Royal Decree 298/1991 of March 12, restructuring of ministerial departments, has created the Ministry of Public Works and Transport, for the integration of the two previous Departments of Public Works and Urbanism and Transport, Tourism and Communications, with the exception of the General Secretariat of Tourism and the Autonomous Body of Savings.

The Ministry of Public Works and Transport encompasses a large and complex set of activities aimed at:

1. The adoption of strategic decisions of great importance for the competitiveness of the economic space, the quality of life and the integration of the Spanish physical space into the European.

2. The definition of important public policies in matters such as housing and the environment.

3. The management and regulation of public transport and communications services.

4. The programming and implementation of a major investment effort in infrastructure with the corresponding consequences for the planning of the territory.

The definition and implementation of most of these policies requires an intensive process of coordination and consultation with the Territorial Administrations and the European Communities, given the powers of both bodies. exercise in these matters.

This process of coordination and coordination between the various administrations, as well as the integration into the same ministerial authority of the competences of the previous Ministries of Public Works and Urbanism and of Transport, Tourism and Communications should make it possible to make a more effective approach to the problems affecting territorial development, with particular emphasis on the problems of large urban concentrations, the intermodal planning of the transport system, water policy and the optimization of investments in the infrastructure that integrates the consideration of its environmental impact.

To this end, the organic structure of the new Department should be approximated, in order to ensure the balanced and effective achievement of these objectives, to a modular design that facilitates the development of the functions which it has entrusted within a coherent pool of the available means. It is clear that such an approach should also make possible the incorporation into the management of the new Department of the principles and ideas of modernization of the Public Administration that, in relation to the requirements and demands of the Civil society and the challenge of European integration, preside over the government's orientation and concern.

The organization of the new Ministry is designed from the grouping in functional areas of the set of competencies and activities that the current organs of the integrated ministries play.

These functional areas are as follows:

transport: Composed by the set of activities necessary for the regulation of the transports in tranto which field of economic activity, the management of a set of public services and the programming and execution of physical infrastructure.

Communications: Composed by the set of activities necessary for the regulation of the telecommunications sector, the administration of the radio-electric space, the management of public communications services and control functional of its contractual, public and private operators.

The management and protection of the physical framework in which urban settlements and economic activity are developed, through water policies, in their broad sense of productive and environmental resources, housing and analysis and description of the climate and territory.

To provide the Ministry with an appropriate management system, four operational areas and two areas of planning and organizational support are set up.

The functional area of Communications is in itself an operational area coordinated by the General Secretariat of Communications, in which the future Commercial and Autonomous Agency of the Post and the functional control of Telefónica, as a contractual operator of a public service.

The functional area of the Transports is structured in two areas-operational, incardinated in two General Secretariats, the of the Transports Services and the Infrastructures of the Land Transport, directly dependent both of the Minister.

The General Secretariat of Transport Services is responsible for the regulation of the sectors of activity of air, sea and land transport, and the coordination of public bodies managing infrastructure fixed, ports and airports, with public operators providing transport services, RENFE, FEVE, ENATCAR, and which are directly dependent on the Ministry of Public Works and Transport.

The General Secretariat of Land Transport Infrastructure will be responsible for coordinating the implementation of the ambitious programme of investments in road and rail infrastructure in progress, as well as the First level programming and the technical projects of investments in such infrastructure.

For their part, investments in port and airport infrastructure will be implemented within the joint plans of the Ministry, by the respective organizations that autonomously manage these modes of transport,

The activities that affect the management and description of the physical framework are grouped into three areas of activity: Those that affect the physical description of the territory; the actions in terms of architecture and financial support to the access to housing and those that affect the policy of water and the environment.

The bodies that currently perform functions related to the first two, are assigned to the Department's Secretariat, both for their generic interest for different areas of the Ministry and for their strict character. financial, in the case of housing, within the current jurisdiction of the Public Administrations.

Water and environmental policies do not exhaust each other, since water problems in Spain are not only of an environmental nature and the environmental problems are not only those of the quality of the environment. water, but it is appropriate to approximate their problems by placing them in the same higher organ, given the relevance of their relations in the current moment of the development of our country. Given the importance of these issues and the coordination tasks to be carried out by the Territorial Administrations and the European Communities, this body is set up as a Secretariat of State.

Finally, it is necessary to establish a planning area to provide the necessary unity to the actions of the different operational areas of the Ministry with territorial impact. This planning area will be responsible for evaluating and programming investments in new infrastructure from the perspective of their intermodal coordination, their public or private profitability, their impact on spatial planning, their coherence with the Community's strategies, its impact on urban development and its coordination with the important competences and responsibilities of the Autonomous Communities and Local Corporations.

To do this, it is created in the organic structure of the Ministry, a General Secretariat of Planning and Territorial Concertation, directly dependent on the Minister, whose performance is projected on two major thematic areas. Transport problems in large cities and strategic decisions about major inter-regional infrastructures.

The General Secretariat shall carry out the following tasks, in close contact and collaboration with the relevant operational areas:

Schedule plans for the development of transport infrastructure in large conurbations and to arrange for the affected autonomous and municipal authorities.

Evaluate the execution of the current performance conventions of this subject and prepare the next generation of them.

Coordinate transport policies with territorial spatial planning policies and population and activity settlements

Develop the Investment Plan in the major structural axes of land transport and new port and airport facilities

Analyse and assess the profitability and territorial impact of major policy decisions on hydraulic policy and its induced effects on other infrastructure needs.

The organizational support area is the Secretariat of the Department that must be unique and to which the joint of the Ministry's common services is attached, in addition to the above mentioned.

The complexity of the organizational structures affected advise, however, to deal with the restructuring that is intended with a gradualist methodology that avoids abrupt alterations or interruptions and compagine the adaptation progressive of the arganizative structure with the necessary operativity of the new Department.

In this line it is considered necessary that, during a transitional period, two Directivos will be set up depending on both the Secretariat, one that will assume the full functions of the Technical Secretariat of the Department, and another that, temporarily developing some technical functions in relation to the Direct Centers from the Ministry of Transport, Tourism and Communications, will evolve towards the configuration of a Center of Studies matters relating to transport and communications.

Similarly, the two Directorates-General of Services, depending on both of the Secretariat, must subsist at the moment in order not to interrupt the operational management of the services and the always delicate personnel management, although In the future a Directorate General will deal with the management of material and financial means, while the other will become a Directorate General of Human Resources. A process of deconcentration of the management of the material, personal and financial means between the different areas of the MOPT will also be carried out to advance in the experimental application of the modular organization of the Public Administration, essential guideline of the Ministry's proposals for Public Administrations in this field.

Finally, the two Budget Offices, as long-term managers of the budget-of the current year and the preparation of the next budget-must subsist as such managing each of the budgetary programmes. In order to ensure proper coordination, both Offices are integrated in the Directorate-General for Economic Programming and Budget, which is dependent on the Secretariat.

In its virtue, at the initiative of the Minister of Public Works and Transport, and at the proposal of the Minister for Public Administrations and after deliberation of the Council of Ministers of April 19, 1991,

DISPONGO:

Article 1. º The Ministry of Public Works and Transport.

One. -Corresponds to the Ministry of Public Works and Transport:

1. The proposal and implementation of the Government's policy guidelines in relation to land, air and sea transport infrastructure and systems and their administrative regulation.

2. The higher management of all postal and telegraphic services, as well as the establishment, management and development of civil telecommunications and the functional control of operators in the sector managing public services (a) a contractual relationship with the State.

3. The proposal and implementation of the Government's policy on water, environment, coasts, meteorology, architecture, construction, housing and urban planning.

4. The direction of the services related to astronomy, geodesy, geophysics, cartography and metrology.

5. The planning and scheduling of investments related to the services included in the previous numbers.

Two. -The Ministry of Public Works and Transport is structured in the following Higher Bodies:

The Secretary of State for Water Policies and the Environment.

The Subsecretariat of Public Works and Transport.

The General Secretariat for Territorial Planning and Concertation.

The General Secretariat for Communications.

The General Secretariat for Transport Services.

The General Secretariat for Land Transport Infrastructure.

The General Secretariat of the Environment.

Art. 2. Organs Directly dependent on the Minister.

One. -From the Minister of Public Works and Transport the following Higher Bodies are directly dependent:

The Secretary of State for Water Policies and the Environment.

The Subsecretariat of Public Works and Transport.

The General Secretariat for Territorial Planning and Concertation.

The General Secretariat for Communications.

The General Secretariat for Transport Services.

The General Secretariat for Land Transport Infrastructure.

Two. -Also, directly dependent on the Minister of Public Works and Transport, there is a Cabinet as an organ of support and immediate assistance, the holder of which has the organic level of Director General with the structure and Staff arrangements to prevent Royal Decree 3175/1982 of 22 December 1982.

Art. 3. The Secretary of State for Water Policies and the Environment.

One. -It is the responsibility of the Secretary of State for Water and Environment Policies:

1. The elaboration of the basic regulations on environmental, coastal and industrial waste, as well as their application in the field of competencies of the State Administration.

2. Coordination and concerted action with the Autonomous Communities, Spain's relationship with the EEC, with respect to Community environmental policy, as well as carrying out studies assessing the environmental impact of public works.

3. The implementation of the Government's water policy, both in its qualitative and quantitative aspects, through the implementation of the Water Law, the creation of the necessary infrastructures and the management of water resources, in the field of powers of the State Administration.

Two. -From the Secretariat of State for Water and Environment Policies, the following directly depends on the Higher Organ and the Steering Center:

The General Secretariat of the Environment.

The General Direction of Hydraulic Works.

Three. -It is the responsibility of the General Secretariat of the Environment for the development, under the top leadership of the Secretary of State, of the functions mentioned in paragraph 1. 1 of this article

Four. -1. The General Secretariat of the Environment depends on the following Directives:

The Environmental Policy Directorate General.

The Environmental Management General Direction.

The Directorate General of the National Institute of Meteorology.

2. Directly dependent on the Secretary General there is a Technical Cabinet with the organic level of Subdirectorate General.

Five. -The General Secretariat of the Environment maintains the relationship and exercises functional control over the National Waste Company (ENRESA).

Six. -They are attached to the Ministry of Public Works and Transport, through the Directorate General of Hydraulic Works, the following Autonomous Bodies:

The Hydrographic Confederations.

The Commonwealth of the Taibilla Channels.

The Machinery Park.

Seven. -1. The Secretary of State for Water and Environment Policy also depends on a Cabinet with the structure and staff regime established by Royal Decree 3775/1982 of 22 December 1982, the holder of which has the organic level of Director-General.

2. The Cabinet, apart from the functions of support and assistance to the Secretary of State, will be responsible for the coordination of programs and projects of actions of the Secretariat of State for Water and Environment Policies, on the basis of the objectives approved by the holder of the Department, as well as its monitoring and control.

Art. 4. The Deputy Secretary for Public Works and Transport.

One. -Corresponds to the Subsecretariat of Public Works and Transports the performance of the functions that Article 15 of the Law of Legal Regime of the State Administration attributes to the Undersecretaries of the Departments and, in addition, the direction, drive and supervision of the Direct Centres and Units directly dependent on them.

Two. -In addition to the functions set forth in the previous paragraph, they are attributed to the Secretariat, in so far as they are not directly attributed to the other higher bodies, Autonomous Bodies and public entities of the Department, the following functions for the different common service areas:

1. The programming, direction and coordination of sectoral studies, reports of conjuncture and analysis of evolution and sectoral foresight, in the fields of transport, communications, environment, water resources and urban planning, with the purpose of detecting the social needs and demands of the sectors indicated and to allow the supposed and formulation of the objectives and plans of departmental action.

2. The determination of the structure of the programmes and sub-programmes in which the activity of the Department is carried out, the preparation of the annual preliminary draft budgets and their processing, the monitoring of the implementation of the budget appropriations and the processing of their modifications.

3. The study of the different organizational elements of the Department and the direction and implementation of the organizational projects at ministerial level.

4. The development and implementation of the Department's IT plan, the management of the technical infrastructure and the communications required by the various Directives and Units of the Department, as well as the technical assistance and advice in information technologies.

5. The drafting and processing of draft general provisions, permanent legal advice to those responsible for administrative management, the formulation of proposals for the resolution of administrative appeals against the acts and provisions of the Department, as well as relations with the courts.

6. Coordination of the peripheral services of the Department, cooperation and international relations, in coordination with the Ministry of Foreign Affairs, institutional relations with the other Organizations of the Administration of the State and other public administrations, and relations with the different social partners.

7. The management and administration of the human resources of the Department, the elaboration of the relations of jobs and the annual plan of employment, the preparation and processing of the selective processes for the coverage of the jobs, the training of staff, trade union relations, social action and prevention, hygiene and safety at work.

8. Wealth management, recruitment, technical and maintenance services, library and publications, internal regime, registration and general files at the Department level.

9. Economic and financial management.

10. The organisation of the activities of the Department's control of activity, carrying out financial, management and procedural audits to assess the performance, effectiveness and performance of the staff and services of the Ministry, without prejudice to the activities carried out by ICAE in these matters, in accordance with current regulations.

Three. -In so far as the common services listed under the previous heading are attributed to other Senior Bodies, Agencies and Entities of the Department, the Secretariat will be responsible for coordination, departmental level, of these services.

Four. -From the Subsecretariat of Public Works and Transportation the following management centers depend:

The Directorate-General for Economic and Budget Programming.

The Technical General Secretariat.

The Technical Secretariat for Transport and Communications.

The General Directorate of Public Works Services.

The Directorate General of Transport and Communications Services.

The Audit and Management Control and Procedures Directorate General.

The Directorate General of the National Geographic Institute.

The Directorate General for Housing and Architecture.

Five. -Directorate-General for Economic and Budgetary Programming exercises the same functions as the suppressed Directorate General of Programming and Economic Coordination and retains the same structure as the latter, In addition, the Budget Office of the Ministry of Transport, Tourism and Communications.

Six. -The General Secretariat of the Technical Secretariat maintains the structure and functions of the current Technical General Secretariat of the Ministry of Public Works and Urbanism, and its action will be referred to the Directive Centers and Organizations that belonged to that Ministry, assuming, equally, the functions and structures of the Subdirectorate General of Legislative and Autonomous Development of the suppressed Technical General Secretariat of the Ministry of Transport, Tourism and Communications, according to are determined by Decree 615/1978 of 30 March 1978 and Royal Decree 3579/1982, of 15 December, and also the function of the issuing of reports referred to in Article 1. 130.1 of the Law of Administrative Procedure, in which it refers to the totality of general provisions elaborated within the department.

Seven. -The Technical Secretariat of Transport and Communications maintains the structure and functions of the suppressed Technical General Secretariat of the Ministry of Transport, Tourism and Communications, and its actions will address the Management Centers and Agencies belonging to that Ministry, with the exception of the assignment of structures and functions to the Technical General Secretariat of the new Department in the previous section.

Eight. -Directorate General of Public Works Services maintains the structure and functions of the suppressed General Directorate of Services of the Ministry of Public Works and Urbanism, and its performance will be referred to the Centers managers and bodies belonging to that Ministry. It also corresponds to the performance of these affiliations with respect to personnel not included in the scope of the Directorate General of Transport and Communications Services.

Nine. -Directorate General of Transport and Communications Services maintains the structure and functions of the deleted Directorate General of Services of the Ministry of Transport, Tourism and Communications, except for refers to the Budget Office, and its action will be referred to the Management Centres and Bodies belonging to that Ministry.

Ten. -1. The Directorate-General for Audit and Management Control and Procedures shall exercise the functions of effectiveness control and the performance of management audits, and procedures, with a particular impact on the field of public procurement, Financial and IT. It is also responsible for the evaluation of the Department's policies and economic and financial management, as well as to formulate proposals for legislative changes that are deemed appropriate to increase the efficiency of the administration. public in the areas of action of the Ministry of Public Works and Transport.

2. The new Directorate-General for Audit and Management Control is part of the current General Services Inspections of the two Departments which are incorporated into the new Ministry of Public Works and Transport.

Once. -The Directorates General of the National Geographic Institute and for Housing and Architecture maintain their current structure and functions.

Twelve. -They are also attached to the Ministry of Public Works and Transport:

1. Through the Secretariat, the Autonomous Body "Center for Studies and Experimentation of Public Works" (CEDEX).

2. Through the Directorate General of the National Geographic Institute, the Autonomous Bodies "National Geographic Information Center" and "Spanish Center of Meteorology".

3. Through the Directorate General for Housing and Architecture, the State Society for the Promotion and Equipment of Soil (SEPES).

Thirteen. -1. Directly dependent on the Under-Secretary are the following Units with General Subdirection level:

The Technical Cabinet of the Undersecretary, in which the Technical Cabinets of the Undersecretaries of Public Works and Urbanism, and of Transport, Tourism and Communications are integrated.

The Legal Service of the Department in which the Legal Services of the Ministries of Public Works and Urbanism are integrated, and of Transport, Tourism and Communications.

The State General's delegated intervention that will integrate the two existing delegated interventions in the Departments that are incorporated into the new Ministry of Public Works and Transport. This intervention is broken down in the areas of Post, Transport and Communications and Public Works.

The Economic Advisory that preserves the current structure and tasks of the Economic Advisory of the Ministry of Transport, Tourism and Communications.

Art. 5. The General Secretariat for Planning and Territorial Concentration.

One. -The General Secretariat of Territorial Planning and Concertation, as a direct support organ to the Department's holder, has the following functions assigned:

1. The intermodal programming of transport infrastructure and services plans in large urban concentrations, in concert with the Public Administrations concerned.

2. The planning of major infrastructure investment projects and the assessment of their profitability and their impact on the territory.

Two. -From the General Secretariat of Planning and Territorial Concertation the following management centers depend:

The General Directorate of Intermodal Transport Planning in the Great Cities.

The General Directorate of Interregional Planning for Large Infrastructures.

The Institute of Territory and Urbanism.

Three.-The General Directorate of Intermodal Transport Planning in the Great Cities has the following functions:

1. To plan the development plans of transport infrastructures in large urban concentrations, in concert with the Territorial Administrations.

2. Follow the implementation of the action conventions in this field and prepare the next generation of the agreements.

3. Coordinate transport policies with the territorial policies of spatial planning, population settlements and changes in the urban structure.

Four.-The General Directorate of Interregional Planning for Large Infrastructures has the following functions:

1. Analyse and develop investment decisions in major new infrastructure projects, taking into account their public and private profitability, their complementarity and their impact on spatial planning.

2. In particular:

2.1 To elaborate from the proposals and technical projects of the respective competent administrative bodies the plan of investments in the great axes that articulate the land transport and in the new harbour facilities and In the context of its intermodal coordination and its effects on the territorial development of the economic activity and the settlement of the population.

2.2 Analyze and assess the profitability and territorial impact of strategic decisions on water policy and its induced effects on the needs of other infrastructure.

Five. -The two Directorates-General mentioned will not be structured in a hierarchized form and their operation will be developed through work teams formed based on flexible functional relationships for each one. of the scheduled work and of the Concertation Commissions with each of the, or the Territorial Administrations concerned, in order to draw up the corresponding Conventions of joint action when the nature of the decisions so requires adopt.

Art. 6. The General Secretariat of Communications.

One. -It is the responsibility of the Secretary General of Communications:

1. The regulatory, contractual and technical management of the communications sector.

2. The administrative regulation and, where appropriate, the proposal for regulatory regulation, for cable, satellite and terrestrial television systems of low power.

3. The management of the public services of the television signal transport network and other radio transmissions, of the Spanish satellite communications system, and of the postal and telegraphic communications system.

4. It also corresponds to the relations of the State Administration with the Spanish National Telephone Company and the functional control of the telephone service.

Two. -From the General Secretariat of Communications the following Executive Centers are directly dependent:

The Telecom Directorate General.

The General Directorate of Posts and Telegraphs.

Three. 1. -Directly dependent on the Secretary-General, there are the following units with an organic level of Subdirectorate General:

The Technical Cabinet.

The Communications Infrastructure General Subdirection.

Cuatro. El Ente published Red Tecnica Española de Televisión (RETEVISION) is attached to the Ministry of Public Works and Transport, through the General Secretariat of Communications.

Five. -The General Secretariat of Communications maintains the relationship and exercises functional control over the following public participation societies:

Art. 7. The General Secretariat for Transport Services.

One. -It is the responsibility of the General Secretariat for the Services of Transport in the field of competences of the State Administration:

1. The general regulation of the transport sector and the activity of the air, sea and land subsectors that compose it.

2. Coordination and protection of the management of public transport services and fixed infrastructure for air and sea transport.

3. The training of personnel specializing in the above subjects.

Two. -From the General Secretariat for Transport Services the following Management Centres depend:

1. In relation to land transport:

The Directorate General of Land Transport, which will assume the functions of the Government Delegation in RENFE.

2. In relation to maritime transport:

The General Direction of the Merchant Navy.

The General Direction of Ports and Coasts.

3. In relation to air transport:

The Directorate General of Civil Aviation.

Three. -Directly dependent on the Secretary General for Transport Services there is a Technical Cabinet with the organic level of Subdirectorate General.

Four. -They are attached to the Ministry of Public Works and Transport, through the General Secretariat for Transport Services, the following Autonomous Bodies and Public Entities:

1. In relation to land transport, the National Road Transport Company (ENATCAR).

2. In relation to the marine transport all the Autonomous Harbour and the Public Entes of the existing Ports.

3. In relation to air transport, the Autonomous Body Airports National.

Five. -The General Secretariat for Transport Services maintains the relationship and exercises functional control over the following Public Sector Entes and Societies:

National Network of Spanish Railways (RENFE).

Spanish Railways de Via Estrela (FEVE).

Society for Civil Aviation Teachings (SENACSA).

National Highway Company (ENAUSA).

Art. 8. The General Secretariat for Land Transport Infrastructure.

One. -It is the responsibility of the General Secretariat for Infrastructures of Land Transport, through its dependent Direct Centers:

1. The first level programming and the preparation of the technical projects of the public infrastructure of land transport, both by road and by rail.

2. Coordination of the implementation of those relating to road and rail transport infrastructure, both with the dependent and dependent centres of transport, and with RENFE, FEVE, ENAUSA and with the Territorial and State Administrations affected.

3. In particular, the coordination of the actions developed by RENFE and the Directorate General of Infrastructures of Rail Transport for the construction of New Rail Access to Andalusia (NAFA).

Two. -From the General Secretariat for Land Transport Infrastructures the following Management Centres depend:

The Directorate General of Roads.

The Directorate-General for Infrastructure and Transport Planning, hereinafter referred to as the Directorate-General for Infrastructure for Rail Transport.

The Government Delegation to the National Highway Dealership Companies.

Three. -Also, the General Secretariat for Land Transport Infrastructure directly depends on a Technical Cabinet with the organic level of Subdirectorate General.

Art. 9. Powers of the Secretary of State.

One. -In accordance with the final provision of Royal Decree 1558/1977 of 4 July 1977, the Secretary of State shall exercise, in respect of the Units assigned to him, the powers provided for in the numbers 1, 4, 5, 6, 7, 10 and 11 of Article 14 of the Law of Legal Regime of the State Administration, without prejudice to the superior direction of the Minister of Public Works and Transport.

Two. -Also, the Secretary of State may perform as many duties as the Department holder expressly delegates to him.

Art. 10.

The Management Centers of the Department, under the supervision of the respective Superior Bodies in which they are integrated by this Royal Decree, will retain the structure and functions that the regent regulations attribute to them, except those Directorates-General and Units of the Department in relation to which specific rules have been established in this Royal Decree, in terms of their denomination, structure or functions.

ADDITIONAL DISPOSITION

The following Organ and Units are deleted:

a) Higher organs:

The Subsecretariat of Public Works and Urbanism.

The Assistant Secretary for Transport, Tourism and Communications.

b) Directorates-general:

The Transportation Planning and Infrastructure Directorate General.

The Directorate General for Programming and Economic Coordination.

The Technical General Secretariat of the Ministry of Public Works and Urbanism.

The Directorate General of Services of the Ministry of Public Works and Urbanism.

The Directorate General of Services of the Ministry of Transport, Tourism and Communications.

The Technical Secretariat of the Ministry of Transport, Tourism and Communications.

The Territorial Action Subdirection.

c) General Subaddresses:

The Technical Cabinet of the Undersecretary of Public Works and Urbanism.

TRANSIENT PROVISIONS

First.

Transiently, as long as there is no further restructuring of the Directives of the Ministry of Public Works and Transport, the actions of the General Subdirectorate of Costas will be coordinated by the Secretary-General of the Environment, from the perspectives of the environmental impact.

Second.

Until the new autonomous body "Post and Telegraph" is established, they will continue to perform their duties by the organs of the State administration that currently have them attributed.

Third.

Until the creation of the new public Ente "Spanish Airports and Air Navigation" will continue to perform its functions by the Directorate General of Civil Aviation and the Autonomous Agency " Airports National ", in the way they currently have them attributed.

Fourth.

The Ministry of Public Works and Transport, in the course of this financial year for 1991, will proceed to formulate the initiative provided for in Article 12 of Law 10/1983 of 16 August, with the aim of restructure the services of the Department's Secretariat, differentiating the management of the management personnel from the other instrumental services in different Directives, and transforming the Technical Secretariat of Transport and Communications at a Centre for Transport and Communications Studies.

Fifth.

In the same period as the previous transitional provision, the Ministry of Public Works and Transport will formulate a proposal for the restructuring of the Peripheral Services, in order to adjust the structure of the the same to the design of the new structure of the Central Services.

Sixth.

Also, within the period referred to in the previous transitional provision, the Ministry of Public Works and Transport will formulate proposals to modify the composition and functions of the Collegiate Organs, both interministerial as ministerial, through timely processing. However, for the same transitional period, the dependency and the organic level of the Chairman of the Board of Public Works are maintained.

FINAL PROVISIONS

First.

The Ministry of Economy and Finance will make the budgetary modifications and credits necessary for the fulfillment of the provisions of this Royal Decree.

Second.

All provisions of equal or lower rank are repealed as set forth in this Royal Decree.

Third.

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".
