Having regard to the text of the minutes of 13 March 2013 in which the wage revision agreements of the Collective Agreement for Industrial Cold Industries are collected (Convention Code No. 99002255011981) which was signed by the Association of Refrigeration Farms, Logistics and Distribution of Spain (ALDEFE), representing companies in the sector, and, of the other, by the trade union organizations FITAG-UGT and FITEQA-CC.OO., on behalf of the workers, and in accordance with the provisions of Article 90 (2) and (3) of the Law on the Status of Workers, Recast Text, adopted by Royal Legislative Decree 1/1995 of 24 March, and in the Royal Decree 713/2010 of 28 May 2010 on the registration and deposit of collective agreements and agreements job,

This Employment General Address resolves:

First.

Order the registration of the said salary revision in the corresponding Register of collective agreements and agreements working through electronic means of this Steering Center, with notification to the Negotiating Commission.

Second.

Arrange your publication in the "Official State Bulletin".

MINUTES OF THE JOINT COMMISSION OF THE COLLECTIVE AGREEMENT, STATE-WIDE, FOR INDUSTRIAL COLD COMPANIES

In Madrid, on March 13, 2013, the Joint Commission of the Collective Agreement, State-wide, is gathered for the Industrial River Industries, formed, on the one hand, by the union representatives of FITAG-UGT and FITEQA-CC.OO. on the other hand, by the representatives of the Association of Refrigeration Farms, Logistics and Distribution of Spain (ALDEFE) and of APEF, which with the vote against the latter adopt, by majority within each representation, the following

AGREES

First.

The revision of the salary tables is carried out in order to produce the definitive ones for the year 2012, which are those that are incorporated as an annex and that have had an increase of 0.7% on the definitive ones of 2011. Those tables shall apply with effect from 1 January 2012.

The definitive values of the concepts of Article 42 and the first transitional provision in the same percentage, applicable as of 1 January 2012, are also set out as follows:

" Article 42. Displacements and diets.

Employees who need to travel outside the place where their usual centre of work is located, will receive, in the light of the duration of the journey and the need for the use of the different paragraphs, a diet of 11.74 euros per meal, 11.74 euros per dinner and 23.46 euros per day for accommodation and breakfast, with the complementary perceptions of smaller expenses included in these amounts. The total daily diet will be 46.99 euros.

For the year 2012, the amounts set forth in this Article shall be revalued at the same percentage and conditions in which the salaries are made, including, where applicable, the CPI revision/s, if this is the case.

When the worker does not take the vehicle journey of the company, he or she shall be entitled to be paid the amount of the journey in the means of transport which he has been authorised to use.

The worker will receive before the posting an advance for expenses, settling upon return according to the number of allowances accrued.

If the means of locomotion paid by the Company and the distribution of the timetable allow the worker to make the meals at his or her home or to stay at the same time he will not be entitled to the allowance of diet.

First transient disposition.

Transiently, and until such time as it is assigned a specific salary level, the delivery driver who performs the functions defined in Article 10 (D) (3) shall receive a supplement of at least EUR 1,83 per day effectively worked under those conditions, irrespective of the perception of the supplement provided for in Article 17 if he is entitled to it.

For the year 2012, in the case of continuing to match the above conditions, the amount set will be updated at the same amount as the wages, including the CPI revision/s if any. "

Second.

The parties proceed to draw up provisional salary tables to be submitted as of 1 January 2013, which are annexed to this Act, duly signed by the parties.

The provisional values of the concepts of Article 42 and the first transitional provision in the same percentage, applicable as of 1 January 2013, are also set out as follows:

" Article 42. Displacements and diets.

For the year 2013, the amounts set out in this Article shall be revalued at the same percentage and conditions in which the salaries are made, including, where applicable, the CPI revision/s, if this is the case.

Third.

To use, in solidarity, any of the comparables to carry out the necessary formalities, including the telematic presentation to the General Directorate of Labour, for registration, registration and publication of these agreements and the salary tables in the "Official State Gazette".
