Royal Decree 727/1988, of July 11, of restructuring of ministerial departments, adscribe the autonomous agency Superior Council of Sports to the Ministry of Education and Science.

This circumstance, coupled with the historic moment that the Spanish sport will live and the change that the sports model has experienced in recent years, forces the reorganization of the Superior Council of Sports.

The responsibility contracted by the State, being assigned the city of Barcelona as the host of the Olympic Games of 1992, translates as much to organize these Games as well as to achieve a worthy Spanish representation in the same, and this as a factor associated with good organization. These objectives involve a technification of the Higher Council of Sports and the intensification of the actions on matters related to the high competition, the sports investigation, the control of the illegal practices in the sport, the training of technicians and the control of the plans and sports programmes of the Spanish Federations, which constitute, among others, the responsibilities of the State.

The transformation of physical education into the education system is an urgent objective that is being undertaken both from the point of view of increase of the teacher and in the realization of high and rational investments. in sport facilities in the schools and in the provision of the corresponding equipment. This effort should be complemented by a new approach to sport, both in school age and at the University, which will mean the implementation of new action programmes and a reorganisation of human and other resources. resources currently allocated to the Higher Sports Council.

Together with these approaches, the promotion of grassroots sport in its various manifestations and the provision of better infrastructures for the desirable extension of the practice of sport in the various social fields, make the objectives of the Government's action in this field of administrative activity unavoidable.

To carry out such purposes, this Royal Decree in accordance with the provisions of Article 12 of Law 10/1983, of 16 August, undertakes a reorganization of the Superior Council of Sports that will allow to conjugate the achievement of the objectives set out above, with a better focus on federated sport.

In its virtue, at the initiative of the Minister of Education and Science and at the proposal of the Minister for Public Administrations, after deliberation by the Council of Ministers at its meeting on December 2, 1988,

DISPONGO:

Article 1. Nature, classification and legal status:

One.

1. The Superior Council of Sports is an autonomous body, attached to the Ministry of Education and Science and directly dependent on the holder of the Department.

2. The Ministry of Education shall approve the objectives of its action plans and shall have audits to verify the extent to which its projects are carried out and the effectiveness in the performance of its tasks.

Two.

The Council is classified among the autonomous administrative bodies, referred to in Article 4 (1) (a) of the General Budget Law, recast text approved by the Royal Decree Legislative 1091/1988 of 23 September.

Three.

The Council, which has its own legal personality and ability to act in order to fulfil its purposes and functions, is governed by the provisions laid down in its Statute and by the other provisions of application to the self-employed by the State Administration.

Art. 2. ° Fines and functions:

Correspond to the Superior Council of Sports for the purposes and functions attributed to it in article 23 of Law 13/1980, of March 31, General of Physical Culture and Sport.

Art. 3. Governing Bodies:

One.

Are Council Governing Bodies:

The President.

The Plenary.

The Commission Directive.

Two.

1. The President of the Council, who has the rank of Secretary of State, is appointed and separated by Royal Decree agreed upon in the Council of Ministers, on the proposal of the Minister of Education and Science.

2. Corresponds to the President:

a) Ostend the representation of the Superior Council of Sports.

b) Chair the Plenary and the Body's Board of Directors.

c) To exercise, on behalf of the Council, the high management of the Entity and, in such a sense, to promote, coordinate and supervise the activities of the Management Centers and services thereof.

d) Grant grants to Federations and Sports Associations and other interested entities, in accordance with established rules and with the guidelines of sports policy.

e) Authorizing and, where appropriate, arranging for national and international political demonstrations, without prejudice to the powers that correspond to other authorities, Agencies and Entities.

f) Conceding the distinctions, decorations and other sports prizes of the Superior Council of Sports.

g) Exercise the top management of the Agency's personnel matters, within the scope of its competence.

(h) Manage the assets of the Council and grant on its behalf the acts and contracts of the Agency's activities.

i) to exercise the other powers and prerogatives conferred upon it by the laws in force and, in particular, to carry out those other functions which are not expressly entrusted to other governing bodies of their own Tip.

j) Exercise any other privileges that, in relation to the purposes and functions of the Agency, delegate to it the Minister of Education and Science.

3. The President, in accordance with the provisions of the current legal provisions, may delegate his or her specific privileges to the Directors and Deputy Directors of the Agency, when deemed appropriate in accordance with the needs of the service.

Three.

1. The composition and powers of the Plenary and the Board of Directors of the Superior Council of Sport are those laid down in Article 22 of Law 13/1980 of 31 March, in Royal Decree 229/1986 of 10 January 1986 and in the other provisions in force, without other modifications than those set out in the following number.

2. The Members of the Plenary Assembly representing the State Administration shall be as follows:

a) Five representatives of the Superior Council of Sports, who will be the following:

The Director General of Sports.

The Director General of Sports Infrastructure.

Three Vowels freely appointed by the President.

b) Twenty-nine representatives of the Ministries, appointed by the holder of each Department, who will be distributed as follows:

Three Vowels from the Ministry of Education and Science and three others from the Ministry of Social Affairs.

Two Vocals from each of the Ministries of Foreign Affairs, Defense, Economy and Finance, Interior, Public Works and Urbanism, Labor and Social Security, Culture, and Health and Consumer Affairs.

A Vocal from each of the Ministries of Justice, Industry and Energy, Agriculture, Fisheries and Food, for the Public Administrations, Transport, Tourism and Communications, Relations with the Courts and the Government Secretary and Government Spokesperson.

Art. 4. ° Basic organic structure:

One.

The following management centres are directly dependent on the Agency Presidency:

General Directorate of Sports.

General Management of Sport Infrastructures.

Two.

1. As an organ of support, advice and immediate assistance, directly dependent on the Secretary of State-President of the Agency, there is a Cabinet in accordance with the provisions of article 10 of Law 10/1983, of 16 August, the holder of which has organic level of Director-General.

2. In addition to the Presidency's Cabinet, the functions related to the planning of objectives and coordination of programmes, institutional public relations, international relations and protocol, and the social media, as well as the drafting of the reports, studies and texts from which the President entrusts him.

3. Within the Cabinet, there is a Press Office whose holder has an organic level of Deputy Director General.

Three.

1. It also depends directly on the Presidency of the Council on the Inspection of Federations and Sports Entities, with an organic level of General Subdirection.

2. The following functions are the responsibility of the Inspectorate of Federations and Sports Entities:

(a) To monitor the actions of the Entities to be registered in the Register of Associations and Sports Federations in accordance with Royal Decree 2588/1985 of 20 November, especially as regards their organisation, economic and financial regime and sports facilities.

(b) Fiscalize, where appropriate, the grants awarded by the Council to Federations and Sports Associations, taking care of the adequacy of these grants for the intended purpose.

(c) Provide advice and assistance to the Sports Entities in respect of which they perform their duties.

d) Support and assistance to the Presidency for the proper functioning of services and the normal development of the Council's activities.

Four.

The Chair of the Council is attached to the Delegation of the General Intervention of the State Administration.

Art. 5. The Directorate-General for Sport:

One.

The following functions are for the General Administration of Sport:

1. Know about the sports plans and programs of the Spanish Federations.

2. To propose the approval of the Statutes and Regulations of the Spanish Federations and Sports Associations of supránomenunitary scope, their registration in the Register, and the application, if any, of the provisions relating to their legal regime.

3. Propose the conclusion of agreements for the development of programs of action of the Federations and Public or private entities that organize or promote the realization of activities of a physical-sports character.

4. To propose the granting of grants to the Spanish Federations and Sports Entities of supránomununitary scope, after checking their suitability for the purposes of each one of them.

5. To cooperate with the Spanish Olympic Committee regarding the activities that correspond to it.

6. Carry out or promote studies and research on the development of physical-sports activities and provide advice to Federations and Entities interested in the knowledge and application of their results.

7. Provide the sport of high competition with the aids and means necessary for the elevation of its technical level.

8. To monitor the improvement of the physical condition and technical progress of the athletes of high competition.

9. Collaborate with the Federations in the control of the unauthorized practices used to increase the performance of the athletes.

10. Promote physical culture and extend the practice of sport to all population groups and areas of society.

11. To promote physical education and grassroots sport, especially in school and university areas.

12. Support the practice of sport within the public and social institutions in accordance with their specific aims.

13. Propose, within the framework of the educational competencies of the State Administration, the ordination and development of sports teaching in the academic, professional and sports fields.

14. To raise the proposals, which the competent authorities have made, to the President, to grant aid to sports associations and modest clubs.

Two.

The following units are dependent on the General Directorate of Sports with the organic level of Subdirection General:

General Subdirection of the Competition Sport.

Institute of Physical Education and Sport Sciences.

Base Sport Subdirection General.

Three.

1. The following functions are the responsibility of the General Subdirectorate of Sport:

a) To study and plan the promotion and development of the sport in collaboration with the Spanish Federations.

b) Develop the annual plan of grants to the Spanish Federations and the Spanish Olympic Committee, for the development of their programs and activities, and to promote their effective implementation.

c) Conduct studies and statistics on competitions, sports modalities and specialties, Federations, clubs and federated athletes.

d) To process and report applications for authorization and, where appropriate, to organize or collaborate in the organization of national and international sports or sports events.

e) To collaborate with the Spanish Federations in the training and improvement of high competition athletes and to inform the proposals formulated by those for the formalization of international cooperation agreements sports.

(f) Technical management of high performance centres and, in general, sports facilities for which the Council is directly managed, as well as the preparation of reports on the outcome of the activities carried out in those facilities.

g) Provide the general and specialized information that the Federations, Associations and Sportsmen demand.

2. The following functions are the responsibility of the Institute of Science in Physical and Sport Education:

a) Promote studies and research in relation to physical education and sport.

b) To collaborate with the Universities in the research of Medicine and other fields of Science related to Physical Education and Sport, and in the training of specialists.

c) Promote the incorporation into their activities of professionals from different areas, significantly qualified, taking into account the multidisciplinary and interfacultative nature of the research work undertaken by the Institute.

d) Materialize and technically implement, in collaboration with the Federations, the medical monitoring of the athletes of high competition and the control of unauthorized practices that are used to increase the performance of sportsmen.

e) Study and report rules on specialties, approvals and sports qualifications.

f) Lead and coordinate the various Council publications.

g) Collaborate with other Entities and Organizations that develop physical-sports research and related disciplines.

3. The following functions correspond to the General Subdirectorate of the Sports of Base:

a) Develop plans and propose measures to promote the physical culture and the practice of sport in all population groups and in all social areas, in coordination with the Autonomous Communities.

b) To study and propose the necessary actions for the promotion of physical education and sports practice in non-university teaching centers and to prepare programs for the promotion of sports activities in the university scope, all in coordination, where appropriate, with the competent Autonomous Communities.

c) Organize national and international school sports competitions and coordinate the organization of national and international sports competitions at the university level.

d) Develop and propose the Conventions of support for sport that is developed in institutions or institutions that are dependent on the State Administration or other Public Administrations, in accordance with its aims.

e) To study and write the projects of management of the technical-sports aspects of the Centers, schools and establishments where teaching of initiation or improvement is taught in the practice of the different sports, without prejudice to the competence of the Autonomous Communities.

f) Develop the draft standards for the management of specialized sports teaching that enable the acquisition of technical professional qualifications and develop them in collaboration with the Federations Spanish.

g) Manage the National Institutes of Physical Education that are in charge of the State Administration for the training of Diplomates, Licensors and Doctors in Physical Education.

Art. 6. Directorate-General for Sport Infrastructures:

One.

Correspond to the General Management of Sport Infrastructures the following functions

1. Manage the common services necessary for the General functioning of the Council.

2. Assess needs and develop plans for the construction and improvement of sports facilities in coordination with the Autonomous Communities.

3. Promote the completion of the necessary studies to improve the technical conditions of the sports infrastructure.

4. Carry out the actions that correspond to the Superior Council of Sports in each case, in relation to the granting of the grants and aid necessary to increase the availability of adequate sports facilities.

5. Manage the construction, administration, use and conservation of the Council's own sports infrastructure.

6. Provide assistance and advice to the Public Administrations, Federations and Sports Associations regarding the construction, administration and conservation of their sports facilities.

Two.

The following organic units depend on the General Directorate of Sport Infrastructures:

General Secretariat.

General Sports Infrastructure Subdirection.

Three.

1. The following functions are assigned to the General Secretariat:

a) To be held by the Secretariat of the Plenary and the Board of Directors of the Higher Sports Council.

b) Manage personnel issues and negotiate collective agreements.

c) Develop the Council's preliminary draft budget and investment programmes, process budgetary changes and follow the implementation of the budget.

d) Develop the Agency's economic and heritage management.

e) Handling administrative contracts and controlling their compliance.

f) Take care of the internal regime and issue general matters.

g) Manage database computing services.

(h) to process and, where appropriate, draw up the provisions, instructions or circulars, which are entrusted to you.

i) Manage the Register of Associations and Sports Federations, process the approval of its Statutes and Regulations and report on the resolution of the issues affecting the legal regime of the Sports Entities, where they fall within the competence of the Council.

j) To process the administrative resources that are brought before the Council and to formulate the corresponding proposals for the resolution of the same.

2. The following functions are the responsibility of the General Sports Infrastructure Subdirectorate:

a) Study existing needs and develop the national census of sports facilities, in collaboration with the relevant Public Administrations.

b) Develop, in coordination with the Autonomous Communities, plans for the construction, extension and improvement of sports infrastructure.

c) Conduct technical studies, update technical standards of sports interest and prepare prototypes of sports facilities.

d) Provide technical advice on the sports aspects of the urban plans developed by other Public Administrations and the projects of Federations and Sports Associations, in general.

e) Oversee projects of works and sports facilities financed in whole or in part by the State Administration and carry out the technical and economic evaluation thereof, once completed.

f) Promote, qualify and process grant applications for the construction of sports facilities of the Spanish Federations, with the consequent proposal of granting the corresponding aids.

g) Manage, drive and control the construction of the Agency's own sports facilities.

h) Coordinate the implementation of the completed sports facilities referred to in the preceding paragraphs.

ADDITIONAL DISPOSITION

Deleted:

The General Directorate of the Sports Council.

The General Subdirectorate for Sports Coordination and Promotion.

TRANSIENT DISPOSITION

The units and jobs of the Agency, with a lower organic level to the Subdirección General, remain subsisting and, as long as the development measures are adopted, they will be provisionally dependent on the new ones. General addresses and resulting units according to the functions attributed to each of them by this Royal Decree.

FINAL PROVISIONS

First.

The Minister of Education and Science, prior to the appropriate legal procedures, will dictate the necessary provisions for the development of the provisions of this Royal Decree and will promote the remaining precise measures for the application of the intended on the same.

Second.

The Ministry of Economy and Finance will authorize appropriate budgetary modifications and ratings for the fulfillment of what is ordered in this Royal Decree.

Third.

As many provisions of the same or lower rank are repealed, they oppose the provisions of this Royal Decree and, in an express way, the Royal Decree 814/1986 of 21 March, establishing the organic structure The basic Council of Sports.

Fourth.

This Royal Decree will enter into force the day after its publication in the "Official State Gazette".
