The individual health card is defined, in Article 57 of Law 16/2003, of 28 May, of cohesion and quality of the National Health System, as an administrative document that credits certain data of its holder and facilitates the access of citizens to the benefits of the National Health System. The same law states that, without prejudice to their management by the Autonomous Communities and the National Institute of Health Management, in their respective territorial areas, the cards will include, in a standardised way, the basic data of identification of the holder of the card, of the right to which he or she is assisting in relation to the pharmaceutical and health service or health care service. It is also envisaged that the devices that the cards incorporate to store the basic information and the applications that treat it must allow the reading and verification of the data to be technically possible throughout the territory of the Status.

Moreover, the same Law 16/2003, of 28 May, entrusts the Ministry of Health, Social Services and Equality, the generation of a unique personal identification code for the National Health System, through the development of a database that collects the basic information of the users of the National Health System, in such a way that the Health Services have an exchange of information on the protected population, maintained and updated by the members of the system themselves. This allows compliance with Article 4 (c) of the aforementioned Law, which states that citizens have the right to receive from the health service of the autonomous community in which they are displaced. the catalogue of National Health System benefits that may require, under the same conditions and the same guarantees as citizens resident in that Autonomous Community.

In order to comply with the provisions of Law 16/2003 of 28 May, the Royal Decree 183/2004 of January 30, which regulates the individual health card, which contemplates the necessary standardization of data, was enacted. basic and the availability of the reading, throughout the territory of the State, of the devices that incorporate the cards to store the information. It also develops the creation of the population database protected by the National Health System and the allocation process and characteristics of the Personal Identification Code of the National Health System (CIP-SNS).

For its part, the Royal Decree-Law 9/2011, of August 19, of measures for the improvement of the quality and cohesion of the national health system, of contribution to the fiscal consolidation, and of elevation of the maximum amount of the For 2011, it provides, in Article 5, in relation to the individual health card, that, in order to articulate the provisions of Article 57 of Law 16/2003 of 28 May, the Government, in coordination with the health administrations, will establish the single and common format of valid health card for the entire System National of Health. In order to develop the provisions of the Royal Decree-Law 9/2011 of 19 August, the Interterritorial Council of the National Health System, at its meeting of 29 February 2012, approved the draft single and common health card format. individual valid for the entire National Health System.

In its virtue, on the proposal of the Minister of Health, Social Services and Equality, in agreement with the Council of State, and after deliberation by the Council of Ministers at its meeting on 20 September 2013,

DISPONGO:

Single item. Amendment of Royal Decree 183/2004 of January 30, which regulates the individual health card.

Royal Decree 183/2004 of January 30, which regulates the individual health card, is amended as follows:

One. Article 3 is worded as follows:

" Article 3. Common basic data and technical specifications of the individual health card.

1. In order to have standard data for each person, as a user of the National Health System, regardless of the title of the person accessing the right to health care and the health administration, all Health cards will incorporate a number of common basic data and will be linked to a unique personal identification code for each citizen in the National Health System.

2. The basic data to include in the health card front is:

a) The institutional identity of the autonomous community or entity that issues it.

b) The labels of "Spanish National Health System" and "Health Card".

c) Personal identification code assigned by the health administration of the card (CIP-AUT).

d) Name and last name of the cardholder.

e) Single personal identification code of the National Health System (CIP-SNS).

f) The identification code of the health administration of the card.

3. In the cases where the law is authorized, the management needs of the different health authorities shall be met, the number of the National Identity Document of its holder may be added to the health card. or, in the case of foreigners, the identity number of foreigners, the number of Social Security, the date of expiry of the card for certain groups or the telephone number of health emergency care, all of them in format standard. A photograph of the health card holder may also be included.

4. At the request of a party, or of its own office in those health administrations which provide it in its rules, the characters of the initial Individual Health Insurance Card shall be recorded in braille, in the lower right corner of the health card. (TSI).

5. The Ministry of Health, Social Services and Equality, in agreement with the Autonomous Communities and other competent public administrations, shall establish the necessary requirements and standards for the devices that the cards incorporate to store the basic information, and the applications that treat them must enable the reading and verification of the data to be technically possible throughout the territory of the State.

6. The specific characteristics, the standardised data and the structure of the magnetic band of the Individual Health Insurance Card shall be adapted to the specifications set out in the Annex. '

Two. Article 8 is amended as follows:

" Article 8. Groups insured through special schemes.

Each holder and beneficiary insured through special schemes will be issued with a health card, with the adjustments resulting from the characteristics of these insurance schemes, with computer support, with the basic characteristics defined in this royal decree including the assignment of a personal identification code of the National Health System. The data for that health card shall be incorporated into the information exchange system provided by the protected population database of the National Health System. '

The process of replacing the current cards will be carried out in a progressive manner, due to its renewal for any cause or new emissions, and must be finished before five years from the the entry into force of this royal decree, provided that the budgetary resources of the various competent public administrations so permit.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".
