Royal Decree 1485/1985, of 28 August, creates the Secretariat of State for International Cooperation and for Ibero-America, and puts under its dependence the Management Centers and Autonomous Bodies that, under the Ministry of Foreign affairs, dealing with international cooperation in the economic, cultural, scientific and technical fields.

With this, it was about alleviating the high degree of dispersion and fragmentation of competences and the lack of coordination that have characterized our international cooperation as a result, to a great extent, of the late consolidation of this specific role in the Spanish State Administration.

Today, the growing demand for the objectives set by the Spanish policy of cooperation, and, in particular, in order to strengthen the Ibero-American cooperation, as well as the need for incorporation into the programs The Community's assistance to developing countries is, among others, the circumstances which suggest a rethink of the existing organic instruments of the Secretariat of State for International Cooperation and for Latin America.

To this end, in view of the experience gained since its creation, it is considered essential to proceed to a reorganization of this Secretariat of State, based on the following criteria:

-The need to strengthen the functions of planning, analysis and evaluation of cooperation actions, grouping together in bodies in the Secretariat of State for International Cooperation and for Latin America.

-Need, likewise, to recast the current Autonomous Bodies into a single Entity, exclusively dedicated to the development, management and execution of the programming.

-Desirability of strengthening the capacity of action of the new Agency, by means of the organic breakdown of the areas of the English-speaking Caribbean, non-Arab Islam and the Far East, which in the framework of the cooperation policy offers a Growing singularity, institutionalized after the entry of Spain into the European Economic Community.

-Opportunity to simplify inoperative administrative structures through the abolition of certain collegiate bodies, corresponding to the scope of action of this Secretariat of State, which at present has ceased to be reason to be.

This Royal Decree, having as its purpose the internal redistribution of powers of the Secretariat of State for International Cooperation and for Ibero-America and the Autonomous Bodies so far attached to the , it is dealt with without prejudice to the powers of the other Public Administrations and the functions currently entrusted to other Ministries, Agencies or Entities of the State Administration itself.

To accomplish these purposes, you are part of the immediate possibilities offered by the following legal precepts:

Article 12 of Law 10/1983, of 16 August, of the Organization of the Central Administration of the State, in so far as it permits the modification of the organic structure of the Secretaries of State.

Article 125 (b) of Law No 33/1987 of 23 December 1988 on the General Budget of the State for 1988, in order to recast the existing autonomous bodies attached to the Ministry of Foreign Affairs by means of this Secretary of State.

Article 126 of the same legal text, insofar as it allows the abolition of administrative collegiate bodies created by ordinary law, such as the Board of Cultural Relations.

In its virtue, at the initiative of the Minister of Foreign Affairs and on the proposal of the Ministers for Public Administrations and of Economy and Finance, after deliberation of the Council of Ministers at its meeting of the November 1988,

DISPONGO:

Secretary of State for International Cooperation and for Latin America (SECIPI)

Article 1. º Competition and general organization.

One. Corresponds to the Secretariat of State for International Cooperation and for Latin America:

1. To direct, programme, monitor and evaluate activities in the field of development cooperation and economic, cultural, scientific and technical relations between the organs of the Ministry of Foreign Affairs.

2. To coordinate the activities which, in those same areas, have been attributed to other organs of the State Administration, without prejudice to the provisions of Article 8.2 of Law 13/1986 of 14 April.

3. Drive the commemorative activities of the Discovery of America.

Two. This Secretariat of State is structured in the following Management Centres:

1. Directorate-General for International Economic Relations.

2. Directorate-General for Cultural and Scientific Relations.

Three. As an advisory body and immediate assistance to the Secretary of State, there is a Cabinet, as provided for in Article 10 of Law 10/1983, of 16 August, and in Royal Decree 3775/1982 of 22 December.

Four. 1. The Office of Planning and Evaluation is also directly dependent on the Secretary of State, with the organic level of Subdirectorate General.

2. It is up to this Office, both to draw up the Annual Plans for International Cooperation, and to prepare the corresponding Memories for the assessment of the situation resulting from those.

Five. It is attached to the Secretariat of State for International Cooperation and for Ibero-America the National Commission for the Commemoration of the V Centenary of the Discovery of America that will continue to be governed by its specific provisions.

Six. The Ministry of Foreign Affairs, through this Secretariat of State, is assigned the autonomous agency "Agencia Española de Cooperación Internacional".

Art. 2. General Directorate of International Economic Relations.

One. It is the responsibility of the Directorate-General for International Economic Relations, in the field of competence of the Ministry of Foreign Affairs, for the elaboration, proposal and implementation of the policy with other countries in the following areas:

1. International economic relations of a bilateral nature.

2. Economic, technical and development relations in the multilateral organizations.

3. Cooperation in the field of international communications and energy issues.

4. Coordination of Community programmes in the field of development cooperation, without prejudice to the powers of the Secretariat of State for the European Communities.

Two. The following organic drives depend on this Management Center:

General Sub-direction of Multilateral and Development Economic Relations.

Bilateral Economic Relations sub-directorate with Europe.

General Sub-Directorate of Bilateral Economic Relations with Non-European Countries.

Subdirectorate General of Air, Maritime and Land Cooperation.

Deputy Director-General for Coordination of Community Cooperation Programmes.

Three. It corresponds to the organic units identified in the previous paragraph, without prejudice in any case of coordination with the Departments with competence in the field, the development of the following functions:

1. To the General Sub-Directorate of Multilateral Economic Relations and Development, the preparation and monitoring of multilateral economic relations and development cooperation.

2. To the General Secretariat for Bilateral Economic Relations with Europe, the preparation and follow-up of the economic relations of Spain with the European countries.

3. To the General Sub-Directorate of Bilateral Economic Relations with Non-European Countries, the preparation and follow-up of the economic relations of Spain with the countries of the rest of the world.

4. To the General Subdirectorate of Air, Maritime and Land Cooperation, the preparation and monitoring of policies for the development of land, sea and air communications.

5. To the General Secretariat for the Coordination of Community Cooperation Programmes, to ensure the monitoring and coordination of the activities of the Secretariat of State in relation to the development cooperation policy and to the relations outside the European Community.

Art. 3. General Directorate of Cultural and Scientific Relations.

One. It is the responsibility of the Directorate-General for Cultural and Scientific Relations, within the competence of the Ministry of Foreign Affairs, for the elaboration, proposal and implementation of the policy with other countries in the following areas:

1. Cultural relations.

2. Cultural institutions of Spain abroad.

3. Technical and scientific cooperation.

Two. The following organic drives depend on this Management Center:

1. Deputy Director General for International Cultural Cooperation.

2. Deputy Director General of Cultural Institutions Abroad.

3. Sub-Directorate-General for Scientific-Technical Cooperation.

Three. It corresponds to the organic units mentioned in the previous paragraph, without prejudice in any case of the competences of other departments in the field, the development of the competences of the Directorate General according to the following functions:

1. The General Sub-Directorate of International Cultural Cooperation, those for planning, coordinating, monitoring and evaluating bilateral and multilateral relations.

2. The Subdirectorate-General of Cultural Institutions abroad, those relating to the management of such Centers.

3. The General Secretariat for Scientific and Technical Cooperation, on the planning, coordination, implementation and evaluation of bilateral and multilateral relations in the scientific and technical field with the OECD and Eastern European countries. European.

II. Spanish Agency for International Cooperation (AECI)

Art. 4. Nature, classification and legal status.

One. Under the name of the Spanish Agency for International Cooperation, the autonomous organizations "Instituto de Cooperación Iberoamericana" and "Instituto Hispano-Arab de Cultura" are recast.

Two. 1. The Spanish Agency for International Cooperation is an autonomous agency of the State Administration, attached to the Ministry of Foreign Affairs, through the Secretariat of State for International Cooperation and for Latin America, and classified as provided for in Article 4 (1) (a) of the General Budget Law.

2. The Ministry to which the Agency is attached shall approve the objectives of its action plans and shall have audits to verify the extent to which the projects are carried out and the effectiveness of the development of their functions.

Three. The Agency, which has legal personality, its own patrimony and ability to act for the purpose of its purposes, is governed by the Law on the Legal Regime of the Autonomous State Entities, in the General Budget Law, in the other implementing provisions to the Autonomous Bodies of the State Administration and to this Royal Decree.

Art. 5. Fines and functions.

One. It is the responsibility of the Spanish Agency for International Cooperation, without prejudice to the competences of the various ministerial departments and the Entities and Agencies attached to them, the achievement of the following purposes:

1. Promote economic growth and social, cultural, institutional and political progress in developing countries, especially those with a Hispanic ascendant.

2. To encourage closer links of understanding and cooperation between developed countries, especially those integrated in the European Communities, and the countries referred to in the previous issue.

Two. The Agency shall, in order to comply with the aforementioned objectives and within the framework of Article 1, 1. of this Royal Decree, is expressly empowered to perform the following functions:

1. To promote, coordinate and implement development cooperation programmes and projects in the economic, cultural, scientific and technical fields.

2. To promote and tender for the implementation of programmes which, with matching objectives, can establish other national and international public bodies.

3. Support and encourage public or private initiatives that contribute to the achievement of the Agency's objectives.

4. Carry out and disseminate studies relevant to the progress of the least developed countries.

5. Participate in the defense and dissemination of the Spanish language and other Spanish languages.

6. To develop, within the framework of existing legislation, how many other activities can contribute to the fulfilment of their objectives.

Three. In order to meet its objectives, the Agency may, under the conditions laid down in the applicable legislation, promote associative entities and companies to participate in those already established for the purpose of achieving They are their own. It may also promote the dissolution of participating companies or the disposal of the shares of which it is a holder.

Four. In the cases provided for by the laws in force, the Agency may contract with natural or legal persons, both domestic and foreign, the provision of technical assistance services and the carrying out of specific work, not usual, for a given time.

Art. 6. Government organs.

One. The Spanish Agency for International Cooperation has the following governing bodies:

Governing Council.

President.

Two. 1. The Governing Council shall operate in plenary and in the Executive Committee in a manner determined by the Agency's Rules of Procedure.

2. The Rector Council plenary is composed as follows:

President: The Minister of Foreign Affairs.

Vice President: The Secretary of State for International Cooperation and for Latin America.

Vocals:

The President of the Agency.

The Secretary General of Foreign Policy.

The Secretary-General for the European Communities.

A representative of each Ministry or Secretariat of State, where appropriate, with International Cooperation activities, with a minimum level of Director-General.

Secretary: The Secretary-General of the Agency, who will participate in a voice and without a vote.

3. In any case, it is up to the Rector Council to:

Determine the Agency's overall policy guidelines, in accordance with the forecasts of the Annual Plan for International Cooperation.

Approve the Agency's Activities Program and each of its Management Centers.

Approve the Agency's budget, management memory, and accounts, prior to referral to the competent bodies for approval, as the case may be.

Exercise the remaining functions assigned to you by the Body Regulations.

Three. 1. The President of the Agency, with the rank of Undersecretary, will be appointed and separated by Royal Decree approved in the Council of Ministers, on the proposal of the Minister of Foreign Affairs.

2. Corresponds to the President of the Spanish Agency for International Cooperation:

To provide, for all intents and purposes, the representation of the Body.

To draw up proposals on the matters attributed to the Rector's Plenary Session, which are set out in paragraph 2, 3, of this same article.

Chair the Executive Committee of the Governing Board.

Assume the direction of the Agency, orienting and boosting the activity of its Institutes and services.

Exercise the top leadership of all staff at the service of the Agency.

Inspect the operation of all the Agency's units, with their own resources or through the Ministry's General Inspection of Services.

Draw up the preliminary draft budget, as well as the Management Memory and the Agency's accounts.

Authorize expenses and order the Agency's payments.

Exercise how many other privileges the Law of Autonomous State Entities and other current legal provisions confer on you, as well as those attributed to you by the Agency's own Rules of Procedure.

Delegate your specific privileges, when appropriate according to the general administrative order, in the headlines, both of the Management Centers of the Agency, and of the Units directly dependent on its own Presidency.

Art. 7. ° Basic organic structure.

One. 1. Under the immediate dependence of its President, the Spanish Agency for International Cooperation is structured in the following management centres:

Instituto de Cooperación Iberoamericana.

Institute for Cooperation with the Arab World.

Development Cooperation Institute.

2. At the head of the Institute of Ibero-American Cooperation there is a Director General who will hold the Vice Presidency of the Agency and will be appointed and separated by Royal Decree approved in the Council of Ministers on the proposal of the Minister of External.

3. At the head of the other Institutes there are two Directors-General who will be appointed and separated by Royal Decree approved in the Council of Ministers on the proposal of the Minister of Foreign Affairs.

Two. The following units are also directly dependent on the President of the Agency for the organic level of Subdirectorate General:

Technical Cabinet.

General Secretariat of the Agency.

Art. 8. Instituto de Cooperación Iberoamericana (ICI).

One. In order to strengthen the historical acquis of this Institute in relations between Spain and the Ibero-American world, the Institute is responsible for the development of the Agency's activities in this area, and in particular the exercise of the following functions:

1. To carry out and disseminate how many studies are appropriate to promote a greater approximation between Spain and the countries of Latin America, through a better mutual understanding of their respective realities.

2. Promote projects that aim to defend the Spanish language and to disseminate the other languages of the Ibero-American peoples.

3. To develop projects for cultural, scientific, technological and economic cooperation in all the Ibero-American countries.

4. To carry out training and training projects for Ibero-American professionals in Spain and Spain in those countries.

5. Collaborate on initiatives to create permanent Ibero-American institutions, with Spanish presence and participation.

Two. The Institute has a Superior Council, chaired by the Secretary of State for International Cooperation and Latin America, whose composition and functions will be regulated by ministerial order.

Three. The following organic units shall be determined by the Director-General of the Institute:

1. Sub-Directorate-General for Cooperation Programmes.

2. Deputy General Direction of Cooperative Action.

3. Sub-directorate General for Cultural Promotion.

Four. 1. They correspond to the General Sub-Directorate of Cooperation Programmes, the functions related to the programming and implementation of those projects carried out in the countries with which comprehensive cooperation programmes are signed.

2. They correspond to the Cooperative Action Subdirectorate General, the functions related to the programming and execution of those projects that are carried out in countries with which no comprehensive cooperation programs are signed.

3. It is the responsibility of the Subdirectorate General for Cultural Promotion to develop the functions related to the programming and execution of projects related to the dissemination of Spanish and other Spanish languages, as well as to actions of a character cultural.

Art. 9. Institute of Cooperation with the Arab World (ICMA).

One. It is up to the Institute for Cooperation with the Arab World to develop the Agency's activities in the Arab countries, and in particular the exercise of the following functions:

1. Implement concrete actions to enhance and promote the Spanish-Arab cultural ties and to carry out research, study and defense programs for the common Arab and Hispanic culture.

2. To develop projects for the dissemination of Hispanic culture in the Arab world and Arab culture in Spain and courses, seminars, conferences, exhibitions and congresses on historical and current topics, common to both realities.

3. Maintain exchanges with the relevant institutions of those countries.

4. Develop scientific and technical cooperation programs with the Arab countries.

5. Implement specific economic cooperation projects with the public and private initiative contest.

6. Carry out the concrete actions of multilateral cooperation to be agreed by the Agency's decision-making bodies.

Two. The Director-General shall be responsible for the General Subdirectorate of the Institute and the other organic units to be determined by the Agency's Rules of Procedure.

Three. The tasks relating to the programming and implementation of research and dissemination projects in the respective cultures, as well as the direction of exchanges with the institutions, are the responsibility of the Institute's sub-directorate-general. corresponding in the Arab countries.

Art. 10. Institute for Development Cooperation (ICD).

One. It is for the Institute for Development Cooperation to carry out the activities of the Agency in the countries of lower level of development not referred to in Articles 8 and 9 of this Royal Decree, and in particular the exercise of the following functions:

1. To carry out and disseminate studies on the reality of the countries covered by their field of action.

2. Organize events for the dissemination in Spain of the various indigenous cultures of these countries.

3. Collaborate with Spanish cultural centers and with the corresponding diplomatic representations in the organization of activities for the best knowledge of Spain in those countries.

4. Participate in the implementation of research, exploration and prospecting programs that demand the development of these peoples through the use of scientific and technical personnel or by means of aid to research personnel.

5. Maintain exchanges with relevant public or private entities and institutions in the countries of reference.

6. Implement projects for integrated development and carry out concrete cooperation actions, with the public or private initiative contest.

Two. From the Director General of this Institute the following organic units depend:

1. The General Sub-Directorate of Cooperation Programmes.

2. Deputy General Direction of Cooperative Action.

Three. 1. The General Sub-Directorate of Cooperation Programmes is responsible for the programming and implementation of projects carried out in the countries with which comprehensive cooperation programmes are signed.

2. The functions related to the programming and execution of projects that are carried out in countries with which no comprehensive cooperation programs are not signed are the responsibility of the Cooperative Action Subdirectorate General.

Art. 11. Units directly dependent on the Presidency of the Agency.

One. It is up to the Technical Cabinet to carry out the activities and work of immediate advice and assistance entrusted to it by the President of the Agency.

Two. The Secretariat-General of the Agency is responsible for the functions of the human resources administration, the management of economic and financial resources, the organisation of purchases and supplies, the legal advice, the documentation and the other general services of the Agency.

Art. 12. Goods and economic resources.

The Agency's economic assets and means are as follows:

1. The assets and securities constituting their assets, as well as the income and products thereof.

2. Transfers and grants, which are recorded annually in the General Budget of the State, and those which may be included in the budgets of the Autonomous Bodies and the State Public Entities.

3. The revenue of public or private law that it is entitled to receive as a result of its activities.

4. Grants, voluntary contributions or grants awarded or awarded to you by other public entities or private persons.

5. Any other economic resources, ordinary or extraordinary, that may be legally attributed to them.

ADDITIONAL PROVISIONS

First.

One. At the entry into force of this Royal Decree, the following Executive Centres, Basic Units and Collegiate Bodies will be abolished at the Secretariat of State for International Cooperation and for Ibero-America.

1. Management centres:

Directorate General for International Technical Cooperation.

General Directorate of Cultural Relations.

2. Units with organic level of General Subdiretion.

Cooperation Office with Equatorial Guinea.

Subdirectorate General for Action and Cultural Cooperation.

General Subdirection of Cultural Services.

Subdirectorate General for Technical and Scientific Cooperation.

Subdirectorate General for Land, Maritime and Air Cooperation.

Subdirectorate General for Energy Affairs.

General Multilateral Economic Relations Subdirection.

General Secretariat for Bilateral Economic Relations with European Countries and European Free Trade Zones.

3. Inter-ministerial collegiate bodies.

Cultural Relations Board.

Inter-Ministerial Commission for the Implementation of the Convention for the Protection of Cultural Property in the Event of Armed Conflict.

Two. 1. The autonomous organizations are deleted and are refounded in the Spanish Agency of International Cooperation, and their legal personality has been extinguished since the date of entry into force of this Royal Decree.

2. In particular, government, consultation, administration and management bodies are also deleted:

a) At the Ibero-American Cooperation Institute.

Governing Council.

President.

Vice President.

Governing Board.

Technical Cabinet of the Presidency.

General Secretariat.

Cultural Cooperation Directorate.

Scientific-Technical Cooperation Direction.

Economic Cooperation Directorate.

Purchasing Board.

Publications Advisory Commission.

b) At the Hispanic-Arab Institute of Culture.

Institute sub-direction.

Second.

One. The functions of the Institutes, which are recast by the present Royal Decree, are to be performed by the Agency for International Cooperation.

Two. All references to the functions of the two Institutes, which the existing provisions contain, are hereinafter referred to as the Agency and the Institutes which are dependent on them, where appropriate.

Third.

For the purposes laid down in Article 98 of Law 50/1984 of 30 December 1984, the budgetary appropriations for staff corresponding to the autonomous bodies recast are those set out in Annexes I and II to this Royal Decree.

Fourth.

One. All assets, rights and obligations belonging to the heritage of the self-contained autonomous bodies are incorporated into the assets of the Agency, since the entry into force of this Royal Decree.

Two. In accordance with Article 99 (3) of Law 50/1984 of 30 December 1984, the Agency shall be subrogated to the ownership of the rights and obligations corresponding to the Deleted Institutes.

Three. The changes in ownership, produced in accordance with the provisions of the previous paragraph, shall not in any event be entitled to the termination of the corresponding contracts.

TRANSIENT PROVISIONS

First.

The administrative units with a lower organic level to the general sub-directorate remain subsist and, as long as the development measures are adopted, they are provisionally dependent on the Directorates-General and basic units of the Secretariat of State and the Agency, in accordance with the functions assigned to each of them by this Royal Decree.

Second.

All staff affected by the removal of the recast bodies will be respected for their current administrative or employment situation. In addition, it will continue to receive its remuneration from the credits to which it has been charged until the development measures of this Royal Decree are adopted.

Third.

One. The agency shall assume as its own, from the entry into force of this Royal Decree and until the end of this financial year, the budgets of the Refounded Bodies, not affected by recognized obligations, with the responsibility of the The new obligations would be indistinct.

Two. With a total separation of the implementation of new operations with application to the budgets of the suppressed organizations, the liquidation of these organizations will be practiced that shows their patrimonial situation, rights, obligations and state of the situation in the execution of the budget at the time of extinction.

Three. In addition, the drawing up and accountability of the 1988 budget shall be carried out in accordance with the provisions in force, separating the management of the bodies removed from that carried out by the Agency.

Fourth.

One. Within two months, the Agency shall draw up and, through the Ministry of Foreign Affairs, send to the Ministry of Economy and Finance a complete inventory of the goods corresponding to the self-contained bodies deleted.

Two. Without prejudice to its immediate use, the Ministry of Economic Affairs and Finance, acting at the request of the Ministry of Foreign Affairs, shall attach to the Agency the goods it requires for the performance of the tasks, and shall, where appropriate, obtain the of the remaining ones for incorporation into the State Heritage, as provided for in Article 99, number 1 of Law 50/1984, of December 30.

FINAL PROVISIONS

First.

One. The Minister of Foreign Affairs, after having complied with the appropriate legal procedures, will dictate the provisions necessary for the development of the provisions of this Royal Decree and will promote the remaining precise measures for the implementation of provided in the same.

Two. In particular, through the Order of the Minister of Foreign Affairs, the Regulation of the Spanish Agency for International Cooperation will be approved.

Second.

The Ministry of Economy and Finance will authorize appropriate budgetary modifications and ratings for the fulfillment of what is ordered in this Royal Decree.

Third.

One. All provisions of the same or lower rank shall be repealed as set out in this Royal Decree and, in an express manner, Articles 6 to 9, both inclusive, and the additional provision of Royal Decree 1485/1985 of 28 August, determining the basic organic structure of the Ministry of Foreign Affairs.

Two. Until the Regulation of the Spanish Agency of International Cooperation is approved, they temporarily retain their validity as soon as they do not object to the provisions of this Royal Decree, the precepts contained in the following provisions:

Order of 13 June 1978, approving the Regulation of the Hispanic-Arab Institute of Culture.

Royal Decree 2411/1979, of 11 October, for which the Institute of Ibero-American Cooperation is reorganized.

Royal Decree 359/1981 of 5 February, approving the Regulation of the Institute of Ibero-American Cooperation.

Order of 21 November 1981, for which the organic structure of the Institute of Ibero-American Cooperation is developed.

Fourth.

This Royal Decree will enter into force the day after its publication in the "Official State Gazette".
