Law 10/1983 of 16 August of the Organization of State Administration determines the higher bodies of the Central Administration of the State, and provides, in Article 12, that the creation, modification, recasting or the abolition of these organs and the administrative units with an organic level equivalent or superior to Subdirección General will be carried out, by Royal Decree, at the initiative of the interested department and on the proposal of the minister for the Public Administrations.

Royal Decree 298/1991 of 12 March has created the new Ministry of Industry, Commerce and Tourism, determining in Article 3 the functions assigned to it.

In order to comply with the above precepts, it is now appropriate to adapt the general lines of the basic structures of the Ministry of Industry, Commerce and Tourism, determining the dependence of the higher and higher organs. of the Management Centres with the necessary modifications to ensure a better exercise of their competences, without prejudice to a wider subsequent development in line with the principles of modernization of the Administration designed by the Ministry for Public Administrations.

In its virtue, at the initiative of the Minister of Industry, Commerce and Tourism and at the proposal of the Minister for Public Administrations, after deliberation by the Council of Ministers at its meeting of 5 April 1991,

DISPONGO:

Article 1. °

The Ministry of Industry, Commerce and Tourism is composed of the following higher bodies:

The Secretary of State for Industry.

The Secretary of State for Trade.

The Assistant Secretary for Industry, Commerce and Tourism.

The General Secretariat of Energy and Mineral Resources, with the rank of Undersecretary.

The General Secretariat of Tourism, with the rank of Undersecretary.

The General Secretariat for Industrial Promotion and Technology, with the rank of Undersecretary.

The General Secretariat of Commerce, with the rank of Undersecretary.

Art. 2. °

One. The Minister for Industry, Commerce and Tourism will directly rely on the following higher bodies:

The Secretary of State for Industry.

The Secretary of State for Trade.

The Assistant Secretary for Industry, Commerce and Tourism.

The General Secretariat of Energy and Mineral Resources.

The General Secretariat of Tourism.

Two. Also, directly dependent on the Minister of Industry, Commerce and Tourism there is a Cabinet as an organ of support and immediate assistance, whose holder has the organic level of Director General, with the structure and staff regime that prevents Royal Decree 3775/1982 of 22 December.

Art. 3. °

One. The higher body and the following management centres will be directly dependent on the Secretariat of State for Industry:

The General Secretariat for Industrial Promotion and Technology.

The Industry Directorate-General.

Two. The General Secretariat for Industrial Promotion and Technology will depend on the following Management Centres:

The General Directorate of Electronics and New Technologies.

The General Direction of Technology Policy.

Three. The Secretary of State also directly depends on a Cabinet with the structure and personnel regime established by Royal Decree 3775/1982 of 22 December.

Art. 4. °

One. The Secretariat of State for Trade directly depends on the higher General Secretariat of Commerce.

Two. From the General Secretariat of Commerce they depend, in turn:

The General Direction of Commercial Policy.

The Directorate General of Foreign Trade.

The Directorate General for External Investment.

The Directorate General of Internal Trade.

Three. The Secretary of State is also directly dependent on a Cabinet, with the structure and staff arrangements established by Royal Decree 3775/1982 of 22 December 1982.

Four. The Directorate-General for External Investment shall carry out the tasks which the Directorate-General for External Transactions has up to now, except those referred to in the Legal Regime for the Control of Changes.

Five. The units below Directorate-General, which are currently directly dependent on the Secretary of State for Trade and the Secretary-General for Trade, will retain their respective structures and dependence.

Art. 5. °

One. The following management centres depend on the General Secretariat for Energy and Mineral Resources:

The General Directorate of Mines and Construction.

The Energy Directorate General.

Two. It is also up to the Secretary General of Energy and Mineral Resources to delegate the Government to the Operation of the Electrical System.

Three. The units below Directorate-General, directly dependent on the Secretary-General of Energy and Mineral Resources, will retain their structure and dependence.

Art. 6. °

The General Secretariat of Tourism will retain the organic structure established in Royal Decree 124/1988, of February 12, until the creation of the Institute of Tourism of Spain (TURESPANA) and to dictate the rules referred to in Article 81, one, 9, of Law 4/1990, of 29 June.

Art. 7. °

The Secretariat for Industry and Energy changes its name to the Secretariat of Industry, Commerce and Tourism, maintaining its current organic structure.

Art. 8. °

1. In accordance with the final provision of Royal Decree 1558/1977 of 4 July 1977, the Secretaries of State shall exercise in respect of the units assigned to them the privileges provided for in numbers 1, 4, 5, 6, 7, 10 and 11. Article 14 of the Law of Legal Regime of the State Administration, without prejudice to the superior direction of the Minister of Industry, Commerce and Tourism.

2. In addition, the Secretaries of State may perform as many duties as the Department holder expressly delegates to them.

Art. 9. °

The Secretary of State for Trade, the Secretaries-General, the Secretariat and the Directorates-General of the Department shall retain the powers conferred upon them by the rules in force, except as provided for in the Additional provisions first, third and fourth of this Royal Decree.

ADDITIONAL PROVISIONS

First.

Will continue to be the responsibility of the Ministry of Economy and Finance for the functions related to the defense of competition, the legal regime for control of changes and prices.

The General Directorate of Foreign Transactions is integrated into the Ministry of Economy and Finance's Ministry of State for Economic Affairs, and will continue to exercise its powers in the field of the legal regime for the control of changes.

Second.

are attached to the Ministry of Industry, Commerce and Tourism, through the higher bodies and corresponding management centres, the Autonomous Bodies and Public Entities attached to the former Ministry of Industry and Energy, to the Secretariat of State of Commerce and to the General Secretariat of Tourism, except as provided in the following additional provision regarding the Industrial Property Registry and the Design and Fashion Promotion Center.

Third.

One. The assignment to the Department of the Autonomous Body Registry of Industrial Property will be carried out through the General Secretariat of Industrial Promotion and Technology.

Two. The management functions of the Design and Fashion Promotion Center are attributed to the Secretary General of Industrial Promotion and Technology, in his capacity as President of the Institute of Small and Medium-sized Industrial Enterprise.

Fourth.

It is for the Secretary-General of Tourism the Presidency of the Autonomous Agency of Tourism of Spain (TURESPANA) referred to in article 81 of Law 4/1990, of June 29.

TRANSIENT DISPOSITION

The administrative units and jobs not referred to in this Royal Decree and framed in the higher bodies mentioned therein will continue to remain and the staff who will occupy them will be paid by the The same applies to those who have been charged until the additional rules for the development of this Royal Decree are adopted and the corresponding employment relationships are adapted.

FINAL PROVISIONS

First.

The Ministry of Economy and Finance will make the budgetary modifications and credits necessary for the fulfillment of the provisions of this Royal Decree.

Second.

All provisions of equal or lower rank are repealed as set forth in this Royal Decree.

Third.

This Royal Decree will enter into force on the day of its publication in the "Official Gazette of the State".
