance it attaches to the fact that Article 4 of the Convention stipulates that the measures set out in sub-paragraphs (a), (b) and (c) should be adapted accordingly. consideration of the principles contained in the Universal Declaration of Human Rights and the rights expressly established in Article 5 of the Convention. The Kingdom of Belgium therefore considers that the obligations imposed by Article 4 should be reconciled with the right to freedom of opinion and expression and the right to freedom of peaceful assembly and association. These rights are proclaimed in Articles 19 and 20 of the Universal Declaration of Human Rights and have been reaffirmed in Articles 19 and 21 of the International Agreement on Civil and Political Rights. They have also been established in Article 5, sub-paragraph (d) (viii) and (ix) of the said Convention.

The Kingdom of Belgium would also like to stress the importance it attaches to the rights established in the European Convention for the Protection of Human Rights and Fundamental Freedoms, in particular in Articles 10 and 11 dealing, respectively, with freedom of opinion and expression and freedom of peaceful assembly and association.

7. Bulgaria

The Government of the People's Republic of Bulgaria considers that the provisions of Article 17, paragraph I, and Article 18, paragraph 1 of the International Convention on the Elimination of All Forms of Racial Discrimination, The effect of which is to prevent sovereign states from becoming Parties to the Convention, are of a discriminatory nature. The Convention, in accordance with the principle of the sovereign equality of States, should be open to accession by all States without any discrimination whatsoever.

The People's Republic of Bulgaria does not consider itself bound by the provisions of Article 22 of the International Convention on the Elimination of All Forms of Racial Discrimination that Stipulates Jurisdiction. the International Court of Justice in the settlement of disputes with respect to the interpretation or application of the Convention. The People's Republic of Bulgaria maintains its position that no dispute between two or more States may refer to the International Court of Justice without the consent in each particular case to all States parties to the dispute.

8. Costa Rica

Costa Rica recognizes the competence of the Committee on the Elimination of Racial Discrimination established in accordance with Article 8 of the Convention on the Elimination of All Forms of Racial Discrimination, in accordance with Article 14 of the Convention to receive and study communications of individuals or groups of individuals within their jurisdiction claiming to be victims of an infringement by the State of some of the rights established in the Convention.

The Government of the Republic of Cuba will make reservations that it may consider appropriate if and when the Convention is ratified.

The Revolutionary Government of the Republic of Cuba does not accept the provision of Article 22 of the Convention to the effect that disputes between two or more States Parties shall refer to the International Court of Justice, since it considers that such disputes should be exclusively fixed by the procedures expressly stipulated in the Convention or by negotiation through diplomatic channels between those who discuss it.

This Convention, aimed at eliminating all forms of racial discrimination, should not, as expressly provided in Articles 17 and 18, exclude non-member states from the United Nations. specialised or Parties to the Statute of the International Court of Justice for the implementation of an effective contribution under the Convention, since these articles constitute in themselves a form of discrimination which is found in discrepancy with the principles established in the Convention; the Revolutionary Government of the Republic of Cuba The Convention therefore ratifies the Convention, but with the newly-indicated reservation.

10. Czechoslovakia

The Czechoslovak Socialist Republic does not consider itself bound by the Article 22 stipulation and maintains that any dispute between two or more Parties concerning the interpretation or application of the Convention does not be arranged by negotiation or by means of procedures expressly stipulated in the Convention may refer to the International Court of Justice only at the request of all parties to the dispute, if no other means of fix. >

1. The signing and ratification of the aforementioned Convention by the Taiwan authorities on behalf of China are illegal and null.

2 The People's Republic of China has reservations to Article 22 of the Convention and is not considered bound by it.

12. Denmark

In a communication received on 4 October 1972, the Government of Denmark notified the Secretary-General of the withdrawal of the reservation made in respect of the completion of the Convention on the Faroe Islands, which states that next:

The legislation through which the Convention on the Faroe Islands has been completed will enter into force on 1 November 1972, from the date of which the withdrawal of the previous reservation will be effective.

13. Ecuador

The State of Ecuador, pursuant to Article 14 of the International Convention on the Elimination of All Forms of Racial Discrimination, recognizes the competence of the Committee on the Elimination of Racial Discrimination for receive and study communications from individuals or groups of individuals within their jurisdiction claiming to be victims of an infringement of any of the rights established in the aforementioned Convention.

It is understood that the signing of this Convention does not mean in any way an acknowledgement of Israel by the Government of the United Arab Republic. In addition, treaty relations between the United Arab Republic and Israel will not arise. >

17. Fidji

The reservation and statements made by the UK Government on behalf of Fidji are confirmed but a new draft has been prepared in the following terms:

The Fidji Government wishes to express its understanding of certain articles of the Convention. It interprets Article 4 as requiring that a party to the Convention adopt further legislative measures in the areas referred to in sub-paragraphs (a), (b) and (c) of that Article only to the extent that it may consider it with due respect to the principles contained in the Universal Declaration of Human Rights and the rights expressly provided for in Article 5 of the Convention (in particular the right to freedom of opinion and expression and the right to freedom of assembly and peaceful association), that some legislative addition or variation of legislation is necessary and existing practice in these areas for the purpose of the purpose specified in the first part of Article 4. In addition, the Fidji Government interprets the requirement of Article 6 concerning as being fulfilled if one or other of these forms of remedy is made available and interprets as including any form of remedy. In reference to Article 6 France declares that the question of remedy through the courts as far as France is concerned, is governed by the rules of the ordinary legislation.

In reference to Article 15, the accession of France to the Convention cannot be interpreted as implying a change in its position with respect to the resolution mentioned in that provision.

In a subsequent communication, the Government of France indicated that the first paragraph of the previous declaration did not seek to limit the obligations under the Convention with respect to the French Government, but only record the interpretation of the latter of Article 4 of the Convention

1. The acceptance and ratification of the Convention by Iraq will not in any way mean recognition of Israel, nor will it lead to the accession of Iraq to relations with Israel which are regulated by the Convention.

2. Iraq does not accept the provisions of Article 22 of the Convention concerning the mandatory jurisdiction of the International Court of Justice. The Republic of Iraq does not consider itself bound by the provisions of Article 22 of the Convention and considers it necessary to obtain in all cases the approval of all parties in the dispute before the case is referred to the International Court of Justice.

(a) The positive measures provided for in Article 4 of the Convention and specifically described in sub-paragraphs (a) and (b) of that Article aimed at eradicating any incitement to discrimination, or acts thereof, should (a) to be interpreted, as stated in the article, " with due regard to the principles contained in the Universal Declaration of Human Rights and to the rights expressly established in Article 5 of the Convention. Accordingly, the obligations arising out of that Article 4 should not jeopardise the right to freedom of opinion and expression, as well as the right to freedom of peaceful assembly and association which is established in the Member States. Articles 19 and 20 of the Universal Declaration of Human Rights, were confirmed again by the United Nations General Assembly when it adopted Articles 19 and 21 of the International Agreement on Civil and Political Rights, and are cited above. in Articles 5 (d) (viii) and (ix) of the Convention. In fact, the Italian Government, in accordance with the obligations of Articles 55 (c) and 56 of the Charter of the United Nations, remains faithful to the principle laid down in Article 29 (2) of the Universal Declaration, which stipulates that exercise of their rights and freedoms, each will be subject only to those limitations that are determined by the law solely for the purpose of ensuring due recognition and respect for the rights and freedoms of others and to comply the just demands of morality, public order and general welfare in a democratic society.

(b) Each effective remedy shall be secured against acts of racial discrimination that violate their individual rights and fundamental freedoms, in accordance with Article 6 of the Convention by the ordinary Courts within the the framework of their respective jurisdiction. Claims for compensation for any damage experienced as a result of acts of racial discrimination must be brought against the persons responsible for the malicious or criminal acts that will cause such harm.

In reference to Article 14, paragraph 1, of the International Convention on the Elimination of All Forms of Racial Discrimination, Open to Signature in New York on March 7, 1966, the Government of the Italian Republic recognises the competence of the Committee on the Elimination of Racial Discrimination, established by the above-mentioned Convention, to receive and study communications of individuals or groups of individuals within the Italian jurisdiction claiming to be victims of an infringement by Italy of some of the rights established in the Convention.

The Government of the Italian Republic recognizes that competence, well understood that the Committee on the Elimination of Racial Discrimination will not study any communication without verifying that the same matter is not being studied. or has not already been studied by another international research or conciliation body.

< (a) The Kingdom of Libya does not consider itself bound by the provisions of Article 22 of the Convention, in accordance with which any dispute between two or more States Parties with respect to the interpretation or application of the Convention must refer, at the request of any of the Parties to the dispute, to the International Court of Justice, for decision, and states that, in each individual case, the consent of all the parties in such a dispute is necessary to refer it to the International Court of Justice. >

Pursuant to Article 14, paragraph 1. of the Convention on the Elimination of All Forms of Racial Discrimination, signed in New York on 7 March 1966, the Kingdom of the Netherlands recognises for the Kingdom of Europe Suriname and the Netherlands Antilles, the competence of the Committee to The Elimination of Racial Discrimination to receive and study communications of individuals or groups of individuals within their jurisdiction claiming to be victims of an infringement, by the Kingdom of the Netherlands of any of the rights established in the abovementioned Convention.

37. Papua New Guinea

The Government of Papua New Guinea interprets Article 4 of the Convention as requiring that a State party to the Convention adopt complementary legislative measures in the areas covered by sub-paragraphs (a), (b) and (c) of that Convention. only to the extent that it can be considered to be bound by the principles contained in the Universal Declaration referred to in Article 5 of the Convention in the sense that some additional measures or an amendment of the law and current practice are necessary to make the provisions of Article 4 effective. In addition, the Constitution of Papua New Guinea guarantees some fundamental rights and freedoms to all persons regardless of their race or place of origin, the Constitution also establishes a judicial protection of these rights and freedoms. The acceptance of this Convention does not therefore imply the acceptance of obligations by the Government of Papua New Guinea that go beyond those laid down by the Constitution and does not imply the acceptance of any obligation to introduce a judicial proceedings beyond the provisions of the Constitution.

The Polish People's Republic does not consider itself bound by the provisions of Article 22 of the Convention.

The Polish People's Republic considers that the stipulations of Article 17, paragraph 1, and of Article 18, paragraph 1, of the International Convention on the Elimination of All Forms of Racial Discrimination that Make It Impossible for many States to become parts of the Convention, are of a discriminatory nature and are incompatible with the purpose and intention of that Convention.

The Polish People's Republic considers that, in accordance with the principle of sovereign equality of States, the Convention should be open to participation by all States without any discrimination or restrictions of in question.

40. United Kingdom

41. Syrian Arab Republic

The Syrian Arab Republic states that, in each individual case, the consent of all parties to such a dispute is necessary to refer to the International Court of Justice.

42. German Democratic Republic

The German Democratic Republic does not consider itself bound by Article 22 of the Convention, in accordance with which any dispute between two or more States Parties with respect to the interpretation or application of the Convention Convention must refer at the request of any of the parties to the dispute, to the Lnternational Court of Justice for decision, and states that, in each individual case, the consent of all the parties in such a dispute is necessary to refer it to the International Court of Justice.

The German Democratic Republic considers it necessary to state that Article 17, paragraph 1, of the Convention deprives a certain number of States of the opportunity to become Parties to the Convention since the Convention It regulates matters affecting the interests of all States, it should be open to participation by all States whose policy is guided by the purposes and principles of the Charter of the United Nations.

43. Soviet Socialist Republic of Belarus

The Soviet Socialist Republic of Belarus states that the provision of Article 7 paragraph 1 of the Convention on the Elimination of All Rules of Racial Discrimination by which a number of States are deprived of the opportunity to become Parties to the Convention is discriminatory in nature and maintains that, in accordance with the principle of sovereign equality of States, the Convention should be open to participation by all States interested without discrimination or restriction of any kind.

The Soviet Socialist Republic of Belarus does not consider itself bound by the provisions of Article 22 of the Convention in accordance with which any dispute between two or more States Parties with respect to interpretation or application of the Convention must at the request of any of the parties in the dispute, refer to the International Court of Justice for decision and manifest that in each individual case, it is necessary the consent of all the parties in such a dispute to refer to the International Court.

44. Soviet Socialist Republic of Ukraine

The Soviet Socialist Republic of Ukraine states that the provision of Article 17 paragraph 1 of the Convention on the Elimination of All Forms of Racial Discrimination by which a certain number of States are deprived of the opportunity to become Parties to the Convention is discriminatory in nature and maintains that in accordance with the principle of the sovereign equality of the States to the Convention it should be open to participation by all States interested without discrimination or restriction of any kind.

The Soviet Socialist Republic of Ukraine is not considered to be bound by the provisions of Article 22 of the Convention in accordance with which any dispute between two or more States Parties with respect to the irterpretation or application of the Convention must refer to the request of any of the parties in the dispute, to the International Court of Justice for decision, and it manifests that, in each individual case, the consent of all the parties in such a controversy is necessary to refer to the International Court.

45. Rwanda

The Rwandan Republic does not consider itself to be bound by Article 22 of the Convention.

46. Romania

The Socialist Republic of Romania states that it does not consider itself bound by the provisions of Article 22 of the International Convention on the Elimination of All Forms of Racial Discrimination, any dispute between two or more States Parties with respect to the interpretation or application of the Convention which is not a settlement by negotiation or by the procedures expressly provided for in the Convention shall refer to any of the parties to the dispute to the International Court of Justice. The Socialist Republic of Romania considers that such controversies may refer to the International Court of Justice only with the consent of all parties to the dispute in each individual case.

The Council of State of the Socialist Republic of Romania states that the provisions of Articles 17 and 18 of the International Convention on the Elimination of All Forms of Racial Discrimination are not in conformity with the the principle that the multilateral treaties, whose intentions and objectives concern the world community as a whole, should be open if participation by all States.

47. Sweden

Declaration.-The Government of the Socialist Republic of Vietnam declares that the provisions of Articles 17-1 and 18-1 of the Convention for which a number of States are deprived of the opportunity to be parties to the said Convention is discriminatory and considers that, in accordance with the principle of sovereign equality of States, the Convention should be open to the participation of all States without discrimination or restriction.

Reserve.-The Government of the Socialist Republic of Vietnam is not considered to be bound by the provisions of Article 22 of the Convention and maintains that for any dispute over the interpretation or application of the Convention is tabled before the International Court of Justice will require the consent of all parties to the dispute.

52. Yemen Democratic

2. Austria

The Republic of Austria shall apply the Convention, in accordance with the first sentence of Article 1 (3), to the recognition and enforcement of arbitral judgments handed down in the territory of another Contracting State. only.

3. Belgium

At the time of ratification pursuant to Article I, paragraph 3, the Government of the Kingdom of Belgium declares that it will apply the Convention to the recognition and enforcement of the arbitral judgments handed down in the territory of Belgium. of a Contracting State only.

4. Botswana

The Republic of Botswana shall apply only the Convention to disputes arising out of a legal or non-contractual relationship considered commercial by the right of Botswana.

The United States of America shall only apply the Convention to disputes arising from legal relations, whether or not they are contractual, considered commercial by the internal law of the United States.

The delegation of the Philippines signs "ad referendum" this Convention with the reservation that it does so on the basis of reciprocity and declares that the Philippines will apply the Convention to the recognition and enforcement of the arbitral sentences issued in the Territory of another Contracting State only, in accordance with the provisions of Article I, paragraph 3 of the Convention
