The adoption by the Council of the European Communities of Directive 90 /496/EEC of 24 September 1990 on the labelling of nutritional properties of foodstuffs makes it necessary to transpose it into the national legislation pursuant to Article 11 of that Directive.

The aforementioned Directive 90 /496/EEC and the Standard approving this Royal Decree have a dual purpose. On the one hand, to facilitate the establishment of the European market without frontiers in which the free movement of goods, persons, services and capital is ensured and, on the other, the protection of the health of consumers by improving their food, based on the knowledge of its basic principles and proper labelling of the nutritional properties of foods that contribute to the training of the consumer in order to make the choice of a diet suitable for their needs. In addition, nutrition labelling will encourage a higher incidence in the field of consumer food education.

Royal Decree 212/1992, of 6 March 1992, regulates the labelling, presentation and advertising of foodstuffs intended for the final consumer and contains the general provisions and definitions required in the labelling, which is why the accompanying Standard is limited to the provisions on nutrition labelling provisions.

This Royal Decree and the Standard that it approves are dictated by the provisions of Article 149.1.16. of the Spanish Constitution and of the jurisdiction attributed to the State by Article 40.2 of Law 14/1986, of 25 of April, General Health.

In its virtue, on a proposal from the Ministers of Health and Consumer Affairs, Industry, Commerce and Tourism, and Agriculture, Fisheries and Food, the sectors affected, prior to the mandatory report of the Inter-ministerial Commission for the Food Management, in agreement with the Council of State and after deliberation by the Council of Ministers at its meeting on 17 July 1992,

DISPONGO:

Single item.

The attached Labelling Standard on Nutritional Properties of the Food Products is approved.

Single additional disposition.

This Royal Decree and the Standard it approves are dictated by article 149.1.16. of the Spanish Constitution and pursuant to Article 40.2 of Law 14/1986, of 25 April, General of Health.

First transient disposition.

Without prejudice to the provisions of the second transitional provision, it shall be prohibited from 1 October 1993, the placing on the market of products which do not comply with the Standard to be approved by this Royal Decree.

Second transient disposition.

Until 1 October 1995, the provisions laid down in Article 5 (1) and (2) of the Labelling Standard on Nutritional Properties of Foodstuffs, which require the mention of all the Member States, shall not apply until 1 October 1995. nutrients, when on the labelling of nutritional properties they are mentioned on a voluntary basis or when a declaration of one or more of the following nutrients is made: sugars, saturated fatty acids, dietary fibre and sodium.

Single end disposition.

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".

Nutrition properties labeling rule for food products

Article 1. Scope of application.

1. This Standard regulates the labelling of nutritional properties of food products ready for delivery to the final consumer.

It will also apply to food products intended for restaurants, hospitals, canteens, and other similar collectivities.

All this without prejudice to what is established in the field of labelling in Royal Decree 2685/1976, of 16 October, approving the Technical-Health Regulations for the elaboration, circulation and trade of preparations foodstuffs for dietetic and/or special schemes and their amendments, as well as for specific legislation to be established by means of technical-health regulations in accordance with the provisions of the Annex to Royal Decree 1809/1991, December 13, for which the Technical-Health Regulations are amended mentioned.

2. It will not apply:

(a) To natural mineral waters or to other waters intended for human consumption.

b) To diet members/food supplements.

Article 2. Mandatory labeling.

The labelling of nutritional properties will be compulsory when on the label the presentation or advertising, excluding advertising campaigns relating to generic products, the indication that the product has nutritional properties. In the rest of the cases the labelling on these properties will be optional.

Article 3. Definitions.

For the purposes of this Royal Decree:

1. 'Nutrition labelling' means any information appearing on the label in relation to:

a) The energy value.

b) The following nutrients:

proteins.

Carbohydrates.

Fats.

Food fiber.

Sodium.

Vitamins and mineral salts listed in the Annex where they are present in significant quantities, as specified therein.

2. "Declaration of nutritional properties" means any indication and any advertising message that claims, suggests or implies that a food product has specific nutritional properties:

a) By the energy value it brings, in reduced or increased proportion, or stops contributing.

b) By the nutrients it contains, in reduced or increased proportion, or does not contain.

When the qualitative or quantitative mention of a nutrient is required by a specific regulation it does not constitute a declaration of nutritional properties.

3. 'Protein' means the protein content calculated using the formula protein = total nitrogen (Kjeldahl) x 6,25.

4. 'Carbohydrates' means all carbohydrates which are metabolised by the human body, including polyols.

5. "Sugars": All monosaccharides and disaccharides present in food, excluding polyols.

6. "Fats": All lipids, including phospholipids.

7. "Saturates": All fatty acids that do not have double bonding.

8. 'Monounsaturated': All fatty acids with a double cis link.

9. 'Polyunsaturated': All fatty acids with double cis bonds, cis separated by methylene group.

10. 'Food fibre' means a substance which, in accordance with the established Community procedure, is defined as such and the measurement of which is carried out using the method of analysis defined in accordance with that procedure.

11. 'Average value' means the value that best represents the quantity of a nutrient contained in a given food and which takes into account the tolerances for seasonal differences, consumption habits and other factors that may influence a variation of the value real.

Article 4. Statements supported.

Only declarations of nutritional properties relating to the energy value and nutrients referred to in Article 3 (1) (b) and substances belonging to one of the categories of the product shall be permitted. such nutrients or are components thereof.

Article 5. Modes of information on the label.

1. When the nutrition labelling is carried out, the information to be provided shall be for group 1, either group 2 and shall follow the order set out below:

A) Group 1.

a) Energy value.

b) Amount of protein, carbohydrates and fats.

B) Group 2.

a) Energy value.

b) Amount of protein, carbohydrates, sugars, fats, saturated acids, dietary fibre and sodium.

2. When making a statement of nutritional properties on sugars, saturated fatty acids, dietary fibre or sodium, the information to be provided shall be that of group 2.

3. Nutrition labelling may also include the quantity of one or more of the following substances:

-Starch.

-Polyalcohols.

-Monounsaturated.

-Polyunsaturated.

-Cholesterol.

-Any of the vitamins or mineral salts listed in the Annex and present in significant quantities, as specified therein.

4. Substances belonging to one of the categories of nutrients referred to in paragraphs 1 and 3 of this Article or which are components thereof shall be declared mandatory when those substances are the subject of a declaration of nutritional properties.

In addition, whenever the amount of polyunsaturated, monounsaturated or cholesterol is indicated, the amount of saturated fatty acids must also be indicated, although this indication will not constitute a statement pursuant to paragraph 2 of this Article.

Article 6.

Conversion factors for calculating the energy value to declare on the label.

The energy value that is declared will be calculated using the following conversion factors:

-Carbon water (except polyols): 4 Kcal/g = 17 KJ/g.

-Polyalcohols: 2.4 Kcal/g = 10 KJ/g.

-Protein: 4 Kcal/g = 17 KJ/g.

-Grases: 9 Kcal/g = 37 KJ/g.

-Alcohol (ethanol): 7 Kcal/g = 29 KJ/g.

-Organic acids: 3 Kcal/g = 13 KJ/g.

Article 7.

Quantitative presentation of information.

1. The declaration of the energy value and the nutrient content or its components must be made in numerical form, using the following units:

Energy:

-KJ and Kcal.

-Proteins: Grams (g).

-Carbon water: Grams (g).

-Grases (excluding cholesterol): Grams (g).

-Food fibre: Grams (g).

-Sodium: Grams (g).

-Cholesterol: Milligrams (mg).

-Vitamins and mineral salts: The units specified in the Annex.

2. The information must be expressed per 100 g or per 100 ml. In addition, such information may be given per unit quantified on the label or per portion, provided that the number of portions contained in the package is indicated.

The amounts mentioned must be those corresponding to the food, as it is sold. Where appropriate, this information may also be given in respect of the prepared food, provided that the specific instructions for preparation are indicated on the label in sufficient detail and the information relates to the food in the state. ready for consumption.

4. Information on vitamins and mineral salts should also be expressed as a percentage of the recommended daily amounts (CDR) set out in the Annex for the quantities specified in paragraph 2 of this Article.

The percentage of the recommended daily amounts (CDR) of vitamins and mineral salts may also be indicated in a graph.

5. Whenever the content of sugars, polyols or starch is declared, this declaration shall immediately follow that of the carbohydrate content as follows:

Carbohydrates/g hydrates, of which:

Sugars: g.

Polyalcohols: g.

Starch: g.

6. Whenever the amount, the type of fatty acids or the amount of cholesterol is declared, this statement shall immediately follow that of the total fat content, as follows:

Fats g, of which:

Saturadas: g.

Monounsaturated: g.

Polyunsaturated: g.

Cholesterol: mg.

7. The declared figures must be the average values obtained, as the case may be, from:

(a) The analysis of the food made by the manufacturer.

(b) The calculation made from the known or effective average values of the ingredients used.

c) Calculations from generally established and accepted data.

Article 8. Structure of information on the label.

1. The information on the labelling which is the subject of this Standard must be grouped together in one place, structured in a tabular form and, if space permits, with the figures in column. If there is not enough space, the linear form will be used.

The information will be put in visible place, in clearly legible and indelible characters.

2. The compulsory labelling of nutritional properties of foodstuffs marketed in Spain shall be expressed in the form laid down in Article 20 of the General Standard for Labelling, Presentation and Advertising of foodstuffs. Foodstuffs approved by Royal Decree 212/1992 of 6 March.

3. In foodstuffs which are presented without packaging for sale to the final consumer and restaurants, hospitals, canteens and other similar collectivities or in foodstuffs packaged in the places of sale at the request of the Buyer, together with the product, shall include a sign indicating in a clear manner all the data which the label should contain in the case where the product is packaged, as provided for in Article 5, expressed and structured in accordance with Article 5 (2) of Regulation (EC) No 75/2020. the provisions of Articles 7 and 8.

4. Products packaged by retail trade holders for immediate sale shall be accompanied by a label in accordance with the requirements set out in paragraph 3 of this Article.

ANNEX

Vitamins and mineral salts that can be declared and their recommended daily amounts (CDR):

Vitamin A (Retinol) μg: 800.

Vitamin D (Ergocalciferol or colecalciferol) μg: 5.

Vitamin E (Tocoferol) mg: 10.

Vitamin C (ascorbic acid) mg: 60.

Vitamin B1 (Tiamine) mg: 1.4.

Vitamin B2 (Riboflavin) mg: 1.6.

Vitamin B3 (Niacin) mg: 18.

Vitamin B6 (Pyridoxine or pyridoxal or pyridoxamine) mg: 2.

Vitamin B9 (folic acid or folates) μg: 200.

Vitamin B12 (cyanocobalamin) mg: 1.

Biotin mg: 0.15.

Pantothenic acid mg: 6.

Calcium mg: 800.

Phosphorus mg: 800.

Iron mg: 14.

Magnesium mg: 300.

Zinc mg: 15.

Iodo μg: 150.

As a general rule, to decide what constitutes a significant amount is considered a 15 per 100 of the recommended amount specified in this annex and supplied by 100 g or 100 ml or per package if it contains a single portion.
