In the exercise of the powers conferred by Article 10.2 (b) of Law 10/1990 of 15 October of the Sport, the Commission of the Council of Sports of the High Council of Sports has definitively adopted the Statutes of the Federation Spanish Ski Nautico and authorized its registration in the Register of Sports Associations.

In compliance with the provisions of Article 31.7 of the Law of Sport and Article 12.3 of Royal Decree 1835/1991 of 20 December 1991 on Spanish sports federations, the publication in the Official Journal of the Status > of the Statutes of the same and their modifications.

By virtue of the above, this Secretary of State agrees:

Arrange the publication of the Statutes of the Spanish Federation of Nautical Ski in the Annex to this Resolution.

ANNEX

Statutes of the Spanish Federation of Nautical Ski

General rules

Article 1.

The Spanish Federation of Nautical Ski is a non-profit, associative entity with legal personality and its own and independent patrimony of its associates, of private character and legal configuration, dedicated to the promotion, practice and development of nautical skiing within the national territory. He is a delegation of public functions of an administrative nature, acting in this case as a contributing agent of the Public Administration.

Article 2.

The Spanish Federation of Nautical Ski is made up of sports federations with autonomy, clubs, athletes, technicians (judges, pilots and monitors).

Article 3.

The Spanish Federation of Nautical Ski will be governed by the provisions of Law 10/1990 of 15 October; Royal Decree 1835/1991 of 20 December, on Spanish sports federations, and other implementing rules, as well as by the present Statutes and provisions or regulations of internal order.

Article 4.

In the field of sport and training are the functions of the Spanish Federation of Nautical Ski, among others, the following functions:

4.1 Encourage the development and practice of its sports modality and any extension recommended by the International Federation of Nautical Ski.

4.2 Reglamenting and organizing competitions.

4.3 Starting courses of technicians, monitors and issuing the corresponding national certification.

Article 5.

In addition to the activities of government, administration, management, organization and regulation of the specialties that correspond to its sports modality, the Spanish Federation of Nautical Ski, exercises under the organization and protection of the Superior Council of Sports, the following technical functions of an administrative nature.

5.1 Qualify and organize all state-wide activities and competitions.

5.2 To act in coordination with the regional federations, the promotion of their sports modality throughout the national territory.

5.3 Design, develop and execute in collaboration, in their case, with the regional federations, the plans of preparation of their respective high level athletes.

5.4 Collaborating with the State Administration and the Autonomous Communities in the training of sports technicians and in the prevention, control and repression of the use of prohibited substances and pharmacological groups and methods regulations in sport.

5.5 Organize or protect all official international competitions held in the national territory.

5.6 Exercise disciplinary, sporting, in the terms established in the Law of Sport, in its specific provisions of development, statutes and regulations.

5.7 Exercise the control of the grants to be assigned to the associations and sports entities, according to the conditions set by the Superior Council of Sports.

5.8 Run the resolutions of the Spanish Sports Discipline Committee.

5.9 The acts performed by the Spanish Federation of Nautical Ski, in the exercise of public functions of an administrative nature, are subject to appeal to the Superior Council of Sports, whose resolutions deplete the administrative route.

Article 6.

The Spanish Federation of Nautical Ski holds the representation of Spain in the official sports activities and competitions, of an international character, held outside and within the National Territory.

6.1 To organize, request or compromise this type of activities or competitions of any kind, the corresponding permission will be requested to the Spanish Federation of Nautical Ski and this, in turn, must obtain the Authorisation of the High Council of Sport.

6.2 The Spanish Federation of Nautical Ski represents in Spain, with exclusive character to the International Federation of Nautical Ski.

Article 7.

The scope of the Spanish Federation of Nautical Ski, in the development of the competences that are their own, in defense and promotion in general of their sports modality, extends to the entire national territory.

Article 8.

The address of the Spanish Federation of Nautical Ski is located in Barcelona, on the street of Sabino de Arana, number 30. It can be transferred within the same term, by agreement of the General Assembly on a proposal of the Board of Directors.

For a move out of the region a change of Bylaws will be necessary.

Organic structure

Article 9.

9.1 The upper organs of government and representation of the Spanish Federation of Nautical Ski are:

General Assembly

Whose breast will be chosen a Commission Delegate of assistance to it.

President.

These are complementary organs of the above:

Board of Directors.

Manager.

Secretary.

9.2 The President, the General Assembly and the Delegate Committee are elected bodies.

The rest of the organs, Board of Directors, Manager and Secretary, will be freely appointed and revoked by the President.

Article 10.

The convening of the governing bodies and representation of the Spanish Federation of Nautical Ski is up to its President, in the form and time that will be indicated later.

Article 11.

The agreements of the governing bodies and representation of the Spanish Federation of Nautical Ski will be adopted by a simple majority of the assistants, except in those cases provided otherwise by the laws in force and/or by the present Statutes.

Article 12.

The votes against the agreements adopted by the governing bodies and representation of the Spanish Federation of Nautical Ski, and the reasoned abstentions, will exempt from the responsibilities that such agreements could If they are contrary to the law.

General Assembly

Article 13.

The General Assembly is the top organ of the Spanish Federation of Nautical Ski in which the entities and natural persons are represented according to Article 2 of these Statutes.

Your composition will be as follows:

Presidents of regional federations.

Athletes ' station.

Club station.

Station of technicians.

The proportions and numbers in which the indicated estates will be represented will be those determined in the electoral regulation, as well as in the legal provisions at that time.

Article 14.

14.1 The Presidents of the Autonomous Federations will be part of the General Assembly by showing the representation of those, while their term of office lasts.

14.2 The remaining members of the General Assembly shall be elected every four years, coinciding with the years of the Summer Olympic Games, by free and secret suffrage, equal and direct between and by the components of each in accordance with the proportions laid down in the Rules of Procedure.

In the event that a natural person elected as a member of the General Assembly changes the affiliation of one Autonomous Community to another, it will not be able to represent the autonomy for which he was elected.

The autonomy of this case should again elect among all its members the vacancy.

All members of the General Assembly, in order to be able to attend the General Assembly, must be in possession of their current federal license and previously communicated to the Spanish Federation of Nautical Ski.

Article 15.

15.1 The General Assembly shall meet once a year, on an ordinary basis, for the purposes of its competence. The other meetings shall be extraordinary and may be convened at the initiative of:

President of the Spanish Federation of Nautical Ski.

15.2 The sessions of the General Assembly will be able to attend with a voice, but without a vote, the President of the Spanish Federation of Nautical Ski, of the last term.

15.3 The functions of the General Assembly shall be as follows:

The approval of the annual budget and its liquidation.

The approval of the sports calendar.

The approval and modification of its Statutes.

The election and the end of the president.

Article 16.

The convocation of the ordinary General Assembly of the Spanish Federation of Nautical Ski corresponds to its President, who must carry out with, at least, thirty days in advance, by means of notification addressed to each of the its members, accompanying the appropriate agenda.

Within ten days of the notification of the call, the member who considers it appropriate may, individually or jointly, request the President of the Spanish Federation of Nautical Ski, in writing reason, the inclusion on the agenda of those items which are deemed necessary. The President shall, within a period of not less than 10 days before the date of the General Assembly, send the members of the General Assembly the new items on the agenda, as well as the documents relating thereto.

Article 17.

The General Assembly shall be validly constituted when the majority of its members are present, and in the second, the third part of the members of the General Assembly.

Article 18.

The General Assembly agreements shall be adopted by a simple majority of the assistants, except for the reason that the present Statutes provide for a more qualified majority.

President

Article 19.

The President is the executive organ of the Spanish Federation of Nautical Ski. It holds its legal representation, convenes and presides over the governing and representation bodies, and executes the agreements thereof.

Article 20.

It is for the President to grant the powers of representation, administration and any other kind deemed necessary, to show the direction of the federal administration, to authorize with his signature all kinds of documents public or private and authorise payments.

Article 21.

He will be elected every four years, coinciding with the years of the Summer Olympics, by free, direct, equal and secret suffrage, by the members of the General Assembly.

The candidates, who may not be members of the General Assembly, must be supported by at least 15 percent of the members of the Assembly, where they will only be able to support a single candidate and their election will be produced by the Assembly. double system, in the event that in a first no candidate reaches the absolute majority of the votes cast.

Article 22.

The President of the Spanish Federation of Nautical Ski will also be of the General Assembly and of the Commission Delegate, with a vote of quality in case of a tie in the adoption of the agreements of one and another organ.

Article 23.

The performance of the office of President will be the cause of incompatibility to occupy managerial positions in another Spanish sports federation.

Article 24.

You may not be elected President of the Spanish Federation of Nautical Ski, who would have held such a condition uninterrupted during the three periods immediately above, whatever the effective duration was. of these.

Article 25.

The procedure of election of the President shall be carried out in accordance with the provisions of its corresponding electoral regulation.

Article 26.

Vacancy the presidency, the Board of Directors will hold elections to the same, chaired by one of the Vice-Presidents or, in its absence, by the Vocal of greater age.

Article 27.

In cases of absence or temporary incapacity, the President will be replaced by the Vice President, who will be a member of the General Assembly.

Article 28.

The President will cease for any of the following reasons:

1. Course of the deadline for which he was elected.

2. Death.

3. Resignation.

4. Approval of a motion of censure as provided for in these Statutes.

5. To incur any of the reasons for incompatibility previously provided or in those of ineligibility expressly related in its corresponding electoral regulation.

Article 29.

The motion of censure against the President of the Spanish Federation of Nautical Ski may be proposed by:

1. The General Assembly, by virtue of an agreement approved by a third of the assembly members.

2. The whole of the members of the Delegate Committee.

Article 30.

The motion of censure shall be presented in a reasoned manner to the President, stating in writing the reasons for the motion and signed by the members who support it.

General Assembly will be convened by the President in an extraordinary manner, so that the General Assembly will meet within a maximum of 15 days, with this motion of censure as the only item on the agenda.

Between the presentation of the motion of censure and the celebration of the General Assembly may not exceed thirty working days.

In the event of failure to proceed, the motion of censure may not be filed until one year after the vote.

Article 31.

When the motion of censure is presented, an alternative candidate should be proposed to the presidency, which will have to obtain a favorable vote of one-third of the assembly members at the time of their presentation.

The motion of censure will require the vote of the absolute majority of the attendees for approval. The session at which the motion of censure is debated will be chaired by the member of the General Assembly of the oldest age.

In the event of the approval of the vote of no confidence, the candidate presented by the promoters of the motion will be sworn in as President.

If the motion of censure does not prosper, no other vote may be filed until one year after the last.

Article 32.

The President and all other members of his Board of Directors will perform their duties with the utmost diligence and will respond to the Spanish Federation of Nautical Ski and in front of the creditors of the same for the property damage or economic that they have caused by malice, abuse of faculties or gross negligence. In any case, they will be exempt from liability, provided they have saved their vote in the agreements causing the damage.

Article 33.

The position of President of the Spanish Federation of Nautical Ski can be remunerated, provided that such an agreement, as well as the amount of the remuneration, is approved by half plus one of the members present in the Assembly General.

Gross remuneration, including legally established social expenses, cannot be satisfied by the public subsidies received by the Spanish Federation.

Article 34.

The President's remuneration will end with the end of his term of office, not being able to extend such remuneration beyond the duration of the term.

Delegate Commission

Article 35.

The Delegate Commission will be elected by the General Assembly to whom it also corresponds to its renewal in the form provided for in the electoral regulation.

Article 36.

The following functions are assigned to the Delegate Commission:

36.1 The modification of the sports calendar.

36.2 The modification of the budgets.

36.3 The approval and modification of the regulations.

36.4 The preparation of a report prior to the approval of the budgets.

36.5 The monitoring of the economic and sports management of the Federation, through the elaboration of an annual report to the General Assembly, on the memory of activities and the liquidation of the budget.

36.6 The Delegate Commission shall be collected four times a year, at least.

Article 37.

The proposals on these issues, included in Articles 36.1, 2 and 3, correspond exclusively to the President of the Federation or two-thirds of the members of the Delegate Committee.

Article 38.

The modifications before these may not exceed the limits and criteria that the General Assembly itself establishes.

Article 39.

The members of the Delegate Committee, who will be members of the General Assembly, will be elected every four years, by free, secret, equal and direct suffrage, with the possibility of replacing the vacancies that occur annually.

Article 40.

The Delegate Commission will be made up of three members, all of whom are entitled to speak and vote, and their President will be the Spanish Federation of Nautical Ski.

Your composition will be as follows:

A member corresponding to the presidents of the autonomic federations, chosen from each other.

A member corresponding to the club of clubs, chosen from among and by the different clubs integrated in the Assembly.

A member corresponding to the rest of the estates forming the General Assembly, elected from among all and with the corresponding estates, all according to the provisions of the electoral regulation.

Article 41.

The agreements of the Delegate Commission shall be adopted by a simple majority of the assistants, except for the exceptional circumstances provided for in the Law and in these Statutes, the quorum being necessary for it to be considered validly. The delegation of the two-thirds of its members.

Board of Directors

Article 42.

The Board of Directors is the collegiate body of management of the Spanish Federation of Nautical Ski. Its members are appointed and revoked by the President of the Spanish Federation of Nautical Ski, which will also be the Board of Directors.

Article 43.

Members of the Board of Directors who are not members of the General Assembly shall have access to the sessions of the General Assembly, with the right to a voice but without a vote.

Article 44.

The composition of the Board will be as follows:

President.

Three Vice-presidents. One of them has to be a member of the Assembly.

Ten Vocals, as the maximum number.

Article 45.

The members of the Board of Directors will not be remunerated, except when they are in function of the labor contract with the Spanish Federation of Nautical Ski.

Article 46.

The Board of Directors of the Spanish Federation of Nautical Ski will meet with ordinary character once a month and with extraordinary character whenever the President of the same, or request a number of Member States shall not be less than one third of the members.

The call is for the Secretary of the Board of Directors, under the mandate of the President, who must carry out the call with at least ten days in advance, except in exceptional cases of urgency by means of a notification addressed to each of its members, accompanying the agenda.

Article 47.

The Board of Directors will be validly constituted when the half plus one of its members is present, and the President or Vice-President must necessarily be present.

The agreements will be adopted by a majority of the attendees.

In case of a tie, the President, or whoever replaces him, will have a vote of quality.

Article 48.

48.1 The President may appoint from among the members of the Board of Directors a Permanent Commission composed of the President himself, the Secretariat of the Spanish Federation of Nautical Ski, the Vice President and a designated Vocal for the President.

48.2 The agreements adopted by the Permanent Commission must be brought to the attention of the Board of Directors.

48.3 The Permanent Commission shall be convened by the President when deemed necessary, with the assistance of half more than one of its members.

48.4 The agreements of the Permanent Commission shall require the approval of at least half of the members present, having the vote of the President in the event of a tie.

48.5 The Permanent Commission will be validly constituted when the majority of its members and in the second convocation, a third of the same, are present.

Article 49.

These are the functions of the Board:

49.1 Develop the projects of the Regulations for approval by the Delegate Commission.

49.2 Develop and propose the Economic Balance of the Federation to the General Assembly.

49.3 Develop and propose the draft budget of the Federation to the General Assembly.

49.4 Draw up reports and proposal to the General Assembly concerning matters falling within the scope of its powers.

49.5 Any other, which in the scope of the functions that are their own, are assigned to them by the implementing provisions or delegated by the President or the General Assembly.

Article 50.

The incompatibilities foreseen for the President of the Spanish Federation of Nautical Ski in Article 24 of these Statutes will be applied to the members of the Board of Directors.

Article 51.

Members of the Board of Directors will respond to the Higher Sports Council as to the grants received from the Board.

Manager

Article 52.

The Manager of the Spanish Federation of Nautical Ski is the administrative organ of the same, which will be appointed by the President and who will perform the following functions:

52.1 Take the accounting of the Spanish Federation.

52.2 Exercise the economic inspection and control of all the organs of the Spanish Federation.

52.3 Coordinate the performance of the technical-sports bodies of the Spanish Federation.

52.4 Authorizing payments by delegation of the President.

52.5 Generate own resources.

52.6 The other functions that could be attributed to the regulatory norms of the Spanish Federation.

Article 53.

The position of Manager of the Spanish Federation of Nautical Ski can be remunerated by agreement of the Board of Directors.

Secretary

Article 54.

The Secretary of the Spanish Federation of Nautical Ski is the complementary organ that deals with the functions of assistance to the President of the Spanish Federation of Nautical Ski, as well as to the other organs of government and representation of the same.

In addition to the specific functions noted above, the Secretary of the Federation is attributed to the following:

54.1 Velar for the fulfillment of all the legal-sports norms, having duly informed the content of the same to the organs of the Spanish Federation.

54.2 Prepare the meetings of the governing bodies and representation of the Spanish Federation, assisting them, with a voice but without a vote.

54.3 Organizes, maintains and custody the archives of the Spanish Federation.

54.4 Supports the documentation and timely reports to the governing bodies and the technical bodies of the Spanish Federation.

54.5 Prefor the resolution and dispatch of all matters of competence to the Secretariat of the Federation.

54.6 Receives and exrequests all the official correspondence of the Spanish Federation, carrying a record of entries and exits of the same.

Article 55.

The position of Secretary of the Spanish Federation of Nautical Ski can be remunerated by agreement of the Board of Directors.

Territorial Organization

Article 56.

The territorial organization of the Spanish Federation of Nautical Ski will have to conform to the autonomy of the State, being structured in federations or delegations of autonomy.

Article 57.

The autonomic federations will retain their legal personality, their own and differential assets, their budget and their particular legal regime.

Article 58.

The presidents of the regional federations will be part of the General Assembly, showing the representation of those. In any case, only one representative will exist for each autonomous federation.

Article 59.

The sports disciplinary regime, in the case of official state-wide competitions, will be provided for in the corresponding disciplinary regulation and other regulatory provisions of the Spanish Ski Federation. Nautical.

Article 60.

When in an Autonomous Community there is no autonomous federation, the Spanish Federation may establish in that Community, in collaboration with the Sports Administration of the Autonomous Community, a Territorial Delegation, respecting in all The regional organization of the State.

Article 61.

There will be no Territorial Delegation of the Spanish Federation, in the autonomous territorial area, when the autonomous federation is integrated into that.

Article 62.

For the participation of its members in official or international sports activities or competitions, the federations of autonomy must be integrated in the Spanish Federation of Nautical Ski.

62.1 The federations integrated in the Spanish Federation of Nautical Ski must provide this information necessary so that it can know the programming and development of the sports activities, as well as its budget, in the event that they receive a grant from the Spanish Federation of Nautical Ski.

Article 63.

The federations integrated in the Spanish Federation will have to satisfy the quotas that in their case establish the same for participation in competitions of state level and also those that could correspond to the expedition of licences.

Without prejudice to the patrimonial independence and the autonomy of the federations ' own economic management, the Spanish Federation will monitor the grants received from it or through it.

Article 64.

The governing bodies and representation of the various autonomous federations, as well as their composition, electoral system, functioning and competences, will be those provided for in their own Statutes and Regulations, notified to the Spanish Federation the same, and the modifications that would have taken place.

Article 65.

Territorial Delegations which exist or may be created as a result of the absence of the corresponding Autonomous Federation shall be governed by the provisions of this Statute.

The organs of these Territorial Delegations will be chosen according to the agreements of democratic and representative principles.

Licenses

Article 66.

For participation in official and international sports activities or competitions, it will be necessary to be in possession of a license issued by the Spanish Federation of Nautical Ski of the current year, corresponding to the activity being performed.

Article 67.

Unjustified non-issuance of licenses will behave for the Federation Te

rritorial the corresponding disciplinary responsibility, as provided for in the sports legal system.

The licences issued by the autonomic federations which have their own licence will enable such participation when they are integrated into the Spanish Federation, are issued under the conditions of economic character to be established by the Spanish Federation, communicating its expedition to it.

Article 68.

Licences issued in accordance with the provisions of the preceding Articles shall enable the participation in official State-wide sports activities or competitions, including at least the corresponding data in the official language of the State.

These licenses will reflect the following three concepts:

Required insurance.

Quota for the Spanish Federation of Nautical Ski.

Share for the Autonomous Federation concerned.

Article 69.

The autonomous federations will be able to set their corresponding quota, endorsed by their General Assembly, being communicated to the Spanish Federation.

The quotas for the Spanish Federation of Nautical Ski, in its economic montante, will be fixed by the General Assembly of the Spanish Federation for each station and category.

National licenses can only be issued by the Spanish Federation of Nautical Ski.

Technical Organs

Article 70.

For the best development of federal and sports purposes, as many national committees as the Board of Directors will be established on a proposal from the President.

Article 71.

The national committees will develop and implement the plans concerning the activities of their competence, raising their agreements to the ratification of the Board of Directors and in the cases that are considered appropriate to the General Assembly.

Article 72.

By agreement of the Board of Directors, the various existing or newly created national committees may be grouped under the direction of a single person, who will assume the role of Technical Director.

Article 73.

In any case, the existence in the Spanish Federation of Nautical Ski will be mandatory:

National Committee of Classics.

National Committee of Racing.

National Cable Committee-Ski.

National Committee for the Disabled.

National Committee of Judges.

National Sports Discipline Committee.

Article 74.

It shall be chaired by the Technical Director, which may be assisted by the number of persons or departments deemed necessary for the best development of their competencies.

All the functions and development of the committees, as well as their work plans, must be approved in the first instance by the Board of Directors of the Spanish Federation and endorsed by the General Assembly of the same.

National Committee of Classics, Racing and Cable-Ski

Article 75.

Your functions will be as follows:

75.1 Set the criteria for national team selection.

75.2 Set the national team training schedule.

75.3 Select the international championships for the participation of our teams.

75.4 Conduct the relevant meetings of the Committee with the technical staff that is created during the season.

75.5 Coordinate the promotion plans with the autonomous federations.

75.6 Control and protect your state-wide championships.

National Committee of Judges

Article 76.

Your functions will be as follows:

76.1 Set training levels for judges.

76.2 To classify the judges technically, proposing the assignment to the corresponding categories.

76.3 Propose international judge candidacy.

76.4 Approve the rules of regulation of the championships, preparing, editing and updating the Regulations of the same.

76.5 Coordinate levels of training with the regional federations.

76.6 Fixing judges in state-wide competitions.

76.7 Set the remuneration.

National Sports Discipline Committee

Article 77.

It will be chaired by the member of the Board of Directors appointed by the President of the Spanish Federation of Nautical Ski, and must gather legal and sports knowledge.

It shall be composed of a number of members not less than four, not more than six and the President of the Committee.

Article 78.

It's competition from the National Sports Discipline Committee:

78.1 To first resolve the complaints submitted by the federations, clubs, athletes and technicians, as a result of the national and international competitions.

78.5 The elaboration and updating of the Sports Discipline Regulation, in accordance with the provisions laid down in the legal provisions.

Article 79.

To the meetings of the National Committee for Sports Discipline will attend with a voice, but without a vote, the technical director of the Spanish Federation of Nautical Ski, who will act as an advisor, without prejudice to the other advisors who could require the President of the Federation if he considers it appropriate.

Article 80.

To the meetings of the National Committee for Sports Discipline will be attended by the Secretary of the Spanish Federation of Nautical Ski, which will take up the minutes of its sessions, will take care of the transfer of its agreements and sanctions, carrying the control and background of all of them.

Article 81.

The National Sports Discipline Committee will draft a Sports Discipline Regulation, in which at least the following extremes will be contained:

81.1 The typing and classification of faults.

81.2 The criteria for differentiation of the same, in mild, severe and very serious.

81.3 The penalties for each of the types of infringement.

81.4 The mitigating and aggravating circumstances of the offender's liability.

81.5 The extinction requirements for liability.

81.6 disciplinary procedures for the handling and enforcement of sanctions.

81.7 System of resources against imposed sanctions.

In the preparation of this Regulation, the provisions of Law 10/1990, of Sport, and Royal Decree 1543/1992, of 23 of December, will have to be established.

Entities and affiliates

Article 82.

The clubs will be integrated into the Spanish Federation of Nautical Ski through the Federation or Delegation of regional autonomy that corresponds to them for their geographical situation and/or their legal domicile, provided that the The law of the Spanish Federation of Nautical Ski and to submit to the authority of the Federative organs, in relation to the matters of its competence, are committed to comply with the Statutes and Regulations of the Spanish Federation of Nautical.

The clubs of those Autonomous Communities, in which there is no Federation or Delegation constituted, or have been suspended by the governing body of the Autonomous Community, may be directly integrated into the Spanish Federation of Nautical skiing.

Article 83.

The same criteria will apply with a preferential character for the integration in the Spanish Federation of Nautical Ski, of the athletes and technicians.

Article 84.

The integration in the Spanish Federation of Nautical Ski will be produced by the granting of the relevant federal license, which will be agreed by the Board of Directors of the Federation or Delegation of regional autonomy that corresponds.

Article 85.

All members of the Spanish Nautical Ski Federation are entitled to:

1. Participate in the governing bodies and representation of the Spanish Federation of Nautical Ski in the form provided for in the present Statutes and regulations that develop them.

2. To subscribe the corresponding license in the legally established terms.

3. Participation in competitions and organization of the same, provided that the requirements of the regulation are met.

Article 86.

The members of the Spanish Federation of Nautical Ski will have the following obligations:

1. Comply with and abide by the federative rules, subject to the discipline of the Spanish Federation of Nautical Ski.

2. To satisfy the quotas and penalties imposed on them.

3. Attend the calls and activities organized by the Spanish Federation of Nautical Ski.

4. The other ones that come to them imposed by the laws and regulations.

Economic Regime

Article 87.

The Spanish Federation of Nautical Ski has its own system of administration and management of budget and patrimony, with the application of the provisions of article 36 of Law 10/1990, of October 15, of the Sport, and the Article 29 of Royal Decree 1831/1991 of 20 December 1991 with the following scope:

It can promote and organize sports activities and competitions aimed at the public, and must apply the economic benefits, if there is to the development of the ends that are its own.

You may exercise, in addition, industrial, commercial, professional or service activities, and assign your assets and resources to the same sporting objectives, but in no case will you be able to distribute benefits among your members.

You can tax or dispose of your real estate, take money on loan, and issue debt securities or equity securities, provided that such legal businesses do not irreversibly commit the assets of the entity, or its social object.

The lien or disposal of your real estate will require the authorization of at least three-quarters of the members of the Delegate Committee.

When the amount of the operation is equal to or greater than 10 per 100 of your budget or a maximum of 50,000,000 pesetas will require the approval of the General Assembly.

It shall not commit expenditure of a multiannual nature, in its term of office, without prior authorisation of the High Council of Sport, where the committed annual expenditure exceeds 10 per 100 of its budget and exceeds the period of mandate of the President.

These amounts and percentages may be reviewed annually by the Superior Council of Sports.

The administration of the budget will respond to the principle of a single box, with its own revenues being devoted, as a priority to its structural expenditure.

The accounting will be adjusted to the rules for adapting the General Accounting Plan to the Spanish sports federations, regulated by the Order of 2 February 1994.

Article 88.

Within the first two months of each year, the Board of Directors shall draw up the financial statements provided for in the laws and regulations in force, as well as the settlement of the budget, together with the corresponding memory explanatory.

Article 89.

Constitute the income of the Spanish Federation of Nautical Ski:

89.1 The grants of the Superior Council of Sports and other organs of the Public Administration or of any entity whose purpose is of public or private interest.

89.2 The goods or rights you receive by inheritance, legacy, or donation.

89.3 The shares of your affiliates.

89.4 The economic sanctions imposed on its affiliates.

89.5 The income and interest of their assets.

89.6 Loans or loans granted to them.

89.7 The income that you obtain in relation to the development of the activities that you own, as well as the derivatives of the contracts that you make.

89.8 Any other items that may be attributed to you by legal provision or by virtue of a convention.

Article 90.

In case of dissolution of the Spanish Federation of Nautical Ski, its net worth, if any, will be applied to the realization of analogous activities, determined by the Superior Council of Sports its concrete destiny.

Documentary Regime

Article 91.

The documentary regime of the Spanish Federation of Nautical Ski will comprise the following books:

91.1 Book of Registry of Federations and Territorial Delegations, which shall reflect the names of the federations, their registered office, the identity of their President or Delegate and of the governing and representation bodies, indicating the dates of the inauguration and the cessation of the possession.

91.2 Book of Register of Clubs, in which the names of the clubs, their registered office, the identity of their President, indicating the dates of the inauguration and the cessation of the same.

91.3 Book of minutes, which will record the meetings held by the governing, representation and technical bodies of the Spanish Federation of Nautical Ski.

91.4 Books of Accounting, in which the patrimony, income and expenses of the Spanish Federation of Nautical Ski will be included, and the origin of those and the investment of them must be specified.

91.5 These books may be consulted by the members of the Assembly, but they may not be extracted from the Spanish Federation of Nautical Ski, in terms that are regulated.

In any case, generic queries will not be allowed, without being determined and in writing.

Modification of Statutes and Regulations

Article 92.

The Statutes of the Spanish Federation of Nautical Ski, can only be modified by agreement of the General Assembly.

Article 93.

Proposals for amendments to the Statutes may be made by:

1. For the Board of Directors.

2. For the Delegate Committee.

3. For a quarter of the members of the General Assembly.

Article 94.

For the approval of the amendment of the Statutes it will require the favorable vote of the two-thirds of the assistants to the General Assembly to the called effect, and its validity will be conditioned to the approval by the Superior Council Sports.

Article 95.

The same rules expressed in the previous articles will be for the amendment of regulations, requiring the favorable vote of two-thirds of the Delegate Committee for approval.

Article 96.

Any Federation of the Spanish Federation will have the option of attending the Assembly, although without a voice or vote.

Extinction

Article 97.

The Spanish Federation of Nautical Ski will be extinguished for the following reasons:

1. By agreement of the General Assembly, adopted by a majority of two thirds of it and ratified by the Superior Council of Sports.

2. By judicial resolution.

3. By integration into other federations.

4. For the other reasons provided for in the general legal order.

5. By revocation of their recognition.

Article 98.

The revocation of the recognition of the Spanish Federation of Nautical Ski, by the Superior Council of Sports, must conform to the provisions of the laws in force.

Extra-judicial reconciliation

Article 99.

Legal issues of a sporting legal nature, raised or which may arise between all entities or persons, may be resolved through the application of arbitration and conciliation formulas.

In such cases the arbitrators will be appointed by the Superior Council of Sports.

Final disposition.

This Statute shall enter into force on the day following the modification of its final approval by the Superior Council of Sports, without prejudice to its publication in the Official Journal of the State.
