Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure, promotes the use and application of electronic means and techniques in public administrations. for the development of its activities and the exercise of its powers. Furthermore, subsequent regulatory developments have extended this provision, namely Royal Decree No 209/2003 of 21 February 2003 on the regulation of telematic registers and notifications, as well as on the use of media telematic systems for the replacement of the contribution of certificates by citizens. Finally, Law 11/2007, of 22 June, of electronic access of citizens to public services, recognizes the right of citizens to interact electronically with the Administration for the exercise of the rights foreseen in the Article 35 of Law 30/1992 of 26 November 1992 on the Legal Regime of Public Administrations and the Common Administrative Procedure.

In this regard, Law 11/2007, of 22 June, of electronic access of citizens to public services, in its articles 24, 25 and 26, establishes the obligation to create electronic records for the reception and referral of applications, writings and communications. In turn, Article 27 of Royal Decree 1671/2009 of 6 November 2009, which partially develops Law 11/2007 of 22 June 2009 on the electronic access of citizens to public services, regulates the creation of electronic registration, establishing that "electronic records shall be created by Order of the corresponding Minister or Resolution of the holder of the Public Body, which shall be published in the" Official Gazette of the State "", determining the minimum content of this standard creation.

For compliance with the above, the corresponding draft resolution was prepared by the Port Authority of Valencia. In accordance with Article 4.3 of Order FOM/716/2009 of 4 March, which regulates the composition and functioning of the Ministerial Committee on Electronic Management, the draft has been informed by the Commission on 4 April of this year. 2013.

According to the competition attributed to him by article 30.5.c) of the Royal Legislative Decree 2/2011, of 5 September, for which the recast text of the Law of Ports of the State and the Merchant Navy is approved, corresponds to the Board of Directors of the Port Authority of Valencia the creation and regulation of the electronic headquarters of the agency. To these effects, the Board of Directors of the Port Authority of Valencia dated June 24, 2013, agreed to delegate to Mr. President the signing of all documents necessary for the implementation and operation of the Headquarters Electronic Port Authority.

In its virtue, I resolve:

Article 1. Object and scope of application.

The purpose of this resolution is to create the electronic register of the Port Authority of Valencia (hereinafter also electronic registration).

Through the electronic registration service, the reception and referral, by electronic means, of requests, writings and communications directed to the organs and departments of the Port Authority of Valencia, will be possible. in accordance with the provisions of Article 24 of Law 11/2007 of 22 June 2007 on the electronic access of citizens to public services and Article 27.1 of Royal Decree 1671/2009 of 6 November 2009, for which the Law. The procedures that are included in the scope of the electronic register and which may be processed through such registration are set out in the Annex to this resolution.

The electronic register will have the character of general registration of the Port Authority of Valencia, in accordance with the provisions of Article 12 of Royal Decree 772/1999, of 7 May, which regulates the presentation of applications, written and communications to the General Administration of the State, the issuing of copies of documents and the return of originals and the arrangements for the registration offices.

Article 2. Identification of the organ or unit responsible for its management.

The Archive and Registry Unit of the General Secretariat of the Port Authority of Valencia will be in charge of the management of the electronic register.

The technology and IT management of the electronic register will be the responsibility of the Information Systems Department of the Port Authority of Valencia.

Article 3. Official date and time and reference to the calendar of business days.

The official date and time will be those of the electronic headquarters. The timing of the date and the time of the headquarters of the Port Authority of Valencia will be carried out with the Royal Institute and Observatory of the Navy, in accordance with the previewed on the legal hour in article 15 of the Royal Decree 4/2010, of 8 of January, by which the

Having regard to the territorial scope over which the Port Authority of Valencia exercises its powers, the calendar of the indefable days of its electronic registration will be determined, for each year, in the resolution published in the Official Gazette of the State by the Ministry of Finance and Public Administrations, which establishes the calendar of working days, for the purposes of calculating deadlines, in the General Administration of the State, as well as the calendar of industrial parties that for the Autonomous Community of Valencia and the town of Valencia, in It is published annually by the Autonomous Administration in the Official Journal.

Electronic registration shall be governed, for the purposes of time limits, by the provisions of paragraphs 3, 4 and 5 of Article 26 of Law 11/2007, of 22 June, on the electronic access of citizens to public services.

Article 4. Competent body for the approval of the relationship of standardised electronic documents and the identification of the procedures and procedures to which they relate.

The competent body for the approval and modification of the list of standard electronic documents admitted by electronic registration and identification of the procedures and procedures to which they relate shall be the Director General of the Port Authority of Valencia.

Article 5. Means of submission of supplementary documentation.

The electronic register may, on the initiative of the persons concerned or on the basis of a prior request, provide additional documentation to a previously submitted communication, written or application, provided that comply with the standards of format and safety requirements established by Royal Decree 3/2010 of 8 January, which regulates the National Security Scheme and Royal Decree 4/2010, which regulates the National Scheme of Interoperability.

Article 6. Electronic signature of citizens.

For the submission of applications, writing and communications in the electronic register, the citizens, in accordance with the provisions of Article 10 of Royal Decree 1671/2009, must sign electronically the same. To this end, they will be able to use both the electronic signature systems incorporated in the National Identity Document, as well as those systems specifically recognized by the Port Authority of Valencia as valid, according to the provisions of the Article 13 (2) of Law 11/2007.

The electronic signature systems validly admitted by the electronic register of the Port Authority of Valencia shall be those expressly indicated in the electronic headquarters that are admitted for this purpose.

Article 7. Proof of application submission.

Finalized the procedure for submitting a request, written or communication through the electronic register of the Port Authority, will automatically issue by the same means a receipt signed electronically containing, inter alia, a copy of the document, communication or application submitted, the date and time of the submission, the registration number and, where appropriate, the listing and description of the documents attached to the submission form or document presented, followed by the electronic footprint of each of them.

Article 8. Accessibility requirements.

With regard to the provisions of Article 5 of Royal Decree 1494/2007 of 12 November 2007 on the basic conditions for the access of persons with disabilities to technologies, products and services related to the information society and social media, and in compliance with it, in the electronic headquarters of the Port Authority of Valencia, in the section of Accessibility, will specify the degree of accessibility to the content of the electronic register, in the terms set out in that Article.

Single transient arrangement. Operation of the electronic register.

The electronic record that is created by this resolution shall begin to operate within a maximum of one month from the publication of the same in the "Official State Gazette".

Final disposition first. Habilitation in Mr Director.

Without prejudice to the power delegated to the Presidency, the Director of the Port Authority of Valencia is hereby authorised to adapt the electronic register to the applicable rules and to amend the content of the Annex, before mentioned, as well as to approve new standard and preprinted models and, in any case, to the inclusion of new procedures within the scope of the competence of the Harbour Authority in the context of what the Royal Decree has in this respect 1671/2009.

Final disposition second. Entry into force.

This resolution shall enter into force on the day following that of its publication in the "Official State Gazette".
