In the exercise of the powers conferred by Article 10.2.b) of Law 10/1990 of 15 October of the Sport, the Commission of the Council of Sports of the High Council of Sports has definitively adopted the Statutes of the Federation Spanish Boxing and authorized its registration in the Register of Sports Associations.

In compliance with the provisions of Article 31.7 of the Law of Sport and Article 12.3 of Royal Decree 1835/1991 of 20 December 1991 on Spanish sports federations, the publication in the Official Journal of the Status > of the Statutes of the same and their modifications.

By virtue of the above, this Secretary of State agrees:

Have the publication of the Statutes of the Spanish Boxing Federation contained in the Annex to this Resolution.

ANNEX

STATUTES OF THE SPANISH BOXING FEDERATION

TITLE I

General provisions

Article 1.

The Spanish Boxing Federation is the private entity of public utility that, without profit, gathers within the Spanish territory sportsmen, technicians, judges/referees, clubs, territorial federations and other collectives dedicated to the practice of boxing, its object being the promotion, organization and development.

The Spanish Boxing Federation has its own legal personality and full capacity to act in order to fulfil its aims, it exercises administrative functions, as a contributing agent of the Public administration and is governed by the provisions contained in Law 10/1990 of 15 October of the Sport; in Royal Decree 1835/1991 of 20 December, on Spanish sports federations, and in the corresponding implementing rules of both legal bodies, by the present Statutes and their specific Regulations, and by agreements validly adopted by their governing bodies and representation.

Article 2.

The Spanish Boxing Federation is affiliated with the Amateur International Boxing Association (AIBA), European Amateur Boxing Association (EABA) for amateur boxing and the World Boxing Council (WBC), World Boxing Association (WBA), Association Boxing World Hispanic (ABMH), International Boxing Federation (IBF) and the European Boxing Union (EBU) for professional boxing, to which it belongs as a member and whose representation is exclusive in the Spanish State, being able to to join any other association which at the discretion of the Spanish Boxing Federation and prior to the authorization of the Superior Council of Sports is beneficial for professional boxing and that its regulations conform to the current regulations, obliging accordingly in the international aspect to the established in the Statutes and codes sports of international organizations.

As a federation whose object is the practice and promotion of an Olympic sport is affiliated with the Spanish Olympic Committee (COE), acata, within the respect of the Spanish legal system, the rules governing the Olympic Committee International, Spanish Olympic Committee and the agreements of these agencies.

Article 3.

The scope of the Spanish Boxing Federation extends to the entire territory of the State in the development of its own competences and in the fulfilment of its aims, without prejudice to the competences that legally owned by the Autonomous Federations.

Article 4.

The Spanish Boxing Federation will not allow any form of discrimination between its members by reason of birth, race, opinion or any other condition or personal or social circumstance.

Article 5.

Organs dependent on the Spanish Boxing Federation shall be governed by their own rules and regulations, subordinated to this Statute and other existing federal rules, enjoying full competition within the scope of are assigned. These rules and regulations shall require the approval of the General Assembly.

Article 6.

The address of the Spanish Federation of Boxing is located in Madrid on the street of Ferraz, number 16, in the right, and can be moved, within that capital, by agreement of the Assembly on a proposal of the Board Directive.

Article 7.

Autonomous federations, once integrated into the Spanish Boxing Federation, will be represented in the corresponding Autonomous Community. Therefore, no territorial delegation of the Spanish Boxing Federation may exist in any of the areas of such Federations.

The Spanish Boxing Federation may establish in that Community, in collaboration with the Sports Administration thereof, a Territorial Delegation in that Autonomous Community where there is no Boxing Federation, or that, having made it, would not have been integrated.

Article 8.

1. Under the coordination and tutelage of the Superior Council of Sports, the Spanish Boxing Federation will exercise the following administrative functions:

(a) Qualify and organise, where appropriate, official activities and competitions at the State level.

For these purposes, the organization of such competitions is understood to be related to the regulation of the general framework of the same, as established in the corresponding federal rules.

b) To act in coordination with the Federal Federations, for the general promotion of the sport of boxing, throughout the national territory.

c) Design, elaborate and execute, in collaboration, in their case, with the Autonomous Federations, the plans of preparation of the high level athletes.

d) Collaborate with the State Administration and the Autonomous Communities in the training of sports technicians and in the prevention, control and repression of the use of prohibited substances and pharmacological groups and methods regulations in sport.

e) Organize or protect the official international competitions held in the territory of the State.

In order to organize, request or compromise this type of activities or competitions, the Spanish Boxing Federation must obtain authorization from the Superior Council of Sports, being, as regards the regime of the same, to the planning on international sports activities and performances.

f) Exercise the disciplinary authority of sport, in the terms established in the Law of Sport, its specific provisions of development and its Statutes and Regulations.

g) To exercise control over grants to associations and sports entities under the conditions set by the High Council for Sport.

h) To execute, as appropriate, the resolutions of the Spanish Committee for Sports Discipline.

2. The Spanish Boxing Federation plays in relation to its members, which are those who are determined in Article 1 of the present Statutes, the functions of guardianship, control and supervision that the sports legal system recognizes.

The acts performed by the Spanish Boxing Federation in the exercise of public functions of an administrative nature are subject to appeal to the Superior Council of Sports, whose resolutions deplete the administrative.

Article 9.

The Spanish Boxing Federation regulates federative activity by means of the following hierarchical rules:

Statutes.

Regulations.

Circulars.

Within the normative set of the Spanish Boxing Federation, the Statute occupies the highest rank and consequently repeals any other federative rule that he objects to. It is up to the Superior Council of Sports to approve it on a proposal from the General Assembly of the Spanish Boxing Federation.

The Regulations will develop the general rules and principles established in the Statutes, corresponding to the Commission Delegated its approval and ratification by the Superior Council of Sports. The Regulations are in force as long as they are not expressly repealed by other Regulations or by the Statute itself and shall enter into force at the time of their approval by the Delegate Commission and subsequent ratification of the High Council of Sports.

The circulars will contain rules of a circumstantial and clarifying nature.

TITLE II

Rendering and governance organs

Article 10.

The governing and representation bodies of the Spanish Boxing Federation will be, necessary, the General Assembly and the President.

Within the General Assembly, a Delegate Commission will be set up.

Are requirements to be a member of the organs of the Spanish Boxing Federation:

First. -To be Spanish or nationality of a member country of the European Communities.

Second. -Having a civil age majority.

Third. Not to be disabled for public office.

Fourth. -Have full capacity to work.

Fifth. -Not to be subject to sports disciplinary sanction that you disable for it.

Sixth. Not to be in the way of legal or statutory incompatibilities.

Seventh. -The specific ones that for each case, if any, determine the present Statutes.

Article 11.

As complementary organs of government and representation there will be the Board of Directors and the Secretary-General, assisting the President.

All the agreements of the various organs of the Spanish Federation will be public.

The Secretary-General shall also take up the minutes of each meeting of the various governing bodies.

Article 12. General Assembly.

It is the top organ of the Spanish Boxing Federation, in which the natural persons and entities referred to in Article 1 of Royal Decree 1835/1991 and Article 1 of these Statutes will be represented. Its members shall be elected every four years on the basis of the summer Olympic Games, by free and secret, equal and direct suffrage, between and by the constituents of each of the units, in the proportion established by the provisions In addition to Royal Decree 1835/1991, due to the peculiarities of the Spanish Boxing Federation.

Article 13.

The number of members of the Assembly shall be fixed in each call, in accordance with the electoral rules, being composed of and according to the following percentages:

(a) By the Presidents of the Autonomous Federations integrated into the Spanish Boxing Federation.

b) Sports associations: 51.3 per 100.

c) Sportsmen: 29.3 per 100.

d) Technicians: 9.2 per 100.

e) Judges/referees: 9.2 per 100.

f) Other collectives: 1.0 per 100.

Article 14.

When a vacancy occurs among the elected members of the Assembly, it shall be subtracted by the one who follows in the number of votes obtained, by the constituency and the establishment concerned. To this end, the provisional and final lists shall be published as substitutes for each of the two persons who have obtained the largest number of votes after the elect, and shall be referred to as alternate number 1 and Number 2, according to the votes obtained, respectively.

In default, the Assembly may agree to hold elections in the constituency and to cover the vacancy or vacancies where the number of seats is equal to or greater than 20 per 100 of the members of the Assembly. Assembly.

Article 15. Competence.

1. It is for the General Assembly, with an ordinary character:

a) The approval of the annual budget and its liquidation.

b) The approval of the sports calendar.

c) The approval and modification of the Statutes.

d) The election and the end of the President.

2. They are also the powers of the Assembly:

a) Choose and cease the members of the Delegate Committee.

(b) Establish the limits and criteria to which the Delegated Commission is to be subject to the exercise of its powers.

c) Approve the administration of the President, prior to the report of the Delegate Committee.

(d) Approve, where appropriate, the issues of debt securities.

e) Approve the alienation of elements of the real estate, with the limitations established in article 36 of Law 10/1990.

f) Approve legal business involving the taxation of the federal assets in the case of operations exceeding 10 per 100 of the budget or 50,000,000 pesetas.

g) Agree on the change of address of the Spanish Boxing Federation.

h) Decide on the motion of censure on the President.

i) Deciding on any other matter submitted to you by the President or the Delegate Committee.

Article 16.

The General Assembly shall meet, on an ordinary basis, once a year to deal with the following matters:

a) Annual budget and its liquidation.

b) Annual sports calendar.

c) Managing the President and other governing bodies.

(d) financial statements provided for in the rules for the adaptation of the General Accounting Plan for Federations, as well as the settlement of the budget and the audit report referred to in Article 36 of Law 10/1990, of Sport.

e) Sports activity performed during the previous year or annual memory of the Spanish Boxing Federation.

f) Annual sports program to be developed.

Article 17.

The other meetings of the General Assembly shall be extraordinary and may be convened by the President, at the request of the Commission Delegated, by a simple majority, or by a number of members of the Assembly not less than the 20 per 100.

Article 18.

The call for the General Assembly shall be notified to its members at least 15 days in advance, except in duly justified cases of urgency, accompanying the corresponding order of the day.

Article 19.

The Assembly will be validly constituted when one half of its members attend, in the first call, and one third in the second.

Article 20.

Members of the Assembly may propose any subject that falls within the competence of the Assembly, duly documented, with a minimum of ten days ' notice to the celebration.

Article 21. Adoption of agreements.

1. The General Assembly decides by a simple majority of the votes cast, except for those matters in which the Statutes or higher provisions point out another majority.

2. A two-thirds majority of its members will be required to:

Agree on the issuance of debt securities.

Agree on the disposal of real estate and movable property.

3. An absolute majority of the votes cast shall be required for the motion of censure against the President, in the terms of Article 35.

4. The votes shall be either by show of hands or by call, except in the case of elections or motion of censure on the President, in which case the vote shall be secret. The secret ballot may also be taken when the Assembly itself decides, on the proposal of at least 10 per 100 of the assistants.

5. The Secretary shall be drawn up by the agreements and votes.

Article 22. Delegated Commission.

In the Assembly, a Delegate Commission will be set up.

Corresponds to the General Assembly's Delegate Commission:

1. The modification of the sporting calendar.

2. The modification of the budgets.

3. The adoption and amendment of the Regulations.

4. The preparation of a report prior to the adoption of the budgets.

5. The monitoring of the economic and sports management of the Federation, through the elaboration of an annual report to the General Assembly, on the memory of activities and the liquidation of the budget.

The modifications may not exceed the limits and criteria that the General Assembly itself establishes.

Article 23.

The members of the Delegate Committee, who will be members of the General Assembly, will be elected every four years, by means of suffrage, and the vacancies to be filled annually must be filled annually in the first assembly. which is celebrated.

The Delegate Commission will be composed of 15 members plus the President, who will be the Spanish Boxing Federation, in accordance with article 17, 3 of Royal Decree 1835/1991, of November 20.

Five members will correspond to the presidents of the autonomous community and will be elected by and among the members of the Assembly who are Presidents of Federations of the Autonomous Community.

Five members will correspond to the sports associations, and they will be chosen by and among the members of the Assembly elected by this station without those corresponding to the same Autonomous Community having more than 50 percent. 100 of the representation.

Five members corresponding to the rest of the distributed estates as follows: Three by the athletes, one by technicians and one by referees/judges.

The Delegate Committee shall meet at least once every four months, on a proposal from the President, and its mandate shall coincide with that of the General Assembly.

Article 24. The President.

The President of the Spanish Boxing Federation is the executive organ of the Federation, holds its legal representation, convenes and presides the governing bodies and represents and executes the agreements of the same.

Article 25.

The President holds the economic, administrative and sporting direction of the Spanish Boxing Federation, in accordance with the provisions of these Statutes, assisted by the Board of Directors and, in particular, by the Vice-Presidents, the Secretary-General and the Treasurer.

Article 26.

1. The President of the Spanish Boxing Federation is the computer of expenses and payments of the same, in accordance with the provisions of these Statutes, exercising the control and economic inspection of all the organs of the Spanish Federation of Boxing.

2. You can hire and lay off staff.

3. It can appoint and remove Board members as well as those who provide services in the Spanish Boxing Federation.

Article 27.

The President will have a vote of quality in the event of a tie in the votes that will take place in the collegiate bodies he presides.

Article 28.

He will be elected every four years, coinciding with the summer Olympic Games, by free, direct, equal and secret suffrage, by the members of the General Assembly. The candidates, who may not be members of the General Assembly, shall be presented, at least, by 15 per 100 of the members of the Assembly, and their choice will be produced by a double-lap system, in the event that in a first round no candidate reaches the absolute majority of the votes cast.

In the event that the Presidency is exceptionally vacant before the end of the four-year period mentioned above, the General Assembly shall make a new election to cover that vacancy for the time remaining until the end of the period of four years. termination of the period corresponding to the ordinary term of office, unless this is less than one year, in which case the Chair shall first be the Chair.

Article 29.

It may not be elected President who would have held such a condition without interruption during the three periods immediately preceding it, whatever the effective duration of these periods would have been.

Article 30.

The office of President of the Spanish Boxing Federation may be remunerated whenever such agreement, as well as the amount of remuneration, is approved by half plus one of the members present in the General Assembly. Gross remuneration, including legally established social expenditure, may not be met by public subsidies received by the Federation.

The President's remuneration will end with the end of his term of office, not being able to extend such remuneration beyond the duration of the term.

The President of the Spanish Boxing Federation will also be in charge of his position according to the regime of dedication and incompatibilities to be established in these Statutes.

Artitle 31. Incompatibilities.

1. The performance of the office of President will be the cause of incompatibility to occupy managerial positions in other Spanish sports federations and sports associations integrated in the Spanish Boxing Federation.

2. It shall not be able to carry out any charge in commercial companies or have economic interests in companies and companies which directly or indirectly engage with the Spanish Boxing Federation.

3. It shall also be incompatible with the activity as a sportsman, technician, arbitrator, manager or promoter of the Spanish Boxing Federation, without prejudice to the retention of his licence.

Article 32.

The President will cease by:

1. Course of the deadline for which he was elected.

2. Death.

3. Resignation.

4. Approval of a motion of censure by the General Assembly.

Article 33.

Article 34.

In cases of absence or temporary incapacity, the President shall be replaced by the Vice-Presidents in his order, the first of which shall be a member of the General Assembly.

Article 35. Motion of censure.

The motion of censure shall be proposed, at least, by a third of the Assembly and approved by secret ballot, by an absolute majority of votes cast, which constitute at least half of the total of its components. Voting by mail will not be allowed for this vote. A new motion of censure may not be tabled until one year after the previous one.

The maximum period for convening the Assembly to this effect will be twenty days after the proposal is received in the Spanish Boxing Federation.

Article 36. Board of Directors.

The Board of Directors is the board of directors of the Spanish Boxing Federation, its members being freely appointed and revoked by the President of the Board, who will preside over it.

Article 37.

The Board of Directors will be composed, in addition to the President, by three Vice-Presidents, one Treasurer and 16 members. The first Vice-President shall be a member of the Assembly.

The maximum number of its members may not exceed 21.

Will be assisted by the Secretary General of the Spanish Boxing Federation, with a voice but without a vote.

Article 38.

All of the Board of Directors ' positions are honorary except that of the President, if this is agreed upon in the Assembly.

Article 39.

The Board of Directors will meet in plenary session, in ordinary session at least once every two months.

The convocation, which corresponds to the President, must be notified to its members with forty-eight hours, at least, in advance, except for cases of urgency, accompanying the agenda.

The sessions convened in cases of urgency will always be extraordinary.

Article 40.

The validity of the meetings of the Board of Directors will require the majority of its members to attend, in the first call, and, second, the third part of the meetings.

The deal-making will be done by simple majority.

Article 41.

Board members will cease by:

1. Death.

2. Resignation.

3. Revocation of appointment.

Article 42.

Without prejudice to the powers of the General Assembly and the Delegate Committee, where appropriate it is for the Board of Directors:

1. Prepare the documentation that will serve as a basis for the General Assembly to carry out the functions that correspond to it.

2. Propose the date and order of the day of the ordinary and extraordinary General Assembly.

3. To call general elections to the General Assembly and to the Presidency of the Spanish Boxing Federation.

4. To resolve the issues arising from the agreements of the Boards of Directors of the Autonomous Federations in relation to the licenses or the recognition of the income in the Spanish Federation of Boxing.

5. To propose to the Commission Delegate the approval of the regulations of elections to the General Assembly and to the Presidency.

6. To propose to the Commission Delegated the approval of the internal regulations of the Spanish Federation of Boxing, both technical and of competition and of its modifications.

7. Collaborate with the President in the economic, administrative and sports direction of the Spanish Boxing Federation and in the execution of the agreements of the other higher collegiate organs of government and representation of the same.

Article 43.

Regardless of the criminal, civil and administrative responsibilities that are generally enshrined in the Spanish law, the members of the various organs of the Spanish Boxing Federation are responsible, specifically, of the acts, resolutions or agreements adopted by the latter.

Members of the Board of Directors will respond on the same terms to the High Council of Sports as to the grants received from the Board, as well as the irregularities in the implementation of the budget.

The same responsibility will exist for all the members of the Board of Directors with respect to the various organs of the public administrations, so to the grants of the same refers.

Article 44. The Treasurer

1. The Treasurer will take care of the President of the collection and payment operations.

2. He shall authorize with his signature, joint with that of the President, or person in whom this delegate, all movements of funds.

3. It shall assist the President in drawing up the balance sheets which are periodically submitted to the Board of Directors, to the Commission Delegated and which shall be submitted annually to the General Assembly.

Article 45. The Secretary-General.

The Secretary-General assists all governing and representative bodies, as well as all the technical bodies and commissions of the Spanish Boxing Federation.

By delegation of the President holds the leadership of the staff of the Spanish Boxing Federation.

Article 46.

The Secretary-General shall act as Secretary of all the collegiate higher bodies of the Spanish Boxing Federation, provide documentation and information on matters to be deliberated and shall draw up the minutes of his or her sessions. Once the minutes have been approved, he will sign them with the President's approval, and he will keep the corresponding record books.

Article 47.

The competencies of the Secretary-General are as follows:

1. He is the head of the staff of the Spanish Boxing Federation.

2. He coordinates the performance of the various organs of the Spanish Boxing Federation.

3. Prepares the resolution for the dispatch of all matters.

4. It ensures compliance with all legal and sports rules, having duly informed about the content of the same to the organs of the Spanish Boxing Federation.

5. Take care of the good order of all the federative dependencies.

6. It prepares the meetings of all the governing bodies and the technical bodies, acting in them with a voice but without a vote. He raises the minutes of his meetings and is responsible for the record books.

7. He receives, signs and exrequests the official correspondence of the Spanish Boxing Federation, except for the one that is reserved for himself the President, and carries an entry and exit record of the same.

8. Organizes, maintains and custody the file of the Spanish Boxing Federation.

9. He provides documentation and informs the governing bodies and the technical bodies of the Spanish Boxing Federation.

10. Prepares the annual memory of the Spanish Boxing Federation for presentation to the General Assembly.

11. It issues the appropriate certifications of the acts of the organs of government and representation.

Article 48. The Manager.

The Manager of the Spanish Boxing Federation is the administrative organ of the same.

These are the Manager's own functions:

1. Carry the accounting of the Spanish Boxing Federation.

2. Exercise the economic inspection of all the organs of the Federation.

3. How many functions the President and the Board of Directors entrust to him in administrative economic matters.

TITLE III

Technical committees

Article 49.

They are technical bodies of the Spanish Boxing Federation:

Amateur Boxing Committee.

Professional Boxing Committee.

National Discipline Committee.

National Medical Commission.

National Committee.

National Committee of Referees/Judges and Timers.

National Committee of Preppers.

National Committee of Kick-Boxing (Muay Thai).

Article 50. Amateur Boxing Committee.

The Amateur Boxing Committee will be composed of:

President.

Five vowels.

The Presidency will correspond to one of the Vice Presidents of the Spanish Boxing Federation appointed by the President, and the vowels will necessarily be members of the Board of Directors of the Federation.

The functions of this Committee, under the authority of the President of the Spanish Boxing Federation, will be: The supervision, control and development of all state and international amateur boxing activities, as well as in Those who are involved in the participation of two or more territorial Federations, qualified as officers.

Article 51. Professional Boxing Committee.

The Professional Boxing Committee will be composed:

The Presidency will correspond to one of the Vice-Presidents of the Spanish Boxing Federation appointed by the President, and the vowels will necessarily be members of the Board of Directors of the Spanish Boxing Federation, appointed for its President.

The functions of this Committee, under the dependence of the President of the Spanish Boxing Federation, will be:

1. The supervision, control and authorisation of all official professional and state-wide boxing competitions involving professional athletes from two or more territorial Federations.

2. Control and authorization of the Spanish professional boxing championships in their different weight categories.

3. Classification of professional boxers according to their record.

4. Supervision of periodic medical checks on professional athletes, with the advice of the National Medical Commission, for the renewal of licenses and new solutions.

5. Monitoring of the results and approval of results records for records.

6. Information to the international bodies of the professional activity carried out.

7. Proposal to the President of the Spanish Boxing Federation for approval by the General Assembly of the price of the licenses of boxers, manager, organizers, referees, judges, timekeepers, technicians, as well as the organization fees or any other federal law.

8. Authorisation to hold world championships, Europe or any other international title.

9. Representation in international professional boxing organizations.

Article 52. National Discipline Committee.

The National Sports Discipline Committee will be composed of a President, appointed by the President, and a maximum of four vowels licensed in law.

You will be assisted by those people whose presence is deemed necessary for information on specific issues.

Article 53.

The National Disciplinary Committee is the highest federative body, to whom it is appropriate to know how many issues or incidents occur on the occasion of the competition and the violations committed against the discipline and the sports rules for persons subject to federal jurisdiction.

Its competence, organization and operation will be determined by a specific regulation in accordance with the regulations in force in the material, and, in particular, Royal Decree 1835/1991 of 20 December, on Federations Spanish sports, and Royal Decree 1591/1992, of 23 December, on sports discipline, and which must be approved by the Superior Council of Sports.

Article 54. National Medical Commission.

The National Medical Commission is an advisory technical body and advisor to the Spanish Boxing Federation, and has by mission:

1. Advise the Board of Directors and the Professional Boxing Committee on medical issues related to boxing.

2. Propose the medical tab for annual initial recognition, pre-combat and post-combat.

3. Dictate medical standards in case of special recognition.

4. Advise the medical vowels of the Federations and control the medical examinations.

5. Propose to the Board of Directors the medical representatives in the International Medical Commissions.

6. Maintain relations with the International Medical Commissions.

7. Name the Olympic team doctor.

Article 55.

The National Medical Commission will be composed of:

A president, a secretary and four vowels, who will be specialists in neurology, trauma, ophthalmology and electrophysiology.

Article 56. National Committee of Referees/Judges and Timers.

The National Committee of Referees/Judges and Timers will be in charge, under the direction of the Spanish Boxing Federation, for the organization of official and state-wide arbitration activities, creating for such purposes the the necessary delegated bodies to carry out their duties in all national sectors, within the federative organisation, establishing proper coordination between their respective roles and exercising the inspection of the arbitral functions. The competence of the National Committee of Referees/Judges and Timers shall also be extended to other auxiliary persons.

Article 57.

The National Committee of Referees/Judges and Timers will have a President, appointed by the President of the Spanish Boxing Federation.

Your functions will be:

Set up the levels of arbitration training.

Classify judges or referees technically, proposing the membership of the corresponding categories.

Approve the administrative rules by regulating the arbitration.

Designate the collegiates in the competitions at the state and international level to be held in Spain and be of their competence.

Article 58.

The National Committee of Referees/Judges and Timers will have the Commissions that are appropriate for the fulfillment of their purposes, for the general government and for carrying out the care work, promotion, technical training and assessment of the actions of the judges, referees and timekeepers.

Article 59.

The National Committee of Referees/Judges and Timers will adjust their actions to the Regulation that determines their functions and how to carry them out.

This Regulation should be approved by the Delegation of the Spanish Boxing Federation.

Article 60. National Preparatory Committee.

The National Preparatory Committee will have a President, appointed by the President of the Spanish Boxing Federation.

Your functions will be:

Set training levels for technicians.

Classify coaches technically, proposing the attachment to the corresponding categories.

Approve administrative rules by regulating the functions of technicians.

The National Preparatory Committee directly serves the functioning of the collective of those, by framing coaches (national, territorial, provincial), both those who engage in work with boxers They are professional, and they correspond, with subordination to the President of the Spanish Boxing Federation, the government and representation of the collective above.

The composition, operating system and competencies of the National Committee of Prepares shall be determined by regulation. This Regulation must be approved by the Delegation of the Spanish Boxing Federation.

Article 61. National Committee of Kick-Boxing (Muay-Thai).

The National Committee of Kick-Boxing (Muay-Thai) has the task of supervising, developing and regulating the activities of this discipline, the operating system and powers will be determined in its Rules of Procedure, which will necessarily have to submit to the approval of the Delegate Commission.

The National Committee will be composed of a President, a Vice President, a Secretary and three vowels.

TITLE IV

Sports associations, athletes, technicians and referees/judges

Article 62.

Sports associations will be integrated, at their own request, in the Spanish Boxing Federation through the Autonomous Federation that corresponds to them due to the geographical situation and their legal domicile, provided that they conform to the the laws in force and are committed to comply with the Statutes and Regulations of the Spanish Boxing Federation and to submit to the authority of the federative bodies in relation to the matters of their competence.

Article 63.

The same criteria and requirements will apply for integration into the Spanish Boxing Federation of sportsmen, technicians and referees/judges.

Article 64.

The integration in the Spanish Boxing Federation will be produced by the granting of the corresponding federal license, which can only be denied in duly justified exceptional cases.

Article 65.

All members of the Spanish Boxing Federation have the right to receive guardianship of the same in respect of their legitimate sporting interests, as well as to participate in their activities and in the functioning of their organs, in accordance with these Statutes and with the Rules of Procedure of that Statute.

The members of the Spanish Boxing Federation have, in turn, the duty to abide by the agreements of their organs without prejudice to recourse, to the competent federal authorities and, where appropriate, to the ordinary jurisdiction, those who consider rights contrary.

TITLE V

Licenses

Article 66.

For participation in official state-wide sports activities or competitions, it will be necessary to be in possession of a license issued by the Spanish Boxing Federation, according to the following minimum conditions:

Uniformity of economic conditions for each category, the amount of which shall be fixed by the General Assembly. The revenue produced by these concepts will be primarily aimed at financing the structure and functioning of the Spanish Boxing Federation.

Uniformity of content and data expressed according to different sports categories.

The Spanish Boxing Federation shall issue the requested licenses within 15 days of its application, after verification of compliance with the sporting requirements established for its issuance, in its Statutes or Regulations.

The licences issued by the Autonomous Federations shall enable such participation when they are integrated into the Spanish Boxing Federation, issued within the minimum conditions of economic character and The Commission shall be responsible for the information provided by the Commission.

For these purposes, the rating will take place once the Autonomous Federation pays the Spanish Boxing Federation the corresponding economic quota within the deadlines that are set in the regulations of this Federation.

The licenses issued by the autonomic Federations which, as provided for in the preceding paragraphs, enable participation in official state-wide sports activities or competitions, will be recorded by the details, at least in the official Spanish language of the State.

These licenses will reflect three economic concepts:

Mandatory insurance as referred to in article 59.2 of the Law of Sport, in the case of non-professional boxers.

Share for the Spanish Boxing Federation.

Share for the Autonomous Federation.

TITLE VI

Economic Regime

Article 67.

The Spanish Boxing Federation has its own system of administration and management of budget and patrimony, application of article 36 of Law 10/1990.

The deficit budgets will not be approved except for the authorization of the Superior Council of Sports.

Article 68.

The Spanish Boxing Federation, which has its own heritage and budget, will adapt its accounting to the rules of adaptation of the General Plan of Accounting to the Spanish sports federations that the Institute develops Accounting and Audit of Accounts of the Ministry of Economy and Finance.

Article 69.

The Board of Directors will prepare the draft budget for each financial year, which, with the report of the Delegate Commission, will be presented to the Superior Council of Sports.

Article 70.

The Board of Directors shall draw up the financial statements provided for in the adjustment rules of the General Accounting Plan for Federations, as well as the settlement of the budget, together with the corresponding memory explanatory statement and with the report of the Delegate Committee. Those financial statements shall be audited in accordance with the provisions of the Law on Sport and supplementary provisions and the report issued by the auditors shall be brought to the attention of the Assembly.

Article 71.

1. The assets of the Spanish Boxing Federation shall be made up of the assets and rights of which it is entitled.

2. They are resources of the Spanish Boxing Federation, among others, the following:

(a) The grants that public entities can grant them.

b) The donations, inheritances, legacies and prizes awarded to them.

c) The benefits of the sports activities and competitions they organize, as well as the derivatives of the contracts they make.

d) The fruits of your heritage.

e) The loans or credits they obtain.

f) Any other items that may be attributed to you by legal provision or by virtue of a convention.

TITLE VII

Disciplinary regime

Article 72.

Sports discipline is governed by the Law of Sport, by Royal Decree 1591/1992, of 23 December, on sports discipline, by the present Statutes and by the Federative Regulation that is approved according to the Article 20 of the aforementioned Royal Decree on sports discipline.

Article 73.

The Spanish Boxing Federation exercises disciplinary authority over all the persons who are part of its own organic structure; on the clubs and their athletes, technicians and leaders; on the referees and, in general, on all persons or entities which, being attached to the Spanish Boxing Federation, carry out functions or exercise positions in the State sphere.

Article 74.

1. The scope of the federative discipline extends to the infringements of the rules of the game and the general rules of sport, typified in the Law of the Sport, in its provisions of development and in the own legal order of the Federation Spanish Boxing.

2. Actions or omissions which, during the course of the game, violate, prevent or disturb their normal development are violations of the rules of the game.

3. Other actions or omissions which are contrary to what they determine, oblige or prohibit, are an infringement of the general rules of sport.

Article 75.

1. In determining the responsibility for sporting offences, the federative disciplinary body must abide by the principles reporting on the right of sanctioning.

2. No penalty may be imposed for actions or omissions which are not typified as an infringement at the time of the date of application; nor may corrective measures be imposed which are not laid down as a rule prior to Commission of the European Union

3. Penalties may be imposed only on the basis of a file instructed to the effect with an audience of the person concerned and subsequent right or appeal.

Article 76.

At the express and well-founded request of the person concerned, the disciplinary bodies may, in a reasoned opinion, agree to suspend the execution of the penalties imposed, irrespective of the procedure followed, without the mere interposition of the resources which the same applies to paralyse or suspend its compliance.

The possibility of suspension, with the same capacity as powers, will also be exercised in the case of sanctions consistent with the closure of sports facilities.

In any case, it will be weighted, as a special circumstance to access to leave in abeyance the execution of the act resorted, the damages of difficult or impossible reparation that could be derived from its fulfillment.

Article 77.

At the Secretariat of the disciplinary body of the Spanish Boxing Federation, a record of the sanctions imposed, for the purposes, among others, of the possible assessment of circumstances, must be carried out scrupulously and in the day. changes in the liability and the calculation of the terms of the prescription, both for infringements and for penalties.

Article 78.

The resolutions must express the classification of the fact that is sanctioned, by appointment of the violated precept and expression of the appeal that can be brought, illustrating about the organ to which it corresponds to direct it and of the term established for this.

Article 79.

The faults can be very serious, serious and mild, determination that will be made based on the principles and criteria set out in Royal Decree 1591/1992, of December 23, on sports discipline.

Article 80.

They will be considered, in any case, as very serious common violations of the rules of the game or competition or the general sports rules, the following:

1. Abuse of authority.

2. The breaches of sanctions imposed. The infringement shall be assessed in all cases where the sanctions are enforceable. The same scheme shall apply in the case of a breach of precautionary measures.

3. Actions aimed at predetermining by price, intimidation or simple agreements the result of a test or competition.

4. Aggressive and anti-sports behaviour, attitudes and gestures of players, when they are addressed to the referee, to other players or to the public.

5. The public statements of directors, technicians, referees and athletes or members who incite their teams or spectators to the violence.

6. The lack of non-justified assistance to the calls for national sports teams.

To these effects the call is understood as regards both the training and the celebration of the test or contest.

7. Participation in competitions organized by countries that promote racial discrimination, or those that weigh sports sanctions imposed by international organizations, or with athletes representing them.

8. The acts of law and public that threaten the dignity or decorum of sport, when they are a special gravity. The recidivism in serious infringements by facts of this nature shall also be considered to be very serious.

9. The manipulation or alteration, either personally or through person, of the material or sports equipment against the technical rules when they can alter the security of the test or contest or endanger the integrity of the people.

10. Improper alignment and unjustified inappearance or withdrawal of evidence, meetings or competitions.

11. The implementation of the resolutions of the Spanish Committee for Sports Discipline.

Article 81. Other very serious breaches of managers.

In addition to the common infractions previously provided, they are very serious specific violations of the President and other management members of the Spanish Boxing Federation:

1. Failure to comply with General Assembly agreements, as well as electoral regulations and other statutory or regulatory provisions.

Non-compliance with the constitutive sports discipline shall be those expressed in the Statutes and Regulations of the Spanish Boxing Federation, or those which, not yet, are of a serious nature or are of special importance. Transcendence.

2. The non-convocation, within the legal deadlines or conditions, in a systematic and repeated manner of the federal collegiate bodies.

3. The incorrect use of private funds or subsidies, guarantees and other aid from the State, its autonomous bodies, or otherwise granted, from the General Budget of the State.

To this effect, the assessment of the incorrect use of public funds will be governed by the criteria that for the use of public subsidies and subsidies are contained in the specific legislation of the State.

As for the private funds, it will be the negligent or intentional character of the conduct.

4. The commitment of expenditure of a multiannual nature of the budget of the Sports Federations, without the regulatory authorization.

Such authorization is provided for in Article 29 of Royal Decree 1835/1991 of 20 December, on Spanish sports federations, or in the regulations that at any time regulate such cases.

5. The organisation of official sports activities or competitions of an international nature, without the regulatory authority.

Article 82. Other very serious infringements in the field of professional sport.

In addition to those set out in the previous two articles, they are very serious specific infringements of professional sports clubs, organizers and, where appropriate, their administrators or managers:

1. Failure to comply with the agreements on the bags.

Non-compliance will be understood to have occurred once the time-limits provided for in each case have been exceeded, which will be counted since the commitment has been met.

2. Failure to comply with the duties or commitments acquired with the State or with the athletes.

3. Failure to comply with the liability regimes of the members of the Boards of Directors.

Article 83. Very serious infringement of the Spanish Boxing Federation.

A very serious infringement of the Spanish Boxing Federation shall be deemed to be the unjustified non-issuance of a licence, as provided for in Article 7.1 of Royal Decree 1835/1991 of 20 December 1991 on Federations Spanish sports, and development provisions.

Article 84. Serious infringements.

Serious violations will be considered:

1. Repeated non-compliance with orders and instructions issued by the competent sports bodies. Such bodies include the arbitrators, judges, timekeepers, technicians, managers and other sports authorities.

2. The notorious and public acts that threaten the dignity or sports decorum.

3. The exercise of public or private activities declared incompatible with the activity or sporting function performed.

4. The non-convocation, within the legal deadlines or conditions, of the federal collegiate bodies.

5. Failure to comply with the rules of administration and management of the budget and assets provided for in Article 36 of the Law of Sport and specified in its implementing provisions.

6. The manipulation or alteration, either personally or through person, of the material or sports equipment against the technical rules.

Article 85. Minor infractions.

Any conduct contrary to sports rules which are not subject to the classification of very serious or serious in the previous articles or in the regulations of the Federation shall be considered to be minor offences. Spanish Boxing.

In any case, they will be considered minor faults:

1. The comments made to the judges, arbitrators, technicians, managers and other sporting authorities in the performance of their duties in such a way as to mean a slight correction.

2. The slight incorrectness with the public, companions and subordinates.

3. The adoption of a passive attitude in the performance of the orders and instructions received from judges, referees and sports authorities in the performance of their duties.

4. Neglect in the conservation and care of social premises, sports facilities and other material means.

Article 86. Penalty to the Federation for very serious misconduct.

By the commission of the infringement provided for in Article 83 of the present Statutes, a fine of 50,000 to 5,000,000 pesetas may be imposed on the Spanish Federation of Boxing, regardless of the right to repeat against the person or persons who may be directly responsible for such an offence, who, where appropriate, may be punished for incurring abuse of authority.

For the determination of the amount of the penalty the budget of the Federation will be taken into account.

Article 87.

The penalties for application by the commission of very serious common faults will be as follows:

1. Fines not less than 500 000 pesetas and no more than 5,000,000 pesetas.

2. Loss of places in the rankings.

3. Closure of sports venues.

4. Prohibition of access to the places of development of the tests or competitions, no longer than five years.

5. Disablement to occupy positions in sports organizations, suspension or deprivation of federal license on a temporary basis of two to five years.

6. Disablement in perpetuity to occupy positions in sports organizations, suspension or deprivation of federal license also in perpetuity, in case of recidivism in infractions of extraordinary gravity.

Article 88.

The sanctions that can be applied by the commission of very serious faults of the directors will be the following:

1. Public admonition.

2. Temporary disablement from two months to one year.

3. Removal from office.

Article 89. Penalties for serious infringements:

1. Public admonition.

2. Fine of 100 to 500,000 pesetas.

3. Loss of places in the rankings.

4. Closure of the sports hall for two months.

5. Disablement to hold positions in sports organizations, suspension or deprivation of a federal license from one month to two years.

Article 90.

The penalties for application by the commission of minor faults will be as follows:

1. Warning.

2. Admonition.

3. Disablement to hold office, suspension, or license deprivation for up to one month.

Article 91.

Only penalties consisting of a fine may be imposed in cases where the boxers, technicians or judges/arbitrators receive remuneration for their work. Their amounts must previously be quantified in the disciplinary regulation of the Spanish Boxing Federation.

For the same infringement, a fine may be imposed simultaneously on any other sanction of a different nature, provided that they are intended for the category of the infringement and are consistent with the seriousness of the infringement.

The non-payment of financial penalties will be considered as a violation of sanctions.

Article 92.

The disciplinary body shall be entitled to alter the outcome of the competitions, in the case of a punishable event due to pre-determination by price, intimidation or simple agreements to alter the outcome of the event. test.

Article 93. Prescription, timing and computation.

Infringements will be prescribed at three years, a year or a month, depending on whether they are very serious, serious or minor, starting to count the limitation period to the next day of the commission of the offence.

The limitation period shall be interrupted by the initiation of the sanctioning procedure, but if the person or entity subject to the procedure is paralyzed for one month for reasons not attributable to the person or entity, he shall return to the the relevant time limit, the limitation of the time limit being renewed once the processing of the dossier is resumed.

The penalties shall be imposed at three years, the year or the month, in the case of those relating to very serious, serious or minor infringements, beginning to count the limitation period from the day following that in which the (a) the resolution by which the sanction was imposed, or from the fact that its compliance was broken if it has begun.

Article 94. Disciplinary proceedings.

Only disciplinary sanctions may be imposed on the basis of a case-file.

In the case of the substantiation of the different procedures, the provisions of Title II of Royal Decree 1591/1992 of 23 December 1992 on Sports Discipline will be included.

Article 95. Matters which may be reconciled.

The dispute settlement procedure may be submitted to the conciliation procedure or disputes arising between members of the Spanish Boxing Federation, or subjects directly interested in boxing, on the occasion of the application of the sports rules which, because they are not included in the legal system, are freely available to the parties and whose infringement is not subject to disciplinary action.

The following issues cannot be reconciled:

1. Those arising in relations with the High Council of Sport, relating to the tasks entrusted to that body.

2. Those that relate to the control of banned substances and methods in sport, and safety in sports practice.

3. Those relating to grants awarded by the High Council for Sport and, in general, those relating to public funds.

4. As a general rule, those included in Article 2 of the Arbitration Act of 5 December 1988.

Article 96. Procedure rules.

1. The expression of the unambiguously will of the parties in conflict to submit to the conciliation procedure will be required. To this end, an arbitration agreement shall be signed in writing, in which the waiver of the judicial path, the obligation to submit to the arbitrator or arbitrators and the rules of procedure shall be expressed in writing.

2. The appointment of the arbitrator or arbitrators may be made by the parties to the arbitration agreement or entrusted to a third party. These are the causes of abstention and recusal from the legislation in force.

3. The costs incurred by the conciliation procedure shall be borne in equal parts by the litigants, unless the arbitral tribunal decides otherwise.

4. The arbitration agreement may agree to entrust the procedure to corporations governed by public law or non-profit entities in whose Statutes the arbitration functions are provided.

5. For the matters governed by this title, the rules on extrajudicial conciliation contained in the Law of Sport, its standards of desa

TITLE VIII

Documentary Regime

Article 97.

The documentary regime of the Spanish Boxing Federation will comprise the following books:

1. Record book of Autonomous Federations and Delegations, which shall reflect the names of the same, their registered office, field of competence, organization, names and names of the President and the collective organs of government and representation, dates of the inauguration and the cessation of the same.

2. Book of boxing sports associations, in which the names of these and registered offices, names and names of the Presidents and other members of the Board of Directors, date of possession and termination of the said posts shall be established.

3. Record books, which will record the meetings held by all the collegiate bodies of the Spanish Boxing Federation, both in government and representation, as well as technicians.

Advertising and reporting rules:

(a) By way of certification through the General Secretariat, upon request, addressed to the President of the Spanish Boxing Federation.

b) Direct statement of the books: Prior written reasoned and directed to the President. The exhibition of the books will be made at the premises of the Spanish Boxing Federation and in the presence of the Secretary General.

c) The Sports Council shall have the right to supervise the books and accounts of the Spanish Boxing Federation.

TITLE IX

Legal regime

Article 98.

In the light of the acts and agreements of the organs of the Spanish Boxing Federation which does not involve the exercise of public functions of an administrative nature, the members of the Federation may attend, once the resources have been exhausted federative, to the ordinary jurisdiction. If the parties involved in the dispute voluntarily submit to it, they may refer to an arbitration of equity, in which the arbitrators will be appointed by the Superior Council of Sports.

TITLE X

Autonomic Federations

Article 99.

The integration of the autonomic Federations into the Spanish Boxing Federation will be produced after agreement adopted by the organ that according to its Statutes corresponds, which will be raised to the Spanish Federation of Boxing, with express the declaration that they are freely and expressly subject to the determinations which, in the exercise of the federative powers, must be taken in respect of participation in competitions at the state and international level.

Article 100.

The integration produced, the following rules apply:

1. The Autonomous Federations shall retain their legal personality, their own and differentiated assets, their budget and their particular legal status.

Without prejudice to the foregoing, the Spanish Boxing Federation shall monitor, in accordance with the criteria of the General Assembly, the grants received by the Autonomous Federations of the Federation or through it, seeking to obtain the budgets.

2. The Presidents of the Autonomous Federal Federations shall be a member of the General Assembly of the Spanish Boxing Federation, representing them. In any case, only one representative shall exist for each of them.

3. The sports disciplinary regime, in the case of official state-wide competitions, will in any case be the one provided for in the Law of Sport, in the Royal Decree of Sports Discipline, in the present Statutes and in the specific regulation of sports discipline of the Spanish Boxing Federation, regardless of the content of the provisions in force in the respective autonomous areas.

4. The Autonomous Regional Federations, integrated in the Spanish Boxing Federation, will be represented in the respective Autonomous Community.

5. There shall be no territorial delegation of the Spanish Boxing Federation in the field of an autonomous federation, when it is integrated into that Federation.

Article 101.

Federations integrated into the Boxing Federation will have to provide the necessary information to enable them to know, at all times, the programming and development of the sports activities.

They will transfer their statutory and regulatory rules to the Spanish Boxing Federation.

They will also account for the Spanish Boxing Federation of the ups and downs of their affiliated clubs, boxers, referees and technicians.

Article 102.

The territorial jurisdiction of the Federations will coincide with that of the respective Autonomous Communities.

Article 103.

The autonomic federations will be represented through their President in the General Assembly.

Article 104.

the autonomic federations with legal personality will adjust their statutes to the rules dictated by the corresponding Autonomous Communities, which will have to recognize the competition of the Spanish Boxing Federation in the official competitions organised by it or which the same delegates to them, which exceed their autonomy and in disciplinary matters according to Royal Decree 1591/1992.

Article 105.

The Autonomous Federations will have to collect the shares of the members of the Spanish Boxing Federation and hand them over to it.

Article 106.

The autonomic federations lacking legal personality will have the character of delegations, likewise there will be delegations of the Spanish Federation of Boxing in those Autonomous Communities whose Federation is not integrated in the same, according to rules of the Royal Decree.

TITLE XI

Article 107. Extinction.

The Spanish Boxing Federation will dissolve:

1. For the revocation of his recognition. If the conditions or motivations that gave rise to it disappeared, or the Board of Directors of the Higher Sports Council considers that the objectives for which the Federation was constituted, a procedure will be instructed addressed to the revocation of that recognition, with the hearing of the Spanish Federation of Boxing itself and, where appropriate, of the Federations of autonomy within it integrated.

The Board of Directors of the Higher Sports Council will decide on such a revocation and against its agreement to bring the relevant administrative resources.

2. By judicial resolution.

3. For the other reasons provided for in the general legal order.

In case of dissolution of the Spanish Boxing Federation, its net worth, if any, will be applied to the carrying out of analogous activities, determined by the Superior Council of Sports its concrete destiny.

TITLE XII

Amendments to the Statutes

Article 108.

The Statutes of the Spanish Boxing Federation may only be amended by agreement of the Assembly, after the inclusion of the amendment in the order of the day of the amendment.

Article 109.

The modification proposal may be performed:

1. For a quarter of the members of the Assembly.

2. For the Delegate Committee.

3. For the President.

Article 110.

Approved the modification of the Statutes, this will only be effective from the moment it is ratified by the Superior Council of Sports.

Transitional provisions.

First.-As long as the integration of the territorial Federations into the Spanish Federation of Boxing is carried out, as provided for in the present Statutes, all territorial Federations will be considered to be integrated into the Spanish Boxing Federation, with the deadline of one year being set from the publication in the Official State Gazette to bring it into effect.

Second.-The changes that the Superior Council of Sports may make to the contents of these Statutes shall be automatically considered assumed by the General Assembly without the need for a new meeting of the same for the ratification of these possible amendments, which shall be incorporated in the final text of these Statutes.

Final provisions.

First.-The Statutes of the Spanish Boxing Federation have been repealed until now in force, approved by the Board of Directors of the Superior Council of Sports on January 11, 1989.

Second. -Likewise, the Sports Discipline Regulation of the Spanish Boxing Federation is repealed, as well as all the modifications made to it during its validity, in all that is in contradiction with the legal provisions and present Statutes.

Third. -This Statute shall enter into force on the day following its approval by the Board of Directors of the Superior Council of Sports, without prejudice to its publication in the Official Journal of the State.
