The persistence of the current adverse weather conditions in some regions recommends that measures should be taken to help alleviate the effects of the adverse weather on farms, particularly from the economic point of view. irrigation.

Likewise, it is appropriate to authorize a transfer of flows of up to 10 cubic meters during 1994 between the water basins of the South and the Segura, in order to compensate for the irrigation deficit.

The General Administration of the State is competent to regulate the matters contained in this provision, in accordance with the competent titles contained in Article 149.1.1. and 22. of the Constitution.

In its virtue, in use of the authorization contained in article 86 of the Constitution, on a proposal of the Ministry of Public Works, Transport and Environment, and after deliberation of the Council of Ministers at its meeting of the 4th of February 1994,

D I S P O N G O:

Article 1. Moratoria on the payment of water utilization rates.

The payment of water usage fees, deferred until 1994 by Article 3.3 of Royal Decree-Law 8/1993 of 21 May, is postponed until 1995. The Ministry of Public Works, Transport and the Environment will determine, from 1995, the system of multi-annual depreciation of debts accumulated by the moratoria applied to the rates of the different irrigation campaigns of this period.

These new deferral measures will not apply in the regables areas of the Tagus river basin and in the municipal terms falling within the scope of the same as listed in the Annex to this Royal Decree-law.

The decrease in revenue which, for the affected Hydrographic Confederations, may result from such deferrals will be compensated in its entirety by a transfer of funds to be carried out by the Ministry of Public Works, Transport and Environment.

Article 2. Transfer of flows from the Almanzora basin to the southern regadios of the Segura river basin.

A transfer of up to 10 cubic hectolitres of water volume during 1994 is authorized from the Almanzora reservoir in the Southern hydrographic basin to the southern regadios of the Segura hydrographic basin. to compensate for irrigation deficit.

Single end disposition. Entry into force.

This Royal Decree-law will enter into force on the same day as its publication in the Official Journal of the State.
