The Higher Council of Physical Education and Sports of the Armed Forces, created by Order 601/1979, of January 19, finds its current regulation, after various complementary norms of the previous one, in Order 12/1988, of 11 of February.

By Order 487/1980, of January 31, the Civil Guard Corps is represented in the Higher Council of Physical Education and Sports of the Armed Forces.

Since the last Council regulation until today, Law 17/1989, of 19 July, Regulation of the Regime of the Professional Military Personnel; 10/1990, of 15 October, of the Sport, and Organic 13/1991, of 20 of 20 of In November, the Military Service, as well as Royal Decree 765/1992, of 26 June, of basic organic structure of the Superior Council of Sports. Provisions all of them that, in one way or another, have an impact on the Higher Council of Physical Education and Sports of the Armed Forces.

This impact and the conclusions drawn from the experience gained over the years of the Council's action and through the relations it has maintained with other sporting bodies, advise to modify its organisation. and functions to improve the practice and promotion of physical education and sport in the Armed Forces.

Pursuant to the above, in accordance with the Minister of the Interior as regards the Civil Guard Corps and with the approval of the Minister for Public Administrations, I have:

First. Definition.-The Higher Council of Physical Education and Sports of the Armed Forces, an organ attached to the Secretariat of State of Military Administration and hierarchically dependent on the Minister of Defense, exercises the powers of the Ministry of Defence in the fields of physical education and sport, in accordance with the provisions of the following paragraphs.

Second. Functions. -They are the functions of the Higher Council of Physical Education and Sports of the Armed Forces:

(a) Define the general objectives of the activities to be developed in the areas of competence that are attributed to and coordinate those activities when they are interarmies or have national or international projection.

b) To know the constitution of the Central Boards of Physical Education and Sports of the Armies and Civil Guard, coordinate and monitor their regulations, grant them the economic grants that come and check the appropriate application of these to the purposes for which they have been granted.

(c) Establishing appropriate and appropriate relationships with institutions, bodies and entities, national or foreign, competent in the field of physical education and sports, designate representations to each other and direct the performance of these representations.

d) Approve national or international military competition programs and corresponding budgets.

e) Qualify the character, national or interarmies, of the official military competitions.

f) Authorizing or denying the celebration in Spanish territory of international military sports competitions and the participation of Spanish military teams in international competitions.

g) Officially acknowledge the existence of military sports modalities and approve the corresponding competition regulations.

(h) Develop proposals in order to establish lessons for the members of the Armed Forces to obtain the qualifications of sports technicians who are deemed appropriate in the framework of the definitions referred to in point (a) of this paragraph.

i) Promote and promote scientific and technical research on matters related to physical education and sport, through the corresponding proposals.

j) Advise the relevant bodies of the Ministry of Defence on the definition, establishment, evaluation and periodic monitoring of the physical fitness of the career and employment military, as well as of the students of military teaching centers and those who aspire to enter or receive their teachings through the corresponding reports.

k) Advise the General Directorate of the Military Service, when required, in relation to the provisions of Article 31 and the fourth additional provision of Organic Law 13/1991, of 20 December, of the Military Service and Articles 5 and 53.3 (d) of Law 10/1990 of 15 October of the Sport, by means of the corresponding reports.

l) To promote the organization, construction, improvement and operation of military sports facilities, drawing up concrete proposals in collaboration with the Central Boards; advising on these matters of the Ministry of Defense through the corresponding reports, and to update the census of these facilities permanently, with the collaboration of the relevant agencies.

m) Authorizing and encouraging the creation of sports associations in the Armed Forces.

n) Approve the preliminary draft of your budget and request the necessary credits for the performance of your duties.

or) Any other that is derived from the above or in the first paragraph of this Order.

Third. Decision-making bodies. -They are the governing bodies of the Higher Council of Physical Education and Sports of the Armed Forces, the following:

a) Unipersonal: The President, the Vice President and the Secretary-General.

b) Collegiate: The Plenary and the Standing Committee.

Fourth. President of the Council. -1. He will be President of the Higher Council of Physical Education and Sports of the Armed Forces, the Secretary of State for Military Administration.

2. It corresponds to the Chairman of the Higher Council of Physical Education and Sports of the Armed Forces:

a) Ostend the representation of the Council.

b) to exercise the senior management of the Council, in accordance with the guidelines laid down by the Minister of Defence.

c) agree to the convening of the plenary session of the Council in an ordinary or extraordinary session and the establishment of the agenda, taking into account, where appropriate, requests from other members in good time.

d) Chair the sessions of the Council plenary session.

e) Visar the minutes and certifications of the organ agreements.

f) Conceding the Council's distinctions, decorations and other sports awards.

g) To exercise any other functions inherent in his or her status as President of the Council, arising from the provisions of this Order or delegated to him by the Minister of Defense.

Fifth. From the Vice-President of the Council. -1. He will be Vice President of the Higher Council of Physical Education and Sports of the Armed Forces, the Director General of Teaching at the Ministry of Defense.

2. It is up to the Vice President of the Higher Council for Physical Education and Sports:

a) Replace the President in cases of vacancy, absence, illness or other legal cause.

b) Chair of the Standing Committee.

c) Any other powers delegated to it by the President, shall be entrusted to it by the Plenary or arising from the provisions of this Order.

Sixth. Of the Secretary-General of the Council. -1. The Secretary-General of the Higher Council of Physical Education and Sports of the Armed Forces, who will act as such in the plenary and in the Standing Committee, as well as a member of the Council, will be a senior officer of any Corps, appointed by the Minister of Defence, acting on a proposal from the President of the Council, as Head of Unit, in the Directorate-General for Education of the Ministry of Defence.

2. It is up to the Secretary-General of the Higher Council for Physical Education and Sports of the Armed Forces:

(a) Prepare the meetings of the Plenary and the Permanent Commission of the Council and convene them to indicate their respective presidents.

b) To draw up the minutes of the sessions of the plenary session and of the Permanent Commission of the Council and to attest to their agreements, with the approval of their respective presidents.

c) Custodian of the books and other documentation of the Council, as well as of its archives.

d) Exorder certifications requested by the authorities and stakeholders or their representatives.

e) Organise the solemn acts whose conclusion the Council agrees. To supervise, by express delegation of the President, the organisation and the protocol of those accompanying sporting events approved by the Council.

f) Manage, coordinate and control the personal and material resources of the Council and in particular: Order its administrative regime, in accordance with the President's or, where appropriate, the Vice President's guidelines, to exercise, under the the authority of the Director-General of Education of the Ministry of Defence, the Head of Staff of the Council, preparing, through the General Secretariat, the preliminary draft budget of the Council, drawing up the Council's inventory and maintaining it updated.

g) A further function entrusted to it by the President or the Vice-President of the Council, within their respective fields of competence, or arising from the provisions of this Order.

Seventh. Composition of the Council Plenary. -1. The plenary session of the Higher Council for Physical Education and Sports of the Armed Forces will be composed of the President, the Vice President and the Secretary-General of the Council, and the Vocals.

2. They will be members of the plenary session:

(a) The Presidents of the Central Boards of Physical Education and Sports of the Armies and Civil Guard.

b) The Deputy Director-General of Military Personnel of the Directorate-General of Personnel of the Ministry of Defense.

c) The Deputy Director-General for Educational Management of the Ministry of Defence's General Directorate of Education.

d) The Deputy Director-General of Educational Management of the Ministry of Defence's Directorate-General for Education.

e) The Deputy Director General of Military Service of the Military Service of the Military Service of the Ministry of Defense.

f) The President of the Spanish Delegation to the International Council of Military Sport (CISM).

g) The Secretaries of the Central Boards of Physical Education and Sports of the Armies and Civil Guard.

(h) A Senior Official or Officer of the Military Legal Body, headed by the General Legal Counsel of the Defense, appointed by the Secretary of State for Military Administration.

i) A senior officer or officer of the Military Intervention Corps, headed by the Ministry of Defense's Directorate General for Economic Affairs, appointed by the Secretary of State for Defense.

j) A Senior Officer or Officer of the Higher Scale of the Military Corps of Health (Medicine), appointed by the Secretary of State for Military Administration.

3. The President of the Plenary Session may, on his own initiative or at the request of any of the Vocals, authorise the attendance of the plenary sessions of experts whose advice is deemed appropriate in relation to the matters to be dealt with on the agenda corresponding. These experts will be involved in the session in question with a voice, but without a vote, and with regard to the matter on which they advise.

4. In the absence of the Secretary-General, the President may appoint an official from the plenary session to an official from among those who are assigned to the Council or to the Directorate-General for Education of the Ministry of Defence.

5. The Presidents of the Central Boards may delegate their representation and rights, in the Council's plenary sessions, to the Vice-Presidents of their respective Boards.

Eighth. Operation of the Council Plenary. -1. The plenary session of the Higher Council of Physical Education and Sports of the Armed Forces, will meet in ordinary session twice a year, the first of these sessions will be held within the first quarter and the second within the last of each year.

2. The plenary session may meet in extraordinary session on the initiative of the President of the Council or at the request of the Standing Committee.

3. The ordinary and extraordinary meetings of the Plenary Session shall be convened by the Secretary-General, at the President of the Council or, where appropriate, the Vice-President.

4. Without prejudice to the peculiarities provided for in this Order, the collegiate bodies which are regulated in this Order shall adjust their operation as provided for in the Law on the Legal Regime of Public Administrations and the Administrative Procedure. Common on collegiate bodies.

Ninth. Functions of the Council Plenary. -They are the functions of the Plenary of the Higher Council of Physical Education and Sports of the Armed Forces, those established in the second paragraph of this Order. However, the President of the Council or, where appropriate, the Vice-President, may, at any time, entrust the Standing Committee with the following tasks as referred to in that paragraph:

(a) As a general rule: The checks referred to in point (b), (h), (j), (k) and (k), and the advice and updating referred to in point (l).

(b) For specific cases: the coordination referred to in point (a), the address referred to in point (c), and those referred to in point (f).

The President of the Council or, where appropriate, the Vice-President, may at any time return to the Plenary Session those of the previous functions entrusted to the Standing Committee, which shall give an account of its performance to the Plenary Session. in the first session which is held after the return of the duties has been resolved and in any case at the second of the annual ordinary sessions.

10th. Composition and powers of the Standing Committee. -1. The Standing Committee of the Higher Council for Physical Education and Sports of the Armed Forces shall be composed of the Vice-President of the Council, the Assistant Directors-General for Educational Management and Management of the General Directorate of Education Ministry of Defence and the Secretary-General of the Council.

2. It corresponds to the Standing Committee:

a) Comply or enforce, as the case may be, the plenary agreements.

b) To perform those tasks entrusted to it by the President or, where appropriate, the Vice-President of the Council, in accordance with the provisions of paragraph 9 of this Order.

(c) Appoint technical work commissions, either on the basis of the President of the Council, or after the plenary or own initiative, or after accepting a reasoned proposal from a plenary session.

d) Approve the Statutes of the clubs and sports associations that are believed in their scope of action and the regulations of the military competitions.

e) To present the preliminary draft annual budget of the Council to the plenary session.

(f) To approve the accounts of the Council without prejudice to their subsequent surrender to the plenary session.

(g) To issue matters which, by their nature or urgency, do not require their elevation to the plenary session or do not allow for delay, without prejudice to the latter case of requesting the plenary's most extraordinary convocation, in which to give account of the action taken in respect of the case in question.

11th. From the General Secretariat of the Council. -1. The General Secretariat is the auxiliary organ of the Higher Council of Physical Education and Sports of the Armed Forces, to which it provides technical-administrative assistance. He shall be in charge of the Secretary-General of the Council.

2. The General Secretariat shall have the staff necessary for the performance of its duties, in the Unit whose headquarters the Secretary-General of the Council holds.

3. Corresponds to the General Secretariat:

(a) Develop the preliminary draft provisions, instructions and circulars relating to the area of competence of the Council.

(b) to coordinate the relations of the Council with other organizations, institutions or entities in Spain or abroad, between the Central Committee for Physical Education and Sports and the Council's bodies; and collaborate with the Council's representations to the Council, providing them with the necessary administrative assistance.

c) To process and report on the resolution of the matters which are the Council's powers.

(d) Prepare the Council's annual budget year, the budgets for the competition programmes and the proposals for grants to the Central Committee for Physical Education and Sport, as well as implementing the resolutions adopted in these matters.

12th. From the Spanish Delegation to the International Council of Military Sport. The Spanish delegation to the International Council of Military Sport will depend directly on the Higher Council of Physical Education and Sports of the Armed Forces. This delegation shall be chaired by a senior officer of any body, appointed by the Secretary of State for Military Administration on a proposal from the Director-General of Education of the Ministry of Defence, and shall have the number of Vocals which establish the Statutes of the International Military Sports Council. The Vowels will be Senior Officers or Officers of any Corps, appointed by the Plenary of the Higher Council of Physical Education and Sports of the Armed Forces on the proposal of one of its members.

13th. From the Central Boards of Physical Education and Sports. -1. The Central Boards of Physical Education and Sports, organs attached to the Directorates of Teachings of the Personnel of the respective Armies, and to the Head of Teaching of the General Staff Subdirectorate in the Corps of the Guard Civil, exercise the powers of their respective Armies and Civil Guard in the fields of physical education and sport, in accordance with the provisions of this Order and in their regulations, and as agreed by the Council Plenary Superior of Physical Education and Sports of the Armed Forces and to which they establish their internal guidelines.

2. The Military Personnel Subdirectorate General of the Directorate General of Personnel of the Ministry of Defense, in coordination with the Permanent Commission of the Higher Council of Physical Education and Sports of the Armed Forces, will perform the duties. assigned to the Central Boards as soon as they are aware of the military personnel of the specific Corps of the Armed Forces, destined to the central organ or in centers or agencies that are dependent on the Armed Forces.

3. They are the functions of the Central Boards of Physical Education and Sports:

a) Centralize, unify and direct the activities to be developed in their fields of competence, when they have national projection, and coordinate them when they are regional, departmental or zone.

b) Regulate the constitution of the Physical Education and Sports Boards for each Region, Department, Command or Zone, coordinate their regulations, grant them the economic grants that come and check the appropriate application of these to the purposes for which they have been granted.

c) To advise the competent bodies on the definition, establishment, evaluation and periodic monitoring of the physical fitness of the military personnel, by means of the corresponding proposals.

d) Develop proposals for the development of training and training plans, as regards the acquisition, maintenance and improvement of the physical training of the personnel of the troops and marineria.

e) Approve the annual programme of sports competitions to be held in their respective area of competence and the corresponding budgets.

f) Organize and develop inter-military, national or international competitions, entrusted to them by the Higher Council of Physical Education and Sports of the Armed Forces, as well as the national championships military sports in its field.

g) Monitor the development of the physical-military training programs of the personnel of troops and marineria in the various units, centers or agencies.

h) Advise competent bodies on the need for the construction, maintenance or improvement of military sports facilities, to draft and update the census of existing sports facilities in their field of reference, through the relevant reports.

i) Request the credits necessary for the performance of their duties.

j) Encourage and propose the creation of military sports associations.

k) Any other arising from the provisions of the preceding letters or points 1 and 2.

4. The Central Boards shall be composed of a President, a Vice-President, a Secretary and the Vocals who shall regulate.

5. In each Army or Civil Guard they shall be the Chairs of the Central Boards of Personnel, Vice-Presidents, Directors or Heads of Education, and Secretaries, Senior Officers in Physical Education, assigned to the Address or Head of Teaching.

14th. Additional provision.-The entry into force of this Order, the staff who are carrying out their duties in the General Secretariat of the Higher Council of Physical Education and Sports of the Armed Forces, will be in the Directorate General of Teaching, in the Unit whose headquarters the Secretary-General of the Council holds, telling all the effects of the time served in that unit.

15th. The Order is repealed. -Order 12/1988 of 11 February ("Official State Gazette" number 42, 18) is hereby repealed, and any provisions of equal or lower rank shall be contrary to this Order.

sixteenth. Final provisions. -1. The Secretary of State for Military Administration is empowered to issue the resolutions and to take the necessary measures for the implementation and application of this Order, in accordance with the Secretary of State for Security in refers to the Civil Guard Corps.

2. This Order shall enter into force on the day following its publication in the Official Journal of the State.
