Article 35 of the Organic Law 1/1990 of 3 October, for the General Management of the Educational System, provides that the Government, after consulting the Autonomous Communities, will establish the titles corresponding to the vocational training, as well as the minimum teaching of each of them.

Once, by Royal Decree 676/1993 of 7 May, the general guidelines for the establishment of vocational training qualifications and their corresponding minimum teachings have been laid down, the Government should also After consulting the Autonomous Communities, as provided for in the abovementioned rules, establish each professional training title, set out their respective minimum teachings and determine the various aspects of the relevant academic organisation. to professional lessons which, without prejudice to the powers conferred on them Educational administrations responsible for the establishment of the curriculum of these teachings, guarantee a basic training common to all students.

For these purposes, the duration and level of the corresponding training cycle will be determined in each case; the convalidations of these teachings; the access to other studies and the minimum requirements of the institutions (i)

The teachers ' specialties to be taught must also be determined and, in accordance with the Autonomous Communities, the equivalence of qualifications for the purposes of teaching as provided for in the Additional provision of the Organic Law of 3 October 1990 on the General Management of the Educational System. Subsequent rules must, if necessary, complete the teaching of the teachers ' specialties defined in this Royal Decree with the professional modules that come from other formative cycles.

On the other hand, and in compliance with article 7 of the aforementioned Royal Decree 676/1993, of 7 May, it is included in this Royal Decree, in terms of professional profile, the expression of the professional competence characteristic of the title.

This Royal Decree establishes and regulates in the basic aspects and elements the title of professional training of the Technical Superior in the Management of Transport.

In its virtue, on the proposal of the Minister of Education and Science, consulted by the Autonomous Communities and, where appropriate, in agreement with them, with the reports of the General Council of Vocational Training and the School Council of the State, and prior to the Council of Ministers meeting at its meeting on 22 July 1994

DISPONGO:

Article 1.

The title of professional training of the Technical Senior in Transport Management is established, which will be of official character and validity throughout the national territory, and the corresponding minimum teachings are approved. in the Annex to this Royal Decree.

Article 2.

1. The duration and level of the training cycle are as laid down in paragraph 1 of the Annex.

2. In order to access the professional studies regulated in this Royal Decree, the students will have to take up the subjects and/or contents of the Baccalaureate which are indicated in section 3.6 of the Annex.

3. The specialities required of the teaching staff providing teaching in the modules which make up this title, as well as the minimum requirements to be met by the educational establishments, are those expressed in paragraphs 4.1 and 5 of the Annex.

4. Baccalaureate subjects which may be taught by the teachers of the specialties defined in this Royal Decree are laid down in paragraph 4.2 of the Annex.

5. In relation to the provisions of the 11th additional provision of the Organic Law 1/1990 of 3 October, the qualifications referred to in paragraph 4.3 of the Annex are declared equivalent for the purposes of teaching.

6. The modules which may be validated by occupational vocational training or correspondence with the work practice are those specified in paragraphs 6.1 and 6.2 of the Annex respectively.

Without prejudice to the foregoing, on the proposal of the Ministries of Education and Science and of Work and Social Security, other modules capable of validation and correspondence with the training may be included, as appropriate. occupational occupational and occupational practice.

7. The university studies to which this title gives access are those referred to in paragraph 6.3 of the Annex.

Single additional disposition.

In accordance with the provisions of Royal Decree 676/1993 of 7 May 1993 laying down general guidelines on diplomas and the corresponding minimum training courses for vocational training, the elements which are enunciate under the heading in paragraph 2 of the Annex to this Royal Decree do not constitute a regulation of the exercise of profession entitled any and, in any case, will be understood in the context of the present Royal I decree with respect to the scope of the professional exercise linked by the legislation in force to the Professions entitled.

Final disposition first.

This Royal Decree, which is of a basic nature, is given in the use of the powers conferred on the State in Article 149.1.30. of the Constitution, as well as in the first paragraph 2 of the Organic Law The Law of 3 July 1985 on the Right to Education, and by virtue of the empowerment conferred on the Government by Article 4.2 of the Organic Law 1/1990 of 3 October of General Ordination of the Educational System.

Final disposition second.

It is up to the competent educational authorities to dictate how many provisions are precise, in the field of their competences, for the execution and development of the provisions of this Royal Decree.

Final disposition third.

This Royal Decree will enter into force on the day following its publication in the Official Journal of the State.

The general professional qualification requirements of the production system for this technician are:

Manage and market the freight and passenger transport service according to specifications received and organize and plan the exploitation of land operations at national and international level and in the framework of the objectives and processes established.

This technician will act, if any, under the general supervision of Licensors and/or Diplomates.

2.1.2 Professional skills.

-Apply the national and international regulations in force in the transport operations, adapting to the frequent changes that occur in the transport operations.

REALIZATION CRITERIA

1.1 Get and process transport sector information necessary for the development of the activity, optimizing the availability and the access time to it. /-The needs for economic, legal and regulatory information affecting the sector are identified.

-Information sources related to the sector are identified (Ministry of Public Works, Transport and Environment, Ministry of Industry and Energy, ASTIC, IMO, FETEIA, IATA, AENA, CLECAT, FIATA, IRU, ICAO, Chambers of Trade, embassies, consulates, , , industry publications, and others) that provide the most reliable information.

-Companies in the sector are identified, differentiating between the partners and those of the competition to obtain information on business practices, development and usual actions.

-Select the industry-specific publications that are of interest to the company.

-Procedures are established to obtain information in an easy and fast way (regular meetings, interviews, subscriptions, membership of professional associations and others) according to the established budget.

1.2 Manage and control the insurance of the fleet, of the goods and travelers, in order to guarantee the responsibility according to the current regulations. /-The regulations on insurance of means of transport, goods and passengers are identified, as well as the established in concept of compensation and responsibilities to know the periodic framework of action.

-The choice between the different offers of insurance requested (covers, risks, etc.) is best suited to the needs of the company, ensuring the coverage up to the maximum possible and/or advisable of the real risks and/or potential derivatives of the transport operation, applying the criteria established by the company.

When the characteristics of the insurance to be contracted exceed the area of assigned responsibility, the various offers received promptly are transmitted to management.

-The appropriate parties are prepared to notify insurance companies of the imputations to the floating policies, within the prescribed time limits, specifying correctly dates and characteristics of the different shipments.

-In case of claims, the insurance policy is checked for the clause on obligations, liabilities and limits of compensation, in order to determine actions appropriate to the situation.

-It is transmitted and presents to the insurance company in accordance with the established procedures the claim for the sinister produced and all the necessary documentation for its processing within the deadlines required in the Code of Commerce and the Law of Insurance.

-It is verified that the amount and process of the settlement of the claim is correct and according to the required.

Declarations of transport (national highway) C.C., applying the LOT/ROTT.

-Prior to the compliance of the Chief of Traffic, correspondent, subsidiary and/or franchise, the clients are invoiced for the services provided within the established time limit, according to the contracted conditions and with the current regulations.

1.5 Manage and control administrative relations with correspondents, affiliates and/or franchises in the time and form established. /-Management is provided in time and forms the necessary information to select the appropriate correspondent or franchise in each zone, according to the reports received from the Traffic Department.

-The various contracts or protocols of collaboration with correspondents, franchises, transport companies, etc. are elaborated correctly, according to the instructions received by the management.

-Administrative procedures are established to streamline communication and information processes with correspondents, subsidiaries and/or franchises and facilitate the control of the services provided.

-The status of the accounts with the correspondents is controlled at any time, informing the relevant department to proceed with its billing or payment in the established time.

1.6 Control the profitability of each shipment, medium, line of transport, department and section, valuing the parameters involved in the formation of costs. /-All necessary information is obtained and systematized in order to be able to determine the costs of the transport of the goods or passengers (rates, current fluctuation of prices, offers of the suppliers, prices that the correspondent, subsidiary and/or (ii) the right to access and access to the data easily, in the light of the necessary arrangements, in the light of the need for its use.

REALIZATION CRITERIA

-They establish with correspondents, subsidiaries and/or franchises the routes, itineraries and schedules of the regular lines and the occasional transports identifying and/or establishing:

2.3 Manage the use of the fleet and/or the hiring of transport units or cargo spaces in other means, allocating the necessary human and material resources to each service, according to the organization and (i) planning, in such a way as to maximise their profitability, to achieve the quality of the service and to ensure compliance with road safety standards. /-Information is obtained from the maintenance department, about the availability of the fleet and its possible use for the intended transport.

-The situation of the vehicles being repaired, the duration of the vehicles, the place of repair and the allocated budget are controlled.

-Regular evaluations of the life of the fleet are carried out, taking into account the degree of use and the legislation in force to control their renewal and compliance with the regulations.

-The precise information of the commercial department and/or of the clients, centers of distribution of loads and companies collaborating of the sector on the contracted transports is obtained sufficiently in advance.

-The loads are assigned to the regular and/or discretionary transport units according to the technical, schedule and travel characteristics, achieving the optimization of the resources (avoiding vacuum returns, on average load and time dead) and the quality of service.

-Sets, if necessary, the required extension of the number of outputs a line has, assessing the amount of load and its characteristics.

-When the units of the own fleet are insufficient to satisfy the contracted services or the profitability of the same it requires, it comes to the rental of means of transport of the collaborating companies in the conditions (i) established or contracted other means under the best conditions according to the market situation.

It is proven that the means of transport itself or contracted meets all the requirements set and has all the authorizations and equipment necessary for its implementation by identifying and/or establishing:

The technical state of the transport units from the corresponding reports.

Technical characteristics, with due permissions (number of axes, weights and dimensions, pollution, tachograph, etc.).

5. Minimum requirements for spaces and facilities to impart these teachings

In accordance with Article 39 of Royal Decree 1004/1991 of 14 June 1991, of the training cycle of higher-grade vocational training: Management of Transport, it requires, for the delivery of the lessons defined in the Royal Decree, the following minimum spaces, which include those laid down in Article 32.1.a) of that Royal Decree 1004/1991 of 14 June 1991.

The degree of utilization expresses in so much percent the occupation in hours of the planned space for the imparting of the minimum teachings, by a group of students, regarding the total duration of these teachings and, therefore, has a guiding sense for which educational administrations will define when setting up the curriculum.

In the margin allowed by the "degree of utilization", the established training spaces can be occupied by other groups of students who will be able to attend the same or other educational courses or other educational stages.

In any case, the learning activities associated with the training spaces (with the occupation expressed by the degree of use) may be carried out on surfaces used for other related training activities.

It should not be interpreted that the different learning spaces identified must necessarily be differentiated by means of closure.
