Article 25 of the current General Regulation of the Public Service of Fuel Gas, approved by Decree 2913/1973 of 26 October, states that gas receiving facilities can only be carried out by companies installers, to be used in their installers with , issued by a Provincial Delegation of the Ministry of Industry and Energy, in accordance with the provisions of Article 26 of the aforementioned General Regulation.

Up to now, the meat of installers has been granted by the Provincial Delegations of the Ministry, in accordance with the instructions given on a provisional basis, by Resolution of the Directorate General of the Energy of 30 April 1973, having established several types of meat, granted in accordance with the knowledge and experience shown by the persons concerned, prior to the completion of the relevant aptitude tests.

In view of the technological development achieved by the gas industry, with the consequent requirement of due professional training for the realization of the facilities and the review and repair of the same, it turns out It is necessary for gas installers to have the theoretical and practical knowledge of the work to be carried out.

Without prejudice to the future introduction of a specific professional qualification in the field of gas installations, the requirements to be observed for obtaining the meat of gas are laid down in this provision. Gas installer, developing the provisions on this subject in the General Regulation of the Public Service of Fuel Gas. For these purposes, it is considered appropriate to establish several categories of gas Installer meats and at the same time to equate the existing categories of Installers with the new ones established in this provision, provided that demonstrate the work and experience gained and prior to the Superation of the relevant training and adaptation tests.

On the other hand, in the framework of a general management of the Fuel Gas Industry, and missing the qualification of Company with , it becomes necessary to regulate the gas installation companies, both existing and new implementation, as outlined in this respect in Chapter III of the General Regulation of the Public Fuel Gas Service. The aim is to ensure compliance with minimum requirements for technical solvency and specialisation and preparation, in order to offer, in the final analysis, good consumer service and efficiency and safety in the performance and functioning of the system. of the facilities.

This provision establishes a distinction between the obligations and responsibilities of the gas-installing companies that deal with the receiving facilities (included in Chapter II of the Instruction). (a) and those of other plant-based undertakings, known as category D, which are part of Chapter III and which carry out their activities to the distribution facilities of liquefied gases, by means of tanks and pipe networks, up to the receiving facilities and the storage and supply centres of liquefied gas oil in bulk, for use as fuel for motor vehicles. All of this in the development of Article 28 of the General Regulation of the Public Service of Fuel Gas and the provisions of the specific regulations concerning the aforementioned installations of liquefied petroleum gases.

In its virtue, this Ministry, on a proposal from the Directorate General of Energy, and in accordance with the provisions of final provision 3 of Decree 2913/1973, of 26 October, has had the following to have the following:

First.-The Instruction on Authorized Gas Installers and Installer Companies is approved, which is listed as an annex to this Order.

Second. For the purposes of this Instruction, the definitions mentioned in section 1 of the Instruction on Documentation and the Service of the Gas Receiving Facilities, approved by the Commission, will be taken into account. Ministerial order dated 14 February 1983.

Third. This Instruction will enter into force on May 1, 1983.

Fourth. -The General Directorate of Energy is empowered to make the additional or clarifying provisions necessary for the development and application of the provisions of this Order.

Fifth. -As many provisions of equal or lower rank are repealed as set forth in this Order.

CHAPTER FIRST

Authorized Gas Installer

It is every natural person who, for his theoretical-practical knowledge of the technology of the gas industry, as well as of the current regulations, accredited by the corresponding meat of Installer issued by an Directorate Provincial of the Ministry of Industry and Energy and its registration in the Register of Installers, is authorized to carry out the operations referred to in this Instruction.

The Authorized Gas Installer may not perform such operations more than within an Installatory Company entered in the Register referred to in Chapter IV of this Instruction.

CHAPTER II

Gas receiving facilities

1. MODALITIES OF THE APPROVED GAS INSTALLER MEATS

The following two gas-authorized installer types or categories are set:

1.1 Category B. Authorized Installer

You are authorized to perform the following operations within an installation enterprise that meets the requirements of this Instruction:

(a) Run by itself, or supervise the execution by specialist operators, individual receiving facilities for domestic uses, in buildings intended for housing, where the following requirements are met:

1. The installation consists, at most, of a domestic cooking appliance and an instant water heater for exclusively sanitary use.

2. The nominal power of the domestic cooking appliance is not more than 16,28 KW (14 termine/hour).

3. The rated power of the instantaneous water heater is not greater than 17,44 KW (15 thermal/hour).

4. The power is to be made by a single bottle of commercial butane of less than 15 kilograms, or by connection to a common receiving installation of piped gas. Two bottles of commercial butane shall be allowed, one by apparatus, when they are installed in isolation.

5. There is no buried pipe in the installation.

(b) Make modifications or extensions to the facilities referred to in the previous paragraph, provided that this does not imply exceeding the limitations set out in that paragraph.

(c) Carry out checks and repairs at the facilities referred to in paragraphs (a) and (b). The checks will be carried out by the Installer itself, admitting that in the repairs it will supervise the work carried out by other specialists.

d) Verify and service, with performance of the tests and regulatory tests, the facilities executed by the same or under its supervision, as well as modifications, extensions and repairs of the facilities that you have the right to perform, by subscribing to the installation certificates set out in the current regulations.

(e) Subscribe to the certificates of review of the facilities referred to in paragraphs (a) and (b) established in the current regulations, prior to the testing, testing and repairs that may be appropriate.

1.2 Category A Authorized Installer

You are authorized to perform in the bosom of an installation company that meets the requirements of this Instruction, the following operations:

a) Run by itself any gas receiving facility, as well as its modifications or extensions, or monitor its execution by specialist operators.

In the case of installations, extensions or modifications for which a project is required by a technical qualified project, the execution of the installation or the supervision of its performance by operators The experts will be all this, under the control and responsibility of the technical director of the gas installation.

b) Carry out or supervise the execution by specialist operators of the maintenance, checks and repairs of any gas receiving facility.

c) Verify and put into service, with the conduct of the tests and regulatory tests, all under the control and responsibility of the Technical Director of work when there is, the facilities executed by himself or under his/her supervision as well as modifications, extensions and repairs of the facilities, subscribing to the installation certificates established in the current regulations.

d) Subscribe to the certificates of review of the receiving facilities established in the current regulations, prior to the testing, testing and repairs that in their case correspond.

2. OBTAINING THE AUTHORIZED INSTALLER MEAT

The licensed gas installer meat can be obtained from a Provincial Directorate of the Ministry of Industry and Energy, with the following requirements:

2.1 To access category B authorized installer:

(a) Be in possession of a degree or certificate of first-degree Professional Training studies of the gas installations branch.

(b) Those who do not have the qualifications referred to in the previous paragraph, exceed the aptitude tests on a theoretical-practical course relating to the technical subjects listed in Annex 1. To this end, a minimum duration of one hundred and twenty hours will be followed, which will be taught by Entities recognized by the General Directorate of Energy.

(c) Regardless of the above, to exceed, before the Provincial Directorate of the Ministry of Industry and Energy, the appropriate aptitude tests on the Regulations set out in Annex IV. Such tests may be carried out at the same time as those referred to in subparagraph (b).

2.2 To access category A authorized installer:

(a) Be in possession of a degree or certificate of second-degree Professional Training studies of the gas installation branch.

(b) Those who do not have the qualifications referred to in the previous paragraph, exceed the aptitude tests on a theoretical-practical course relating to the technical subjects listed in Annex III. For this purpose, a minimum duration of three hundred and sixty hours shall be followed, which shall be taught by Entities recognized by the General Directorate of Energy.

The minimum duration of such course shall be one hundred and eighty hours when the person concerned is in possession, with a minimum age of two years, of a category B Installer card obtained in accordance with the provisions of this Regulation. Instruction and accredit to the Provincial Directorate of this Ministry have carried out at least fifty individual receiving facilities, by certification of the supplying companies.

(c) Regardless of the above, to exceed, before the Provincial Directorate of the Ministry of Industry and Energy, the appropriate aptitude tests on the Regulations set out in Annex IV. Such tests may be carried out at the same time as those referred to in subparagraph (b).

To provide the courses referred to in paragraphs 2.1 (b), and 2.2 (b), the Entities, public or private, interested must be recognized by the Directorate General of Energy for which they shall submit to the said Body the relevant application accompanied by the documentation in which the following ends are found:

a) Geographical scope of action.

b) Types of courses to be developed.

c) Number and qualifications of teaching staff.

d) Material media such as premises, teaching material, etc.

e) Teaching methodology, indicating the organisation of the teaching and the assessment systems envisaged.

f) Previous experience in the delivery of courses for gas installers or similar ones.

3. OBLIGATIONS OF THE AUTHORISED INSTALLERS

The Authorized Installer will have the following obligations:

(a) That the various operations and operations carried out are in accordance with the technical regulations in force on gas installations.

(b) Subscribe to the installation and revision certificates established by the applicable regulations concerning the facilities that you have executed for yourself or under your supervision.

4. GAS INSTALLING COMPANY

The activities of assembly, repair, review and maintenance of gas receiving facilities may only be carried out by the undertakings which comply with the minimum requirements laid down by this provision, accredited by registration in the Register of Companies of the corresponding Provincial Directorate of the Ministry of Industry and Energy.

5. MODALITIES AND COMPETENCIES OF GAS INSTALLERS

5.1 Modes. -The following types of gas installation companies are established:

5.1.1 Category B. Installation Enterprise

Regardless of the requirements required of any Company, you must collect the following:

a) Dispose, at least, an installer with Type B Installer meat, included in template.

b) That the ratio between the total number of specialist workers and the number of approved type B installers is no more than five.

(c) Having cover the civil liability that may result from your performance by an insurance policy for a minimum amount of five million pesetas.

d) Dispose of a local and the appropriate technical means for the development of its activity.

5.1.2 Category A installer company

Regardless of the requirements required of any Company, you must collect the following:

a) Dispose at least one Installer with type A Installer meat, included in template.

b) That the ratio between the total number of specialist workers and the number of authorized installers type A is not greater than 10.

(c) Dispose, with full or partial dedication, of a qualified technician, who will necessarily act as the Director of Works of the gas installations which, according to the regulations of the Ministry of Industry and Energy, require project, by subscribing to the corresponding certificate of address and completion of the work.

(d) To be covered by the civil liability that may arise from his/her performance, by means of an insurance policy for a minimum amount of 25 million pesetas.

e) Dispose of a local and the appropriate technical means for the development of its activity.

5.2 Competencies.

5.2.1 Type B installer company

Category B gas installers may only develop their activity in an area identical to the one recognized by the Authorized Installer of type B that determines the category of the type B.

5.2.2 Type A installer company

The scope of your competition extends to the entire gas receiving facility.

6. OBLIGATIONS AND RESPONSIBILITIES OF GAS INSTALLERS

6.1 The installing companies will have the following responsibilities:

(a) To be responsible for the execution and repair of the installations to be carried out in accordance with the project of the same, if any, and, in any case, for the installation to comply with the current regulations of the (i) implementation and the fact that the tests and regulatory tests have been carried out, with satisfactory results and under their direct responsibility.

(b) Be responsible for the deficiencies in the performance of the installations which they build or repair and that the equipment and accessories installed have the corresponding type-approval.

c) Be responsible for the review and maintenance operations performed.

6.2 Gas-installing companies will have the following obligations:

(a) Be registered in the Register of Companies of the corresponding Provincial Directorate of the Ministry of Industry and Energy.

(b) Meet at all times the minimum conditions corresponding to the category of the installation company in which they are classified.

c) Control the execution of the works carried out by their Installers and other operators to their service, as well as the materials used comply with the current regulations.

d) Issue the required Certificates of Installation or Review, once the facilities have been completed, repairs or revisions, and the tests and regulatory tests performed. These certificates will be signed by an authorized installer of the installation company.

e) Make the above Installation or Review Certificates available to the Company.

(f) Discontinuing the service in the affected parts of the facility when, on the occasion of the extension, repair, revision or maintenance of the facility, there is a serious danger of an accident or an accident has taken place. In addition to the users or owners of the facilities to the supplying company and to the Provincial Directorate of the Ministry of Industry and Energy, the service will be given account of any interruption of the service, describing the facts and justifying the measure taken.

CHAPTER III

Other gas installations

1. CATEGORY D INSTALLERS

The assembly and repair activities of the gas installations listed below can only be carried out by companies that, under the name of the category D-installed companies, meet the minimum requirements established in this chapter accredited by the registration in the Register of Installer Companies:

(a) The distribution facilities of liquefied gases by means of a unit capacity of more than 0,1 cubic metres (tanks and pipe networks up to the receiving facilities, excluding those).

(b) The storage and supply centres of liquefied petroleum gases in bulk for use as fuel for motor vehicles.

2. REQUlslTOS AND COMPETENCIES OF CATEGORY D INSTALLERS

2.1 Requirements.-In addition to the requirements required of any Company, they must meet the following:

a) Dispose, at least, an Installer in possession of a Type D Installer Meat, included in template.

b) That the ratio between the total number of specialist workers and the number of approved type D installers is no more than ten.

c) Dispose, with full or partial dedication, of a qualified technician. which will necessarily act as the Director of Work of the gas installations, by subscribing to the corresponding Certificate of Management and Termination of the Work.

(d) To be covered by the civil liability that may arise from his/her performance by an insurance policy, for a minimum amount of 50 million pesetas.

e) Dispose of a local and the appropriate technical means for the development of its activity.

2.2 Competencies.

In addition to the specific powers referred to in paragraph 1 of this Chapter, type D installers shall have their own category A companies.

3. CATEGORY D AUTHORIZED INSTALLER

You are authorized to perform, within an installation company that meets the requirements of this Instruction, the following operations:

a) Those of the Type A Installer

(b) Run the facilities and repairs referred to in points (a) and (b) of paragraph 1 of this Chapter by themselves or supervise their execution by specialist operators all under the control and responsibility of the Technical Director of Work of the gas installation.

4. GETTING THE TYPE D INSTALLER MEAT

This meat may be obtained from a Provincial Directorate of the Ministry of Industry and Energy. The following requirements must be met by the person concerned:

(a) Be in possession, with a minimum age of one year, of an authorized, category A, installer, obtained in accordance with the provisions of Chapter II.

(b) Credit, by certification of the supplying companies, having carried out a minimum number of 50 individual receiving facilities or 15 common receiving facilities.

(c) Superar, to the Provincial Directorate of the Ministry of Industry and Energy, the appropriate aptitude tests on the regulations set out in Annex V.

5. OBLIGATIONS OF APPROVED TYPE D INSTALLERS

They will have, in addition to the specific obligations set for Type A Installers, the following:

(a) That the assemblies and repairs carried out comply with the technical regulations in force on the gas installations concerned.

b) Subscribe to the documentation established by the current regulations.

6. OBLIGATIONS AND RESPONSIBILITIES OF TYPE D INSTALLERS

6.1 You will have the following responsibilities:

(a) To be responsible for the execution and repair of the installations to be carried out in accordance with the project of the same and, in any case, for the installation to comply with the current rules of application and for carried out, with satisfactory results and under its direct responsibility, the tests and the regulatory tests.

(b) Be responsible for the deficiencies in the execution of the installations which they build and for the equipment and accessories fitted with the relevant type-approval.

6.2 Type D installers will have the following obligations:

(a) Be registered in the Register of Companies of the corresponding Provincial Directorate of the Ministry of Industry and Energy.

b) Meet at all times the minimum requirements for your category.

c) Control the execution of the works carried out by their Installers and other operators to their service, as well as the materials used comply with the current regulations.

d) Issue the documentation established in the current regulations once the installations and repairs have been carried out and the tests and the regulatory tests carried out.

(e) Discontinuing the service in the affected parts of the facility when, on the occasion of an extension or repair of the facility, serious danger of an accident is assessed or has taken place. Any interruption of the service shall be followed, to the other of the users or owners of the facilities, to the supplying company and to the Provincial Directorate of the Ministry of Industry and Energy, describing the facts and justifying the measure taken.

CHAPTER IV

Installer and Installation Business Records

1. INSTALLERS

In each Provincial Directorate of the Ministry of Industry and Energy, a book-registration of the Installer meats granted by the Ministry of Industry will be carried out.

Authorized gas installer meats will be valid throughout the national territory.

The meat of the authorized gas installer will have five years of validity, and must be renewed before the date of its expiration by the Provincial Directorate of the Ministry of Industry and Energy that granted them, upon request of the interested in the Provincial Directorate of the province in which they perform their activities.

For reasons of technological evolution of the gas industry or substantial changes in its regulations, the Ministry of Industry and Energy will be able to establish requirements for the renewal of the meat of Installer.

2. INSTALLING COMPANIES

To obtain registration in the Registry of Installers will be presented in the Provincial Directorate of the Ministry of Industry and Energy in whose territorial scope the company's registered office is located. corresponding application accompanied by the documentation certifying compliance with the requirements for the category of the installation company concerned.

Effected the registration, the Provincial Direction will extend a certificate of the same, which will allow to accredit to third such circumstance.

If an installation company needs to carry out its activity in the territorial area of another province it will be required to register in the corresponding Register of the new Provincial Direction in whose demarcation it will be carry out their activities, for which a certificate of the Provincial Directorate of Provenance must be presented that accredits the inscription in the Registry of the same. The period of validity of the certificate issued for this sole purpose shall be two months.

Registration in the Registry of Installer Companies will be valid for three years, and must be renewed before the end of the term. To this end, the documentation showing compliance with the minimum requirements of the category of company concerned shall be submitted together with the relevant application.

CHAPTER V

Sanctions

Failure to comply with the provisions contained in this provision shall be sanctioned in accordance with Chapter IX of the General Regulation of the Public Fuel Gas Service.

The withdrawal of the meat from the Installer or the registration in the Register of Installers shall not be effected but after the corresponding sanctioning dossier, which shall be processed in accordance with the provisions of Chapter II of Title VI of the Law of Administrative Procedure, and will be initiated by the corresponding Provincial Directorate of the Ministry of Industry and Energy.

In the event of a serious breach of its obligations, these Provincial Directorates may suspend the validity of the meat of the Installer, as well as the registration of the installation company in the Register where appropriate, as long as the file is substantiated and for a period not exceeding three months.

TRANSIENT PROVISIONS

First.-Current Category A, B or C Installer meats will retain their current validity until they are left without it for any of the causes set out in these transitional provisions.

Second.-The natural persons who, at the entry into force of this Order, possess the meat of an Installer of any type A, B or C, must, within the maximum period of three months, apply for a maximum period of three months from the date of entry into force of this Order. (a) the change of the same by one of those defined in this provision. Those interested will join the photocopy request for the Installer meat they own.

Elapsed time without the interested parties having requested such a change, the existing meat will be without validity for all intents and purposes.

Third.-In order to obtain the new cards of the Installer for those who have the existing ones (types A, B or C) it will be necessary to exceed the tests of aptitude mentioned in the transitional provision fourth.

Exceptionally, the current installer meats may be validated by one of the new ones, without any need to overcome any aptitude test. For this purpose, the relevant Provincial Directorate of the Ministry of Industry and Energy shall, within a maximum period of one month, request the relevant Provincial Directorate from the entry into force of this provision. For the validation of the meat, consideration shall be given to:

a) Studies carried out by stakeholders.

b) Acquired experience and time of exercise of the installation activity.

c) Relation of more significant installations performed.

d) Absence of unfavorable background.

e) Any other information to justify the ability and professional experience of the Installer.

As a complement to the above requirements, the Provincial Directorates will be able to obtain a report from the Gas Supply Companies on the activity developed by the applicants.

The Provincial Directorate shall decide on each case within the maximum period of two months from the request.

Fourth.-The requirements to be met by holders of existing types A, B or C to access one of the new meats shall be as follows:

1. To exceed the aptitude tests on a theoretical-practical adaptation course relating to the technical subjects listed in Annexes I and III. For this purpose, a course of a duration of at least one hundred and fifty hours shall be followed for obtaining the type A and sixty hours for the B, which shall be imparted by the Entities referred to in the transitional provision seventh.

2. To exceed, in the case of the Provincial Directorate of the Ministry of Industry and Energy, the appropriate aptitude tests on the Regulations set out in Annexes II and IV. Such tests shall be carried out simultaneously with the tests referred to in paragraph 1, provided that this is possible.

The maximum number of calls for each of the tests referred to in paragraphs 1 and 2 above which an Installer may use shall be three.

In the event that the three calls without a positive result are exhausted by the interested party, the Provincial Directorate of the Ministry of Industry and Energy will proceed to the cancellation in the Register of Installers, leaving, Therefore, the validity of the meat of the Installer, for all intents and purposes, has been annulled. The person concerned may, however, benefit from the general arrangements for obtaining the authorised installer meat provided for in this provision.

Exceptionally, the current Installers may replace the first call for the tests referred to in paragraphs 1 and 2 by a single examination with the Provincial Directorate of the Ministry of Industry and Energy on the materials of Annexes I and II (for the Category B Installer or Annexes III and IV for the installer A), without the need to follow any adaptation course. In the case of not exceeding that examination, they shall have only two more calls, which shall be concluded in accordance with the above.

Fifth.-The currently existing gas Installer meats (types A, B or C) will automatically be left without validity for all effects after obtaining a new meat from the Installer, as indicated in the provisions Third and fourth, and, in any case, two years, counted from the entry into force of this provision.

Sixth.-The Provincial Directorates of the Ministry of Industry and Energy shall carry out the first of the calls referred to in the fourth transitional provision within the maximum period of nine months from the date of entry into force. force of this Instruction.

The second call must be held within the maximum period of six months, counted from the date of the first, the same period shall apply to the third call for the second call.

If it will not be possible to follow in some Provincial Direction the cited calendar, for justified reasons, will propose to the General Directorate of Energy a new one, without in any case being able to exceed its total duration of two years from the entry into force of this provision.

Seventh.-The Entities that may impart the adaptation courses referred to in the fourth transitional provision shall be:

1. The National Employment Institute.

2. Gas supply companies, which in the opinion of the Provincial Directorates of the Ministry of Industry and Energy have the necessary technical and human resources to this end.

3. Those other Entities that are authorized by the General Directorate of Energy, upon presentation of the documentation that accredits their suitability.

Eighth.-The existing installation companies must apply within the maximum term of four months, counted from the entry into force of this Instruction. The registration in a of the corresponding Provincial Directorate of the Ministry of Industry and Energy. The interested parties shall join the application with the documentation certifying compliance, regardless of the requirements required of any company, of the following:

a) Dispose at least one Installer included in template, with

of one of the currently existing types, issued by a Provincial Directorate of the Ministry of Industry and Energy.

b) The relationship between the total number of specialist operators and the number of authorized installers is not greater than ten.

(c) Having cover the civil liability that may arise from its activity, by means of an insurance policy for a minimum amount of five million pesetas.

d) Dispose of a local and the appropriate technical means for the development of its activity.

After the aforementioned four-month period without the interested companies having applied for such registration, they will be disabled to continue to carry out their activity until they can obtain the enrollment in the , as provided in Chapter IV of this Instruction.

The same regime will be followed when the Provincial Directorate denies the registration in the aforementioned Provincial Register.

Effected the registration, the Provincial Direction will extend a certificate of the same that will allow to accredit to third such circumstance.

The resolutions on the registration in the Provisional Register and the issuance of the corresponding certificates must be completed within eight months, counted from the entry into force of this Instruction. From this date, the supplying companies will not accept the installation certificates issued by the installation companies not registered in that Provisional Register.

The Provisional Registry of Installers, and therefore, the inscriptions and their certificates shall be valid for no more than two years after the entry into force of this Instruction.

Novena.-The installation companies that are in compliance with this transitional regime will have to fulfill the obligations and will be subject to the responsibilities referred to in Chapter II of this provision.

The aforementioned installation companies will only be able to develop their activity in an area identical to that of their Installer or Authorized Installers.

When an installation company requires its activity in the territory of another province, the procedure indicated in Chapter II of this Instruction shall be followed.

Tenth.-The entry into force of the provisions of Chapter III of this provision, concerning installers and type D installers, is suspended until March 1984.

Eleventh-Until the date indicated in the previous transitional arrangement, you may obtain Category D Installer meat for those Installers that meet the following requirements:

(a) In application of the provisions of these transitional provisions, the new type A Installer meat has been obtained.

(b) have carried out a minimum number of ten installations as specified in point (a) of Chapter III of Chapter III, prior to the date of this Instruction.

(c) Superpower tests before the Provincial Directorate of the Ministry of Industry and Energy on the Regulations set out in Annex V to this Instruction, unless they have made a minimum number of 50 Installations referred to in point (a) of paragraph 1 of Chapter III before the date of this provision.

The Provincial Directorates will verify the number of installations made from the data in their file or those of other Provincial Directorates in which the Installer has developed its activities.
