The Act concerning the Conditions of Accession of the Kingdom of Spain to the European Communities lays down in Articles 392 and 395 that, since the time of accession, Spain has received notification of directives and decisions (a) Community law, of which it is to be regarded as an addressee, and shall be obliged to bring into force the measures necessary for its implementation.

The Council Directive 85 /384/EEC of 10 June 1985, as amended by the Act of Accession of Spain by Directives 85 /614/EEC of 20 December 1985 and 86 /17/EEC of 27 January 1986, regulated the mutual recognition of the diplomas, certificates and other evidence of formal qualifications in the field of architecture, including measures to facilitate the effective exercise of the right of establishment and the freedom to provide services.

Consequently, it is necessary to proceed to the transposition of the provisions of the aforementioned Directives to the Spanish legal system and to regulate the conditions of the exercise of the activity of the architect in Spain professionals from other Member States, as well as the designation of a particular Authority of the Spanish Administration which is responsible for the receipt and issue of certificates permitting the exercise of the right of establishment and services in the Architecture sector.

It is also necessary to establish minimum channels so that the function of the Architect is exercised by guaranteeing both the safety of the construction work and its occupants, and public safety, regulating such effects. measures necessary to ensure that professionals comply with the regulations on building in force in Spain.

In its virtue, prior to the report of the Superior Council of the Colleges of Architects of Spain, according to the Council of State, on the proposal of the Ministers of Public Works and Urbanism and of Education and Science and after deliberation of the Council of Ministers at its meeting on 25 August 1989,

DISPONGO

Recognition of titles

Article 1. º

The diplomas, certificates and other titles that give access to the activities of the Architecture sector, usually exercised with the title of Architect, are recognized in Spain, related in Annex I of the present Real Decree, provided that they have been issued to nationals of any of the Member States of the European Economic Community.

Art. 2. º

The diplomas, certificates and other titles that give access to the activities of the Architecture sector, usually exercised with the title of Architect, are recognized in Spain, related in Annex II to the present Royal Decree, provided that they have been issued to nationals of the Member States of the European Economic Community and which correspond to studies initiated before the academic year 1988-89.

Art. 3. º

1. It is considered that they meet the conditions required to carry out the activities of the Architecture sector, which are referred to in this Royal Decree, with the professional title of Architect, the nationals of a Member State authorized to use a law conferring on the competent authority of a Member State the power to grant this title to nationals of Member States who have distinguished themselves in a special way by the quality of their achievements; in the Architecture field.

2. The quality of the architect of the persons concerned referred to in the preceding paragraph shall be tested by means of a certificate issued by the Member State of origin or the source of the beneficiaries.

Art. 4. º

The certificates of the competent authorities of the Federal Republic of Germany for which the respective equivalence of training certificates issued to nationals of Member States are to be sanctioned are recognised in Spain. after 8 May 1945 by the competent authorities of the German Democratic Republic, with those referred to in the first article of this Royal Decree.

Art. 5. º

1. It is also recognized that the certificates issued to nationals of Member States by the Member States in respect of which there would be, on 20 December 1985, a regulation of access to and the pursuit of activities in the field of Architecture with the professional title of Architect and which accredit that its holder has received the authorization to use the professional title of Architect before August 5, 1987, and has been effectively dedicated in the framework of this regulation to the activities concerned for at least three consecutive years during the five years preceding the year issue of the certificates.

2. The certificates issued to nationals of Member States by the Member States which had introduced, between 20 December 1985 and 5 August 1987, a regulation of access to and the exercise of the right to exercise the right of access to the activities in the field of architecture with the professional title of Architect and which certify that the holder has received the authorization to use the professional title of Architect since the last date cited, and has been dedicated effectively in the the framework of this regulation to the activities in question for at least three consecutive years during the the five years prior to the issue of the certificates.

Art. 6. º

The holders of the diplomas, certificates and other evidence of formal qualifications referred to in Articles 1 to 5, inclusive of this Royal Decree, are hereby recognized as having the right to use such training certificates in Spain. and, where appropriate, its corresponding abbreviation, in the language of the country of origin, with a compulsory indication of the name and place of establishment or of the court which issued it. The interested parties may also use the name "Architect" in Spanish.

Art. 7. º

The verification that the diplomas, certificates and other evidence of formal qualifications awarded to nationals of the Member States of the European Economic Community correspond to one of those in the relations listed as annexes I and II of this Royal Decree or respond to the cases referred to in the third, fourth and fifth articles thereof, as well as the verification of their authenticity, shall be carried out by the Ministry of Education and Science. In the event of a justified doubt, the said Ministry shall request from the relevant authority of the State of origin confirmation of the authenticity of the diploma, certificate or title and, where appropriate, of the fulfilment of the training requirements. corresponding.

Art. 8. º

1. In the case of Spaniards or nationals of other Member States of the European Economic Community who are in possession of the official Spanish title of Architect, the competent authority to prove the validity of the title, for the purposes of Free establishment in other Member States of the European Economic Community is the Ministry of Education and Science.

2. The Spanish titles valid for the purposes set out in the preceding paragraph are those specified in Annex III to this Royal Decree.

Right of establishment

Art. 9. º

1. The exercise in Spain of the professional activity of Architect under the establishment requires the incorporation of the person concerned as a collegiate in the Official College of Architects in whose territorial scope the profession is intended to practice. In the relevant application for membership, the following shall be recorded together with the other data required by the following:

a) Residence address in Spain.

b) Professional address in Spain, which will be the case of your study if you are self-employed or at your job if you do so under employment.

c) The professional name to be used according to the sixth article of this Royal Decree.

The application mentioned must be accompanied by the certification corresponding to the verification carried out by the Ministry of Education and Science referred to in the seventh article of this Royal Decree, as well as, in its (a) a report by the Member State of origin or the Member State of origin, specifying its disciplinary record and, if any, the penalties of a professional, administrative or criminal nature adopted against the person concerned in connection with his professional practice in that State. This report shall be secret and shall not be valid after three months from the date of issue.

2. In order to decide on incorporation, the Architects of Architects shall have a maximum period of three months from the date of submission of the complete file of the person concerned, without prejudice to the time limits which may arise from an appeal to the Complete the procedure.

3. In the event of knowledge of serious and detailed facts which have occurred before the establishment of the person concerned in Spain, or of incorrect information in their documentation and which may have consequences for the access to the exercise of the occupation, the competent Spanish authorities shall ask for themselves, or at the request of the Colleges of Architects through its Board of Governors, the information referred to in Article 18 of Directive 85 /384/EEC by suspending the period provided for in Article 18 of Directive 85 /384/EEC. in the preceding paragraph until such information is received or, in the case of silence, until three months after the request for it.

4. Where the application for incorporation is rejected, the decision shall be reasoned and notified with the expression of the resources which it has taken.

Art. 10.

1. By virtue of their collegiation, the graduates referred to in this Royal Decree will enjoy the same rights and assume the same obligations as the Spanish collegiate architects. In particular, as regards the disciplinary procedures and the corresponding penalties, the Statutes of the Colleges of Architects and the professional rules of conduct of the Council of the Council are applicable to them. 2. Where the assistance consists in drawing up implementing projects or taking over the optional management of works, graduates from other Member States, whose title has been recognised in Spain in accordance with the provisions of this Royal Decree, they may not exercise in Spain different powers from those which, according to the qualification of the country of origin, could develop in this country, unless they act in collaboration with another professional trained to exercise them and with qualifications also recognised under Spanish law.

Service Delivery

Art. 11.

1. Qualified graduates from other Member States who are legally established in one of them may, under the provision of services, exercise occasional activities in Spain.

2. The service delivery scheme does not allow for the opening of a study or another professional address, principal or secondary, in Spanish territory, or to have a permanent representative.

Art. 12.

1. For the purposes of the professional exercise under the provision of services, the person concerned shall formalise a temporary registration in the Official College of Architects corresponding to the place where is to be carried out or to have effect professional service in question, when it involves the completion of a project, or other activity that it performs according to its quality of Architect.

2. The registration will be formalized by communication to the Dean President of the corresponding College of Architects, with the expression of:

(a) Personal identification data, nationality, residence and professional address in their State of origin or provenance, and Association or Professional Body to which they belong.

(b) Certification issued by the State of origin or origin attesting to the possession by the person of a diploma, certificate or other title of those referred to in this Royal Decree. These documents will be accompanied by certification by the Spanish Ministry of Education and Science.

(c) Service that you intend to provide, place of completion, customer identity, maximum expected duration and address in Spain during your stay.

The reference to the services to be provided by the person concerned shall also serve the disciplinary effects provided for in Article 22.1 of Directive 85 /384/EEC.

(d) Certification issued by the competent authority of the Member State in which it is established, stating that the beneficiary is legally exercising that particular activity in that State.

The documentation referred to in paragraphs (b) and (d) shall not be valid for more than twelve months of issue.

3. The registration shall be free of charge, being formalised at the time of submission of the application with the required complete documentation, unless it results in deficiencies which are to be remedied and shall be maintained until the completion of the work originate.

4. The refusal of the application for registration shall require express and reasoned decision, and shall be notified with an indication of the resources against it.

5. The beneficiary shall exercise equal rights and obligations with the Spanish Architects, thus being subject to the provisions in force on the visa and control of professional work and the deontological and disciplinary procedure of colegial and administrative character applicable in Spain.

6. Where the beneficiary or the professional entity or firm to which he is a member intends to carry out work in Spain in the direction of work or who requires assistance in a period exceeding six months, he shall be informed of his or her activity must be subject to the rules governing the right of establishment.

Provisions common to the right of establishment and the right to provide services

Art. 13.

1. The graduates referred to in this Royal Decree must declare to the College of Architects concerned if they have assurance of their professional responsibility and, in the event that they have it concluded with Insurance Entity Spain, with its translation, will have to provide a copy of the corresponding policy and certification of its validity and clear expression of the risk coverage in Spain.

2. In the course of the professional activity of Architect, qualified graduates from the Member States will be subject, in any case, to the provisions of Spanish legislation and, in particular, to the sector of the building, deontological regulations and professional statutes, as well as state and local taxes, without prejudice, in this case, to the provisions of the international treaties on double taxation.

3. The construction work projects shall be subject to the granting of the corresponding works licence, to a verification procedure by means of the collegial visa, or administrative supervision where appropriate, on their Compliance with design specifications and regulations on building and security of enforced compliance in Spain.

4. In addition, in order to carry out projects for public administrations, they shall be subject to the provisions of the relevant provisions governing the Contracting Administration.

Art. 14.

1. It is for the High Council of the Colleges of Architects to provide the service to inform the beneficiaries of the other Member States of the applicable legislation and professional ethics, and to issue, in the field of their competences, the supplementary instructions for the proper exercise by the Colleges of Architects of the functions assigned to them in compliance with this Royal Decree.

2. The High Council of the Colleges of Architects shall keep an independent register, in which the interventions and performances of the graduates referred to in this Royal Decree are reflected.

ADDITIONAL PROVISIONS

First.

The provisions of this Royal Decree shall also apply to nationals of Member States who, under the Regulation of the European Economic Community No 1612/1968, are employed as salaried workers. activities under the professional title of Architect, without prejudice to temporary exceptions to the free movement of workers provided for in the Treaties.

Second.

Annexes I and II to this Royal Decree shall be automatically considered as amended in accordance with the updates of the list of diplomas, certificates and other academic titles of architecture which may occur by decision of the Commission of the European Economic Community and which are the subject of publication in the Official Journal of the Communities.

Third.

The studies leading to the acquisition of the securities whose recognition is regulated in this Royal Decree must, in any case, have been submitted within the Member States, without prejudice to the Article 4. º

FINAL PROVISIONS

First.

For the purposes set out in this Royal Decree and in relation to the provisions of Articles 7 and 8 thereof, the certificates issued by the Ministry of Education and Science are fully valid and effective. since 1 September 1987 for the purpose of verifying the correspondence between diplomas, certificates and other evidence of formal qualifications in the field of architecture, obtained in the Member States of the European Economic Community, with those laid down in the Directive of Council 85 /384/EEC of 10 June 1985, as amended by Council Directive 85 /614/EEC, of 20 December 1985.

Second.

The Ministries of Public Works and Urbanism and of Education and Science will request from the Superior Council of the Colleges of Architects of Spain the data they deem necessary in order to implement the provisions of the Present Royal Decree.

Third.

The Ministers of Public Works and Urbanism and of Education and Science are authorized to dictate, in the field of their respective competences, how many provisions require the development and implementation of this Royal Decree.

Fourth.

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".

Relationship of diplomas, certificates and other evidence of formal qualifications recognised under the first article of this Royal Decree

Belgium

Titles issued by higher national architecture schools or higher architecture institutes (architecture-architecture).

The titles issued by the superior provincial school of Architects of Hasselt (architect).

The titles issued by the royal arts academies (architecture-architecture).

The titles issued by the Saint-Luc (architect-architecture) schools.

The titles of Civil Engineer Architect and Engineer Architect issued by the faculties of applied sciences of the universities and by the polytechnic faculty of Mons (ingenueur-architect, ingenueur-architect).

Denmark

The titles issued by the school of architecture of the fine arts academy of Kubenhavn and by the architecture school of Århus (arkitekt cand. arch.).

Germany

The titles (Diplom-Ingenieur, Diplom-Ingenieur Univ.) issued by the universities, architecture section (Architektur/Hochbau), higher technical schools, architecture section (Architektur/-Hochbau), technical universities, architecture section (Architektur/Hochbau), universities grouped in Gesamthochschulen, architecture section (Architektur/Hochbau), plastic top schools, high schools of fine arts.

The titles (Diplom-Ingenieur, Diplom-Ingenieur FH) issued by the Fachhochschulen, architecture section (Architektur/Hochbau) and by the universities grouped in Gesamthochschulen, architecture section (Architektur/Hochbau) within the training corresponding to that of the Fachhochschulen (*).

(*) Such securities should be recognised under the conditions laid down in Article 4 (1) (l) of Directive 851384 /EEC, pursuant to paragraph 1 of Article 4 (1) or under paragraph 2 thereof, according to the duration of the training which credit.

France

The title of architect awarded by the Government (diploma d' architect DPLG) issued by the Minister in charge of architecture.

The title of architect issued by the special school of architecture of Paris (diploma d' architect ESA).

The title of architect awarded by the national higher school of arts and crafts of Strasbourg, section of architecture (diplome d' architect ENSAIS).

Ireland

The Bachelor of Architecture (Bachelor of Architecture) degree, awarded by the national university of Ireland (B Arch. NUI) to the architecture graduates of University College Dublin.

The university degree of architecture issued by the "College of Technology" Bolton Street, Dublin (Diplom Arch.).

The partner certificate of the "Royal Institute of Architects of Ireland" (ARIAI).

The "Royal institute of Architects of lreland" (MRIAI) member certificate.

Italy

Degree in architecture (laurea in architettura) awarded by the universities of Chieti, Firenze, Genoa, Napoli, Palermo, Reggio Calabria and Rome La Sapienza, by the polytechnic institutes of Milano and Torino, and by the university institute of architecture of Venezia.

Portugal

United Kingdom

The diplomas in architecture issued by the polytechnic schools of Central London, North London, North East London, South Bank, Thames, Birmingham, Brighton, Huddersfield, Kingston, Leeds, Leicester, Liverpool, Manchester, Oxford, Plymouth or Portsmouth; or awarded by the universities of London, Cambridge, Sheffield, Heriot-Watt, Edinburgh, Belfast, Aberdeen or Glasgow, or issued by the Canterbury College of Arts, Humberside College of Higher Education, Robert Gordon's Institute of Technology or Glasgow School of Art,

or titles in architecture ("degrees in architecture") issued by the universities of Bath, Liverpool, Manchester, Newcastle, Nottingham, Wales, Dundee, Strathcelyde or Glasgow; or the final examination of the " Architectural Association "; or the" Royal College of Art " architecture exam,

or the examination, Part II, of the "Royal Institute of British Achitects".

1. Germany

The certificate of aptitude issued by the Commission of Architects in accordance with Law No 202 of 28 May 1975 (registreret arkitekt);

The diplomas awarded by the Higher Schools of Civil Engineering (bygningskonstruktor), accompanied by a certificate from the competent authorities stating that the person concerned has passed the examination of his qualifications, compliance with Article 13;

4. France

The Diploma of Architect Diplomated by the Government issued until 1959 by the Ministry of National Education and from that date by the Ministry of Culture (architect DPLG).

The diplomas awarded by the Special School of Architecture (architect DESA).

The diplomas awarded since 1955 by "L' École National Superieure des Arts et Industries de Strasbourg" (formerly "Ecole Nationale D' lngenieurs de Strasbourg", Section Architecture (architect ENSAIS)

5. Greece

The diplomas of Engineering-Architect issued by the Metsovion Polytechnion of Athens, accompanied by a certificate issued by the Technical Chamber of Greece conferring the right to the exercise of activities in the field of the architecture.

The diplomas of Engineering-Architect issued by the Aristotelion Panepisimion of Thessaloniki, accompanied by a certificate issued by the Technical Chamber of Greece conferring the right to the exercise of the activities in the architecture industry.

6. Ireland

The university-level diploma in architecture awarded by the College of Technology, Bolton Street, Dublin (Dipl. Arch.).

The partner certificate of the Royal Institute of Architects of Ireland (ARIAI).

The member certificate of the Royal Institute of Architects of Ireland (MRIAI).

7. Italy

The diplomas of "Laurea in Architettura" awarded by the Universities, the Polytechnic Institutes and the Higher Institutes of Architecture of Venice and Reggio Calabria, accompanied by the diploma that enables the exercise independent of the profession of architect issued by the Minister of Public Instruction after the candidate has passed, before a competent court, the examination of the State which entitles him to the independent exercise of the profession of Architect (Dott. Architetto).

The diplomas of "Laurea in Ingegneria" in the construction sector issued by the Universities and the Polytechnic Institutes, accompanied by the diploma that enables the independent exercise of Public Instruction the candidate has, before a competent court, passed the examination of the State which entitles him to the independent exercise of the profession (Dott. Ing. Architetto or Dott. Ing. in Ingegneria Civile).

8. Netherlands

The certificate certifying the completion of the Bachelor of Architecture examination issued by the Department of Architecture of the Higher Technical Schools of Delfs or Eindhoven (Bouxkundig Ingenieur).

A certificate from the competent authorities stating that before the date of entry into force of this Directive the person concerned has been admitted to the examination of "Kandidaat in de Bouwkunde", organised by the Technical School Superior to Delft or Eindhoven, and which for a period of at least five years immediately preceding that date has carried out architectural activities whose nature and importance guarantee, according to the criteria accepted in the Low, sufficient competition for the exercise of these activities (architect).

A certificate from the competent authorities issued only to persons who have reached the age of forty years before the entry into force of this Directive and who accredit the person concerned for a period of at least five years immediately prior to that date has pursued activities of an architect whose nature and importance ensure, in accordance with the criteria accepted in the Netherlands, sufficient competence for the exercise of these activities (architect).

The certificates referred to in the seventh and eighth indents do not need to be recognised from the date of entry into force of the laws and regulations relating to access to the activities of Architect and (a) his or her pursuit of the professional title of Architect in the Netherlands, in so far as these certificates do not, under those provisions, confer access to such activities with that professional title.

9. Portugal

The Diploma "Diploma do Special Course of Architecture" issued by the Schools of Fine Arts of Lisbon and Oporto.

The Diploma of Architect "Diploma of Architect" issued by the Schools of Fine Arts of Lisbon and Oporto.

The Diploma "Diploma of Architecture Course" awarded by the High Schools of Fine Arts of Lisbon and Oporto.

The diploma "Diploma of Bachelor of Architecture" awarded by the High School of Fine Arts of Lisbon.

The Diploma "Charter of the Bachelor of Architecture" issued by the Technical University of Lisbon and the University of Oporto.

"Bachelor's degree in Civil Engenharia" issued by the Technical Higher Institute of the Technical University of Lisbon.

"Bachelors em Engenharia Civil" issued by the Faculty of Engenharia of the University of Oporto.

"Bachelor's degree in Civil Engenharia" issued by the Faculty of Science and Technology of the University of Coimbra.

"Bachelors em Engenharia Civil Produção" issued by the Univacería del Mino.

10. United Kingdom

The titles conferred after the exams are exceeded in:

The Royal Institute of British Architects,

The Architecture Schools:

The Universes,

Higher Polytechnic Colleges,

Colleges,

Academies (Private Colleges),

The Schools of Technology and Fine Arts, which are or are recognized at the time of the adoption of this Directive by the Architects Registration Council of the United Kingdom for registration of the profession (architect).

A certificate stating that your holder has an acquired right to maintain your professional title of Architect under section 6 (1) a, 6 (1) b or 6 (1) d of the Architects Registration Act of 1931 (architect).

A certificate stating that your holder has an acquired right to the maintenance of his professional title of Architecture under section 2 of the Architects Registration Act of 1938 (architect).

11. The examination of the titles referred to in the fourth indent of paragraph 1, in the third indent of paragraph 3 and in the sixth indent of paragraph 9, involves the evaluation of the projects produced and carried out by the candidate during an effective practice, during, at least, six years, of the activities in the field of architecture.
