The Technical Regulation on the Control and Certification of Seeds of Fodder Plants, approved by Order ARM/3370/2010, of 27 December, establishes the requirements that must be fulfilled in the process of production of the seeds of fodder plants, in accordance with the provisions of Council Directive 66 /401/EEC of 14 June on the marketing of fodder plant seed.

The Sorgo Technical Control and Seed Certification Regulation, approved by Order ARM/3374/2010, of December 27, establishes the requirements that must be met in the process of production of sorghum seeds, according to as laid down in Council Directive 66 /402/EEC of 14 June on the marketing of cereal seed.

These Directives 66 /401/EEC and 66 /402/EEC have been amended by Commission Implementing Directive 2012 /37/EU of 22 November 2012 amending certain Annexes to Directives 66 /401/EEC and 66 /402/EEC the Council as regards the conditions to be met by the seeds of Galega orientalis Lam., the maximum weight of each batch of seed of certain fodder plant species and the size of the sample of Sorghum spp. It is therefore appropriate to incorporate the aforementioned Directive 2012/37/EU, through the corresponding amendment of the Technical Regulations for the Control and Certification of Seeds of Fodder Plants and Sings of Sorgos.

However, the modifications to the conditions to be fulfilled by the seeds of the eastern Galega Lam., do not need to be made, since they were included in the aforementioned Order ARM/3370/2010, of December 27, in its Annex I, A, Table 2.A.

In the preparation of this provision, the Autonomous Communities and the representative entities of the sectors concerned have been consulted.

In its virtue, according to the State Council, I have:

Article first. Modification of the Technical Regulations of Control and Certification of Seeds of Foraging Plants, approved by the Order ARM/3370/2010, of December 27.

Annex II (weights of the lots and samples) of the Technical Control and Certification Regulation of Fodder Plant Seeds, approved by Order ARM/3370/2010, of 27 December, is amended in the following terms:

One. The line for 'Gramine:' is replaced by the following:

"Poaceae (Gramineae) (*)"

The line for "Legumins:" is replaced by the following text:

"Fabaceae (Leguminosae):"

Two. The following paragraph is added at the end of the Annex:

"(*) The maximum weight of each batch may be increased to 25 tonnes if the supplier has been authorised for this purpose by the competent authority of the Autonomous Community responsible for the certification of these seeds."

Article 2. Modification of the Technical Regulations of Control and Certification of Sings of Sorgo, approved by the Order ARM/3374/2010, of December 27.

The table in Annex 2 (weights of the lots and samples) of the Technical Control and Certification Regulation of Sörgo Seed, approved by Order ARM/3374/2010 of 27 December 2010, is replaced by the next:

Final disposition first. Incorporation of European Union law.

This order incorporates into Spanish law Commission Implementing Directive 2012/37/EU of 22 November 2012 amending certain Annexes to Council Directive 66 /401/EEC and 66 /402/EEC in respect of the for the conditions to be met by the seeds of Galega orientalis Lam., the maximum weight of each batch of seed of certain fodder plant species and the size of the sample of Sorghum spp.

Final disposition second. Entry into force.

This order will take effect the day following your publication in the "Official State Bulletin".
