THIS REAL DECREE COLLECTS IN ARTICLE 4.2 AS A COMPETENCE OF THE MINISTRY OF HEALTH AND CONSUMPTION
MOREOVER, THE INTERNATIONAL CONVENTION ON THE HARMONIZATION OF CONTROLS ON GOODS AT FRONTIERS, MADE IN GENEVA ON 21 OCTOBER 1982, AND TO WHICH SPAIN ACCEDED ON 13 APRIL 1984, SEEKS TO FACILITATE THE FREE MOVEMENT OF GOODS. INTERNATIONAL MOVEMENT OF GOODS, AS WELL AS THE REDUCTION OF THE REQUIRED FORMALITIES AND THE NUMBER AND DURATION OF THE CHECKS BY NATIONAL AND INTERNATIONAL COORDINATION OF THE CONTROL PROCEDURES AND THEIR DETAILED RULES OF APPLICATION.
FOR THE PROPER PERFORMANCE OF THESE FUNCTIONS IT IS NECESSARY, ON THE ONE HAND, TO FIX A SPECIFIC RELATIONSHIP OF PRODUCTS SUBJECT TO SANITARY CONTROL, IN THE GUARANTEE OF THE ADMINISTERED, IN ORDER TO AVOID DOUBTS AND DISPARITIES OF CRITERIA IN INTERNATIONAL TRAFFIC, AND ANOTHER, TO LIMIT HEALTH CONTROL POINTS TO THOSE WITH THE NECESSARY INFRASTRUCTURE, GIVEN THAT THE PROPER IMPLEMENTATION OF CONTROLS AND INSPECTIONS REQUIRES, INEXCUSABLY, PERSONAL AND PHYSICAL RESOURCES. IN HIS VIRTUE, HEARD THE PARACER OF THE MINISTRY OF ECONOMY AND FINANCE, I HAVE HAD TO DISPOSE:
FIRST. THE LIST OF FOREIGN TRADE PRODUCTS SUBJECT TO CONTROL AND HEALTH INSPECTION AT THE BORDER, WHICH IS PUBLISHED AS ANNEX I. THE GENERAL DIRECTORATE FOR FOOD HEALTH AND CONSUMER PROTECTION MAY BE APPROVED AT ANY TIME BY THE REASONS OF PUBLIC INTEREST, TO MODIFY IN A PERMANENT OR TRANSITIONAL MANNER SUCH A RELATIONSHIP, TOGETHER WITH THE GENERAL DIRECTION OF PHARMACY AND MEDICAL DEVICES, IN RESPECT OF PHARMACEUTICAL PRODUCTS.
SECOND. THE TRAFFIC OF SUCH PRODUCTS, WHEN THEY ARE THE CONSTITUENT OF COMMERCIAL DISPATCH, SHALL BE CARRIED OUT BY CUSTOMS AUTHORITIES EMPOWERED TO CARRY OUT THE HEALTH INSPECTION AND INSPECTION OF THOSE PRODUCTS. THOSE LISTED IN ANNEX II SHALL BE ELIGIBLE FOR THIS PURPOSE IN GENERAL.
EXTERNAL TRADE OPERATIONS AFFECTING BLOOD, PLASMA AND PLASMA FRACTIONS, WHATEVER THE USE FOR WHICH THEY ARE INTENDED; VIRAL AND BACTERIAL VACCINES AND THEIR CONCENTRATES OR GRANALS AND NARCOTIC SUBSTANCES PSYCHOTROPICS WILL BE CHANNELLED EXCLUSIVELY BY THE CUSTOMS OF BARCELONA, BILBAO, MADRID, SEVILLE AND VALENCIA, WHICH WILL BE ABLE TO ENTRUST CONCRETE ACTIONS TO OTHER UNITS OF EXTERNAL HEALTH OF THEIR DEMARCATION.
