Articles 43 to 47 of Law 17/1989, of July 19, regulating the Professional Military Staff Regulations, establish the general criteria for admission to the military training centers, and Articles 106 and 107 access to the condition of military employment, where necessary, in both cases, to proceed with its regulatory development.

In its virtue, on the proposal of the Minister of Defense, in conjunction with the Interior Ministry, as regards the Civil Guard, according to the State Council and after deliberation by the Council of Ministers at its meeting on May 1990.

The General Rules of Entry into the Military Training Centres for Training and Access to the Status of Military Employment are hereby approved, the text of which is inserted below.

REPEAL provisions

First.

The following provisions are hereby repealed, including those which, in accordance with the provisions of paragraph 2 of the derogatory provision of Law 17/1989 of 19 July 1989, regulate the Military Personnel Regime Professional, having had a rank of law, have continued in force with a regulatory nature:

Articles 5, 6 and 7 of the Law of 27 September 1940, establishing the Technical Corps of the Army and the Polytechnic School.

Items 8. 9. 10 and 13 of Law 142/1962, of December 24, on the organization of the Corps of Specialist Air Force Subofficers.

Article 6 of Law 61/1967, of July 22, of the creation of the Corps of Engineers of the Navy.

Article 2 of Decree 3147/1967, of December 28, developing Law 61/1967, of July 22, of the creation of the Corps of Engineers of the Navy.

Decree 731/1973, of 23 March, on access to the Polytechnic School of the Army of IMEC Subofficers, with a degree of higher degree.

Articles 12, 13, 24, 33 and additional provision fourth of Law 19/1973, of July 21, of Navy Specialists.

Royal Decree 1180/1989 of 29 September 1989 laying down the conditions and tests to be exceeded for admission to higher grade military teaching centres.

Order communicated, dated December 17, 1979, establishing age limits for entry into the Military Corps requiring higher academic qualifications.

Second.

The provisions cited below and which relate to matters governed by this Royal Decree. in that they do not object to it, remain in force. The development provisions of this Royal Decree will expressly repeal them.

Order 78/1988, of 16 December, approving the regime of exercises and common professional matters for entry into and the Body and Scale of Musician Subofficers of the Armed Forces.

Order 3/1989 of 16 January, amending in part Annexes I and II of Order 722/39020/1985 of 14 November 1985 on exercise and material programmes for the entry into the Military Intervention Corps of the Defense.

Order 75/1989 of 2 October, approving the programmes, medical table of exclusions and physical exercises by which the selective processes for the entry into the military training centers of training have to be governed higher grade.

Third.

Those provisions of equal or lower rank that are contrary to the provisions of this Royal Decree are also repealed.

FINAL PROVISIONS

First.

By the Minister of Defense, together with the Minister of the Interior for all that refers to the entry into the Civil Guard Corps, it will dictate how many rules are necessary for the development of this Royal Decree.

Second.

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".

CHAPTER FIRST

General rules

Article 1. Application Scope.

1. This Regulation regulates:

(a) The selection procedures for admission to the military training schools, through the forms of direct income or internal promotion.

b) The selection procedures for access to the condition of military employment.

2. The selection procedures for direct entry into the military training centres for training in order to obtain the duty of Lieutenant of the Civil Guard shall be governed by the provisions of this Regulation for the General Corps of the Armies. The remaining access procedures to the Vicil Guard Corps, as well as internal promotion, will be governed by the particular provisions of this Corps.

3. This Regulation shall not apply to the provision of military service in its various forms, which shall be governed by its specific rules.

Art. 2. º Regulatory Provisions.

The entry into the military training centres of training and access to military employment will be governed by the respective calls, which will in any case be adjusted to the provisions of this Regulation and the provisions of this Regulation. concordant concordant.

Art. 3. Selection Systems for income and access.

1. The selection for admission to the training military training centres and for access to the condition of military employment shall be made by means of public notice through the systems of competition, opposition or free opposition, in the the principles of equality, merit and capacity, as well as the principles of advertising, are guaranteed.

2. The contest consists exclusively of the qualification of the merits of the applicants and the ranking of the same in the selection; the opposition consists in the celebration of one or more tests of ability to determine the aptitude of the aspirants and set the order of precedence for the same in the selection; the contest-opposition consists of the successive realization, as part of the selection procedure, of the two previous systems.

3. In the selection process, there may be no more differences on the basis of sex than those arising from the different physical conditions which, where appropriate, may be considered in the table of conditions required for entry into the teaching centres. military training or for access to the condition of military employment.

Art. 4. Internal Promotion.

1. The internal promotion consists in the access of the career military to an immediately superior Scale of the Body in which they are framed, once the evidence of entrance has been passed in the military training center of formation and the plans of corresponding studies.

It also includes the access of the military personnel to the Military Corps Scale that complement, after overcoming the entrance tests and the corresponding study plans.

2. The assessment of the military history of women in the internal promotion will take into account the provisions of article 89.4 of Law 17/1989, of July 19. Regulation of the Staff Regulations of the Professional Military Personnel, in order to guarantee equal opportunities for men of the same origin.

CHAPTER II

Calls

Art. 5. Annual Provision of Places.

The Government, on a proposal from the Minister of Defense, together with the Minister of the Interior regarding the Civil Guard, will determine each year the provision of places for admission to the military teaching centers of training, specifying the quotas that correspond to the different forms of direct income and internal promotion, and for e! access to the status of military employment in the categories of officer and troop and professional marineria.

To this effect, the forecasts of the planning of military defense, and of citizen security regarding the Civil Guard, as well as the credits established in the General Budget Laws of the State will be taken into account.

Art. 6. The elaboration of the proposals of the calls.

1. Once the provision of places as referred to in the previous article has been published and, in any case, within thirty days of its publication, the Directorate General of Teachings of the Ministry of Defense will elaborate the proposals of the calls for the selective entry processes in the military training centres for the training of the Special Corps of Armies to be carried out in a unitary manner and those of the Common Corps of the Armed Forces, as well as the concerning access to the status of a military officer of employment of the category of officer who complement the latter Bodies.

2. The proposals for the calls for selective entry into the military training centres for military training and access to military personnel for employment not covered by the previous paragraph shall be drawn up within the same time limits by the Commando. o Chief of Staff of each Army or Civil Guard, who will forward them to the General Directorate of Education.

Art. 7. Approval of the calls.

The Assistant Secretary of Defense, according to the Director of State Security with respect to the Civil Guard, will convene, in the first quarter of each calendar year, the corresponding selective systems of access for the planned places.

Art. 8. Publication of the calls.

1. The calls, together with their bases, will be published in the "Official Gazette of the State", except those that refer exclusively to internal promotion that will be published in the "Official Defense Bulletin".

2. The calls may be of a unitary nature for the entry of the same level of training in a number of military training centres at the same level.

3. The calls are linked to the administration and to the selection bodies referred to in Article 13 of this Regulation which are to judge the selective tests.

4. The calls, once published, may only be amended subject to the rules of Decree 1408/1966 of 2 June, adapting the Law of Administrative Procedure of 17 July 1958, with the exception of the increase in the number of of the places called, which originated from being deserted places of internal promotion that can accumulate to those of direct income. In this case, the opening of a new deadline for the submission of instances will not be mandatory.

Art. 9. Content of the calls.

1. Calls shall contain at least the following circumstances:

(a) The number and characteristics of the places called and the distribution, where appropriate, of key specialties.

(b) Express statement that the selection bodies may not declare a number of applicants higher than the number of seats convened and that any proposal contrary to the above will be void of full right.

c) The Unit, Center, or Body to which the instances should be directed.

(d) Conditions or requirements to be met or fulfilled by applicants in the form of access, taking into account the provisions of Chapters IV, V and VI of this Regulation.

e) selective tests to be carried out and, where appropriate, the merit ratio to be taken into account in the selection in each of the forms of access.

f) Composition of the selection body to act.

g) Rating system.

h) Program to govern in the testing or indication of the "Official State Gazette" or "Official Defense Bulletin" where it has been published.

i) General schedule for the conduct of the tests, taking into account that they must be initiated within the year in which they are called and not before one month after the publication of the call.

(j) The initial order of action of the applicants, according to the result of the draw referred to in Article 11 of this Regulation.

k) Places where the different tests will be held and where the announcements regarding the development of the tests will be published.

l) Determination, where appropriate, of the characteristics and duration of the training periods and practices for access to the corresponding Scale in each of the forms of income.

m) Examination rights to be paid by the applicant.

n) Model of instance to be raised by the aspirant, or indication of the "Official State Bulletin" or "Official Defense Bulletin", where it has been published.

2. The Minister of Defence, together with the Minister of the Interior with regard to the Civil Guard, may approve a general basis for determining the selective system and the general circumstances of paragraph 1 of this Article. Article, applicable to successive calls for one or more Bodies and Scales and for different forms of access.

Art. 10. Extraordinary calls.

Special calls may be made, outside the time limit laid down in Article 7 of this Regulation, when the selective process is initiated, it is envisaged that no one of the places called for will be covered, either by lack of petitioners or because the number of successful applicants who have accredited the conditions of capacity and requirements required in the call is less than the number of places offered.

Art. 11. Order of action of the aspirants.

The Ministry of Defence's Directorate-General for Teaching will determine, by means of a single public draw, a prior notice in the "Official State Gazette", and within the first quarter of each calendar year, the order of action of applicants in all selection procedures for the entry or access to be held during the year. This drawing shall determine the letter of the alphabet from which the order of action of the applicants shall be established, taking into account the first name of the applicants. The result of this draw to be published in the "Official State Gazette" must be collected on each call.

Art. 12. Challenges.

The calls, the bases and how many administrative acts are derived from them and the action of the selection bodies, may be contested in the cases and in the form provided for in Decree 1408/1966, of 2 June, adaptation of the Administrative Procedure Act of 17 July 1958.

CHAPTER III

Selection Organs

Art. 13. Courts and Permanent Selection Commissions.

1. The selection bodies shall be the Permanent Committees of Selection and the Courts.

2. The Permanent Committees of Selection are the bodies entrusted with the selective process for access to those Bodies and Scales in which the high number of applicants and the level of qualification and specialization required so advise. The Permanent Selection Commissions shall be composed of a President and a number of vowels.

3. The Courts shall consist of a President and an even number of vowels, not less than four, and many other alternates.

4. Each call shall include the selection body to which the development and qualification of the selective tests shall be carried out, as well as their composition.

5. The composition of the selection bodies shall ensure compliance with the principle of specialty on the basis of membership in the body, scale and, where appropriate, a major specialty.

6. The Deputy Minister of Defence or the authority in which he has delegated shall appoint the members of the selection bodies for each call. This designation will be made public in the "Official State Gazette" or "Official Defense Bulletin."

7. The Presidents of the selection bodies may require the addition of specialist advisers to their work, for all or some of the tests, as provided for in the relevant calls. Such advisers shall be limited to the exercise of their technical expertise, on the basis of which they shall cooperate with the selection bodies.

CHAPTER IV

General Conditions

Art. 14. General conditions.

Aspiring members of the military training or access to military training centres will have to meet the following conditions:

Having Spanish nationality.

Comply at least eighteen years of age in the year in which the tests are initiated and not exceed the age referred to in this Regulation.

Accredit good citizen behavior in accordance with Law 68/1980 of 1 December on the issue of certifications and reports on citizen conduct.

Not being deprived of civil rights.

Not be prosecuted for criminal offense or separate from the Public Administrations service or disabled for the exercise of public service.

Possess the psycho-physical fitness that is determined for each Body or Scale.

Be in possession or in a position to obtain the titles listed in this Regulation.

Not having been removed in three previous calls for entry into the relevant training military training centre or for access to military employment.

Where the calls are unitary for entry into the military training centres of the same level, the options mentioned above will have been exhausted when the applicant has been eliminated in three of these calls.

CHAPTER V

Conditions for admission to the military training teachers ' centres

Art. 15. Particular conditions for direct income.

Aspiring military training teachers will have to meet the particular conditions that for each Body or Scale are listed below:

1. Titles: To be in possession or in a position to obtain the titles that expressly appear in the corresponding calls, among which for each Body or Scale are indicated in this section. Where more than one title qualifies for entry into a given Body or Scale, the total number of places corresponding to each of them may be included in the call.

(a) General Corps of Armies and Marines: The levels of qualifications required in the general education system to access the Centers in which qualifications are obtained equivalent to each of the degrees of military education.

b) Corps of Armies Specialists:

1) Generally, the levels of qualifications required in the general education system to access the Centers. In which the qualifications equivalent to each of the degrees of military education are obtained.

2) For access to certain fundamental specialties of the Middle and Middle Scales, titles of Technical Engineer or University Diplomacy and Specialist Technician will be required, respectively. These requirements shall be expressly detailed in the calls.

c) "Intrend Corps of Armies": Licensed in Economic and Business Sciences or Law.

d) Corps of Engineers of the Armies: Engineer of Roads, Channels and Ports, Industrial, of Mountains, Agronomist, of Mines, Naval, Aeronautical, Telecommunications or Electromechanical, Architecture.

e) Military Legal Body: Licensed in Law.

f) Military Intervention Corps: Licensed in Economic and Business Sciences or Law.

g) Military Body of Health:

Top Scale: Licensed in Medicine and Surgery, Dentistry, Pharmacy or Veterinary.

Average Scale: University Diplomacy in Nursing, Physical Therapy, or Optics.

h) Body of Military Musicians:

Top Scale: Master's Degree of Orchestra, or Harmony, Counterpoint, and Composition.

Basic Scale: Instrumentalist or Singer Diploma.

2. Age limits: Failure to comply or have complied within the year in which the holding of the entrance tests begins at most the following ages:

a) General Corps of Armies and Marines: Twenty-two years.

b) Corps of Armies Specialists:

1) Average scales: Twenty-two years, except for those who access by the system in paragraph 1, b), 2) of this article, which is established in thirty-one years.

2) Basic scales: Twenty-two years.

c) Bodies of Intrend of the Armies, Corps of Army Engineers, Military Legal Corps, Military Intervention Corps, Military Corps of Health (Middle and Upper Escalas) and Military Musician Corps (Escalas basic and superior): Thirty-one years, except for career military personnel, which is established in thirty-six years.

Art. 16. Particular conditions for internal promotion.

Domestic promotion applicants must meet the following specific conditions:

The internal promotion of the basic steps to the stockings and the average Scales to the superiors of the General and Specialist Corps of the Army and the Marine Corps will be carried out by means of calls public by the system of concurring-opposition among those aspirants who meet the following conditions:

Take at least two years of effective services on your Scale.

Not having reached the third job on your Scale.

Do not meet or have met the age of thirty-one years at most in the year in which the entrance tests are held.

2. The military personnel of the category of Officer who supplement the Escalas of the Specific Corps of the Armies not mentioned in the following paragraph may enter the military training centers of formation, through their participation in the public calls for the system of competition which is called for, and the following conditions must be met:

Take at least two years of effective military service.

Do not meet or have met the age of thirty-one years at the latest within the year in which the entrance tests are held.

In order to qualify for admission to the military training centres, middle-grade training will be required at least to be in possession or in a position to obtain the qualifications which are required in the general education system for access to the University Schools that teach the first cycle of the university level. At the same time, at least the degree of University Diplomacy, Technical Engineer or Technical Architect will be required for admission to the middle grade training military teachers.

3. The military officers of the category of Officer who complement the Escalas of the Intrend Corps and of the Army and the Common Corps of the Armed Forces will be able to enter the military training centers (a) by means of their participation in public calls by the competing opposition system for the same, and must meet the following conditions:

Possess the titles that for each of the Scales and Bodies are determined in Article 15 of this Regulation.

Take at least two years of effective military service.

Do not meet or have met the age of thirty-one years at the latest within the year in which the entrance tests are held.

4. The military personnel of the classes of professional troops and marineria will be able to enter the military training centers of formation of the Basic Scale that complement, participating in the public calls for the system of contest-opposition, in which they shall be reserved, at least, 60 per 100 of the places called, and shall meet the following conditions:

Have achieved the employment of Cape.

Do not comply with or have met the age of thirty-one years at the latest within the year in which the entrance tests are held.

Art. 17. Special conditions for direct entry with equivalent qualifications.

It will also be possible to enter directly into the Military Academies, in the quota of places that for each Scale the Government establishes, if the qualifications equivalent to the different degrees of the military education of formation are held, exceeding the relevant evidence to be referred to the effect by the system of competition-opposition, and not exceeding thirty-one years of age in the year in which such tests are carried out.

CHAPTER VI

Conditions for access to military employment

Art. 18. Special conditions. Category of Officer.

The military access to employment of the category of Officer will be performed by the procedures and under the following conditions:

1. Access by the opposition.-To cover the places to be fixed, selective tests will be called for the system of concurring-opposition, and the applicants must meet the following conditions:

Have fulfilled the military service in the form of service for the formation of command cadres, attached to the corresponding Body and Scale.

Possess the title to be determined in the call.

Do not comply with or have complied within the year in which the selective tests are held for the age of thirty-five years, at most.

2. Access by free opposition.-To cover the places to be determined, selective tests will be called for the free opposition system. These tests may be carried out by those who, by meeting the general conditions laid down in Article 14 of this Regulation, are of the age and hold the title to be established in each call. Those who pass the preubs must carry out the training and training periods, which will establish the calls, and which in any case will be computed as a military service time.

Art. 19. Particular conditions Category of professional clothing and Marineria.

Access to the status of military personnel of the category of troops and professional marineria will be carried out by public notice to cover the places to be established, by the system of competition between the special volunteers who request it during the third year of their service, counted from their entry into rows. and have the qualification or the specialty to be determined in the call.

CHAPTER VII

Tests

Art. 20. Instances.

1. The bodies to participate in the entry procedures shall be made on the forms and with the systems for the payment of the examination rights set out in the corresponding calls. They must be submitted within 20 calendar days from the date of publication of the respective notice in the "Official State Gazette" or "Official Defense Bulletin".

2. In order to be admitted and, where appropriate, to take part in the practice of the relevant selective testing, it is sufficient for applicants to manifest in their instances that they meet each and every required condition.

3. The calling authority, by itself or on a proposal of! President of the selection board, he must give the competent authorities the account of the inaccuracies or untruths in which the applicants could have incurred the effects.

Art. 21. List of supported and excluded.

1. The time limit for the submission of instances expired. the Deputy Secretary of Defense, or the authority in which he has delegated, shall give a decision within the maximum period of one month, declaring the list of admitted and excluded approved.

The resolution will be published in the "Official State Gazette" and will be stated:

a) List of excluded applicants.

(b) The term of the remedy which, in the terms of Article 71 of Decree 2408/1966, of 2 June, is granted to the excluded applicants.

c) The place and date of commencement of the tests and, where applicable, the order of action of the applicants.

d) "Official Gazette of the Ministry of Defense", in which the complete lists of eligible and excluded applicants are published.

2. The date of publication in the "Official Gazette of the State" of the proposed resolution shall be decisive for the time-limits for possible challenges or appeals.

3. The members of the selection bodies shall refrain from taking part in the selective procedure if they are in the circumstances of those provided for in Article 21 of Decree 1408/1966 of 2 June 1996 adapting the Law of Procedure. Administrative authorities of 17 July 1958, and shall inform the convening authority thereof. Applicants may promote the challenge of membership or members of the selection bodies, as provided for in Article 22 of the said Decree.

4. Once the selective tests have been started, the publication of the successive announcements of the remaining tests will not be obligatory in the "Official Gazette". These notices must be made public by the selection board, at the premises where the previous tests have been held with twelve hours, at least, in advance at the beginning of the next test, in the case of the continuation of the course, or twenty-four hours in advance if this is a new exercise.

Art. 22. Provisional relationships of selected aspirants.

1. Once the qualification of the applicants has been completed, the selection bodies shall make public the provisional relations of those who are selected, by order of punctuation, not being able to exceed their number of places called. The President of the Selection Board shall elevate those relations to the Deputy Secretary of Defense or authority in which he has delegated. Any proposal that contravene the above will be null and void.

2. The decisions of the selection bodies are binding on the Administration, without prejudice to the fact that it may, where appropriate, revise them in accordance with the provisions of Article 109 et seq. of Decree 1408/1966 of 2 June 1996 adapting the Law of Administrative procedure of 17 July 1958, in which case the evidence or formalities affected by the irregularity must be reapplied.

CHAPTER VIII

Appointment of selected aspirants

Art. 23. Contribution of the documentation.

The selected applicants will bring before the Director General of Education of the Ministry of Defense, before the Director General of the Civil Guard, if any, or authorities in which they have delegated, within the 20 calendar days after the publication of the relations of selected applicants referred to in the previous Article, the documents proving the conditions of capacity and requirements required in the call. Those who, within the prescribed period, and with the exception of cases of force majeure, do not submit the documents, shall not be appointed, all of their actions being cancelled, without prejudice to the liability in which they may have incurred false instance.

Who has the status of a career military officer, a military officer or a public official will be exempt from justifying the requirements already accredited to obtain such a condition, and must present only certification of the Ministry or body to whom it depends, crediting its condition and the other circumstances in its personal file.

Art. 24. Appointment of students from military training centres training.

The Assistant Secretary of Defense will appoint students from the appropriate training military training center to the selected candidates; these will follow the vicissitudes provided for in the respective call and regulations. (s).

The list of the appointed students will be published in the "Official State Gazette", at which time they will acquire the military status.

Art. 25. Appointment of military personnel.

Selected applicants who have agreed to the procedures laid down in Article 18 (1) and Article 19 of this Regulation, after signing the undertaking providing for the call, shall be appointed Military employment by the Deputy Secretary of Defense, with this appointment being initiated with this appointment.

It shall also designate those selected applicants who have agreed to free opposition, as provided for in Article 18 (2) of this Regulation, to carry out the training period provided for in the call for tenders. respective. These applicants, after overcoming this period and signing the commitment provided for in the call, shall acquire the status of a military officer of employment.

These appointments will be published in the "Official State Gazette".

TRANSIENT PROVISIONS

First. Admission of professional military personnel to the military training centers of the Armed Forces Common Corps.

The professional military personnel who, prior to the entry into force of this Royal Decree, would have submitted to a call for entry into the Common Corps of the Armed Forces and would not have exhausted the number (a) maximum of the opportunities provided for in Article 14 of this Regulation, may be eligible for such entry provided that it fulfils the conditions laid down in Articles 14 and 15, except as regards the maximum age limit laid down as express below:

Thirty-five years for the Complement Escalations and Naval Reserve Escalas, whatever their category.

Forty years for which you have a minimum of ten years of effective services.

Second. Internal promotion of the officers of the average Escalas to the superiors.

For a maximum period of three years, from the entry into force of this Royal Decree, the officers belonging to the Escalas pursuant to the provisions of the sixth and tenth additional provisions of Law 17/1989, July 19, a regulator of the Professional Military Personnel Regime, will be integrated into the middle steps of the General Corps of Army and Marine Corps. The military training centres for the training of the corresponding higher scales comply with the conditions laid down in Article 16 (1) of this Regulation, provided that they have at least two years of effective service on their new scale or on the new scale.

Third. Internal promotion of complement officers.

The complement officers who, by virtue of the provisions of paragraph 2 of the additional provision of Law 17/1989, of July 19, regulatory of the Staff Regulations of the Professional Military Personnel have agreed to the condition (a) of the employment military, may participate in the internal calls for promotion referred to in Article 16 (2) and (3) of this Regulation without complying with the age limits laid down therein.

Fourth. Admission of non-commissioned officers and classes of troops and marineria in the military teaching centers of the higher Escalas.

Fifth. Internal promotion of Sub-Officers.

Only up to the maximum number of candidates per square that the government determines in the provision of places for admission to the military training centers in the corresponding year will be admitted to the competition. Seats remaining unfilled may be cumulated to the quota set for entry by the opposition for the internal promotion provided for in Article 16.1 of this Regulation.

Those who, because of the conditions laid down in Article 16 (1) of this Regulation, are only able to opt for only one time to access to military education in the middle grade by the procedure laid down in that Article, shall be entitled to a second choice of access by contest, in the form expressed in this transitional provision.

Sixth. Access to basic grade military teaching facilities for Assistant Officers.

Ninth. Minimum effective service times for internal promotion revenue.

10th. Deadline for the publication of the calls for the year 1990.

The calls for the corresponding selective access systems for the places provided for in the year 1990 shall be published no later than three months after the entry into force of this Regulation.
