Article 20.1 of the Organic Law 15/1999 of 13 December on the Protection of Personal Data and Articles 52 to 54 of its Implementing Regulation, approved by Royal Decree 1720/2007 of 21 December, states that The creation, modification or deletion of automated files of Public Administrations may be made only by means of a general provision published in the "Official Gazette of the State" or "Official Journal".

The instruction of the Spanish Data Protection Agency, of 8 November, on the processing of personal data for surveillance purposes through cameras or video cameras, published in the Official Gazette the State " of the day 12 December 2006, establishes that these files, when they are of public ownership, fall within the forecast established in article 20 of the Organic Law 15/1999, of 13 December, of Protection of Data of Personal Character.

By the Order of 27 July 1994, the personal data files of the State Tax Administration Agency were regulated, containing in two annexes the relationship and description of the different automated files; The Order was partially amended by the Order of 4 August 1995.

The Order of 21 December 1999, subsequently, came to replace the Annexes of the Order of 27 July 1994, in turn, as amended by Order HAC/2632/2002 of 16 October 2002 amending and approving the files of the State Tax Administration Agency, and whose unique additional provision authorizes its Director General, to create, modify or delete files owned by it.

The Resolution of 30 April 2008, from the Directorate General of the State Administration of Tax Administration, approved the creation of an automated file of personal data, which was published in an Annex.

Subsequently, by Resolutions of the Directorate General of the State Administration of Tax Administration of 25 May 2011 ("BOE" n. 134 of 6 June 2011) and 20 July 2012 ("BOE" n. 182 of 31 July 2012), amended and updated the Annex to the previous Resolution.

The resolution now being approved updates again the relationship of buildings of the State Tax Administration Agency in which there are surveillance media with image recording.

By virtue of that authorization, I have:

First.

The Annex to the Resolution of 30 April 2008, by the Directorate-General of the State Tax Administration Agency, which approves the creation of an automated file of personal data, is replaced by the following: which is listed as an annex to this Resolution.

Second.

This Resolution will enter into force on the day following its publication in the "Official State Gazette".

19. Video surveillance file of the State Tax Administration Agency.

a) Purpose and use: Recording and treatment of images for the internal and external security of persons accessing and transiting through the building of the Tax Office.

The intended use is the performance of security and surveillance tasks.

b) Persons and collectives: Natural persons who access or transit through the building of the Tax Office.

c) Data Collection Procedure: Recorded data is collected by video surveillance cameras by capturing images.

d) Basic structure of the file and types of personal data included in it: File of images obtained through video surveillance cameras and images obtained with them.

e) Data Cefunes: This data is not provided to any other Agency, or to third countries, except in its case to the State Security Forces and Corps.

f) Responsible for the file: Regional Security Chiefs of the State Administration of Tax Administration and Assistant to the Coordinator of the Security Area of the State Administration of Tax Administration, in their corresponding areas of competence.
