In compliance with the provisions of Article 82 of Law 4/1990, of 29 June, of the General Budget of the State for 1990, by Royal Decree 905/1991 of 14 June, the effective constitution of the public Ente Spanish Airports and Air Navigation (AENA).

Such a constitution did not entail the immediate provision by the Ente of the services which the abovementioned rules confer on it, with the completion of the period of commencement of such a benefit being delayed, in accordance with the additional provisions The first and third of the Royal Decree, to its later determination by the Minister of Public Works and Transport.

Date 21 October 1991 was published Royal Decree 1508/1991 of 11 October, which regulated the exercise of the right of choice by the officials affected by the transformation produced, thus enabling the transfer to the Ente of the staff necessary for the commencement of the provision of the services attributed to it, and in an immediate manner, those of an airport nature, since that is subrogated in all the rights and obligations of the Agency Autonomous Airports.

On 28 October 1991 the Order in which the date of commencement of the provision of its services by AENA was determined, differentiating between those relating to national airports and those relating to navigation air, in such a way that the start of the first was fixed for 2 November 1991 at the same time as the complexity of the technical and administrative order which led to the satisfactory completion of the preparatory tasks for the succession of the the provision of services in the field of air navigation and for the restructuring of the Directorate-General Civil Aviation, advised, at the time, to delay the latter transfer.

Those difficulties arise, it is appropriate to determine the date for such services to begin to be provided effectively by AENA.

In its virtue, and in accordance with the above provisions, I have:

Article 1. 1. The provision of services which, in the field of air navigation, attribute to the public Ente AENA, Article 82 of Law 4/1990, of 29 June, and Royal Decree 905/1991 of 14 June 1992, will be initiated on 1 November 1992.

2. The functions which the public Ente is attributed in terms of management and approval of the fractional periods of time for landing and taking off, will be assumed by that Ente published on July 15, 1992.

3. By way of derogation from the above paragraphs, the abovementioned services shall be subject to the prior restructuring by the Government of the Directorate-General for Civil Aviation, as provided for in the additional provision. Royal Decree 905/1991 cited above. In this case, the commencement of the provision of such services will take place at the time of the entry into force of the provisions to be adopted.

4. At that time, the public Ente will be subrogated on how many rights and obligations the Units will hold and whose services it assumes.

Art. 2. 1. The work staff of the Ministry of Public Works and Transport who will be providing their services in the units whose functions AENA assumes, will be integrated in the aforementioned Ente, on the date determined in the preceding article.

2. The integration of the official staff of the Ministry of Public Works and Transport affected by the transfer of functions to the public Ente will take place in accordance with the provisions of Royal Decree 1508/1991 of 11 October 1991, effect is determined by the Government.

Art. 3. The goods of public domain affected by the Ministry of Public Works and Transport referred to in the fifth paragraph of Article 82 of Law 4/1990, of 29 June, shall be attached to the Public Ente on the dates determined in the Article 1. of this Order.

FINAL DISPOSITION

This Order shall enter into force on the day following that of its publication in the Official Journal of the State.
