In exercise or of the powers conferred by Article 10.2. (b) of Law 10/1990 of 15 October of the Sport, the Board of Directors of the Superior Council of Sports has definitively approved the Statutes of the Spanish Federation of Sports for Mentally Handicapped Persons and authorized their registration in the Registration of Sports Associations.

In compliance with the provisions of Article 31.7 of the Law of Sport and Article 12.3 of Royal Decree 1835/1991 of 20 December on Spanish sports federations, the publication in the Official Journal of the Spanish Status > of the Statutes of the same.

By virtue of the above, this Secretariat of State agrees to arrange for the publication of the Statutes of the Spanish Federation of Sports for Mentally Handicapped Persons contained in the Annex to this Resolution.

Statutes of the Spanish Federation of Sports for Mentally Handicapped

CHAPTER FIRST

General rules

NAMING, ASSOCIATIVE OBJECT, AND SPORTS MODES

Article 1. With the name of the Spanish Federation of Sports for Mentally Handicapped, a Sports Federation is constituted as a private associative entity, without profit and with legal personality and its own and independent patrimony of its associates.

Your anagram will be FEDEMPS.

Art. 2. The Spanish Federation of Sports for Mentally Handicapped is governed by the Law of Sport 10/1990, of October 15; by the Royal Decree of Sports Federations 1835/1991, of December 20; by Royal Decree 1591/1992, of December 23, on sports discipline; by the Order of 28 April 1992; by the present Statute; by its Regulations, and by the other rules of internal order which it validly dictates in the exercise of its powers.

Art. 3. The objective of the FEDEMPS shall be the qualification, organisation, defence and promotion of sport for the mentally handicapped in all its modalities and degrees. In addition to its own powers, it shall exercise administrative functions of an administrative nature, acting in this case as a contributing agent of the Public Administration.

Art. 4. The Spanish Federation of Sports for Mentally Handicapped Persons will be composed of the sports federations of regional autonomy, sports clubs, athletes and technicians who practice or contribute to the development of the sport for the disabled psychics.

Art. 5. The scope of action of the Spanish Federation of Sport for Mentally Handicapped People, in the development of the competences that they are themselves of defense and general promotion of the federated sport of state, extends to the whole of the territory national and its territorial organization is in line with that of the State in Autonomous Communities.

Art. 6. The Spanish Federation of Sports for Mentally Handicapped Persons is a public utility entity, in accordance with the provisions of Article 44 of the Law of Sport 10/1990, of October 15, and in Article 1. of Royal Decree 1835/1991 of 20 December 1991.

Art. 7. The head office of the FEDEMPS is established in the city of Madrid, street of O ' Donnell, number 31, first floor.

Art. 8. The FEDEMPS may establish other premises and facilities where their needs so require.

COMPETENCIES

1. Of a general character

Art. 9. The Spanish Federation of Sports for Psychic Handicapped, in addition to its own activities of government, administration, management, organization and regulation of the specialties of each sports modality, will exercise under the tutelage of the Council Top of Sports the following administrative functions of an administrative nature:

(a) Qualify, organize and authorize the official activities and competitions of a state nature for the mentally handicapped that are organized throughout the national territory. For these purposes, the organisation of such competitions is understood as referring to the regulation of the general framework of such competitions as laid down in the relevant federal rules.

b) To act in coordination with the Federal Federations for the general promotion of their sports modalities throughout the national territory.

c) Design, develop and implement, in collaboration, in their case, with the autonomic Federations, the plans of preparation of the high level athletes in their respective sports modalities, as well as participate in the drawing up of the annual lists of the same.

d) Design, elaborate and execute, in collaboration, in their case, with the autonomic Federations, plans and programs of sport adapted for the most severe and deep psychic disabled athletes.

e) To collaborate with the State Administration and the Autonomous Communities in the training of sports technicians and in the prevention, control and repression of the use of prohibited substances and pharmacological groups and methods regulations in sport.

f) to organise or protect official international competitions for the mentally handicapped who are held in the territory of the State.

g) Exercise the disciplinary authority of sport, in the terms established in the Law of Sport, its specific provisions of development and its Statutes and Regulations.

h) Exercise the control of the grants that are assigned to the clubs, Associations and Sports Entities under the conditions set by the Superior Council of Sports.

i) To execute, as appropriate, the resolutions of the Spanish Committee for Sports Discipline.

Art. 10. The Spanish Federation of Sports for Psychic Handicapped plays, with respect to its members, the functions of guardianship, control and supervision that the sports legal system recognizes.

Art. 11. The acts carried out by the Spanish Federation of Sports for Mentally Handicapped Persons in the exercise of public functions of an administrative nature are subject to appeal to the Superior Council of Sports, whose resolutions deplete the administrative route.

Art. 12. The sports modalities to which the Spanish Federation of Sports for the Psychic Handicapped serves the promotion and development are all those officially recognized and the criteria that will govern each one will come ready in their respective ones. Regulations.

Art. 13. Official state-wide competitions are open to athletes and sports clubs in the Autonomous Communities. In accordance with the Spanish Constitution and international standards, the FEDEMPS shall not permit discrimination on grounds of sex or social, political, religious or ideological reasons.

In the same way, it will not allow foreign interference of a sporting character in the sphere of its competence.

Art. 14. The athletes participating in the official sports competitions must be in possession of a sports license that will enable them for such participation.

2. International representation

Art. 15. The Spanish Federation of Sports for Mentally Handicapped will have the representation of Spain in the official sports activities and competitions of an international character and expressly organized for the mentally handicapped inside and outside the Spanish territory.

Art. 16. It is the responsibility of the Spanish Federation of Sports for Mentally Handicapped to choose the athletes who need to integrate national teams.

Art. 17. In order to organize, request or commit such activities or competitions, the Spanish Federation of Sports for Psychic Handicapped must obtain authorization from the Superior Council of Sports.

3. Of the Autonomous Federations

Art. 18. For the participation of its members in official or international sports activities or competitions, the sports federations of regional autonomy must be integrated into the FEDEMPS.

Art. 19. The Autonomous Federations will retain their legal personality, their own and differentiated assets, their budget and their particular legal regime, and they will be able to apply for their integration into this Spanish Federation of Sports for the Disabled. Art. 20. The Presidents of the Autonomous Federal Federations shall be part of the General Assembly of the FEDEMPS.

(a) In the event that the Autonomous Federation collects all or several of its disabilities within its Statutes, the representative valid for the Assembly of this FEDEMPS shall be the person representing in that Autonomous Federation to the group of mentally handicapped persons or persons designated by the Autonomous Federation of the Autonomous Community. In any case, only one representative may exist for each Autonomous Federation.

(b) The sporting disciplinary regime in the case of official state-wide competitions shall in any event be provided for in the Statutes and Regulations of the FEDEMPS irrespective of the disciplinary regime contained in the provisions in force in the respective autonomous areas.

c) The autonomous regional sports federations integrated into the FEDEMPS will be represented in the respective Autonomous Community.

Art. 21. There shall be no territorial delegation of the FEDEMPS in the territorial territorial area when the regional sports federation is integrated into the FEDEMPS.

(a) Where, in an Autonomous Community, there is no autonomous sports federation or has not been integrated into the FEDEMPS, the latter may establish in that Community in coordination with the sports administration of the territorial unity or delegation, while respecting the autonomy of the State.

(b) Representatives of these territorial units or delegations shall be elected in that Community on the basis of democratic and representative criteria. These criteria should be included in the corresponding Rules of Procedure, after a report by the Sports Administration of the Autonomous Community.

4. Of the Federations and International Organizations

Art. 22. The Spanish Federation of Sports for Mentally Handicapped Persons will be enrolled in the International Federation of Sports for Psychic Handicapped, with the express authorization of the Board of Directors of the Superior Council of Sports, as well as in any other international sports body for purposes similar to those of the Federation.

The FEDEMPS will also be able to establish contacts, study plans and collaboration programs with other organizations, entities and international institutions of other countries for the development and promotion of sport for mentally handicapped.

5. Licenses

Art. 23. For participation in activities or sports competitions at the state level, it will be necessary to be in possession of the official license that will be issued by the Spanish Federation of Sports for Mentally Handicapped with the following conditions:

(a) Abono of the corresponding quotas, whose economic conditions are set uniformly for each sports modality, in similar structure and category, and whose value will be established by the respective Assemblies.

The revenue generated by these concepts will be used to finance the structure and operation of the Spanish Sports Federation for Mentally Handicapped People.

(b) The Spanish Federation of Sports for Mentally Handicapped Persons shall issue the requested licences within 15 days of their application, after verification of compliance with the sporting requirements laid down for their purpose. issue in the relevant Regulation.

(c) Licences issued by the Federal Federations or Delegations shall enable such participation when they are integrated into the Spanish Federation of Sports for Mentally Handicapped Persons, within the minimum conditions of an economic and formal nature which it establishes and communicates its expedition to the Spanish Federation.

For these purposes, the habilitation will take place once the Federation of regional autonomy has paid to the Spanish Federation of Sports for Mentally Handicapped the corresponding economic quota within the deadlines to be fixed in the regulatory standards for the latter.

(d) Licences issued by the Sports Federations of the Autonomous Community which, as provided for in the preceding points, enable participation in official activities or sporting competitions State, at least, in the official Spanish language of the State.

e) The licenses to be issued have three economic concepts included:

1. Compulsory insurance as referred to in Article 59.2 of the Law of Sport 10/1990 of 15 October.

2. Quota for the Spanish Federation of Sports for Mentally Handicapped Persons.

3. Quota for the sports federations of regional autonomy.

f) The quotas for the Spanish Federation of Sports for Mentally Handicapped will be of equal economic amount for each sport modality, standard and category, and will be fixed by the Spanish Sports Federation for Mentally Handicapped.

CHAPTER II

Governance and representation organs

Art. 24. The governing bodies and representation of the Spanish Federation of Sports for Mentally Handicapped:

(a) The General Assembly, in whose bosom shall be constituted a Commission Delegate of assistance to it.

b) The President.

Art. 25. They are complementary organs of government and representation:

(a) The Board Of Directors.

b) The Secretary of the Federation.

c) The Manager.

For a better and more efficient performance, both in the FEDEMPS and in the Committees and Sub-Committees, Directorates and Commissions on a provisional or permanent basis, can be created.

Art. 26. It is the court of the FEDEMPS the Committee of Appeal.

Art. 27. The President, the General Assembly and its Delegate Committee will be elected bodies of the Spanish Federation of Sports for the Disabled. The other bodies shall be freely appointed and revoked by the President.

1. From the General Assembly

Art. 28. The General Assembly is the representative body of the Spanish Federation of Sports for Mentally Handicapped Persons, in which the natural persons and entities referred to in Article 4 may be represented. of these Statutes. Its members shall be elected every four years, coinciding with the years of the Summer Olympic Games, by free and secret, equal and direct suffrage, between and for each of the corresponding sports modality and according to the criteria and in the proportion which is laid down in the provisions for the development of Royal Decree 1838/1991 of 20 December 1991, in view of the peculiarities which identify this Spanish Federation of Sports for Mentally Handicapped Persons.

Art. 29. The General Assembly may meet in plenary session or in a delegated committee.

Art. 30. The Delegate Commission shall be elected by the General Assembly, which shall also be renewed, in the manner that it shall be determined.

Art. 31. It is for the General Assembly, in a plenary meeting, as necessary and independent of the provisions of the Statutes:

a) The approval of the annual budget and its liquidation.

b) The approval of the sports calendar.

c) The approval and modification of its Statutes.

d) The election and the end of the President.

Art. 32. The General Assembly shall meet once a year in plenary session, for the purposes of its competence. The other meetings shall be extraordinary and may be convened at the initiative of the President, the Commission delegated by a majority or a number of members of the General Assembly not less than 20 per 100.

Art. 33. The number of members of the General Assembly shall be set out in the provisions governing the call for elections and the vacancies produced therein may be covered in such a way as to be determined.

Art. 34. The sessions of the General Assembly may attend, with a voice but without a vote, the outgoing Presidents of the last term.

The deadline for the convocation of the ordinary General Assembly will be thirty days, being fifteen days for the extraordinary General Assembly.

2. From the Delegate Commission

Art. 35. It is for the Delegation of the General Assembly, regardless of what may be assigned to it in the Federative Statutes:

a) The modification of the sports calendar.

b) The modification of the budget.

c) The approval and amendment of the Regulations is the responsibility of the General Assembly's Delegation.

The modifications may not exceed the limits and criteria that the General Assembly itself establishes.

The proposal on these issues corresponds exclusively to the President of the Federation or two-thirds of the members of the Delegate Committee.

d) The preparation of a report prior to the approval of the budgets.

e) The monitoring of the sports and economic management of the Spanish Federation of Sports for Mentally Handicapped, by drawing up an annual report to the General Assembly on the Memory of Activities and the settlement of the budget.

Art. 36. The members of the Delegation, who shall be members of the General Assembly, shall be elected every four years by means of suffrage, with the possibility of replacing the vacant posts annually.

Art. 37. The composition of the Delegate Commission, with a maximum number of 15 members plus the President, will be as follows:

1. One third for the presidents or representatives of sports federations of regional territorial scope. This representation shall be designated by and among the Presidents of the same.

2. A third corresponding to the sports clubs, designated this representation by and among the same clubs, without those corresponding to the same Autonomous Community having more than 50 per 100 of the representation.

3. One third for the rest of the estates in proportion to their representation in the General Assembly.

Art. 38. The delegated Commission shall meet at least once every four months on a proposal from the President, and its mandate shall coincide with that of the General Assembly. It shall be convened at least seven days in advance.

3. From the President

Art. 39. The President of the Spanish Federation of Sports for Mentally Handicapped is the executive organ of the same. It holds its legal representation, convenes and presides over the governing and representation bodies and executes the agreements thereof.

Art. 40. He will be elected every four years, coinciding with the years of the Summer Olympics, by free, direct, equal and secret suffrage, by the members of the General Assembly. Candidates who may not be members of the General Assembly shall be presented, at least, by 15 per 100 of the members of the General Assembly, and their choice shall be produced by the double-lap system, in the case of a first No candidate shall reach the absolute majority of the votes cast.

Art. 41. The President of the Spanish Federation of Sports for Mentally Handicapped will also be the General Assembly and the Delegate Commission, with a vote of quality in the event of a tie in the adoption of the agreements of the General Assembly and of the Delegated Commission.

Art. 42. The position of President of the Spanish Federation of Sports for Mentally Handicapped Persons may be remunerated, provided that such an agreement, as well as the amount of the remuneration, is approved by half plus one of the members present in the Assembly General. The gross remuneration, including legally established social expenditure, cannot be satisfied by the public sports grants received by the Spanish Federation of Sports for Mentally Handicapped Persons.

Art. 43. It shall not be elected President who has held such a condition without interruption during the three periods immediately preceding it, whatever the actual duration of the periods.

Art. 44. The remuneration of the President concludes with the end of his term of office, not being able to extend such remuneration beyond the duration of the term.

Art. 45. The President shall cease by:

Course of the period for which he was elected.

Death.

Resignation.

Approval of a motion of censure by the plenary assembly of the Federation.

Serious illness that incapacitate you for the exercise of your office.

Having been convicted, by means of a firm court judgment that carries a penalty, principal or accessory, of disablement or special disqualification for the performance of public office.

Art. 46. 1. When the President ceases to be in office for having completed the time of his term of office, the Board of Directors shall be constituted as a Gestora Commission and shall convene elections to the governing bodies and representation of the FEDEMPS in accordance with the Rules of Procedure. The elections will be approved by the Board of Governors of the Supreme Council of Sports.

2. If the President ceases for any other cause, the process shall be limited only to the choice of who is to replace him, who shall hold the office for a time equal to that which he subtracted from fulfilling the replacement.

3. The time limit for the submission of applications and the conclusion of the Assembly shall be as appropriate as possible to the Rules of Procedure in force in the Olympic period concerned. In any event, the General Assembly shall take place within the maximum period of 30 days from the time of the cessation.

Art. 47. In cases of absence, temporary incapacity or temporary suspension, the President shall be replaced by the Vice-President, who shall be appointed by the First Vice-President, and who shall be a member of the General Assembly.

4. From the Board of Directors

Art. 48. The Board of Directors of the Spanish Federation of Sports for Psychic Handicapped is the collegiate body of the same, being its members appointed and revoked freely by the President.

The convening of the governing bodies and representation is up to the president, who must notify the members of the office, accompanied by the order of the day, with a deadline of 15 days, except for urgent cases.

Art. 49. They are members of the Board of Directors: The Vice President, the Technical Director, the Chair of the Medical Committee and three Vocals. They will attend Board meetings, the Secretary and the Manager, with voice but no vote.

The agreements of the governing bodies and representation of the Spanish Federation of Sports for Mentally Handicapped Persons will be adopted by a simple majority of assistants, except in those cases where expressly provided for This is a matter for the Laws and the present Statutes.

Art. 50. Members of the Board of Directors who are not members of the General Assembly shall have access to the sessions of the General Assembly with the right to a voice but without a vote. The Vice President shall replace the President in case of absence and shall be a member of the General Assembly.

Art. 51. The Board of Directors shall meet in ordinary session at least once every quarter, corresponding to the call to the President, who shall communicate it to its members at least seventy-two hours in advance, except for cases of urgency, accompanied of the order of the day.

The sessions convened in cases of urgency will always be extraordinary.

The validity of the sessions of the Board of Directors will require the first call by the majority of its members and, second, a third of them.

ELECTION OF GOVERNING BODIES AND REPRESENTATION

Art. 52. The elections to the General Assembly and President of the FEDEMPS shall be held every four years, coinciding with those in which the Summer Olympic Games take place.

Suffrage will be in any case free and secret and will be carried out by the various components of the different sports systems for the mentally handicapped.

Art. 53. The electoral processes for the election of the aforementioned bodies may be carried out as appropriate through the autonomous federal structures.

Art. 54. The electoral constituency for clubs and sportspersons shall be as set out in Article 7. of the Order of 28 April 1992 of Spanish Sports Federations.

The electoral constituency for technicians will be the state constituency.

Art. 55. The development of electoral processes shall be regulated in accordance with the provisions of the Order of 28 April 1992.

The FEDEMPS Electoral Regulation should at least regulate the following issues:

a) Number of members of the Assembly and distribution of the same by means.

b) Electoral Circunconstituencies and number of representatives of each unit for each of them.

c) Election calendar.

d) Electoral Census with the expression of official state-wide competitions and the criteria for the qualification of the same.

e) Composition, competencies and functioning of the electoral boards.

f) Requirements, deadlines, presentation and proclamation of candidates.

g) Procedure for resolution of disputes and complaints, to be resolved without delay.

h) Possibility of electoral resources.

i) Composition, competence and functioning of the electoral tables.

j) Election of the President in accordance with the provisions of Article 17 of Royal Decree 1835/1991 of 20 December (R. 1991, 3022), of Spanish sports federations.

k) Composition of the Assembly's Delegate Committee.

l) Vote by mail for the election of members of the General Assembly. This system may not be used for the election of the President or the Delegate Committee.

m) System of replacement of the casualties or vacancies that may occur and which may be carried out through alternates in each of the estamento and constituency or through the holding of partial elections.

n) At the time of the opening of the deadline for the submission of nominations for the election of President, the list of the members elected to the General Assembly shall be published. The deadline for the submission of nominations for the election of President shall not be less than 10 calendar days.

n) The President of the FEDEMPS and the members of the Delegation will be elected at the first meeting of the new General Assembly.

INELIGIBILITY AND INCOMPATIBILITIES

Art. 56. These will be causes that make it impossible to be chosen for the performance of management positions of the FEDEMPS:

1. Do not possess Spanish nationality.

2. Having been convicted by a firm criminal sentence bearing the principal or ancillary penalty of absolute or special disablement for public office.

3. To have been declared incapable by a firm judicial decision.

4. Be subject to sports disciplinary sanction that you disable.

Art. 57. 1. As long as he carries out his term of office, the President shall not be able to hold any office in another federal body, except in the case of his or her own, or Entity, Association or club subject to the federal discipline or the Spanish sports federation. is that of the psychic and will be incompatible with the activity as a sportsman, arbiter or coach, continuing in possession of his license, if he has it, that he will remain in suspense until he stops holding the presidency of the FEDEMPS.

2. The members of the Board of Directors shall not be able to perform any duties in another Spanish sports federation and shall apply to them the incompatibilities provided for in the previous paragraph, if they are athletes, referees or coaches.

Art. 58. The President, the members of the Board of Directors or any of the members of the administrative, technical or judicial bodies of the Federation who aspire to the Federal Presidency shall present the resignation of their posts at the beginning of the the electoral period.

ADMINISTRATIVE, TECHNICAL AND JURISDICTIONAL BODIES

1. From the General Secretariat

Art. 59. The President of the Spanish Federation of Sports for Mentally Handicapped Persons may appoint a Secretary who will exercise the functions of fedatary and Advisor and more specifically:

(a) To raise minutes of the sessions of the collegiate bodies of the Spanish Federation of Sports for Mentally Handicapped Persons, in the cases provided for in the Statutes and complementary rules.

b) To request the appropriate certifications of the acts of the governing and representation bodies.

c) How many functions are entrusted to him by the President and regulations of the Spanish Sports Federation for Mentally Handicapped People. In the event that he does not appoint Secretary, the President of the Federation shall be responsible for the performance of his/her duties, and may delegate them to the person deemed appropriate.

Art. 60. Of all the agreements of the collegiate bodies of the Spanish Federation of Sports for Mentally Handicapped Persons shall be drawn up by the Registrar, specifying the name of the persons who have intervened and the other circumstances which consider appropriate, as well as the outcome of the vote and, where appropriate, the special votes against the agreement adopted.

Art. 61. The votes against the agreement adopted or the reasoned abstentions shall exempt from the responsibilities which may be derived, where appropriate, from agreements of the collegiate bodies.

2. From the Technical Director

Art. 62. Given the multi-purpose and multiple nature of the FEDEMPS, and in the context of greater coordination, diligence and systematic collaboration, the figure of the technical director, whose post will be placed on a person elected by the President of the European Parliament, is created. Their roles are as follows:

a) Streamline and coordinate the meetings of the Committees.

b) Attend and act as Secretary of Proceedings in all technical meetings.

c) Report and provide the necessary documentation to the Committee of Competition.

d) Coordinate the execution of the tasks of the staff that is part of the Committees and Commissions, seeking the unification of methods, systems and criteria.

e) Responsible for the direction and control of the various sports programmes that are carried out from the FEDEMPS.

The position of Technical Director will be remunerated and will have the consideration of senior staff for the purposes of the Workers ' Statute.

3. From the Manager

Art. 63. Management is the administrative and economic management body and will be made up of the manager and the administrative staff that will be required.

Art. 64. The Manager will have the economic and administrative responsibility. Care will be taken to ensure that collection and payment operations of the FEDEMPS are properly carried out. It shall carry out the accounting and exercise the economic inspection of all the bodies of the FEDEMPS, jointly sign with the President all the documents of movement of funds and formulate the periodic balance sheets for submission to the Board of Directors. and the annual budget, the draft of which shall be drawn up with the Secretary-General.

The position of Manager will be remunerated and will have the consideration of senior staff for the purposes of the Workers ' Statute.

4. Of other administrative bodies

Art. 65. The President of the FEDEMPS, in the light of the federal needs, may create other charges and administrative bodies which he considers necessary for the best functioning of the same.

5. Of the technical bodies

Art. 66. The technical bodies of the FEDEMPS are:

(a) The Technical Committee.

b) The Medical Committee.

For the implementation, development and advice of the Board of Directors, the President may have other technical bodies that he considers necessary.

Art. 67. The Technical Committee, which shall be constituted by the Presidents of the National Committees of each sport modality, shall have the task of coordinating and composing the national calendar, designating the national teams, establishing the order of priorities for international participation, advising the Board of Directors

irective and propose the approved technical modifications of each Committee for ratification by the General Assembly.

Art. 68. The Technical Committee shall be chaired by the Technical Director of the FEDEMPS.

Art. 69. The Medical Committee is responsible for the medical advice, management and control of sports initiatives. It shall be composed of the respective medical advisers of the different autonomic Federations, under the chairmanship of the President of them, which shall be appointed by the President of the FEDEMPS and shall be a member of the Board of Directors.

6. Of the courts

Art. 70. The judicial and disciplinary body of the FEDEMPS is the Committee of Competition, which is autonomous and independent, and whose main task is to resolve, correct and punish, if there is a place, any infringements that may occur. in the various championships, competitions, official meetings, as well as to resolve the dispelled issues that arise in relation to the persons subjected to the federative discipline.

This Committee, and within its scope, will enjoy full freedom in the assessment and assessment of evidence, background and reports. The rulings made by this Committee will be executive.

Against the sanctions and actions of the Competition Committee, which ends the federative path, the Spanish Committee for Sports Discipline is an appeal.

Art. 71. In the Spanish Federation of Sports for Mentally Handicapped, the Committees will respond, both those that respond to the development of each specific sports modality covered by the Federation and those that attend to the the operation of the collectives and their members and those of a strictly sporting nature.

Art. 72. The Committees which are formed in the Spanish Federation of Sports for Psychic Handicapped, in principle are the ones listed below:

1. Athletics committee.

2. Basketball Committee.

3. Esqui Committee.

4. Handball committee.

5. Committee of Football Hall.

6. Swimming Committee.

7. Tennis Committee.

8. Table Tennis Committee.

9. Cycling committee.

10. Adapted Sport Committee.

There is also a Committee of Several Sports, which will have the same powers and privileges as the rest and will bring together those sports considered to be minority.

Art. 73. The Presidents of the Committee on the Rules of Procedure and the Sports Specialties referred to in the previous Article shall be chosen by the collective concerned in such a way as to lay down the rules of each Committee.

The other Presidents of the Committees shall be appointed by the President of the Spanish Federation of Sports for Mentally Handicapped Persons.

The Federative Regulations reflect their functioning and the competences delegated by the Spanish Federation of Sports for Psychic Handicapped in these Committees.

CHAPTER III

Administration and heritage

Art. 74. The Spanish Federation of Sports for Psychic Handicapped has its own system of administration and management of budget and patrimony, application of article 36 of the Law of Sport 10/1990, of October 15, with the following scope:

(a) They may take money on loan and issue securities representing debt or equity, provided that such legal businesses do not irreversibly commit the assets of the Federation and its social object in the terms and conditions outlined in the General Assembly.

(b) The lien or disposal of his immovable property shall require the authorization of the Delegation of the General Assembly with the quorum of two-thirds of its members. Where the amount of the operation is equal to or greater than 10 per 100 of its budget, it shall require approval by the Plenary General Assembly.

(c) It shall not commit multi-annual expenditure in its term of office without prior authorisation of the High Council of Sport; where the committed annual expenditure exceeds 10 per 100 of its budget, it shall require approval of the Plenary General Assembly.

(d) The budget administration will respond to the single cash principle, with its own revenue being devoted as a matter of priority to its expenditure on structures.

e) The accounting will be adjusted to the standards of adaptation of the General Plan of Accounting to the Spanish sports federations that the Institute of Accounting and Audit of Accounts of the Ministry of Economy and Finance.

Art. 75. The Spanish Federation of Sports for Psychic Handicapped will base its economic-financial regime on the following concepts:

a) Integration quotas to be set for effect.

b) Official grants from public and private bodies.

c) Economic assistance of Entities and public and/or private persons.

d) Short-and long-term loans to be agreed upon in the General Assembly.

e) The products of the property and rights that correspond to you in property, as well as the grants, legacies and donations that you can receive in a legal manner.

f) Any other means of income that is not prohibited by the Laws.

Art. 76. The Spanish Federation of Sports for Psychic Handicapped is obliged to present all the documentary information that is necessary to all the official bodies of the sport, including the Federations of autonomy and sports clubs.

Art. 77. Coinciding with the closing of the accounting year and/or the end of the sports season and within the period of one month must deliver the complete documentation regarding the activities of the previous economic-sports season with all the details of the operation and development of the same.

CHAPTER IV

Disciplinary regime

Art. 78. The infringements and penalties shall be fixed in accordance with Articles 76 and 79 of the Law of Sport 10/1990 of 15 October and consistent with Royal Decree 1591/1992 of 23 December 1992 on sports discipline.

Art. 79. In order to resolve any possible incidents, to correct and to sanction, if there is a place, the infringements which may occur in the various competitions or championships, the FEDEMPS shall adapt the present Statutes to the legal provisions of the in the period specified in the fourth transitional provision, the disciplinary rules of the Spanish Valides Federations shall apply, in general, to the rules laid down in the transitional provision.

In any case, for the sanction of disciplinary misconduct, the Regulations will be adjusted in everything established in Law 10/1990 and Royal Decree 1591/1992 on sports discipline.

CHAPTER V

Dissolution

Art. 80. The Spanish Federation of Sports for Psychic Handicapped will be extinguished for the following reasons:

a) By the revocation of your knowledge.

b) By judicial resolution.

c) By integration into other Federations.

d) For non-ratification within two years of registration.

e) For the other reasons provided for in the General Legal Order.

Art. 81. In the event of the dissolution of the Spanish Federation of Sports for Mentally Handicapped Persons, their net worth, if any, will apply to the carrying out of similar activities, determined by the Superior Council of Sports their specific destination.

Art. 82. These Statutes may be amended when the General Assembly agrees with the vote of its members in plenary.

Art. 83. They should also be modified in cases where the laws and official rules of the State are ordered.

Art. 84. Any modification made to them, necessarily with the approval of the General Assembly, shall be communicated to the Board of Governors of the Superior Sports Council for approval or refusal.

CHAPTER VI

Regulations

Art. 85. The questions or disputes arising between the members of the Spanish Federation of Sports for Mentally Handicapped Persons on the occasion of the application of sports rules not included in the present Statutes, in their Different Regulations or in the Law of Sport 10/1990, of October 15, may be subjected to the specific formulas of conciliation and arbitration in an extra-judicial way and will be governed by its own Rules that will be approved in the Assembly, although the grounds for recusal and abstention shall be the same as for the judicial bodies of the legislation in force in the field of sport.

ADDITIONAL PROVISIONS

First. -All the mentions contained in these Statutes to the Federations of the Autonomous Community must be understood as referring not only to those that integrate exclusively to the mentally handicapped, but to those that comprise all or some of the handicaps referred to in Article 1 (5) of Royal Decree 1835/1991 of 20 December 1991 on Spanish sports federations, in which the integration and representativeness will be limited to the collective of the mentally handicapped.

Second. The exercise of the rights of active and passive suffrage and the performance of the elected office that could correspond to the athletes with declared incapacity, and to the extent that it does necessary, will be exercised by the legal representatives of the disabled.

TRANSIENT PROVISIONS

First.-All autonomic Federations shall be considered as integrated in the FEDEMPS, unless otherwise expressed, during the period of one year, counting from the validity of these Statutes, in the course of of which they may exercise their right to do so.

All of these Federations that could be set up are also considered to be integrated, although the calculation of the deadline will start from their recognition by the corresponding Autonomous Communities.

Concluded that term, the Federations which would not have done so will be able to carry it out at any time in the form provided for in Article 19 of the present Statutes.

Second. -Within four months of the entry into force of these Statutes, the Management Board of the FEDEMPS shall draw up the corresponding Rules of Procedure, with the particulars contained in these Statutes, and in accordance with the Order dated 28 April 1992 which it will submit for approval to the Board of Governors of the High Council for Sport.

Exceptionally, for these first elections will have the status of electors and eligible the Sports Associations, sportsmen and technicians with the only requirement to be assigned or to be in possession of the FEDEMPS lycience the season in force on the date of the call for elections.

Third. -This FEDEMPS collects the possibility of jointly creating with the remaining Spanish Federations of Sports for the Disabled, as specified in article 1, point 5., of Royal Decree 1835/1991, a Confederation of national scope to be able to coordinate the activities common to them and to contribute to the extent that corresponds to the elaboration and presentation of the Statutes of this Confederation for approval to the Commission of the Superior Council of Sports.

Fourth. -Within six months, from the end of the electoral elections referred to in the second provision, the General Assembly must present a new Statute to the Board of Directors of the Superior Council of Sports, adapted to Law 10/1990, of 15 October, of the Sport; Royal Decree 1591/1992, of 23 December, on sports discipline, and other legal provisions of application.

Fifth. -As long as the standards of development referred to in Article 74 (d) of these Statutes are not dictated, the Spanish Federation of Sports for Psychic Handicapped, which has its own heritage and budget, it will adapt its accounts to the rules laid down for the General Accounting Plan, in accordance with the Order of the Ministry of Finance of 10 February 1984 and the Order of the Ministry of Culture of 20 December of the same year.

FINAL DISPOSITION

This Statute will enter into force on the day following its publication in the Official Journal of the State.
