The need to adapt legislation specifically in the field of control and certification of seeds to the directives of the Council of community economic European 87/480/EEC, 88/380/EEC and 89/2/EEC, that modify the directives 66/400/EEC, 66/401/EEC, 66/402/EEC, 66/403/EEC, 69/208/EEC and 70/458/EEC on the marketing of beet seed , cereals, forage plants, potato seeds, oleaginous and fibrous plants and horticultural plants, respectively, as well as the convenience of introducing some modifications to adapt the legislation to the current circumstances, requires an amendment to the current regulations. For all of the above, I have: first.

Amending chapter V: sealed seeds and plants nursery, the General regulations technical Control and certification of seeds and nursery plants, approved by order of 23 May 1986, and amended by order of 26 November 1986, in the following terms: 1. paragraph 20 of the mentioned chapter V will be replaced in its entirety by the following : '20. The contents of containers or packages constituting a batch will be indicated by a label issued by the Institute or by an indelible impression on the package that contains the data that should appear on the label, except as provided for small containers or seed of standard categories.

The colour of the official label shall be white with a diagonal violet stripe for pre-basic seed; White for the seeds or plants nursery base; Blue for certified and certified first reproduction; Red for the certified of successive, and pardo reproductions for commercial ones.

Official, in the case of basic seed and certified, labels shall contain, as a minimum, the following data: header with the name or initials of the Institute (INSPV) and the country (Spain).

The inscription: "Rules and standards EEC".

Reference number of the lot and the tag number.

Species, indicated at least in Roman characters.

Variety stated, at least in Latin characters.

Category.

Country of production.

Month and year of sealing (sealing date) or month and year of the last official taking of samples.

Declared weight (gross, net or number of seeds).

Where solid additives (pelleted, etc.) being used must indicate the nature of the additive and proportion approximate the weight of actual seeds and the total weight.

In the case of hybrid varieties or inbred lines: for those seeds of category basis or generations earlier, belonging to hybrids or inbred lines, entered in the register of commercial varieties, shall indicate the denomination with which appear inscribed, with or without reference to the final variety, accompanied by the word "component" when it is exclusively intended to act as such in the production of the above-mentioned final variety.

For gold cases of base or previous generation seeds shall indicate the name of the component to which belongs the seed, which may be cited in code form, accompanied by a reference to the final variety, with or without indication of its function (male or female), and accompanied by the word "component".

For certified seed, the name of the variety to which they belong shall be accompanied by the word "hybrid".

Pre-basic seed labels shall contain, in addition to the listed above, the following data: number of generations to certified seed.

For all cases, on the back of the official label shall contain the following text: "This batch,... a sample has taken it in store during the operations of sealing, which remains properly preserved for a longer term than twelve months the validity of sealing", and must appear in blank the reference of the administration or acting control services.

In seeds of pre-basic and base labels will appear on the back, then of the previous text, the following: "the agricultor-colaborador keep this tag available to the inspector staff of official control services".

Certified seed of the first generation labels shall show in the back, then the text cited in the first place, the following: "If the seed contained in this package is intended to new playback, the agricultor-colaborador will retain this tag available to the inspector staff of official control services".

For commercial seed, data from the official label shall be indicated for the category base and certified, with the exception of the mention of the variety, including the text "not certified as to variety".

Also, the data must be replaced "country of production" by "production area".

The size of the official label, in all cases, will be at a minimum of 110 by 67 mm.»

2. at the end of paragraph 22 of the above-mentioned chapter V, the following paragraph shall be added: "in the case of the category prebase, base and certified, labels or instructions of the producer and, where appropriate, the importer, will be drafted in such a way that they can not be confused with the official labels.»

3 following paragraph 26, the following paragraph is added: '26a. In those cases that specified in the corresponding technical regulations of Control and certification of seeds, they will officially certify as certified seed, upon request, seeds collected in any Member State of the European economic community, that have been subject of a field inspection and official examination to verify that the requirements established for the seed of the corresponding category meet. Previously mentioned seeds, and that can be the subject of certification, they must come directly from basic seed, certified seed or certified first play seed officially certified in one or more Member States of the European Economic Community or in a third country which has been granted equivalence, or directly from the crossing of basic seed officially certified in a Member State with basic seed officially certified in such third countries.

«When in such cases the seeds have produced directly from officially certified seed of generations prior to basic seed, may authorise it official certification as basic seed, if the requirements laid down for this category.»

4. be added following the paragraph 26a, the paragraph 26b, with the following text: «26b. Seeds that referred to in the preceding paragraph, collected in Spain and aimed at the final certification in another Member State shall be: to) packaged, sealed and marked with an official label satisfying the following requirements: be grey.

Contain the following information: headword: INSPV-Spain.

Name or initials of the authority that carried out the inspection on the ground.

Species, indicated at least in Roman characters.

Variety stated, at least in Roman characters; in the case of varieties (inbred lines, hybrids foundational) intended only for components of hybrid varieties, the word "component" shall be added.

In the case of hybrid varieties, the word "hybrid".

Category.

Field or lot reference number.

Declared net or gross weight.

Inscription: seed not finally certified.

b) be accompanied by an official document containing the following definition: authority issuing the document.

Category.

Reference number of the seed used and name the country or countries that had certified that seed.

Field or lot reference number.

Area cultivated for the production of seed which includes the lot covered by this document.

Amount of seed collection and number of packages: in the case of seeds of pre-basic, number of generations to basic seed.

In the case of certified seed, number of reproductions that have been following the basic seed.

Attestation that crops come from seeds that have fulfilled the requirements.

Where appropriate, results of a preliminary seed analysis.'

5 the following paragraph is added following the paragraph 26b: «26 c. In cases where specified in the corresponding technical regulations of control and certification of seeds shall certify officially certified seed, upon request, seeds collected in a third country, if they have been subject to an inspection in field, complying with the conditions laid down in Community decisions of equivalence with third countries, and if official examination proves that the conditions laid down for the seeds of the corresponding category met. «Seeds mentioned above and which can be object of certification must come directly from basic seed, certified or certified first play, officially certified in one or more Member States of the European Economic Community or in a third country to which have been granted is equivalence, or directly from the crossing of basic seed officially certified in a Member State with basic officially certified in the abovementioned third countries seed.»

Second.

Amending the regulation technical Control and certification of seeds of cereals, approved by order of 1 July 1986 and amended by orders of 26 January 1988, on July 5, 1988 and October 6, 1988, in the following terms:


1 the chapter II, categories of seeds, is replaced by the following: "chapter II categories of seeds 1. For non-hybrid varieties of oats, red oat, oat estrigosa, barley, rice, triticale. common wheat, durum wheat, poulard wheat and spelt smaller, are supported the following categories of seeds: parent Material.

Pre-basic seed.

Basic seed.

Certified seed of the first generation (R 1).

Certified seed of the second generation (R-2).

2. for varieties of millet, except their hybrids; Rye and hybrid varieties of oats, barley, rice, wheat, durum wheat and spelt smaller, are supported the following categories of seeds: parent Material.

Basic seed.

Certified seed.

3. it is understood by.

3.1. parent material: the initial unit used in the conservation of the variety and constitutes the generation G-0.

(3.4 seed of hybrid varieties of oats, barley, rye, rice base, soft wheat, durum wheat and spelt smaller, are the seeds: to) from the Division of the parent material, through a controlled process, and which are intended to produce hybrids.

(b) they meet the relevant requirements of annexes 1 and 2 of the present technical regulations for this category, proving so far by the mandatory official control.

3.5 certified seed, Canary seed, excluding hybrids thereof; (rye and varieties hybrids of oats, barley, rice, wheat, durum wheat and spelt smaller, are the seeds: to) that come directly from seed base or, at the request of the breeder, from seed of a generation prior to basic seed, always that the requirements which are set out in annexes 1 and 2 of the present technical regulations for this category.

(b) your destination other than the production of seed.

(c) that they meet the relevant requirements of annexes 1 and 2 of the present technical regulations for this category, proving so far by the mandatory official control.

(3.6 certified seed, first generation (R-1) of non-hybrid varieties of oats, red oat, estrigosa, barley oats, rice, triticale, wheat, durum wheat, poulard wheat and spelt smaller, are the seeds: to) that come directly from seed base or, at the request of the breeder, from seed of a generation prior to basic seed, always that the requirements which are set out in annexes 1 and 2 of the present technical regulations for this category.

(b) that your destination can be the production of certified seed, second generation (R-2) or other than the production of seed.

(c) they meet the relevant requirements of annexes 1 and 2 of the present technical regulations for this category, proving so far by the mandatory official control.

(3.7 certified seed, second generation (R-2) of varieties non hybrid of oats, red oat, estrigosa, barley oats, rice, triticale, wheat, durum wheat, poulard wheat and spelt lower, seeds: to) that come directly from basic seed, of certified seed of prevail playback (R-1) or, at the request of the breeder, from seed of a generation prior to basic seed , provided that it meets the requirements of the basic seed.

Amending the regulation technical Control and certification of seeds of sorghum, approved by order of 1 July 1986, and amended by order of 6 October 1988, in the following terms: 1. at the end of chapter IV. Seed production, the following paragraph shall be added: «f) for seeds of species of the genus 'sorghum spp.', shall apply the provisions of sections 26a, 26b, 26 c of the General technical regulations for Control and certification of seeds and nursery plants, seeds not definitively, and only in the cases that come from the multiplication of seeds of the category certified concerning prebase or base.»

Fifth.

Modifies the technical regulation of Control and certification of seeds give oil plants, approved by order of 1 July 1986, and amended by order of 13 October 1987, in the following terms: 1. Chapter V, sealing of seeds, is added to a nine paragraph, in the following terms: «d) to listed species. " This Regulation shall apply as provided in sections 26a, 26b and 26 c of the General technical rules of Control and certification of seeds and nursery plants, relating to seed not finally, certified and only in cases in which derived from the multiplication of seeds of the following. categories: soybean, peanut and linseed: Prebase, base and certified first play.

Amending the technical regulation of Control and certification of seeds of textile plants, approved by order of 1 July 1986, in the following terms: 1. in section VI, sealing of seeds, the following paragraph is added: «d) for the species included in this Regulation shall apply the provisions of sections 26a, 26b and 26 c of the General technical regulations for Control and certification of seeds and nursery plants» «, relating to non-certified seed definitely, and only in the cases that come from the multiplication of categories prebase, base or certified first play.»

Seventh.

Amending the technical regulation of Control and certification of seeds and fodder plants, approved by order of 1 July 1986, amended by orders of 13 October 1987 and October 6, 1988, in the following terms: 1. in the chapter II, categories of seed: 1.1 section II.1, shall be replaced by the following : «II.1 are supported categories of seeds: parent Material.»

Seed of proved.

Basic seed.

Certified seed.

Commercial seed."


1.2 paragraph II.4, is replaced by the following.

«II.4 with exception of the ecotypes of alfalfa in what can support up to a second generation of certified seed (R-2), will only accept a single reproduction of the aforementioned category. Exceptionally, by the Ministry of agriculture, fisheries and food may be authorized the production of a second generation of certified seed.'

2. in chapter V, sealing of seeds, will be added a new paragraph with the following text: «V.5 for species included in these regulations shall be applicable as provided in sections 26a 26b and 26 c of the General technical rules of Control and certification of seeds and nursery plants, relating to seed not certified definitely, and only in the cases that come from categories pre-basic seed multiplication «, base or certified.»

3. in Chapter VIII, marketing; section VIII.2, repackaging of seeds, is sustituiré the first paragraph by the following: «Will not accept the repackaging of seeds of carob, fenugreek, vetch, Lupine, sainfoin, peas, beans, vetch, yeros and zulla unless we proceed to a new official seal.»

4. in annex III, labels; paragraph A), indication of official labels, shall be added the following: «(En el apartado a), the word prebase, before the base, and in the indents to fifth and sixth, after each of the words kind and variety: indicated at least in Roman characters. '

(B)), in the sixth indent, after the word species (1): indicated at least in Roman characters.

"

The seeds of other species referred to in this Regulation may be marketed if "Basic seed", belong to the category "Pre-basic seed", "Certified seed" "Standard seed", provided that they meet the requirements laid down in annexes I and IL.»

3. in chapter IV, varietals denominations, is replaced entirely the current text by the following: «Chapter IV designations varietal varietal designations of the seeds of horticultural plants which are marketed will be exactly that are registered in the register of commercial varieties, or in the common catalogue of varieties of horticultural plants of the EEC.» If there is no list of commercial varieties, for a particular species, or may not be included in the common catalogue of varieties of horticultural plants of the EEC, the variety denomination must meet the standards in respect of the General Regulation of the registration of varieties.

For varieties which are notoriously known prior to the March 1, 1986, you can mention in labels or inscriptions on the containers, in addition to the information prescribed in paragraph X.2, the name of a certain conservative selection of the variety, provided that it has been previously declared to the National Institute of seeds and nursery plants, and does not refer to special properties associated with such conservative selection. This mention will follow the varietal name, which will be clearly separated, preferably by a hyphen, and should not highlight more than the variety denomination.

As of a certain date, I know fixed before July 1, 1992, following the procedure laid down in the rules of the EEC, only those conservative selections declared prior to the date that is set can mention on the label.»

4. in chapter V, seed production, the following paragraph is added: «V.5. For the species included in this Regulation shall apply as provided in sections 26a, 26b and 26 c of the General technical rules of Control and certification of seeds and nursery plants, relating to seed not finally, certified and only in cases in which derived from the multiplication of categories pre-basic or base.»

5. in chapter X, marketing, the item X.2, the producer labels, is replaced. by «X.2. Tags', modifying the existing text with the inclusion of a paragraph, which reads as follows: «the seed of the categories prebase, base and certified to carry an official label which shall comply with the requirements of chapter V, article 20, of the General technical regulations for Control and certification of seeds and nursery plants, and indicate the name of the species and the variety» «at least, in Latin characters.»

Is deleted the last paragraph of the item X.2, and added the following: "in the case of basic seed and certified, labels or inscriptions of the producer and, where appropriate, the importer is drafted in such a way that they can not be confused with the official label referred to above.»

«In the case of seed of standard category, except in the case of small packages, information for label or inscription on the packaging, laid down in the annex VII, shall be clearly separated from any other information appearing on the label or on the packaging.»

6 in annex I, section d), the denominations «Chicory coffee» are replaced by «Industrial chicory»; and point 1 shall be replaced by: «1. in connection with the plots of other species of the same genus or other subspecies: 1.000 m.»

In point 2 shall be replaced, also coffee chicory industrial chicory by denominations.


7. in annex II, the seed requirements, are replaced the words 'Chicory coffee» by the «industrial chicory', and the corresponding figures of specific purity: 95, germination, 65, and maximum content of seeds of other species: 1.5, shall be replaced by the: 97, 70 and 1, respectively. The words Endive or chicory of Brussels are replaced pon Endive, wild chicory (Italian chicory).

8. in annex V, minimum weights the samples and storage times, replaced the words chicory coffee by the industrial chicory, and minimum sample (in grams), corresponding weight, 15, is replaced by the 50. Likewise, the words Endive or chicory of Brussels shall be replaced by the Endive, wild chicory (Italian chicory).

DISPOSAL this order shall enter into force the day following its publication in the "Official Gazette".
