THE SPANISH CONSTITUTION, IN ITS ARTICLE 149.1.16, GIVES THE STATE EXCLUSIVE JURISDICTION FOREIGN HEALTH, AND IN THIS SENSE THE LAW 14/1986 OF 25 APRIL, GENERAL HEALTH, REITERATES IN ITS ARTICLE 38 THIS ATTRIBUTION OF COMPETENCE, WHICH HAS BEEN AGREED, IN WHAT THE MINISTRY OF HEALTH AND CONSUMPTION IS CONCERNED, BY THE ROYAL DECREE 1418 / 1986 , 13 JUNE.


THIS ROYAL DECREE CONTAINS IN ITS ARTICLE 4.2 AS COMPETENCE OF THE MINISTRY OF HEALTH AND CONSUMPTION. IN ADDITION, IN ITS ARTICLE 11 SETS.


ON THE OTHER HAND, THE INTERNATIONAL CONVENTION ON THE HARMONIZATION OF CONTROLS OF GOODS AT THE BORDERS, DONE AT GENEVA ON 21 OCTOBER 1982, AND THAT SPAIN IS ACCEDED ON 13 APRIL 1984, AIMS TO FACILITATE THE FREE INTERNATIONAL MOVEMENT OF GOODS, AS WELL AS REDUCE THE REQUIRED FORMALITIES AND THE NUMBER AND DURATION OF CONTROLS THROUGH NATIONAL AND INTERNATIONAL COORDINATION OF THE CONTROL PROCEDURES AND OF THEIR METHODS OF APPLICATION.


FOR THE PROPER PERFORMANCE OF THESE FUNCTIONS IS NECESSARY, PART, SET A SPECIFIC LIST OF PRODUCTS SUBJECTED TO HEALTH CONTROL, GUARANTEE OF MANAGED, TO AVOID DOUBTS AND DISPARITY OF CRITERIA IN THE TRAFFIC INTERNATIONAL, AND ANOTHER, LIMIT HEALTH CHECKPOINTS THOSE THAT COUNT WITH THE NECESSARY INFRASTRUCTURE, GIVEN THAT THE PROPER IMPLEMENTATION OF CONTROLS AND INSPECTIONS REQUIRES INEXCUSABLY, COUNT ON MEDIA PERSONAL AND SUITABLE MATERIALS.


BY VIRTUE, HEARING THE ROME OF THE MINISTRY OF ECONOMY AND FINANCE, HAVE WELL HAVE: FIRST. APPROVES THE RELATION OF FOREIGN TRADE PRODUCTS SUBJECT TO CONTROL AND SANITARY INSPECTION AT BORDER, THAT THE DIRECTORATE-GENERAL FOR HEALTH FOOD AND HEALTH PROTECTION OF CONSUMERS MAY, AT ANY TIME, FOR REASONS OF INTEREST, PERMANENT OR TRANSIENT MODE MODIFY SUCH RELATIONSHIP, JOINTLY WITH THE DIRECTORATE GENERAL OF PHARMACY AND HEALTH PRODUCTS IS PUBLISHED AS ANNEX I. , IN WHAT IT REFERS TO PHARMACEUTICAL PRODUCTS.


SECOND. THE TRAFFIC OF SUCH PRODUCTS, WHEN THEY ARE CONSTITUTIVE OF COMMERCIAL EXPEDITION, THERE WILL BE CARRIED OUT BY QUALIFIED CUSTOMS FOR THE PRACTICE OF THE CONTROL AND INSPECTION OF THEM. AS A GENERAL RULE ARE ENABLED TO DO SO WHICH ARE LISTED IN ANNEX II.


FOREIGN TRADE OPERATIONS THAT AFFECT BLOOD, PLASMA AND FRACTIONS PLASMA, ANY THAT IS TO USE IS INTENDED; VACCINES VIRAL AND BACTERIAL AND CONCENTRATES OR GRAINS AND NARCOTICS AND PSYCHOTROPIC SUBSTANCES IS CHANNEL FAIL ONLY BY CUSTOMS OF BARCELONA, BILBAO, MADRID, SEVILLE AND VALENCIA, WHICH MAY INSTRUCT OTHER CONCRETE ACTIONS FOREIGN HEALTH UNITS IN THE DISTRICT.


HOWEVER, UPON REQUEST OF THE PERSON CONCERNED TO THE COMPETENT SERVICES OF FOREIGN HEALTH, IS MAY CARRY OUT HEALTH CHECKS AND CLEARANCE OF IMPORT OR EXPORT IN ANY OTHER BORDER POINTS NOT INCLUDED IN THE ANNEX II.
