In application of the mandate, contained in article 138.1 of the Spanish Constitution, to deal with the circumstances of the island, a system of compensation for the marine and air transport of goods with origin or destination in the Canary Islands, the purpose of which is to compensate for the cost of goods traffic as a result of the remoteness of the archipelago of the mainland and the European Union.

Law 19/1994, of July 6, of modification of the Fiscal Regime of the Canary Islands, provides for the establishment of an annual consignment in the General Budget of the State for the attention of the island, with the objective of making the effective cost of maritime and air transport of goods between the islands and with the rest of Spain, as well as the transport of exports to the European Union, establishing that the system of granting such compensation is determine regulations.

This compensation scheme, in respect of goods not covered by Annex I to the Treaty establishing the European Community, has been regulated by Royal Decree 362/2009 of 20 March 2009, as amended by the Royal Decree of 20 March 2009. Decree 350/2011 of 11 March.

The order now approved is due to the need to comply with the provisions of the aforementioned royal decree, in which Article 7.2 expressly states that, for the purposes of delimiting the maximum eligible amount, they shall be drawn up Each year, for the air traffic, the type costs for the inter-island traffic and for the Canarias-Cádiz route, in the case of the maritime traffic, and Canarias-Barajas. For its part, the third paragraph of the same article specifies that the determination of these costs will be carried out by the Ministry of Public Works, which must ask for the necessary information from the independent operators acting in the routes.

In its virtue, I have:

First. Determination of type costs.

The standard costs for transport carried out in the year 2012, as referred to in Article 7.2 of Royal Decree 362/2009 of 20 March 2009 on compensation for the carriage of goods by sea and air not covered by Annex I to Regulation (EC) No 362/2009. Treaty establishing the European Community, with origin or destination in the Canary Islands, shall be fixed, for inter-island traffic and for the Canary-Cadiz route, in the case of maritime traffic, and Canarias-Barajas, in the air, as well as for the different transport units commonly used, in the amounts specified in the attachment of this order.

Second. Single final disposal. Entry into force.

This order will take effect the day following your publication in the "Official State Bulletin".
