Key Benefits:
Article 18 of Law 30/1984, of 2 August, of measures for the Reform of the Civil Service, and Article 34.3 of the Law on the General Budget of the State for 1990, establish the criteria and guidelines in which the provision of public employment, conceived as an instrument for the rationalization of personnel selection processes at the service of the Public Administrations, in which the constitutional principles of equality, merit and capacity.
Similarly, the offer of public employment can be regarded as an effective mechanism for bringing into effect the internal promotion referred to in Article 22.1 of Law 30/1984 of 2 August, in accordance with the wording given by Law 23/1988 of 28 July.
In this sense it should be noted that in the total number of vacancies that are expressed in Annex I of this Royal Decree, they include the corresponding to internal promotion. The number of places deemed appropriate to be provided by such a system may be reserved in the respective calls.
In the same way, and with regard to the employment staff at the service of the Public Administrations, Article 19 of Law 30/1984, of 2 August, establishes systems of selection for such personnel, developed in Title III of Royal Decree 2223/1984 of 19 December 1984.
Furthermore, a procedure is continuing to incorporate people with disabilities into the Public Administration by setting up places for such persons in different selective tests for access to the Public Administration. Officials ' scales as well as job staff positions.
As in previous offers of public employment, the corresponding selective tests will not establish discrimination on the basis of sex, in accordance with the provisions of Article 14 of the Spanish Constitution, and in the Directive Community of 9 February 1976 on the application of the principle of equal treatment between men and women and with regard to access to employment, training and professional promotion and working conditions.
The number of vacancies listed in Annex I may be added, the number of seats resulting from compliance with the provisions of the transitional provision 15 of Law 23/1988 of 28 July.
Finally, the necessary dedication to the selective tasks and the strictly professional character of the selection bodies, they advise to exclude from the same those who hold positions of Director General or assimilated, as well as to the Members of the Gariums of the Ministers or Secretaries of State.
In its virtue, on the proposal of the Minister for Public Administrations, with the favorable report of the Higher Commission of Personnel and after deliberation of the Council of Ministers at its meeting of July 27, 1990,
DISPONGO:
Article 1. º Approval of public employment.
In compliance with the provisions of Article 18 of Law 30/1984, of 2 August, of Measures for the Reform of the Civil Service, and in Article 34.3 of the Law on the General Budget of the State for 1990, the offer of public employment for 1990 in the terms set out in this Royal Decree.
Art. 2. º Quantification of the O. E. P.
The offer of public employment includes vacancies provided in the General Budget of the State for 1990, in the following detail:
Annex I. Body and Scales of Officials included in the scope of Law 30/1984 of 2 August.
Annex II. Places of work staff included in the scope of Law 30/1984 of 2 August.
Art. 3. Internal Promotion.
In each call, the number deemed appropriate for the vacancies convened to be provided by the internal promotion system may be reserved. Such places shall be covered, where appropriate, in accordance with the provisions of the General Rules of Procedure for the Provision of Jobs and the Professional Promotion of Officials of the State Administration, approved by Royal Decree 28/1990, of 15 January 1990, January ("Official State Gazette" of 16).
Art. 4. No. Fixed employment staff in official positions.
The places listed in Annex I may be increased with those resulting from the precept in the transitional provision 15th of Law 30/1984, of 2 August, added by Law 23/1988, of 28 July.
Where required by this provision, selective testing may be called for entry into Bodies or Scales not included in Annex I.
The Government, on a proposal from the Minister for Public Administrations, by means of agreement, will determine the specific characteristics of the selective calls for tests to be held in compliance with this provision. transient 15.
Art. 5. Admission of people with disabilities.
In selective testing for entry into the Corps or Escalations of officials and categories of labour personnel, including those for internal promotion, persons with disabilities on equal terms will be admitted. conditions with other applicants.
Calls shall not establish exclusions for psychic and/or physical limitations without prejudice to incompatibilities with the performance of the relevant tasks or functions.
In selective testing, including training courses or traineeships, the possible adaptations of time and means for their realization will be established for people with disabilities who request it. This possibility should be expressly stated in the calls, as well as the need for the interested parties to make the specific request for the request for participation.
To this effect, the Courts or Commissions of Selection may require a report and, where appropriate, collaboration of the technical bodies of the Administration of Labour, Health or the competent bodies of the Ministry of Social.
Art. 6. Places for people with disabilities.
Of the total number of places offered will be reserved a 3 per 100 of the set of seats to be covered by those with the legal status of people with disabilities.
The distribution by Corps, Escalas or categories of work personnel will be carried out in the respective calls for selective tests heard by the Ministry of Social Affairs.
The option for reserved places shall be made in the request for participation in the calls, with the express declaration of the persons concerned to meet the condition required in this respect, which shall be credited, if the place is obtained, by certification of the competent bodies of the Ministry of Social Affairs and in their case of the Autonomous Community concerned.
The selective tests shall be carried out on an equal basis with applicants for free access, without prejudice to the adaptations provided for in Article 5. of this Royal Decree.
If in the performance of the same questions the Tribunal will be raised with respect to the ability of the applicant for the performance of the activities usually developed by the officials of the Body or Scale to which it is chosen, or Category of work staff, may obtain the relevant opinion of the competent body as provided for in the third paragraph of this Article.
In the initial allocation of the job the competent authority or the Commission of Valuation may require, in respect of the persons entered by this reserve quota, an opinion of the aforementioned organ on the compatibility of the candidate to the post or the adaptations of the post.
Art. 7. Selection of work staff.
The selective tests corresponding to the places of work staff listed in Annex II to this Royal Decree, must relate to posts which, in accordance with the provisions of Article 15 of Law No 30/1984 of 2 August 1984, the version given by Law 23/1988, of July 28, can be performed by labor personnel.
Art. 8. The procedure for the selection of work staff.
When by application of collective agreements or specific regulations they must be covered by internal promotion systems some of the places announced for work staff, it will be realized before or simultaneously that the general system of free access. Seats that are vacant will then be offered on free access systems.
Unless the needs of the service so require, the places of work staff referred to in Annex II shall, necessarily, be convened within the period of validity of this Royal Decree.
Prior to the authorization by the Ministry for Public Administrations of the call for selective tests for entry into one of the places of work personnel listed in Annex II of this Royal Decree, the Proposing bodies shall present accreditation of the Ministry of Economy and Finance in respect of the existence of budgetary allocation.
Art. 9. Interim Staff.
Interim staff shall not be appointed, except for replacements, in places that have not been announced in the public employment offer.
Acting staff of the State Administration, its autonomous bodies and the Social Security Administration shall automatically cease, as appropriate, upon the incorporation of the replacement or the officials of the to take possession as career officials of the candidates approved in the respective calls for selective testing and shall proceed on their own initiative to the cancellation of their registration in the Central Register of Personnel.
In addition, the Education Administration may appoint interim personnel to meet new needs, duly justified and provided that it accredits the insufficiency of career officials to address the same.
Art. 10. Requirements for participation.
In no case will the prior registration in the Employment Offices be necessary to participate in the selective processes derived from the present offer of public employment.
The application models to participate in the entrance procedures and the credit systems of the examination rights will be those approved by the Secretariat of State for Public Administration.
Art. 11. Unit selection tests.
Unit selection tests will be called for the Bodies and Escalations that are related grouped in the following sections:
1. Auxiliary General Body of the State Administration. Auxiliary Body of the Social Security Administration.
2. Administrative General Body of the State Administration. Administrative Body of the Social Security Administration.
3. Body of Industrial Engineers. Body of Mines Engineers.
Art. 12. Geographical distribution of Auxiliary Corps squares.
In the unit selective tests for admission to the General Auxiliary Corps of the State Administration and Auxiliary of the Administration of Social Security, the places to be offered may be distributed territorially. according to the geographical areas to be determined in the call. In this case, these places will be linked to the respective geographical areas throughout the selection and provision process. The selection body shall act and shall evaluate the evidence and publish the approved relationships independently for each geographical area.
Art. 13. Integration into the Civil Service Management Corps of the State.
Of the places listed in Annex I of this Royal Decree for access to the Management Body of the Civil Administration of the State, 64 places are reserved for the integration in said Body of those who, having the qualification required at the entry into force of Law 30/1984, of 2 August, were career officials in the Corps and Escalations that are then determined:
Administrative General Body of the State Administration.
Body of Interpreters-Informators.
CEDEX Taquigraph Translators scale.
Administrative Scale of Autonomous Bodies.
AISS Administrative Scale, to be extinguished.
Administrative Scale from Deleted Autonomous Bodies, to be extinguished.
Administrative Body, to be extinguished (Royal Decree-Law 23/1977).
Administrative Scale of National Heritage, to be extinguished.
SENPA CAT Technical Scale.
Technical-Administrative Scale of the National Editor.
Administrative Scale of the National Inspection and Advisory Service of Local Corporations.
Non-scaled squares, with tasks assimilated to the General Administrative Body of the State Administration and the same group of qualifications, as long as the integration established in Royal Decree 1126/1986 has not been carried out, of 6 June, for which the provisions of the first provision of Law 30/1984, of 2 August, are complied with.
Art. 14. Participation in selective testing courts.
They may not be part of the Selection Commissions or the Courts of selective testing for admission to the Corps or Escalations of the State Administration or of categories of labor personnel, who have the consideration of High Charge in accordance with the provisions of Law 25/1983 on incompatibilities.
ADDITIONAL PROVISIONS
First. Staff of Autonomous Communities.
With the independence of the places detailed in the offer of public employment approved by this Royal Decree, the State Administration, on the proposal of the Autonomous Communities, may select personnel to cover those Communities, including them in the corresponding calls for entry.
Second. University Administration and Services staff.
The State Administration, at the request of the Universities, may select administration personnel and services to fill seats in the same.
Third. Local Administration Staff.
In order to address the needs of the Local Administration, the Ministry for Public Administrations may call for selective testing for access to the Local Administration Officers ' Scale with National rating on the basis of existing vacancies on the various Subscales.
Fourth. Postal Services personnel.
In order to meet the needs of the staff of the Postal Services, the Government, on the proposal of the Minister for Public Administrations and after report of the Ministry of Economy and Finance will authorize by Agreement and in the framework of the public employment offer, the call for selective testing for entry into the Bodies and categories of labour personnel to be carried out in order to provide adequate human resources to the legal framework of such services.
FINAL PROVISIONS
First.
The rules on the coordination and preparation of public employment offers contained in Royal Decree 352/1986 of 10 February 1986 shall be understood as valid.
Second.
No appointments of career officers may be made or contracts of employment personnel are to be formalised for places that lack budgetary allocation or do not appear in the relations of jobs.
Third.
This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".
