Law 8/1989, of 13 April, of Public Fees and Prices, establishes in its article 26.1, a) that the fixing or modification of the amount of the public prices shall be carried out by Order of the ministerial department of which the Organ or Ente which is to be perceived and proposed by them.

The public prices which govern the Spanish airports have been successively regulated by the Resolution of 27 July 1990, and by the Autonomous Body of the National Airports Authority, although the extinction of the of this and the assumption of its powers by the Public Agency Spanish Airports and Air Navigation (AENA), imposes that the fixing of the amounts of the cited public prices must be carried out in accordance with the provisions of the paragraph previous.

This Order maintains the previous tariff structure, although it proceeds to the necessary updating of the tariffs, which are increased in general in a percentage coincident with the increase experienced by the CPI during the previous year. However, the car parking charge is slightly higher than that of the general, due to the different factors involved in its determination.

In its virtue, on a proposal from Inente Public Airports Spanish and Air Navigation, I have:

First. With effect from 1 August 1992, the public prices for aircraft parking, fuel and lubricant supplies, infrastructure use, car parking, administrative concessions will enter into force. Special authorisations and the provision of certain services, developed at airports managed by the Public Authorities of Spain and Air Navigation.

Second.

For the interpretation of the terms referred to in this Order, the following definitions shall be taken into account.

Payload:

Cargo of passengers, baggage, goods and mail, carried on the aircraft.

Landing:

Act of exiting an aircraft after landing, except for crew members or passengers who continue the journey during the next stage of the same direct flight.

Boarding:

Act of boarding an aircraft for the purpose of starting a flight, except for those crew members or passengers who have embarked on one of the previous stages of the same direct flight.

Commercial Scale:

Stop the purpose of which is the loading or unloading of the payment.

Technical scale:

Scale or landing for purposes other than boarding or landing of payment.

Time between Calzos:

The time of the aircraft to stay, counted from the moment when the aircraft stops at the parking point, until it is put into motion.

Direct flight:

A certain operation of the aircraft that the operator identifies in its entirety by designating it with the same symbol from the point of origin, via any intermediate points, to the point of destination.

Third. For the purposes of applying the public prices set out in this Order, the classification of Spanish airports will be as follows:

A. Aircraft parking fee

The use of airport-enabled aircraft parking zones will have the following tariff:

A. 1. The fee for the use of the parking lot of aircraft, per day or fraction of parking time greater than three hours, shall be as follows:

A. 1.1. Airports in Madrid-Barajas, Barcelona, Palma de Mallorca, Gran Canaria, Málaga and South-South.

a) Portion of weight up to 10 metric tons: 800 pesetas.

b) Portion of weight between 10 and 100 metric tons: 93 pesetas for each metric ton or fraction that passes from 10 metric tons.

c) Portion of more than 100 metric tons: 103 pesetas per metric ton or fraction passing 100 metric tons.

A. 1.2. Other airports:

a) Weight Portion up to 2 metric tons:

160 pesetas.

b) Portion of weight between more than 2 and 10 metric tons: 800 pesetas.

c) Portion of weight between 10 and 100 metric tons: 93 pesetas for each metric ton or fraction that passes from 10 metric tons.

d) Portion of more than 100 metric tons: 103 pesetas for each metric ton or fraction that passes from 100 metric tons.

However, when the parking time starts to be counted between the twenty-two and the one fifty-nine hours local time, the above rate shall be applied, per day or fraction of the higher parking time. Six hours.

This fee shall not be required for aircraft whose contact with the runway is between two and seven fifties and nine hours local time, provided that before seven fifties and nine hours local time of the same day, start a maneuver that does not involve a new parking lot.

A. 2 Aircraft car parks whose parking is due to special court situations, such as suspension of payments, bankruptcy, competition of creditors, or abandonment of the aircraft, shall pay 50 per 100 of the established price in paragraph A. 1 above, this fee shall be applied to A. 2, from the date on which the judicial authority or the competent bodies communicate the commencement of such special judicial situation or the abandonment of the aircraft.

To apply the above price it will be necessary for the aircraft during the parking period not to perform any take-off or landing operation and not to occupy a telescopic or hangar gateway position.

For the application of paragraph A. 1 and A. 2, the time between the chocks shall be considered as the time of parking. Each parking lot will be computed for uninterrupted periods of commercial or technical scale time, starting a new parking lot after each landing.

They will be obliged to pay the rates A. 1 and A. 2, the Companies, Organisms and individuals whose aircraft are stationed in the zones that are enabled to the effect in the airports.

In the event that an aircraft landing at an airport on behalf of an operator and, after a certain time of parking due to both operational and judicial reasons, was chartered by a different operator of the on arrival, the accumulated debt outstanding for the non-settled parking lots shall be satisfied in any case before the departure of the aircraft.

B.

Fuel and Lubricant Supply Rate

The tariff for the special use of the airport public domain for the transport and supply of fuels and lubricants, whatever the mode of transport or supply, will be the next in all the airports:

Aviation gasoline: 0.771 pesetas per litre supplied.

Querosine: 0.453 pesetas per litre supplied.

Oil: 0.771 pesetas per litre supplied.

You will be obliged to pay this fee to the Entities supplying the products.

C. Tariff for the use of infrastructure and additional airport facilities

The tariff will be applied for the use of airport terminal areas not accessible to visitors, as well as for complementary airport services and facilities.

This fee will be required at the time of the departure of the passengers.

For the purposes of the application of this tariff, all passengers who do not have the consideration of crew will have the consideration of passengers.

The passengers of a direct flight that stops at a Spanish airport and do not disembark at a Spanish airport will not be obliged to pay this fee.

Passengers who embark on a Spanish airport will be obliged to pay this fee, regardless of the intermediate stages that may be carried out and the destination of the flight.

The amount of this fee will be considered included in the price of the transport, and the particular, Agency or Air Carrier Carrier will liquidate the Public Authority Spanish Airports and Air Navigation.

In order to make this tariff effective, all the airlines operating in the Spanish airports must deliver at the corresponding airport offices, for each departure flight and immediately prior to this, the document called the Statistical Form of Air Traffic F. 1, accompanied by the Load Manifesto, duly completed both; all without prejudice to the provisions of paragraph 4 of this Order.

The rate will be 860 pesetas per passenger of departure in international flight, and 580 pesetas per passenger of departure in domestic flight.

D. Car parking

This tariff includes the use of the parking areas of vehicles established at the airports, operated directly by the Public Agency and Air Navigation, regulated by the clauses the rates of the car parks managed under the concession scheme.

The fees for car parks managed by the Public and Spanish Airports and Air Navigation will be as follows:

D. 1 General rate.

D. 1.1 Airports of Barcelona and Madrid-Barajas:

Cars:

Every hour or fraction: 150 pesetas.

Maximum for twenty-four hours: 950 pesetas.

Buses:

Two first hours or fraction: 325 pesetas.

Every next hour or fraction: 150 pesetas.

Maximum for twenty-four hours: 1,575 pesetas.

Per month: 12,650 pesetas.

Motorcycles: Per day or fraction, 100 pesetas.

D. 1.2 Airport Rest:

Cars:

First two hours or fraction:

125 pesetas.

Every next hour or fraction: 100 pesetas.

Maximum for twenty-four hours: 900 pesetas.

Buses:

Two first hours or fraction: 325 pesetas.

Each next hour or fraction:

150 pesetas.

Maximum of twenty-four hours:

1,575 pesetas.

Per month: 12,650 pesetas.

Motorcycles: Per day or fraction, 100 pesetas.

In the event that you are unable to present the car park the time of the vehicle's removal, the parking fee will be the equivalent of five days of stay.

D. 2 Fare for car dealers and airline companies.

The areas specially indicated by the airport may be used for the parking of the vehicles of the staff of dealers and of airlines, with the following rates per vehicle:

Vehicle and airline personnel vehicles, with parking authorization issued by the airport security office: 2.325 pesetas/month.

The rates in this section are considered with taxes included.

E. Administrative Concessions

E. 1 Administrative concessions of land and paved surfaces.

The present rate exclusively includes the use of land areas, urbanized or not, as well as the paved surfaces transferred under concession, being for the account of the concessionaire any other expenditure by consumption, services or supplies derived from this concession, which are provided by the Public Aviation and Air Navigation directly or indirectly.

For the purposes of the application of this tariff, it is considered urbanized land that has in them or in their proximity access roads, supply and evacuation of water, supply of electric power, or they are easy connection to the general facilities.

For the purposes of the application of this tariff, it is considered undeveloped land that does not have the characteristics mentioned in the previous paragraph.

For the purposes of applying this tariff, land, urbanized or not, is considered to be paved areas, which for the airport do not have the condition of buildables, whose main characteristic or whose primary value consists of the arrangement of a paved infrastructure by slabs, asphaltic irrigation or similar material, and whose preferred use is the parking of vehicles in general, of stairs, forks and other useful ones of , or of installation The invention relates to a method for the use of said device

In addition, where the land or areas are dedicated to building in whole or in part on the parcel subject to concession, the fee resulting from the application of the above tariff shall be increased by the amount resulting of the total constructed area (sum of the surfaces of all the plants and basements built), by the 25 per 100 of the respective previous rates.

To the concessions whose contracts were in force at the time of the entry into force of the Resolution of 27 July 1990 fixing the rates of public prices as from 1 August 1990, they will be applied to the present rate, deducting the amount of the ground floor of the ground floor, until the expiry of the current contracts.

E. 2 Administrative concessions from offices, premises and counters.

The present rate includes exclusively the use of offices and premises of a preferential or non-preferential nature, and of counters of commercial activities other than those of invoicing, ceded in concession, being on behalf of the concessionaire any other expenditure for consumption, services or supplies derived from this concession, facilitated by the Public Agency Spanish Airports and Air Navigation directly or indirectly.

Any space open to the public for commercial, advertising or passenger care purposes, as well as for any other activity other than those referred to in paragraph E. 4, is understood by commercial counter.

E. 2.1 For administrative concessions that are contracted for annual periods, the rates to be applied will be as follows:

When these concessions are contracted for six-month periods, the fee will be increased by 25 per 100. In exceptional cases, the use of counters may be permitted for periods of one month, with the rate increasing in this case by 50 per 100.

E. 2.2 The airport authority may maintain available counters for assignment for uninterrupted periods of occupation. For the administrative concessions of counters which are contracted at the airports of Group A, for periods of less than one month the following tariffs shall apply:

Up to two hours of use:

265 pesetas/square meter/hour.

Each additional hour or fraction: 160 pesetas/square meter/hour.

The maximum amount per day will be 18,990 pesetas.

According to Article 27 of Law 8/1989, of Public Fees and Prices, the public price corresponding to this rate E. 2.2 will be required in advance.

E. 3 Administrative concessions for general and special hangars and hangars.

E. 3.1 The present tariff only includes the use of areas or premises designated for general storage, as well as hangars intended for the shelter of authorized aircraft, transferred under concession, For the account of the concessionaire any other expenditure for consumption, services or supplies derived from this concession, provided by the Public Agency Public Airports and Air Navigation directly or indirectly.

When these concessions are contracted for six-month periods the tariff will be increased by 25 per 100.

When the aircraft shelter in the hangars is carried out for periods of less than six months, the rate of paragraph F. 2 shall apply.

E. 3.2 The present rate includes the use of special storage rooms and rooms. Special storage means a warehouse equipped with refrigeration or storage rooms, an armoured structure or any other device or installation which has meant an additional investment.

E. 4 Billing counter administrative concessions.

The present rate exclusively includes the use of counters with a scale conveyor, with a rear belt without a scale, and without tape, transferred in a concession system, being on behalf of the concessionaire any other expenditure for consumption, services or supplies resulting from this concession, provided by the Public Aviation and Air Navigation directly or indirectly.

E. 4.1 For concessions to be contracted for annual periods, the rates to be applied shall be as follows:

When these administrative concessions are made for periods of six months, the fee will be increased by 25 per 100. In exceptional cases, the use of counters may be permitted for periods of one month, with the rate increasing in this case by 50 per 100.

At the airport of Barcelona, when, for operational reasons, the transfer of counters is not convenient during the twenty-four hours of the day, a reduced monthly fee will be applied, provided that the requesting company has scheduled flights continuously throughout the day and that it is technically possible to use the counter. The assignment schedule will be restricted to a maximum of fourteen hours and will be fixed for each counter during the same season.

For concessions that are contracted for annual periods, the rate to be applied will be E. 4.1, decreased by 15 per 100.

E. 4.2 The airport authority may keep check-in desks available for assignment for uninterrupted periods of occupation, with the following tariffs applicable:

a) Shown with scale conveyor:

Madrid-Barajas, Barcelona, Madrid-South and Palma de Mallorca:

1,150 pesetas/hour or fraction.

Rest of the airports: 2.305 pesetas/hour or fraction.

b) Shout with back tape, without a scale conveyor:

Madrid-Barajas, Barcelona, Madrid-South and Palma de Mallorca:

865 pesetas/hour or fraction.

Other airports: 1,190 pesetas/hour or fraction.

E. 5. Occupation or special use of the airport public domain by the commercial and business dealers of .

According to the provisions of article 24.1, a) of Law 8/1989, of 13 April, of Public Fees and Prices, the consideration of public price will be the use of private use or the special use of the public domain airport by the concessions for the holding of commercial holdings of any nature, as well as the authorizations of .

The corresponding fees or charges shall be the derivatives of the regulatory contracts, in accordance with the administrative procurement procedure for which they derive.

F. Special authorizations

F. 1. Use of non-delimited rooms and zones.

The present rate exclusively includes the use of non-delimited rooms and zones, not operated under concession, and for the user account all the services other than those normally offered in those services. The rooms of the Ente published Spanish Airports and Air Navigation.

The rates to apply will be as follows:

Up to three hours: 16,425 pesetas.

2. VIP room rates:

2.3 Room VIP/Issue:

Up to three hours: 50,550 pesetas.

3. Special room rates:

3.1 Room (Madrid/Barajas Airport):

Up to three hours: 46,080 pesetas.

Hourly or fraction: 13,825 pesetas.

The maximum rate per use of this room will not exceed 103,685 pesetas per day.

3.2 Room (Madrid/Barajas Airport):

Up to three hours: 23,040 pesetas.

Hourly or Fraction Time:

6,910 pesetas.

The maximum rate for use of this room will not exceed 51,845 pesetas per day.

3.3 Room (Madrid/Barajas Airport):

Usage price per person: 2,000 pesetas.

The rest of the Madrid/Barajas airport rooms are subject to the general tariff of paragraph 1 above.

F. 1.2 Use of spaces for commercial and/or promotional purposes in the airports of Madrid-Barajas and Barcelona.

Normal area: 6.330 pesetas/square meter/day.

Special area (air bridge and transit area): 10,550 pesetas/square meter/day.

In any case, the minimum daily billing for this fee will be 16,880 pesetas.

F. 1.3 Using unbounded zones.

Fixed per day: 16,425 pesetas.

According to Article 27 of Law 8/1989, the public prices corresponding to tariffs F. 1.2 and F. 1.3 will be required in advance.

F. 2 Aircraft Shelter

The present rate exclusively includes the use of hangars for the shelter of authorized aircraft, not operated under concession, being on behalf of the user any other expense for consumption, services or supplies derived from this use, provided by the Public Airport Spanish and Air Navigation directly or indirectly.

The use of hangars for aircraft shelter authorized for periods of less than six months will have a rate of 40 pesetas/day per square meter of floor area of the aircraft (size x length), with a minimum of 1,475 pesetas per day and aircraft, whichever is the category of the hangar and the airport.

When the use is for a period of more than six months, the tariffs corresponding to paragraph E. 3 shall apply.

F. 3 Film and film recordings and advertising and photo reports

The present rate exclusively includes the use of certain zones of an airport enclosure for the production of films, recordings and advertising and photographic reports.

When the filming, recordings or reports referred to in this fee involve the use of other services, supplies or consumption, these concepts will be invoiced in addition, according to the rates established in This Ministerial Order.

F. 3.1 Film recordings and recordings:

F. 3.2 Advertising and photographic reportages:

For each advertising or photo report: 29,015 pesetas.

According to Article 27 of Law 8/1989, the public prices corresponding to this rate F. 3 will be required in advance.

F. 4 Vehicle Access to Restricted Zones

The present rate includes the use and access of vehicles to the restricted zone of loading and unloading of goods, to the platform of parking of aircraft, to the area of movements and, in general, to the access routes restricted to public use.

The rate to apply will be as follows:

Annual Vehicle Credit:

170,910 pesetas.

Vehicle Access Canon (every time): 1,225 pesetas.

This fee will not apply to the vehicles of dealers and contractors whose access to the restricted zones is due precisely to the fulfilment of the obligations contracted with the Public Air Navigation.

According to Article 27 of Law 8/1989, the public prices corresponding to this rate F. 4 will be required in advance.

F. 5 Installation and operation of automatic vending machines and connection to the hotel information service.

This tariff includes the occupation of the airport public domain and the use of airport facilities for the installation and operation of automatic vending machines or machines for services or articles, as well as the installation of hotel information panels, being for the account of the operator any other expenditure for consumption, services or supplies provided by the Public Agency Public Airports and Air Navigation directly or indirectly.

Not included in these tariffs are the vending machines for beverages, food, tobacco and the recreational of chance, which will be regulated by the respective contracts of the main concession from which they derive, continuing the contracts The present day of the year.

F. 6 Installation and operation of terminal equipment for banking services.

F. 7 Other uses of the airport.

This rate includes exclusively the use of the public airport domain and its outdoor facilities, for tests, trials, demonstrations and exhibitions, of a non-aeronautical nature, and other uses other than those specified expressly in the other points of this paragraph, being on behalf of the user any other expenditure for consumption, service or supply arising from this authorization, including those of accompanying and/or security, provided by the Public Aviation and Air Navigation, or direct air navigation indirectly.

F. 7.1 Fee for use of the external airport enclosure to the perimeter fencing of the zone of movements.

For each hectare/day or fraction:

26,375 pesetas.

F. 7.2 Fee for use of the external airport enclosure to the perimeter fencing of the zone of movements for the installation of equipment, devices or any kind of measuring apparatus or data collection:

For each apparatus up to four square meters of occupancy of surface or fraction, 15,825 pesetas/month.

The use of this service will always be subject to the operational availability of the airport and the requirements of the airport authority in terms of safety measures and limitations of any kind.

According to Article 27 of Law 8/1989, the public prices corresponding to this tariff F. 7 will be required in advance.

F. 8 Use of advertising zones and facilities.

The present rate exclusively includes the occupation of the airport public domain in the use of the zones and advertising facilities available inside the airport, operated directly by the Ente Public Airports Spanish and Air Navigation, running on behalf of the contractor how many arbitrations, taxes and charges may correspond, as well as any other expenditure for services, consumption and supplies derived from this use, that are provided by the Public Aviation and Air Navigation, or direct air navigation indirectly. The advertising fees managed under the concession scheme shall be governed by the terms of his contract.

F. 8.1 The use of the advertising zones and facilities established in the Spanish airports operated directly by the Public Aviation and Air Navigation Airport will have the following rates for the Spanish airports. Group A airports:

F. 8.2 The use of the advertising zones and facilities established in the Spanish airports operated directly by the Public Transport and Air Navigation Agency, will have the following rates for the Group B airports:

The unit rates for annual or half-yearly periods expressed above are applicable only to groups of advertising support groups contracted by lots and in the seasons and zones established by the airport.

Exterior fence rates of 8 by 3 meters of maximum dimensions (square meters/month):

Rates per exposure platform (square meters/day): 425 pesetas.

Rates for advertising on luggage carriers (trolleys/month): 1,055 pesetas. The illuminated fences will have a surcharge of 25 per 100.

The data on the characteristics, measures and location of each of the support types included in this fee F. 8 are specified in the Annex attached to this Order.

You will be subject to the payment of a fee for the natural and legal persons who contract the use of the advertising zones and facilities.

According to Article 27 of Law 8/1989, the public prices corresponding to this tariff F. 8 will be required in advance.

G. Other services

G. 1 Using telescopic gateways.

This tariff includes the use of airport public domain and airport facilities to facilitate the boarding and disembarkation of passengers to air carriers through gateways. telescopic, or the simple use of a platform position that prevents the use of the corresponding gateway from other users. Past the first three hours will apply the above rates with a surcharge of 50 per 100. However, this surcharge will not apply to the nightly reduced hourly rate.

When the provision of a gateway service elapses between two or more tranches of different tarification, the value of the first service/hour shall be that corresponding to the rate of the time of arrival.

When, by finding an aircraft occupying a gateway position, the operating company requests in writing a remote parking position and no available or, for operational reasons, no available at that time The airport will be switched to the airport authority, the airport will disconnect the service from the runway and the time will be interrupted for the purpose of applying the tariff. When the health care service occurs during the time a passenger is subject to the travel insurance coverage contained in the ticket, that is, since you check in your luggage at the airport departure until the withdrawal on arrival, the benefit must always be done with the prior agreement of the airline or the charterer, since the amount of the invoice, in this case, must be satisfied by this one.

The following charges apply to the above rates:

If the provision of the ambulance service is made outside the municipality where the airport is located, the amount of the allowances provided for may be included in the invoice to the driver or other staff of Airports. G. 4 Fee for special use of platform and local load storage in the storage or storage service.

The present tariff only includes the use of the airport public domain in the cargo and unloading of goods.

G. 7 Accommodation at the airport hostel in Tenerife/North.

This fee includes the use of accommodation services at the airport hostel in Tenerife/North:

Double room: 3,455 pesetas.

Single room: 2,300 pesetas.

G. 8 Supply of electrical energy, water, air conditioning, cleaning service, garbage collection, deratization and other services, materials and miscellaneous products.

This rate includes the actual value of supplies, services, materials and products provided directly or indirectly by the airport, and the use of airport public domain in facilities and equipment necessary for the provision of the same.

The supply rate unit measured by

counter shall be obtained by dividing the amount of the periodic receipt submitted by the supplying company among the number of units of measure consumed, thereby applying a minimum increase of 12,5 per 100 for the use of the public domain in the facilities and equipment necessary for the supply.

G. 10 Power supply to 400 hertz.

The present rate includes the provision of the supply service to the electric power aircraft transformed to 400 hertz, by the airport equipment and facilities.

The rate for service delivery will be as follows:

Aircraft up to 150 metric tons of weight: 7,915 pesetas/hour or fraction.

Aircraft of more than 150 metric tons of weight: 10,550 pesetas/hour or fraction.

Companies, Agencies or individuals who receive the benefit of this service will be obliged to pay this fee.

When the provision of this service is carried out by occupying the aircraft at a telescopic gateway position, both services will be jointly provided as a single service, although they will be invoiced separately. rates for each of them.

Fourth. The Public Aviation and Air Navigation Agency may cease to provide any of the services referred to in this Order to those who are debtors of the same by any concept, except that, in accordance with Article 27 of the Law 8/1989, of 13 April, of Fees and Public Prices, the advance payment or the prior deposit of the amount of the service.

Fifth. The airport authority may require the submission of any supporting documents to the purpose of checking or settling the charges set out in this Order.

Sixth. The amount of the different charges shall be based on the amount of indirect taxes levied on the provision of the services which are the subject of those taxes, in accordance with the terms laid down in the current tax legislation.

Seventh. By way of derogation from the first subparagraph of this Order, the rate laid down in paragraph C of the third subparagraph shall not apply to passengers who are on board a Spanish airport for another Spanish airport until 1 January of this year. 1993.
