Article 61 et seq. of Law 17/2011 of 5 July on food safety and nutrition introduces into our legal system a new tax which is intended to tax the carrying out of official controls on the the import of certain feed and food of non-animal origin as provided for in Commission Regulation (EC) No 669/2009 of 24 July 2009 implementing Regulation (EC) No 882/2004 of the European Parliament and of the Council Proposal for a Council Regulation (EEC) on the application of the rules of the European Community feed and food of non-animal origin and Decision 2006 /504/EC is amended.

In addition, under Article 67 of Law 17/2011 of 5 July, the management of the levy in respect of feedingstuffs corresponds to the current Ministry of Agriculture, Food and the Environment, and as regards the food to the current Ministry of Health, Social Services and Equality.

Therefore, it is necessary to approve the official models for self-validation of the same that are regulated by this order.

Under the proposal of the Minister for Agriculture, Food and the Environment and the Minister for Health, Social Services and Equality, I have:

Article 1. Self-validation.

The fee for official controls on imports of certain feed and food of non-animal origin shall be subject to self-settlement by the taxable person in the terms laid down in this order.

Article 2. Approval of self-validation models.

1. The model of autoliquidation 790, referred to as 'the fee for official controls on imports of certain feed and non-animal food', included in Annex I of this order, is approved for the clearance of the fee for controls official of imports of certain feed of non-animal origin.

2. The model 790 entitled 'Rate for official controls on imports of certain feed and food of non-animal origin', as set out in Annex II to this Order, is hereby approved for the clearance of the fee for controls Imports of food from non-animal origin shall be made official.

3. Each of the 790 models referred to in the preceding paragraphs shall consist of three copies, which shall be used as follows: one for the banking institution where the entry is made (Copy for the contributing entity), one for the submitted by the taxable person to the department responsible for the management of the charge, as proof of payment (Exemplary for the Administration) and the last one for the taxable person, who shall keep it as proof of payment (Exemplary for the interested).

4. Models of self-validation shall be available only and may be downloaded at the electronic headquarters of the Ministry of Agriculture, Food and the Environment in the case of feedingstuffs and at the electronic headquarters of the Ministry of Health, Social and Equality for Food.

Article 3. Rules for the self-validation of the fee.

The settled rate will be entered by the taxable person, through any deposit entity that provides the collaboration service in the revenue management that the State Tax Administration Agency has entrusted to it, in cash, by way of account or by electronic means, in the latter case, after the adoption of the Resolution referred to in the single additional provision of this order.

Single additional disposition. Electronic processing.

By means of the corresponding Resolutions of the Subsecretariats of the Ministry of Agriculture, Food and the Environment, as regards feed, and the Ministry of Health, Social Services and Equality, for the (i) food, it may be established that the payment of the levy may be carried out by telematics, as provided for in Order HAC/729/2003 of 28 March, which lays down the general conditions and conditions for the electronic payment of the fees which constitute resources of the General Administration of the State and its Public Bodies.

Single end disposition. Entry into force.

This Order shall enter into force on the day following that of its publication in the "Official State Gazette".
