Council Directive 92/33/EEC of 28 April 1992 on the marketing of vegetable plants and vegetable propagating material, other than seed, has been partially transposed into the our right by Royal Decree 2273/1993 of 22 December 1993 amending the General Regulation on the production of seed and nursery plants. That is why it is necessary for this Directive to be transposed in its entirety. Directive 93 /61/EEC of 2 July 1993 laying down the conditions for the application of the conditions to be met by plant propagating material and propagating material other than seed of a seed of a in accordance with Directive 92/33/EEC; and Directive 93 /62/EEC of 5 July 1993 laying down detailed rules for the monitoring and control of suppliers and establishments within the framework of the Directive 92 /33/EEC.

Therefore, due to the very specific matters that are regulated in these Directives and given the urgency of being transposed to our right, their incorporation is carried out by this Order.

In its virtue, I have:

Article 1.

This Order regulates the production and marketing of vegetable plants and vegetable propagating material other than seed, of the genera and species referred to in Annex I, and of their hybrids and rootstock and other parts of plants of other genera or species, or of their hybrids, if grafted or if material of the genera or species listed in Annex I or their hybrids is to be grafted.

Article 2.

This Order shall not apply to vegetable propagating and planting material, where it is shown that they are intended for export to countries which do not belong to the European Union, provided that they are correctly identified and properly isolated, without prejudice to the health rules laid down in Royal Decree 2071/1993 of 26 November 1993 on protective measures against the introduction and dissemination of the health and safety at work in the national and European Union of organisms harmful to plants or plant products, as well as to the export and transit to third countries.

Article 3.

For the purposes of this Order:

(a) Propagating materials: Parts of plants and any plant material including rootstock, intended for the multiplication and production of vegetable plants.

(b) Plantons: Whole plants and parts of plants, including grafts, intended to be planted for the production of vegetables.

(c) Supplier: Any natural or legal person who carries out at least one of the following activities, in relation to propagating material or vegetable plants: Reproduction, production, protection, treatment, storage and marketing or placing on the market.

d) Marketing or placing on the market: To keep available or in storage, to expose or to offer for sale, to sell or to deliver to another person, whatever the way it is carried out, propagating material or plants of vegetables.

e) Responsible official body:

The Directorate General of Agricultural Productions and Markets, through the General Subdirectorate of the National Institute of Seed and Plant of Vivero, with respect to the management and coordination in matters of control and certification of Seed and nursery plants.

The competent bodies of the Autonomous Communities, with respect to the execution of the operations necessary for the control and certification concerned.

(f) Official measures: The measures taken by the responsible official body.

g) Official inspection: The inspection carried out by the responsible official body.

h) Official statement: The statement made by the responsible official body or under its responsibility.

i) Lot: A certain amount of elements of a single product from those included in paragraphs (a) and (b) of this article, identifiable by the homogeneity of its composition and its origin.

j) Laboratory: A public or private law entity that performs analysis and establishes correct diagnostics that allow the supplier to control the quality of the production.

Article 4.

1. This Article lays down the requirements to be met, irrespective of the multiplication system used, the plants and vegetable propagating material belonging to the genera or species mentioned in the Annex. Annex I, or the rootstock of other genera or species, in the event that materials of one of the listed genera or species are grafted or are to be grafted onto them.

2. The material shall have adequate identity and purity in relation to the genus or species concerned and shall also have sufficient identity and purity as regards the variety.

3. The material must be substantially free from any defect which may be useful as propagating or planting material.

4. The strength and size of the material shall be satisfactory in relation to their use value, as propagating or planting material. In addition, where appropriate, there shall be an appropriate balance between roots, stems and leaves.

5. The material referred to above shall, where applicable, comply with the relevant phytosanitary conditions laid down in Royal Decree 2071/1993.

6. Without prejudice to paragraph 5 above, the material must be substantially free, at least by visual observation, of harmful organisms and diseases, or of signs or symptoms thereof, affecting the quality of the material. significant and merit the usefulness of vegetable propagating and planting material and in particular those listed in Annex II.

7. Any material which at the growing stage presents visible signs or symptoms of the harmful organisms referred to in paragraph 6 above shall be treated in an appropriate manner as soon as they are manifest or, where appropriate, must be removed.

8. In the case of shallots and garlic bulbs, it must also be satisfied that the propagating material comes directly from material which has been inspected and declared substantially free of the harmful organisms during the cultivation stage and diseases, and signs or symptoms thereof referred to in paragraph 6 of this Article, and in particular those listed in Annex II.

Article 5.

1. Suppliers shall take the necessary measures to ensure compliance with the rules laid down by this Order at all stages of the production and marketing of vegetable propagating and planting material. To that end, the suppliers, either by themselves or by themselves, in collaboration with another supplier or with the responsible official body, shall carry out checks which are based on the following principles:

a) Identification of the critical points of your production process, depending on the production methods used, mainly taking into account the following:

The quality of the propagating and planting material used to start the production process.

Planting, transplantation, framing and planting of propagating and planting material.

Compliance with the conditions set out in Articles 3, 4 and 5 of Royal Decree 2071/1993.

The culture plan and method.

The overall care of the crop.

The multiplication operations.

Collection operations.

Hygiene.

Treatments.

Packaging.

The storage.

The transport.

The administration.

(b) Elaboration and implementation of surveillance and control methods, where appropriate, of the critical points mentioned above, and should take into account:

The actual availability and utilization of these methods to control each of the critical points.

The reliability of these methods.

Your suitability to evaluate the content of the production and marketing modalities, including administrative aspects.

The competence of the vendor's personnel to perform the controls.

(c) Taking of samples where appropriate, which shall be analysed, where necessary, in a laboratory approved for that purpose by the responsible official body in order to verify compliance with the standards established in this Order, and must ensure that:

The samples shall be taken during the various stages of the production process and in accordance with the frequency established by that body, when the production methods are checked when the approval of the product is granted. provider.

Sampling will be performed technically correctly and following a statistically reliable procedure, taking into account the type of analysis to be performed.

People who take the samples will be competent for it.

(d) a written or written record of any other means guaranteeing a lasting preservation of the data referred to in (a), (b) and (c) above and maintaining a record of the production and marketing of the data; plant and propagating material which shall be at the disposal of the responsible official body. These records as well as the documents certifying them shall be kept for a period of at least one year and shall contain, in particular, complete information on:

The material purchased for storage or planting in your facility, in production process or issued to others.

Any chemical treatment that has been applied to the material.

However, suppliers whose activity in this field is limited to the mere distribution of propagating and planting material produced and packaged outside their establishment must bear only one of the following: record or retain long-standing evidence of the purchase, sale or delivery of such products.

e) Collaborate with the responsible official body as regards its activity and the corresponding official control and especially:

To be personally responsible or to designate another person technically prepared in the production of these materials and in plant health issues to relate to that organism.

Make, whenever necessary and at the appropriate time, visual inspections, in the form authorized by the agency.

Facilitate persons empowered to act on behalf of that body for access to the records referred to in point (d) above and for the relevant documents, in particular for inspection or sampling purposes.

This paragraph 1 shall not apply to suppliers whose activity in this field is limited to the delivery of small quantities of vegetable propagating and planting material to final consumers. professionals.

2. Where, as a result of their own checks or of the information available to them, suppliers verify the presence of one or more of the harmful organisms referred to in Article 4 of this Order, they shall immediately inform the Commission of the the responsible official body and shall take the measures indicated to them, or any other measures necessary to reduce the risk of the spread of such harmful organisms. Suppliers shall keep a register of all harmful organisms which have appeared in their establishments and of all measures taken in this respect.

Article 6.

1. The responsible official body shall grant the suppliers and the laboratories the appropriate authorisation. In order to obtain such authorization, the suppliers of plants and vegetable propagating material, of the genera and species included in the list set out in Annex I to this Order, shall submit to the competent bodies of the Autonomous Communities in which they carry out any of the activities or have their own facilities of their supplier status, the corresponding application for authorization in accordance with the procedure laid down in each Autonomous Community, without prejudice to the powers conferred on the Ministry of Agriculture, Fisheries and Food for foreign trade.

The competent bodies of the Autonomous Communities shall enter into the corresponding Register the suppliers authorised for such genera and species, assigning them a reference number.

Where suppliers are producers of vegetable propagating or planting material, belonging to the said genera or species, their registration in the abovementioned Register shall, where appropriate, lead to their reduction in the Provisional Register of Plant Producers of Vivero, created by Order of 14 September 1972.

The competent authorities of the Autonomous Communities shall communicate to the Directorate-General for Agricultural Productions and Markets (Subdirectorate General of the National Institute of Seeds and Plants of Vivero). granted.

For this Directorate-General, a national relationship of vegetable propagating and planting material suppliers will be developed, including the suppliers registered in each Autonomous Community.

2. The supervision and control of suppliers, establishments and laboratories shall be carried out on a regular basis, and at least once a year by the responsible official body or under its responsibility, in order to ensure compliance with the provisions of this Order and in particular the conditions set out in Article 5.

Article 7.

1. Vegetable propagating and planting material may be marketed only by authorised suppliers and provided that they comply with the requirements laid down in Article 4.

2. Paragraph 1 above shall not apply, provided that the provisions of Royal Decree 2071/1993 are complied with, for vegetable propagating and planting material intended for one or more of the following purposes:

a) Scientific tests or purposes.

b) Selection Labors.

c) Measures aimed at the conservation of genetic diversity.

Article 8.

1. Without prejudice to Article 2, propagating material and plant propagating material belonging to the genera and species listed in Annex I and which also fall within the scope of the Technical Control Regulation and Certification of Seeds of Horticultural Plants, approved by Order of 1 July 1986, can only be marketed when they belong to a variety admitted, in accordance with the regulations concerning the Commercial Varieties Register.

2. Without prejudice to Article 2, propagating material and plant propagating material belonging to genera or species referred to in Annex I and not covered by the Regulation referred to above may only be used for the purposes of this Regulation. be placed on the market where they belong to a variety which is officially admitted to at least one Member State of the European Union.

With regard to the procedures and formalities relating to admission, to the conditions of admission and to the conservative selection, the requirements laid down in the regulations relating to the Register of Commercial Varieties.

Article 9.

1. During cultivation, as well as in the grubbing-up or the removal of grafts from the parent material, both the propagating material and the vegetable plants shall be kept in separate batches.

2. If, during the packaging, storage, transport or delivery, propagating or planting material of different sources is pooled or mixed, the supplier shall keep the data corresponding to the composition of the lot and the origin of the consignment. its various components.

3. Compliance with the provisions of paragraphs 1 and 2 above shall be verified by official controls.

Article 10.

1. Without prejudice to Article 9 (2), propagating material and vegetable plants shall only be marketed in sufficiently homogeneous lots.

2. Vegetable propagating and planting material shall comply with the requirements of this Order and shall be accompanied by a document issued by the supplier, which is of appropriate material, which has not previously been used, and in which the following information shall be indicated:

a) Indication: "EEC Quality".

b) Member State code.

c) Name or identification code of the responsible official body.

d) Registration or authorization number.

e) Name of the provider.

f) Serial or batch individual number.

g) Date of issue of the document.

(h) Reference number for the lot of seed, in the case of plants directly derived from seeds marketed in accordance with the Order of 1 July 1986 approving the Technical Control Regulation and Certification of Seeds of Horticultural Plants. Alternatively, this reference number may not be indicated, in which case it shall be available to the responsible official body.

(i) Common name or botanical name where the material is accompanied by a plant passport in accordance with the Order of 17 May 1993 establishing the standardisation of plant passports intended for use in the movement of certain plants, plant products and other objects within the European Union, and laying down the procedures for the issue of such passports and the conditions and procedures for their replacement.

j) Name of the variety. In the case of rootstock, denomination of the variety or its designation.

k) Quantity.

(l) In the case of imports from third countries, the name of the country of production.

If an official declaration is included in that document, it must be clearly distinguished from the other elements contained in the document.

This document must be replaced when the item identified by it is divided or combined with another for commercial reasons or when it is necessary to proceed to a reselection in order to be able to market the consignment, since produced amendments affecting their quality in relation to the requirements and conditions laid down in Article 4.

In the new supplier document, the name of the current supplier and that of the responsible official body together with the word "Repackaging" must be indicated in addition to the data mentioned above.

3. In the case where the propagating material and the vegetable plants are accompanied by a plant passport in accordance with the provisions of that order of 17 May 1993, the latter may, if the supplier so wishes, constitute the issued by the supplier referred to in paragraph 2 above. In that case, the following information must also be clearly separated from the rest of the passport: the words 'EEC quality', the official body responsible for this order, and the name of the variety. In the case of imports from third countries, the country of production must also be indicated.

4. In the case of a retail supplier whose activity is limited exclusively to the supply of vegetable propagating or planting material to a final non-professional consumer, the information required in paragraphs 2 and 3 above may be reduced to points (d), (e), (i) and (j) of paragraph 2 above.

Article 11.

The multiplication material and vegetable plants produced in a third country, in order to be introduced in Spain, must offer the same guarantees, as those produced in the European Union.

As to the processing and documentation necessary to carry out imports and exports of this material, the provisions of the General Technical Control and Certification Regulations of Semillas and Plants of Vivero will apply. in addition to the provisions of Royal Decree 2071/1993.

Article 12.

The responsible official body shall carry out checks and samples during the production and marketing of vegetable propagating and planting material, by means of a survey, for the purpose of verify that the requirements and conditions set out in this Order are met.

Article 13.

1. If, during the surveillance and control referred to in Article 6 (2), or during the official inspection provided for in Article 12, or in the tests provided for in Article 14, the propagating material or the materials used for the inspection Vegetable plants do not comply with the requirements of this Order, the responsible official body shall take all appropriate measures to ensure compliance with those requirements, or, if this is not possible, to prohibit the the placing on the market of such propagating material and plant propagating material.

2. If it is found that the propagating material or vegetable plants marketed by a given supplier do not comply with the requirements and conditions of this Order, the responsible official body shall take the necessary measures. appropriate to that supplier. The possible infringements and penalties in the production and marketing of plants and vegetable propagating material shall be classified and applied in accordance with the provisions of Law 11/1971, of Seeds and Plants of Vivero and provisions In addition to the provisions of Royal Decree 1945/1983 of 22 June 1983, which regulate infringements and penalties in the field of consumer protection and agri-food production, it is in the alternative that they are complementary.

3. If the supplier is prohibited from marketing propagating material and vegetable plants, the Ministry of Agriculture, Fisheries and Food shall inform the Commission of the European Union and the competent national bodies of the other Member States. These measures shall be suspended as soon as it is established, with due certainty, that the propagating material or vegetable plants intended for marketing by that supplier shall in future comply with the requirements and conditions laid down in this Regulation. of this Order.

Article 14.

In order to verify that the propagating material and the plants of vegetables produced or marketed in Spain comply with the requirements of this Order, including those of a plant health nature, they shall be carried out post-control tests.

Article 15.

If, as a result of an official inspection, it is found that propagating material or vegetable plants cannot be marketed for not complying with a condition of a plant health status, the organism responsible officer shall take appropriate measures to eliminate any plant health risks that may occur.

Article 16.

suppliers shall make an annual declaration of the quantities produced and marketed of the vegetable propagating or planting material, indicating the genus, species and variety, specifying, in addition, the destinations of the different items by Autonomous Communities and countries, where appropriate, to establish national statistics and to provide the information provided for in Community legislation.

The said declaration must be sent to the competent authority of the Autonomous Community, which will forward to the Directorate General of Agricultural Productions and Markets (Subdirectorate General of the National Institute of Seeds and Plants of Vivero) the data contained in the said declarations or, where appropriate, a copy thereof.

Single end disposition.

This Order shall enter into force on the day following that of its publication in the "Official State Gazette".
