The artistic creation of the twentieth century, in its various plastic manifestations, deserves to have a National Museum of first importance, by virtue of the outstanding contribution of the Spanish artists to the configuration of the modernity.

The recovery of democracy and the current development of our cultural life accentuate the feeling of this need and offer a favorable opportunity for the creation of a new National Museum that, starting from the collections and of its necessary enrichment, it can present a permanently updated vision of modern and contemporary art.

The constitution of the "Centro de Arte Reina Sofía" in Museo Nacional is the culmination of a process begun with the recovery of the building of the former General Hospital of Madrid, which was declared a monument by Royal Decree 3531/1977 of 9 December 1977. This process has been developed in different phases, highlighting the opening to the public of the "Centro de Arte Reina Sofía" in 1986, from which an important program of temporary exhibitions has been developed in that headquarters. The creation, by Order of the Ministry of Culture of 2 April 1987, of the Advisory Commission for the Development of the "Centro de Arte Reina Sofía" program, had the task of collecting the report of Spanish and foreign experts of recognized prestige. on the criteria for the organisation of the Museum, in particular with regard to its facilities, the formation of the collection and the policy of exhibitions.

In view of the work of this Commission, it is necessary to proceed with the administrative creation of the Museum and, in accordance with the Regulations of Museums of State Entitlement and the Spanish System of Museums, approved by Royal Decree 620/1987, April 10, to provide the "Reina Sofía Art Center" of the organizational system that, without prejudice to further development, allows the performance of its functions.

In its virtue and in accordance with the provisions of article 61 of Law 16/1985, of 25 June, of the Spanish Historical Heritage and in Articles 3 and 4 of the Regulation of Museums of State Entitlement and of the Spanish System of Museums, consulted by the Autonomous Community of Madrid, on the initiative of the Ministry of Culture, and on a proposal from the Minister for Public Administrations, after deliberation by the Council of Ministers at its meeting on 27 May 1988,

DISPONGO:

Article 1. Nature, legal status and location.

One. The "Centro de Arte Reina Sofía" is a National Museum under the Ministry of Culture, through the General Directorate of Fine Arts and Archives.

Two. The "Centro de Arte Reina Sofía" is governed by Law 16/1985, of 25 June, of the Spanish Historical Heritage; the Regulation of Museums of State Entitlement and of the Spanish System of Museums, approved by Royal Decree 620/1987, of April 10, and by the Present Royal Decree.

Art. 2. Objectives and functions.

One. The objectives of the "Centro de Arte Reina Sofía" are to promote the public's knowledge and access to modern and contemporary art in its various manifestations and to promote the social communication of the plastic arts.

Two. The following functions correspond to the "Centro de Arte Reina Sofía":

1. Preserve and enrich the Museum's collection, as well as systematically display it for contemplation and study.

2. Develop programs of temporary exhibitions of modern and contemporary art.

3. Develop cultural and outreach programs to facilitate public access to the Museum's collection and exhibitions.

4. Provide specialized information, documentation and advice services in the field of modern and contemporary art.

5. Establish cooperation programs with other national or foreign institutions that contribute to the best achievement of their respective goals and promote the international communication of the plastic arts.

6. How many other functions lead to the achievement of the Museum's objectives.

Art. 3. The collection.

One. The Museum's collection focuses on the Spanish artists of the 20th century and on the international artists and movements that maintain links and correspondences with those.

Two. The Museum's initial funds are:

1. The collection of the Spanish Museum of Contemporary Art.

2. The works acquired by the State Administration with the assistance of the Advisory Commission of the "Centro de Arte Reina Sofía", created by the Order of the Ministry of Culture of 2 April 1987.

Three. The art collection of the 20th century of the National Museum of "El Prado" can be deposited in the "Centro de Arte Reina Sofía", or assigned to it, once the works of conditioning for the installation of the new Museum have been completed and previous agreement of the Royal Patronates of both Institutions.

Art. 4. Governing bodies and advisers.

One. They are the governing bodies of the "Reina Sofía Art Centre":

The Royal Patronate of the "Reina Sofía Art Center".

The Director.

Two. An advisory board assists the governing bodies for the programming of the Museum's activities.

Art. 5. The Royal Patronate of the "Queen Sofia Art Centre".

One. The Royal Patronato is the collegiate governing body of the "Queen Sofia Art Centre".

Two. The Royal Patronato, constituted under the Presidency of Honor of SS. MM. The Kings of Spain, consists of the following members:

1. Vowels:

The Museum Director.

The Deputy Director of the Museum.

The Director of State Museums.

The Director of the National Exhibition Center.

2. Vowels by designation:

A minimum of five and a maximum of eight, appointed by the Minister of Culture, of which one at the proposal of the Royal Board of the Museum of "The Prado", from among its members and another on a proposal of Entities or Associations Museum collaborators.

Appointed Vowels shall perform their duties for a period of three years from the date of their respective appointments.

3. He is Secretary of the Royal Board of the "Queen Sofia Art Centre".

Three:

1. The Royal Patronate has a President and a Vice-President, elected by the plenary between the Vocals by appointment and appointed by the Minister of Culture for a three-year term.

2. The President shall be replaced in the performance of his duties by the Vice-President and, failing that, by the Senior Vocal.

Four. The Royal Board acts in plenary and in the Standing Committee.

Five. The Permanent Commission is composed of the President, the Vice-President, two Nato Vocals and two Vocals by designation, elected by the Plenary, and the Director of the Museum. He is the Secretary of this Commission that of the Royal Patronate.

Art. 6. The Royal Board of Trustees.

One. It is for the Royal Board of Trustees:

1. To point out the general guidelines of the Museum's performance in the framework of the state's museum policy.

2. Develop and propose to the General Direction of Fine Arts and Archives the annual program of activities and the Annual Report.

3. Establish the criteria for the formation of the Museum collection and accept the assignment of works of art to it.

4. To authorise the acquisition of works of art where the amount exceeds the limit which the plenary establishes in general for the purpose of determining the powers of the Standing Committee in this field.

5. To admit the deposit of works of art in the Museum as provided for in article 9. of the Regulation of Museums of State Entitlement and of the Spanish System of Museums.

6. Request authorization for the deposit of works of art assigned to the Museum, in accordance with Article 8. of the Regulation of Museums of State Entitlement and of the Spanish System of Museums.

7. Approve the general sorting criteria for the collection for permanent exposure.

8. Authorise the organisation of temporary exhibitions and designate the Commissions and Commissioners responsible for its implementation.

9. To determine the general conditions for the provision of services to the public, for the sale of publications and any other class of objects, in the premises of the Museum and for the reproduction of their artistic works, all in accordance with the provisions of a general nature.

10. To report on the requirements of the call for the provision of scientific and technical jobs.

11. Require, through the Director, the referral of how much data, background, reports, and studies it deems useful for the performance of their duties.

Two. It corresponds to the Standing Committee:

1. To study, deliberate and report proposals to be submitted for approval by the Royal Board of Trustees.

2. To take care of the fulfillment, development and execution of the agreements adopted by the Royal Board.

3. Agree to the departure, whatever their destination, of works of art outside the premises of the Museum or of the premises specified in the respective contracts of deposit and to request the authorization provided for in Article 6. Museums of State Entitlement and the Spanish System of Museums. In any case, the prior report of the Head of the corresponding Sectoral Department, submitted through the Director of the Museum, is mandatory.

4. Act as an assessment body for the purposes of Article 8 (f) of Royal Decree 111/1986, of 10 January, of partial development of the Spanish Historical Heritage Act.

5. Authorise the acquisition of works of art for the Museum where the amount of the work does not exceed the general limit set by the plenary for the purposes of determining the powers of this Commission.

6. To assume all other tasks entrusted to it by the Plenary, with the exception of those contained in paragraphs 1, 2, 3, 4, 6, 7 and 9 of paragraph 1 of this Article.

7. To give an account to the plenary of the Royal Board of the agreements adopted, in any case, in the exercise of the above powers.

Art. 7. Royal Board of Trustees operating system.

One. The meetings of the plenary and the Standing Committee are ordinary and extraordinary:

1. The ordinary plenary session shall be held at least every three months and shall be held once a month by the Standing Committee.

2. The extraordinary events shall be held, upon convocation by the President of the Royal Board, on his own initiative, or at the reasoned request of the third part of his Vocals, or of the Director of the Museum.

Two. The Director-General of Fine Arts and Archives, may convene and chair the meetings of the Royal Board of Trustees to which he considers it appropriate to attend.

Three. As not provided for in this Royal Decree on the functioning of this Authority, it will be applied, with an additional nature, as provided for by the Law of Administrative Procedure for the functioning of the collegiate bodies.

Art. 8. ° The Director.

One. The Director is appointed and separated by the Council of Ministers on a proposal from the Minister of Culture.

Two. Corresponds to the Director of the Museum:

1. To promote and direct the exercise of the functions and the development of the Museum's activities.

2. To coordinate the work resulting from the administrative and technical treatment of museum funds in accordance with the provisions of Chapters IV and V of the first title of the Regulation of Museums of State Entitlement and of the Spanish System of Museums.

3. Take the necessary measures within the framework of its competence, for the security of cultural heritage guarded in the Museum.

4. Present to the Royal Board the general criteria for the collection of the collection for its permanent exhibition and propose the acquisitions of works of art.

5. Propose to the Royal Board the organisation of temporary exhibitions and the designation of Commissions or Commissioners responsible for them and supervise their implementation.

6. Promote cooperative relations with other museums, universities and research centers.

7. Present to the Royal Board the project of the annual activity plan and the Annual Report.

8. Assume all other functions are not expressly entrusted to the other organs of the Museum and correspond to them, in accordance with the general provisions.

Art. 9. ° Basic organic structure.

The following units depend on the Director of the Museum with the organic level of Subdirection General:

1. The Subdirection.

2. Management.

Art. 10. The Subdirection.

One. The following functions correspond to the Subdirection:

1. Program the services to your position in coordination with the Management.

2. To direct the elaboration of the inventory and the catalogue of the collection of the Museum, to elaborate the plans of action for the conservation of the works that integrate it, to submit to study the ones that have to be object of treatment of consolidation or restoration and propose to the Director of the Museum the realization of the same.

3. To promote and articulate the development of research programmes in the different areas of their responsibility.

4. Develop and propose the programs of professional improvement of the scientific and technical staff of the Museum.

5. To assist the Director of the Museum in the performance of his or her optional functions and to exercise any other functions entrusted to him by delegation of the Museum.

Two. Dependent on this General Subdirection will exist Sectoral Departments, the Department of Restoration, and the Documentation and Broadcast Department.

Three. The following functions correspond to each Sectoral Department:

1. Draw up the inventory and catalogue of funds entrusted to them, take immediate responsibility for their care and conservation and propose to the Subdiretor works that require consolidation or restoration treatments.

2. Conduct research in the area of your competence and issue the scientific reports requested to you.

3. Organize or collaborate in the organization of temporary exhibitions in the field of their specialty.

4. Assist the Director in the elaboration of the Annual Report, presenting, in any case, a report on the activities of the Department.

Four. Corresponds to the Department of Restoration:

1. Propose at the request of the Subdirector the treatments for the consolidation or restoration of the artistic works of the Museum.

2. Lead and organize workshops, determine the tasks that correspond to each of the restaurateurs and monitor the application of the treatments.

3. Assist the Director in the elaboration of the Annual Report, presenting, in any case, a report on the activities of the Department.

Five. Corresponds to the Department of Documentation and Broadcast:

1. Provide consultation and advice services to professionals, researchers and the general public on modern and contemporary art.

2. Organize the archive of the artistic and scientific documentation generated by the Museum and provide the governing bodies, and all the Museum's offices, with the necessary documentation for the best development of the respective functions.

3. Organize outreach programs around the collection and temporary exhibitions.

4. Assist the Director in the elaboration of the Annual Report, presenting, in any case, a report on the activities of the Department.

Art. 11. Management.

One. The following functions correspond to the Management:

1. The economic and administrative management and the internal system of the general services of the Museum, the intrend and the functioning of the same.

2. The Registry and Administrative Archive of the Museum.

3. The administrative treatment of works of art, as well as the control of the reception and departure of works of art, in coordination with the Subdirection and in accordance with the provisions of Chapter IV of the first title of the Regulations of States of Entitlement State and Spanish Museum System.

4. The management of the technical services of maintenance, surveillance, security and assembly of the rooms and warehouses and the organization of the auxiliary services that the Museum provides to the public.

5. How many other functions are entrusted to you by the Museum Director.

Two. For the performance of these functions, the Management will have technical and economic administrative departments.

ADDITIONAL DISPOSITION

The units dependent on the Subdirection and Management provided for in Articles 10 and 11 of this Royal Decree will have the organic level and the staffing to be determined in the corresponding positions

REPEAL PROVISION

Repealed:

Decree 2935/1968 of 21 November and Royal Decree 188/1981 of 9 January on the organisation of the Spanish Museum of Contemporary Art, without prejudice to the continuing development of the units of this Museum of the activities scheduled until the collection was transferred to the "Centro de Arte Reina Sofía" in 1989.

Royal Decree 1270/1987, of 18 September, amending the regulation of the governing bodies of the Spanish Museum of Contemporary Art.

The Order of April 2, 1987, of the Ministry of Culture, for which the Advisory Commission for the Development of the "Centro de Arte Reina Sofía" program is created, without prejudice to the continued development of its functions as constitute the Royal Patronate of the "Queen Sofia Art Centre".

TRANSIENT PROVISIONS

First.

The units and jobs of the primitive Museum, which have an organic level of less than 30, remain subsisting as long as the corresponding measures of development of this Royal Decree are not adopted.

Second.

All the staff affected by the abolition of the Spanish Museum of Contemporary Art will be respected the administrative situation and will continue to receive, in full, the remuneration as long as the measures of development of this Royal Decree.

FINAL PROVISIONS

First.

One. The Minister of Culture shall dictate the provisions necessary for the implementation and enforcement of the provisions of this Royal Decree.

Two. The composition, competence and functioning of the Advisory Council provided for in Article 4. 2 of this Royal Decree shall be governed by the Order of the Minister of Culture.

Second.

The Ministry of Economy and Finance will make the necessary budgetary changes for the fulfillment of this Royal Decree.

Third.

This Royal Decree will enter into force on the day following its publication in the "Official State Gazette".
