Article 63.8 of Law 33/1987, of 23 December, of the General Budget of the State for 1988, provides for the exemption to be listed, to the Mutuality of Civil Servants of the State, MUFACE, to the General Judicial Mutuality, MUGEJU, and the Social Institute of the Armed Forces, ISFAS, of the retired official personnel integrated into each of the three Entities, as well as the military personnel and assimilated retired equally integrated. It also provides that the Government will give the precise provisions for the implementation of this provision and for the refund of the quantities entered after 1 January 1986.

The budget provision does not list the remaining pensioners who are integrated into the administrative mutual fund, as are the recipients of widower and orphan's pensions, who also, for reasons of equity and equality of The treatment with pensioners of the General Social Security System is excluded from the list of contributions, by the government of a type "0" under the Laws that cover the mechanism of Administrative Mutualism.

In its virtue, and in the use of the authorization conferred in Article 63.8 of the aforementioned Law, on a joint proposal of the Ministers of Economy and Finance and for the Public Administrations, according to the State Council, After the Council of Ministers has been deliberating, at its meeting on 3 June 1988,

DISPONGO:

Article 1. º

According to Article 63.8 of the General Budget Law of the State for 1988, retired civil servants who are part of the Mutual Mutual Fund are exempt from listing on the Management Entities of Administrative Mutualism. The Ministry of Civil Servants of the State, MUFACE, and the General Judicial Mutuality, MUGEJU, and the retired military personnel, integrated in the field of coverage of the Social Institute of the Armed Forces, ISFAS. The exemption shall apply to retired civil servants integrated into ISFAS.

The exemptions granted will have been effective since 1 January 1986. The right to return the contributions made by the interested parties is recognized as of this date.

Art. 2. º

The rate of the contribution of pensioners not officials is fixed with effect from 1 January 1986 as follows:

(a) The recipients of widow's and orphan's pensions falling within the scope of Law 29/1975 of 27 June on the Social Security of Civil Servants of the State shall be listed as "0".

(b) The recipients of widow's and orphan's pensions falling within the scope of Law 28/1975 of 27 June on Social Security of the Armed Forces shall be listed as "0".

(c) The recipients of widow's and orphan's pensions falling within the scope of Royal Decree-Law 16/1978 of 7 June on Social Security of Personnel to the Service of the Administration of Justice shall be listed in the type "0".

Art. 3. º

The repayment of quotas resulting from the application of Law 33/1987 of 23 December, and as provided for in this Royal Decree to the pensioners referred to in Articles 1 and 2 above, will be made after a simple request written from the interested parties to the managing bodies, MUFACE, ISFAS and MUGEJU, communicating the details of the bank accounts or Enabled to which the amount of the refund is to be rotated, and once the retention or entry of the object quotas has been checked of the same.

The right to request the refund of the quotas will be prescribed at five years from the entry into force of this Royal Decree.

TRANSIENT DISPOSITION

Until such time as the corresponding rule is promulgated that the percentages of contributions to the General Mutuality of Civil Servants of the State, the Social Institute of the Armed Forces, and the General Judicial Mutuality be adjusted, the current system of calculation of the State's contribution to Administrative Mutualism shall be maintained.

FINAL PROVISIONS

First.

By the managing bodies, the General Mutuality of Civil Servants of the State (MUFACE), the Social Institute of the Armed Forces (ISFAS), and the General Judicial Mutuality (MUGEJU), the precise measures for the application of the provisions of this Royal Decree.

Second.

The Ministry of Economy and Finance shall process the relevant budgetary changes in order to enable the appropriations necessary to comply with the provisions of this provision.

Third.

All provisions of the same or lower rank that are contrary to the provisions of this Royal Decree are repealed.

Fourth.

This Royal Decree will enter into force the day after its publication in the "Official State Gazette".
