Organic Law 1/1990, of 3 October, of General Management of the Educational System, has established the basic characteristics of the Baccalaureate, as an educational stage of two years of duration, which is part of the Secondary Education, and which gives access to higher education. It has also established the general objectives of the Baccalaureate, expressed in terms of skills. According to the Law, the Baccalaureate will be organized in different modalities, with specific subjects, which, together with the common subjects and with optional subjects, will be the complete curriculum of the students who are teachings.

It is therefore now necessary to fix the structure and management of the Baccalaureate, taking into account its common characteristics and each of its modalities. This must be done in the light of the educational objectives that the Law itself points out and the needs that Spanish society demands.

It is appropriate for the Baccalaureate to meet a threefold educational purpose: general training, orientation of the students and preparation of the students for higher education. The aim of the training is given that the Baccalaureate is to promote a greater personal maturity in those who pursue it, in its general capacity and also in the specific capacities corresponding to the cultural fields of each modality. For its guiding purpose, the Baccalaureate has to contribute to profiling and to develop training projects in the students, which will be concretized in later studies and in the active life. The aim of the pro-deutic or preparatory work must be to ensure that the Baccalaureate provides the basis for such higher education, both university and vocational training.

The unity of the Baccalaureate is reflected in its educational objectives, which are common to all the modalities, in the common subjects that all students have to take and in the title of Bachiller, which will be unique. The Baccalaureate established in the Law, however, is also characterized by its diversity, which is concretely concrete in its different modalities and in the optional subjects that compose it, that allow to configure different itineraries training. Such itineraries, in turn, will facilitate access to higher education and the transition to active life. The principle of the unity of the Baccalaureate is balanced, therefore, with a principle of diversity and specialization in some of the great fields of knowledge, culture and professionalization.

The modalities are organised in relation to the major areas of knowledge and university careers and vocational training courses at a higher level, which may be completed after the Baccalaureate, and have already been established. In the Organic Law 1/1990 of 3 October of General Ordination of the Educational System. Moreover, the Law itself attributes to the Government the competence to establish new modalities or to modify those already defined, according to the Autonomous Communities.

The Government will also regulate, according to the aforementioned Law, the minimum teachings of each of the subjects established in this Royal Decree. In the definition of the basic aspects of these subjects, it will be necessary to take into account that the Baccalaureate is part of the Secondary Education, which must be reflected in a good connection between the subjects of the Baccalaureate and the areas of compulsory secondary education. On the other hand, since the Baccalaureate has to prepare and give access to other studies, the contents and methodology of their subjects must be established in a way that they guide and prepare for the great fields of university and university education. This Royal Decree has been consulted with the Autonomous Communities, within the Sectoral Education Conference, as well as with the various sectors of the Educational Community, gathering the spirit of cooperation that in The Organic Law 1/1990, of 3 October, of General Management of the Educational System, is stated as a principle that should preside over the full development of the reform undertaken.

In its virtue, on the proposal of the Minister of Education and Science, after consulting the Autonomous Communities that are in the full exercise of their competences in matters of education, with report of the School Council of State, agreement with the Council of State and after deliberation by the Council of Ministers at its meeting on 29 November 1991,

DISPONGO:

Article 1. °

1. The Baccalaureate is part of Secondary Education and will be extended through two academic courses.

2. The Baccalaureate will aim at the general training of students, as well as their orientation and preparation for higher education, both university and specific vocational training, and for active life.

Art. 2. °

Students who are in possession of the Graduate degree in Secondary Education will be able to access the Baccalaureate studies.

Art. 3. °

1. The Baccalaureate will be developed in the following modalities: a) Arts; b) Nature and Health Sciences, e) Humanities and Social Sciences; d) Technology.

2. The various forms of the Baccalaureate will serve the threefold formative, guiding and preparatory aim in relation to the corresponding fields of knowledge, culture and professionalization, which define each modality.

3. The various forms of the Baccalaureate will also ensure a basic vocational training and a personal maturity that facilitates the transition of pupils to active life.

Art. 4. º

The Baccalaureate will contribute to the development of the following skills in the students:

(a) Dominate the Spanish language and the official language of the Autonomous Community.

b) Express fluency and correction in a foreign language.

c) Analyze and critically assess the realities of the contemporary world and the background and factors that influence it.

d) Understanding the fundamental elements of research and the scientific method.

e) Consolidating a personal, social and moral maturity that enables them to act responsibly and autonomously

f) Participate in solidarity in the development and improvement of your social environment.

g) Dominate fundamental scientific and technological knowledge and the basic skills of the chosen mode.

h) Develop artistic and literary sensitivity as a source of cultural formation and enrichment.

i) Use physical education and sport to promote personal development.

Art. 5. °

The Baccalaureate will be organized in common subjects, subjects of each mode and optional subjects.

Art. 6. °

1. The following shall be common subjects:

Physical Education.

Philosophy.

History.

Castilian language, official language of the corresponding Autonomous Community and Literature.

Foreign language.

2. Each of the common subjects will be completed in the two years of the Baccalaureate or in one of them. The decision in this respect shall be taken by the competent educational administrations.

Art. 7.or

The subjects of the Arts modality will be as follows: Artistic Drawing I, Technical Drawing, Volume, Art Drawing II, Art History, Image, Design Foundations and Graphic-Plastic Expression Techniques.

Art. 8. °

The subjects of the Nature and Health Sciences Mode will be the following: Biology and Geology, Physics and Chemistry, Mathematics I, Biology, Earth and Environmental Sciences, Technical Drawing, Physics, Mathematics II and Chemistry.

Art. 9. °

The subjects of the Humanities and Social Sciences Mode will be as follows: Economics, Greek, History of the Contemporary World, Latin I, Mathematics applied to the Social Sciences (I), Economics and Organization Companies, Geography, History of Art, History of Philosophy, Latin II and Mathematics applied to Social Sciences (II).

Art. 10.

The subjects of the Technology Mode will be the following: Physics and Chemistry, Mathematics I, Industrial Technology I, Technical Drawing, Electrotechnics, Physics, Mathematics II, Mechanical and Industrial Technology II.

Art. 11.

1. The educational administrations will organize the Modes distributing the materials corresponding to each of them in the two courses that make up the Baccalaureate.

2. The students will have to take six subjects of the chosen modality, in the two courses of the Baccalaureate.

Art. 12.

1. The educational administrations will set the optional subjects of the Baccalaureate, as well as the number of them that the students will have to overcome in each of the courses of the Baccalaureate.

In this setting, educational administrations will also be able to take into account the proposals made by the educational centres.

2. Students may choose as optional subjects not only those which are provided for in the preceding paragraph, but also any of the subjects defined as their own by the different Modes, in accordance with what they determine. Educational administrations according to the possibilities of organization of the Centers.

Art. 13.

1. The minimum teachings of the Baccalaureate curriculum shall be established by the Government in accordance with the provisions of Article 4 (2) of Organic Law 1/1990 of 3 October of General Ordination of the Educational System.

2. The competent educational authorities shall establish the curriculum of the different subjects of the Baccalaureate, which shall, in any case, form part of the basic aspects of the curriculum referred to in the previous paragraph.

Art. 14.

Educational Administrations will establish the conditions in which a student who has completed the first year of the Baccalaureate within a given modality will be able to move to the second in a different modality.

Art. 15.

1. Under Article 29 of the Organic Law 1/1990 of 3 October, students who successfully cure the Baccalaureate in any of its modalities will receive the title of Bachiller. In order to obtain this title, the positive evaluation will be necessary in all subjects.

2. The title of Bachiller will empower you to access higher-grade vocational training and university studies. In the latter case, it will be necessary to pass an access test, which, together with the qualifications obtained in the Baccalaureate, will value, with a target character, the academic maturity of the students and the knowledge acquired in the.

Art. 16.

1. In order to comply with the provisions of the second provision of the Organic Law 1/1990 of 3 October, the Catholic Religion will be the subject of compulsory provision for the Centers, which will also organize study activities. oriented by a teacher. At the beginning of the Baccalaureate the parents or guardians of the pupils, or themselves if they are of age, will make the choice of one of the above options to the Centre's leadership, without prejudice to the possibility that the decision may be modified at the beginning. of each school year.

2. The determination of the Catholic Religion curriculum will correspond to the ecclesiastical hierarchy.

3. The evaluation of the teachings of the Catholic Religion will be carried out in a similar way to that of other subjects, although, given the voluntary nature that these teachings have for the students, the corresponding qualifications will not be taken in it counts in the calls that, within the educational system and the effects of it, make the Public Administrations and in which the academic records of the students have to enter into concurrency.

ADDITIONAL PROVISIONS

First.

1. By virtue of Article 53 (4) of the Organic Law 1/1990 of 3 October, the Government will lay down the conditions under which the educational authorities may organise tests for adults over 23 years of age. years can directly obtain the title of Bachiller.

2. The tests referred to in the previous paragraph shall be organised in a differentiated manner in accordance with the rules of the Baccalaureate.

3. In accordance with Article 53 (2) of the Organic Law 1/1990 of 3 October, the educational authorities shall take the necessary measures to enable adults to take up the Baccalaureate and Training. Specific professional in the ordinary teaching centres provided they have the required qualifications.

Second.

The Government shall also regulate the system of convalidations between the teaching corresponding to the medium-grade specific vocational training and those of the Baccalaureate, in accordance with the provisions of Article 31, Paragraph 4 of the Organic Law 1/1990 of 3 October of General Ordination of the Educational System.

Third.

Students who have completed the third cycle of the middle grade of the teachings of Music and Dance referred to in Articles 39 and 40 of Organic Law 1/1990 of 3 October of General Ordination of the Educational System, obtain the title of Bachiller if they exceed the common subjects of the Baccalaureate, in accordance with Article 41 of that Law.

FINAL PROVISIONS

First.

1. The present Royal Decree, which is given by virtue of the habilitation that confers on the Government Article 27.6 of the Organic Law 1/1990, of October 3, and in use of the state competence for the general ordination of the educational system, collected In addition, the first, second, (a) provision of the Organic Law 8/1985 of 3 July, which regulates the law of education, is of a basic standard.

2. The Minister of Education and Science and the relevant authorities of the Autonomous Communities may, in the field of their respective competences, dictate the rules that are necessary for the implementation and development of this Royal Decree.

Second.

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".
