Royal Decree 939/1997, of 20 June, regulates the affectation to the programme of promotion of agricultural employment, of credits for investments of public administrations in the Autonomous Communities of Andalusia and Extremadura and in the depressed rural areas. Among the actions included in this royal decree are the granting of grants to the Local Corporations for the temporary hiring of unemployed workers, preferably agricultural, for the construction of works and services of general and social interest, in income guarantee projects or in stable employment generation. The grant of these grants is made in accordance with the provisions of the Order of the Ministry of Labour and Social Affairs of 26 October 1998 laying down the basis for the grant of grants by the National Institute. Employment, in the field of collaboration with local corporations for the recruitment of unemployed workers in the performance of works and services of general and social interest.

The Order of the Ministry of Labour and Social Affairs of 26 October 1998 provides, in Article 4 (1) (e), that the works or services to be carried out may be carried out in full within the calendar year of the financial year the budget in which the cooperation is carried out, unless exceptional, duly justified causes are met, which determine the impossibility of implementation within that period, in which case works and services may be approved provided they are be completed within the first six months of the following financial year. However, in 2012, the General Budget of the State for that year was approved by Law 2/2012 of 29 June. This delay in the approval of the budgets has prompted the resolution on the distribution of the funds by provinces for the management by the Provincial Directorates of the State Employment Service of the grants to grant to Local Corporations within the framework of the Agrarian Employment Promotion Programme could not be adopted until June 2012, with the consequent delay on the usual time limits in the granting of the grants and therefore the start of the approved works or services.

It is necessary to add the damage caused by the rains that occurred during the months of December 2012 to April 2013 in much of Spain, which has made it difficult for the local authorities to carry out the works. and obliged to delay or to paralyse in large part the execution of the approved works or services.

For all this, the deadlines for implementing the Order of the Ministry of Labour and Social Affairs of 26 October 1998 are inadequate in the light of the extraordinary circumstances outlined above, with the the impact on the recruitment of unemployed workers who are participating in the contract, who see the recruitment period reduced, and where appropriate the possibility of access to unemployment benefits or allowances, and income land. The objective of improving the employability of the unemployed participants is also altered.

In the process of drafting this order, the State Attorney in the Department and the Delegation of the State General Intervention in the State Employment Service have issued a report.

In its virtue, I have:

Extension of the deadline for the completion of works and services of general and social interest, initiated in the financial year 2012, in the framework of the programme for the promotion of agricultural employment for the Autonomous Communities of Andalusia and Extremadura and in depressed rural areas.

1. 2. In the decisions referred to in paragraph 1 and, where appropriate, in the case of calls made by the State Employment Public Service which gave rise to the same, the time limit for the completion of the works or services shall be referred to. set in this order.

3. The extension of the period of execution provided for in this order will in no case involve an increase in the grants already granted.
