The regulation of the contribution of users and their beneficiaries in the outpatient pharmaceutical provision is included in Article 94 bis of Law 29/2006 of 26 July on guarantees and the rational use of medicinal products and medical devices.  Law 29/2006 of 26 July provides for a rate of contribution on the sale price of medicinal products, proportional to the level of income of the user, between 60% and 10% with contributions ceilings for certain categories of medicines and insured persons with the aim of ensuring the continuity of treatments of a chronic nature, and with an exemption for certain types of users and their beneficiaries.

In accordance with the provisions of Law 29/2006 of 26 July, medicinal products belonging to the reduced-contribution ATC groups are provided with a contribution of 10% of the PVP with a maximum contribution to be updated, automatically, each month of January in accordance with the evolution of the CPI. The update will be formalised by resolution of the pharmacy responsible for the Ministry of Health, Social Services and Equality.

On the other hand, the additional six-seventh provision of Law 17/2012 of 27 December, of State General Budget for the year 2013, provides that the update of the ceilings for the amount of the contribution monthly of the users in the supplementary common portfolio of the National Health System referred to in Article 8b of Law 16/2003, of 28 May, of cohesion and quality of the National Health System, is carried out automatically, every month January on the basis of the consumer price index for the previous 12 months. This update shall be made public by resolution of the competent unit of the Ministry of Health, Social Services and Equality.

At present, the maximum amount of participation in the payment to be paid by the citizens for the reduced-contribution medicines is set at EUR 4.20, in accordance with the provisions of the Resolution of 21 January 2013, of the General Directorate of the Basic Portfolio of Services of the National System of Health and Pharmacy, for which the update of the maximum amount corresponding to the drugs belonging to the ATC groups of contribution is obtained reduced, and the maximum monthly contribution limits for the persons holding the condition of insured persons as Social Security pensioners and their beneficiaries in the outpatient pharmaceutical provision.

By the aforementioned Resolution of 21 January 2013, from the General Directorate of the Basic Portfolio of Services of the National System of Health and Pharmacy, the maximum applicable contribution for the drugs was updated. belonging to the reduced-contribution ATC groups, in accordance with the increase in the CPI in the period between April and December 2012, and to update the maximum monthly contribution limits for persons holding the condition of insured persons as Social Security pensioners and their beneficiaries in the provision Outpatient pharmaceutical, in accordance with the increase in the CPI in the period between August and December 2012.

By this resolution, the maximum applicable contribution for medicinal products belonging to the reduced-contribution ATC groups should be updated, in accordance with the increase in the CPI in the period covered by the between January and November 2013, and update the maximum monthly contribution limits for persons holding the status of insured persons as Social Security Pensioners and their beneficiaries in the outpatient pharmaceutical provision, of agreement with the increase in the CPI over the same period.

By virtue of the provisions of Law 29/2006 of 26 July on the guarantees and rational use of medicinal products and medical devices and Law 17/2012 of 27 December 2013 on the General Budget of the State for the year 2013, by means of the This resolution is applicable to:

First.

Set the maximum contribution for medicines belonging to the reduced-contribution ATC groups by EUR 4.26.

This maximum contribution shall also apply to the medical devices included in the pharmaceutical supply belonging to the reduced-contribution groups.

It will also apply to the participation in the payment to be paid by the AIDS patients, of the drugs financed by the National Health System dispensed through official prescription.

Second.

Update the maximum monthly contribution limits for persons holding the status of insured persons as Social Security Pensioners and their beneficiaries according to the income entered in the liquidable base box General and the saving of the Income Tax declaration of the Physical Persons:

(a) Income less than EUR 18,000: maximum monthly contribution limit EUR 8.26.

(b) Income equal to or greater than EUR 18,000 and less than 100,000: maximum monthly contribution limit EUR 18,59.

(c) Income exceeding EUR 100,000: maximum monthly contribution limit EUR 62.00.

Third.

The provisions of the above points shall begin to have effect from 1 January 2014.
