Law 29/1985, of 2 August, of Aguas, establishes in its article 20.3 that the territorial scope of the basin organizations, which has to understand one or several of the indigenous river basins, with the only limitation derived from the international borders, shall be defined as regulatively.

Also, article 38.2 of the aforementioned Law provides that the territorial scope of each Hydrological Plan will be determined regulatively.

Under its virtue, according to the State Council, on the proposal of the Minister of Public Works and Urbanism and after deliberation of the Council of Ministers at its meeting of 8 May 1987,

DISPONGO:

Article 1. º

The territorial scope of the basin organizations provided for in Law 29/1985 of 2 August of Aguas will be defined as follows:

1. The Spanish territory of the river basins of the rivers that pour into the Cantabrian sea from the mouth of the River Eo, including that of this river, and the border with France. In addition, the Spanish territory of the river basins Mino-Sil, Limia, Nivé and Nivelle.

2. Hydrographic Confederation of the Duero. -Comprises the Spanish territory of the river basin of the river Douro.

3. Hydrogr4phic Confederation of! Taja-Comprises the Spanish territory of the river basin of the Tagus river.

4. The Hydrographic Confederation of the Guadiana. -Comprises the Spanish territory of the river basin of the river Guadiana and the territories of the river basins that pour into the Atlantic Ocean between the border with Portugal and the limit of the terms municipal of Palos de la Frontera and Lucena del Puerto (Torre del Loro).

5. The Hydrographic Confederation of the Guadalquivir. -Comprises the territory of the river basin of the Guadalquivir river, as well as those of the river basins that pour into the Atlantic Ocean from the limit of the municipal terms of the Palos de la Border and Lucena del Puerto (Torre del Loro) and the limit of the municipal terms of Tarifa and Algeciras.

6. Segura Hydrographic Confederation-Comprises the territory of the river basins that pour into the Mediterranean Sea between the mouth of the Almanzora river and the left margin of the Gola del Segura at its mouth; in addition the basin hydrographic of the Rambla de Canales and the endorrecics of Yecla and CorralRubio.

7. The Hydrographic Confederation of Júcar. -Comprises the territory of the river basins that pour into the Mediterranean Sea between the left margin of the Gola del Segura in its mouth and the mouth of the river Cenia, including its basin; Pozohondo's endorreica basin.

8. The Spanish territory of the water catchment areas of the Ebro river, the Garonne river and the other river basins which pour into the Atlantic Ocean across the border with France, except those of the river basins. Nivé and Nivelle rivers. In addition, the endorheic basin of the Gallocanta Lagoon.

Art. 2. º

The territorial areas of the hydrological plans in each Hydrographic Confederation will be as follows:

1. Northern Hydrographic Confederation.

a) Plan Hydrological I. Watersheds of the rivers Mino and Sil and the Spanish part of the Limia river basin.

b) Hydrological Plan II. River basins that pour into the Cantabrian sea between the River Eo, including this river, and the limit of the municipal terms of Castro Urdiales and San Julián de Musques.

c) Hydrological Plan III. River basins that come to the Cantabrian sea between the limit of the municipal terms of Castro Urdiales and San Julián de Musques and the border with France.

2. The Hydrographic Confederation of the Duero. -The Hydrological Plan will be unique, extended to the entire territorial scope defined in

3. The Hydrographic Confederation of Tagus. -The Hydrological Plan will be unique, extended to the entire territorial scope defined in Article

.

4. The Guadiana Hydrographic Confederation.

(a) Hydrological Plan I. Watersheds of the territorial scope defined in Article 1. ° 4, excluding those corresponding to the Hydrological Plan II.

b) Hydrological Plan II. Basins tributaries to the left bank of the river Guadiana, from the confluence of the river Chanza, including the river Chanza, to its mouth, basins of the rivers Piedras, Odiel and Tinto, and intermediate basins of direct discharge to the Atlantic Ocean.

5. The Hydrographic Confederation of the Guadalquivir. -The Hydrological Plan will be unique, extended to the entire territorial scope defined in Article

6. The Segura Hydrographic Confederation. -The Hydrological Plan will be unique, extended to the entire territorial scope defined in Article

.

7. The Hydrographic Confederation of the Sugar. -The Hydrological Plan will be unique, extended to the entire territorial scope defined in Article

.

8. The Hydrographic Confederation of the Ebro. -The Hydrological Plan shall be unique, extended to the entire territorial scope defined in Article 1. ° 8.

Art. 3. º

In compliance with the provisions of the second provision of Law 29/1985 of 2 August, of Aguas, the Autonomous Communities will have a period of three months from the publication of this Royal Decree, for exercise their option of incorporation into the Governing Boards of the relevant Basin Agencies set out below:

-The Autonomous Community of Andalusia, in respect of the Hydrographic Confederations of Guadiana, Guadalquivir and Segura.

-The Autonomous Community of Aragon, in respect of the Hydrographic Confederations of the Tagus, Júcar and Ebro.

-The Autonomous Community of the Principality of Asturias, with respect to the Northern Hydrographic Confederation.

-The Autonomous Community of Cantabria, with respect to the Hydrographic Confederations of the North, Duero and Ebro.

-The Autonomous Community of Castilla-La Mancha, in respect of the Hydrographic Confederations of the Duero, Tajo, Guadiana, Guadalquivir, Segura, Júcar and Ebro.

-The Autonomous Community of Castilla y León, with respect to the Hydrographic Confederations of the North, Duero, Tajo and Ebro.

-The Autonomous Community of Catalonia, in respect of the Hydrographic Confederations of the Júcar and Ebro.

-The Autonomous Community of Extremadura, with respect to the Hydrographic Confederations of Tagus, Guadiana and Guadalquivir.

-The Autonomous Community of Galicia, with respect to the Hydrographic Confederations of the North and the Duero.

-The Autonomous Community of La Rioja, in respect of the Hydrographic Confederations of the Duero and the Ebro.

-The Autonomous Community of Madrid, with respect to the Tagus Hydrographic Confederation.

-The Autonomous Community of Murcia, with respect to the Hydrographic Confederations of the Guadalquivir and Segura.

-The Autonomous Community of Navarra, with respect to the Northern and Ebro Hydrographic Confederations.

-The Autonomous Community of Basque Country, with respect to the Northern and Ebro Hydrographic Confederations.

-The Autonomous Region of Valencia, in respect of the Segura, Júcar and Ebro Hydrographic Confederations.

TRANSIENT PROVISIONS

First.

The current Hydrographic Confederations which, by application of the transitional provision novena of Law 29/1985, of 2 August, of Waters, exercise the functions attributed by the said Law to the Basin Organizations until it is promulgate the corresponding Royal Decrees constitutive of the same shall accommodate their respective territorial areas of action to those defined in the article 1. º of this Royal Decree.

Second.

The Southern Hydrographic Confederation will continue to be assigned for administrative purposes to the Ministry of Public Works and Urbanism, with a unique Hydrological Plan, being able to the Autonomous Community of Andalusia to join the Board of Government of that Confederation, which shall comprise the territory of the river basins which pour into the Mediterranean Sea between the limit of the municipal territories of Tarifa and Algeciras and the mouth of the Almanzora river, including the basin of This last river, being excluded from the Rambla de Canales. It also includes the endorheic basin of Zafarraya.

FINAL DISPOSITION

The Minister of Public Works and Urbanism is authorized to dictate how many provisions require compliance with this Royal Decree and especially to resolve any conflict that may arise between different Hydrographic confederations in relation to the delimitation of the territorial areas defined therein.
