The Directive of the European Economic Community 85/3 EEC on the weights, dimensions and other characteristics of vehicles provides that, as from 1 July 1986, Member States may not refuse or prevent the movement on its territory in international traffic to vehicles registered and put into circulation in any Member State, for reasons of its weights or dimensions if they do not exceed the limit values specified therein. This resulted in the adoption of Royal Decree 2029/1986 of 28 June, which amended Article 55 of the Circulation Code.

This Directive has been amended by the following Community Directives 8 5/3 6 0, 88/218, 89/338, 89/4661 and 91/60 EEC, which are also to be included in our internal rules.

Moreover, with the aim that national carriers may be in the same position to circulate in Spain as hauliers from the other Community countries to which they apply, forecasts of these Directives when international traffic is being carried out, it is necessary to make provision for both new registration vehicles and vehicles in service, which the holders of which are entitled to benefit from the the limits laid down in the previous provisions, for the purpose of registration and movement by the Spanish public roads.

Finally, it has been estimated that the provisions which under Article 220 of the Circulation Code, which are in place for certain vehicles, need to be repealed, should be repealed. (a) a permanent special authorisation for movement, considering that such a requirement, which could only be maintained for national carriers, is meaningless in the new regulatory context. However, restrictions on movement are still in force on certain routes for vehicles which do not conform to the new rules.

In its virtue, on the proposal of the Ministers of Public Works and Transport, of the Interior and of Industry, Commerce and Tourism, in agreement with the Council of State and after deliberation of the Council of Ministers in its meeting of the day 2 of August 1991,

DISPONGO:

Single item.

Articles 55, 57 and 58 of the Circulation Code, approved by Decree of 25 September 1934, are amended, so that the wording of the Code is as follows:

" Art. 55:

I. Circulation is not allowed:

1. Of vehicles with pneumatic wheels or similar elasticity, with a pressure of more than 9 kilograms per square centimetre of gross support surface on the pavement. These vehicles are treated as "caterpillars" whose surfaces of contact with the ground are flat and do not present projections.

2. Of an animal traction vehicle fitted with non-pneumatic wheels or similar elasticity, with a load weight exceeding 150 kilograms per centimetre of tread width.

3. Of those in which the tyres bear loads higher than those determined by their safety standards.

4. Of vehicles with axle weights exceeding the following limits:

4.1 Simple axis:

4.1a Motor shaft, 11.5 tonnes.

4.1b Motor shaft, 10 tons.

4.2 Dual or tandem axis:

The two-axis set whose distance between centers is less than 1.80 meters is considered a double axis or tandem.

4.2a Tandem axle of motor vehicles:

If the two-axis separation is less than 1,00 metres (d < 1,00 m), 11,5 tonnes.

If it is equal to or greater than 1,00 metres and less than 1,30 metres (1,00 m ≤ d < 1,30 m), 16 tonnes.

If it is equal to or greater than 1.30 meters and less than 1.80 meters (1.30 m ≤ d < 1.80 m), 18 tons.

In the case above if the engine shaft is fitted with double tyres and pneumatic suspension or recognised as equivalent at Community level, 19 tonnes

4.2b Tandem axis of trailers or semi-trailers:

If the d separation of the axles is less than 1,00 metres (d < 1,00 m), 11 tonnes.

If it is equal to or greater than 1,00 metres and less than 1,30 metres (1,00 m ≤ d < 1,30 m), 16 tonnes.

If it is equal to or greater than 1.30 meters and less than 1.80 meters (1.30 m ≤ d < 1.80 m), 18 tons.

4.3 Triple axis or tridem of trailers or semi-trailers:

The 3-axis set is considered to be triple or tridem, in which none of the distances between contiguous axis centers is greater than 1.40 meters.

If the distance is equal to or less than 1.30 meters (d < 1.30 m), 21 tons.

If the distance is greater than 1.30 meters and less than or equal to 1.40 meters (1.30 m < d ≤ 1.40 m), 24 tons.

5. Of vehicles with an authorised maximum weight exceeding the following limits:

5.1a Motor vehicle, two axles, 18 tons.

5.1b Two-axis trailer, 18 tons.

5.2a Motor vehicle, three axles, 25 tonnes.

When the engine shaft is fitted with double tyres and pneumatic suspension or recognised as equivalent at Community level, 26 tonnes.

5.2b Three-axis trailer, 24 tons.

5.3 3-axis articulated buses, 28 tons.

5.4 4-axis rigid vehicle with two directional, pneumatic suspension or recognized as equivalent and twin wheels, 32 tons.

Other rigid 4-axis vehicles, 31 tons.

5.5 4-axis road trains, consisting of a 2-axle motor vehicle and a 2-axle trailer, 36 tonnes.

5.6 Road trains of 5 or more axles, 40 tonnes.

5.7 4-axle articulated vehicle, consisting of a 2-axle motor vehicle, fitted on the engine axle with twin wheels and a pneumatic suspension or recognised as equivalent and by a semi-trailer in which the wheelbase is more than 1,80 metres, 38 tonnes.

Other 4-axle articulated vehicles consisting of a 2-axle tractor and a semi-trailer of two other axles, 36 tonnes.

5.8 articulated vehicle of 5 or more axles, 40 tons.

5.9 If the motor vehicle is 3 axles with semi-trailer of 2 or 3 axles and carries an ISO container of 40 ft in combined transpon, 44 tonnes.

6. Of a number of road trains where the distance between the rear axle of the motor vehicle and the forward of the trailer is less than 3,00 metres.

7. Of vehicles or vehicle assemblies in which the weight borne by the motor axle or the engine axles is less than 25 per 100 of the total load weight of the vehicle or set of vehicles.

8. Of 4-axle motor vehicles the maximum authorised weight in tonnes is greater than 5 times the distance in metres between the centres of the extreme axles of the vehicle.

II. The Minister of Public Works and Transpons will dictate the rules that, if necessary, are necessary for the application and development of the provisions of points 4, 5, 6, 7 and 8 of this article.

Art. 57:

The maximum permissible length of vehicles for circular power, including the load, is as follows;

1. Trailers, 12,00 metres.

2. Rigid motor vehicles, whatever the number of axles, 12,00 metres.

3. Articulated vehicles, except buses, 16,50 metres.

The maximum distance between the axle of the coupling pin and the rear part of the semi-trailer shall not be greater than 12; 00 metres.

The distance between the axle of the coupling pin and any point on the front of the semi-trailer shall not be more than 2,04 metres horizontally.

4. Articulated buses, 18,00 metres.

5. Road trains, 18.35 metres.

The maximum distance, measured in parallel to the longitudinal axis of the road train, between the outer points below the load zone behind the cab and further back of the trailer of the vehicle assembly, minus the distance between the rear of the motor vehicle and the front of the trailer, shall not exceed 15,65 metres.

The maximum distance, measured in parallel with the longitudinal axis of the road train, between the outer points below the load zone behind the cab and further back the trailer of the vehicle assembly shall not be possible be greater than 16,00 metres.

Art. 58:

1. The maximum permissible width for vehicles to be circular shall be as a general rule of 2,50 metres, except in the case of thick-walled fridges which shall be 2,60 metres.

Thick-walled cold vehicle means any vehicle whose fixed or movable superstructures are specially equipped for the carriage of goods at controlled temperature according to classes B, C, E and F of the Agreement of 1 September 1970 on the International Transport of Perishable Products and on special machines to be used for such transport (ATP) and with a thickness, for each side wall, including insulation, of At least 45 millimeters.

2. The maximum height of the vehicles included in the load may be up to 4,00 metres.

3. The load must not compromise the stability of the vehicle, damage the works and plantations of the track or constitute an obstacle to its passage under bridges, viaducts or aerial installations.

4. Any motor vehicle, or set of moving vehicles, must be able to be registered in a circular crown of an external radius of 12,50 metres and an internal radius of 5.30 metres. '

ADDITIONAL PROVISIONS

First.

1. Notwithstanding the general provisions of this Royal Decree, it will be subject to the limitations laid down in the Resolutions of the Directorate-General for Land Transport of 10 July 1979 of 4 March 1980, of 17 June 1980. 1980 and 15 October 1980 on authorised routes, as long as they are not modified by provisions of the same or higher rank, the movement of vehicles which are registered under the transitional provisions comply with the requirements of this Royal Decree and are included in any of the following cases:

(a) rigid vehicles when their authorised maximum weight exceeds 16 tonnes.

(b) articulated vehicles where the maximum authorised weight of the assembly consisting of the motor vehicle and the semi-trailer is greater than 16 tonnes or the length of the assembly exceeds 15 metres.

(c) Road trains where the maximum authorised weight of the assembly consisting of the motor vehicle and the trailer is more than 16 tonnes or the length of the assembly exceeds 14 metres.

2. The routes referred to in the previous point may be amended, where appropriate, by joint resolution of the Directors-General for Land Transport, Roads and Traffic.

Second.

The provisions of this Royal Decree shall be without prejudice to the obligation to respect the limitations of the movement which, duly signposted, exist in singular points of the road network according to the weight or dimensions of vehicles,

Third.

articulated vehicles and road trains which are currently authorised for a maximum weight of 38 tonnes may increase this figure to 40 tonnes when they are part of a set of five or more axles, provided that they are approved for 40 tonnes. This data shall be recorded in the vehicle documentation. If you already have such an entry for international transport, no annotation will be required.

Fourth.

The maximum permitted width of specially conditioned bus-type vehicles for the transfer of prisoners, exclusively used in domestic traffic, shall be 2,60 metres.

It is understood by bus type specially conditioned for the transfer of prisoners that constituted by a central compartment for cells separated from the striker (driving and escort) and rear (escort), as well as for a central aisle.

TRANSIENT PROVISIONS

First.

The registration and circulation of vehicles and vehicle assemblies whose weights and dimensions are in accordance with the current regulations up to the date of entry into force of the vehicle shall be accepted, until the dates specified below. this Royal Decree even if they do not comply with the requirements of the provisions of Article 55 (I) which are also determined:

(a) Until 1 January 1993 for the provisions of paragraphs 5.2b and 5.3.

(b) Until 1 January 1995 for the provisions of points 4.1a, 4.1b, 4.2a, 4.2b, 5.1a, 5.1b, 5.2a, 5.4, 5.5, 5.7, 6 and 7.

Vehicles registered from the entry into force of this Royal Decree, and up to the dates allowed as a limit in this transitional provision, may optionally circulate on national territory with the weights and dimensions in force until the date of entry into force of this Royal Decree, for 10 years from the date of its registration, with the limitations of movement referred to in the first provision.

Second.

Vehicles registered or put into circulation prior to the entry into force of this Royal Decree may continue to circulate on national territory with the weights and dimensions with which they were admitted for their registration, as well as with the limitations referred to in the first provision.

Third.

The road trains whose motor vehicle has been put into circulation before 31 December 1991 may run until 31 December 1998, even if they do not meet the requirements of Article 57.5 if their length total does not exceed 18 meters.

FINAL DISPOSITION

The Minister of Industry, Commerce and Tourism is hereby authorised to determine the concept of "suspension equivalent to pneumatics", in accordance with the meaning of this expression in Community legislation.

REPEAL PROVISION

The following provisions are repealed:

Decree 490/1962, of 8 March, fixing the maximum authorized weights and dimensions for vehicles to circulate on public roads.

Decree 1216/1967 of 1 June. on maximum weights and dimensions of vehicles for use in public roads.

Royal Decree 2029/1986 of 28 June amending Article 55 of the Circulation Code and providing for optional new limits for the weights and dimensions of vehicles.

Order of 7 March 1975 for the limitation of movement limitations in permanent special authorisations for certain vehicles.

order of 27 September 1978 amending the document of the permanent special authorisation for the movement of vehicles which require it, as well as the Resolution of the Directorate-General for Land Transport which it develops, of 12 December 1978, with the exception of the Annex to that Order, which shall be in force for the purposes of the first provision.

The provisions of this Royal Decree shall also be repealed as many provisions of the same or lower rank.
