In the context of the reform of the common agricultural policy, Regulation (EEC) No 2078/92 of 30 June on agricultural production methods compatible with the requirements of the protection of the environment and the conservation of space (a) natural resources for the use of agricultural land to be used, inter alia, to promote the exploitation of agricultural land compatible with the requirements of the protection and improvement of the environment, the natural environment, the natural resources of the soil and genetic diversity, providing that it may also include measures aimed at to improve the training of farmers in the field of agricultural or forestry production practices that are compatible with the environment.

On the basis of this, the Ministry of Agriculture, Fisheries and Food, and the Autonomous Communities of Asturias and Castile and Leon consider it appropriate to apply an aid scheme for the promotion of the above measures. in the area of the natural space that constitutes the National Park of the Mountain of Covadonga.

In order to stimulate the participation of farmers and farmers in these measures, it is necessary to compensate for the income of those who commit themselves to their realization.

The two Communities concerned have been consulted on this rule and the procedures provided for in Article 7 of Regulation (EEC) No 2078/1992 have been completed, without prejudice to the direct applicability thereof.

In its virtue, I have:

Article 1. Scope of application.

The scope of the aid set out in this Order is the internal area of the National Park of the Mountain of Covadonga, delimited by Royal Decree of 16 August 1918.

Article 2. Objectives.

The objectives to be achieved with this Order are as follows:

Conservation of the natural space in the area of grassland and grassland, through a balance of grazing, regulating the livestock load supported by the pasture or also transforming land of work in pasture.

Maintaining the environmental conditions of the Park, by grazing, conserving abandoned land, preventing forest fires, combating erosion, conservation of protected flora and fauna, as well as those enabling the maintenance and improvement of such a landscape environment.

Abandonment in areas deemed to be suitable for work land in order to contribute to the maintenance and creation of biotopes.

Training of the population of the area for better knowledge of environmental management and practices. Their knowledge on the management of agricultural holdings and those aimed at improving the environmental management of the area, including those that will improve the quality of agricultural products and the enhancement of values, will be improved. landscape.

Contribution to the improvement of the income of the Park's farmers.

Article 3. Beneficiaries.

1. They may receive the aid provided for in this Order by the holders of agricultural holdings using the pasture of the National Park of the Mountain of Covadonga and the owners of the agricultural land to be kept on request for conformity with the provisions of this provision.

2. They may participate in the training courses provided for in Article 6 of this Order, in addition to the applicants for the aid referred to in the preceding paragraph, other persons belonging to the municipal terms integrated in the the National Park of the Mountain of Covadonga interested or related to the conservation of the environment, especially the young ones.

Article 4. Measures.

To be beneficiaries of the aid provided for in this Order, applicants must undertake, for a minimum of five years, to carry out any of the following measures:

Maintain a minimum livestock load of 0.3 Units of Greater Livestock (UGM) /hectare and maximum of 1.4 UGM/hectare throughout the summer pasture season.

Preserve grassland, mount low, and transform farmland into grassland.

Keep the natural space in the area of forests or forests without timber use.

Article 5. Aid.

1. Applicants who undertake to carry out the measures provided for in the preceding Article shall receive an annual premium per hectare corresponding to each of the measures they undertake.

2. The maximum amounts of these premiums shall be as follows:

To maintain a minimum livestock load of 0.3 UGM/hectare and maximum of 1.4 UGM/hectare throughout the summer pasture season, 12,000 pesetas/hectare.

To conserve grassland, mount low and transform farmland into grassland, 10,000 pesetas/hectare.

To conserve the natural space in the area of forests or mountains without timber use, 15,000 pesetas/hectare.

Article 6. Training.

The training courses referred to in Article 3 (2) of this Order shall be taught at the following levels:

1. Training courses for monitors with a maximum cost per pupil of 400,000 pesetas. These monitors will then be able to participate in the two levels of training below.

2. Training courses for holders of agricultural holdings and owners of agricultural land to be preserved, with a maximum cost per pupil of 200,000 pesetas.

3. Training courses and seminars for persons belonging to the municipal terms integrated in the National Park of the Mountain of Covadonga concerned or related to the conservation of the environment, in particular, young people with a maximum cost of 50 000 pesetas per pupil.

Article 7. Conditions for granting the aid.

1. In order to receive the aid referred to in Article 5, the beneficiaries of the aid shall enter into a commitment for a period of at least five years, in which the obligations they acquire are indicated in order to achieve the objectives set out in that Article. Article 2.

2. The beneficiary must also undertake to allow the controls, both of documents and of the field, to establish the corresponding services of the Administrations.

3. Where the beneficiary of the aid referred to in this Order transmits the agricultural holdings or the agricultural land to be retained without the new acquirer taking over the commitments and obligations incurred by the transferor, he shall to reintegrate the aid that had already been received.

Article 8. Financing.

The financing of the aid referred to in this Order shall be made, in accordance with Article 8 of Regulation (EEC) No 2078/1992, by 75% of the amount of the aid granted by the EAGGF Guarantee Section, as the Autonomous Communities concerned in Objective 1 areas as set out in Annex I to Council Regulation (EEC) No 2052/88 of 24 June 1988 and the remaining 25 per 100 by the Ministry of Agriculture, Fisheries and Food and the Autonomous Communities of Asturias and Castile and Leon when this is the case.

Article 9. Convention.

1. The Ministry of Agriculture, Fisheries and Food is authorized to negotiate and subscribe, if necessary, through the General Secretariat of Agricultural Structures, with the Autonomous Communities of the Principality of Asturias and Castilla y León. for the financing referred to in the previous Article.

2. The following aspects shall be taken into account in these Conventions:

The percentage of funding that corresponds to each of the two administrations in the 25 per 100 that is not financed by the Guarantee Fund.

The maximum amount of aid planned annually and in the five years, the commitments in respect of the management of the aids established and in an explicit way the means and measures to be adopted by each Administration for the correct development of the Convention, in particular the necessary regulatory developments, responsible organisations and administrative units, information to be provided by both administrations and the composition and functioning of the bilateral Commission.

Control and coordination procedures in accordance with the Community implementing regulations, which guarantee the fulfilment of the objectives included in the programme which is the subject of this Order.

The financial compensation mechanisms between the two administrations, which on closed exercises respect the agreed percentage of budgetary participation for each year.

The temporary relaxation clauses regarding the implementation of the agreed measures, as well as the mechanism of redistribution of unused resources in the year for use in successive years.

Article 10. Management and monitoring.

1. Applications for aid shall be addressed to the competent authority of the Autonomous Community, which shall deal with them, decide and pay.

2. In accordance with the provisions of Commission Regulation (EEC) No 2776/1988 of 7 September 1988 on the data to be transmitted by the Member States, the Autonomous Communities concerned shall forward to the General Secretariat of Structures Agricultural the supporting documents for the payment orders, for the purposes of the financing under the Guarantee Section of the Eaggf.

Article 11. File of the information.

The Autonomous Communities of Asturias and Castilla y León will be deposited in origin, of the information to be provided, for the purpose of covering the requirements of the EC in the exercise of the monitoring functions, evaluation and control, communicating to the General Secretariat of Agricultural Structures of the Ministry of Agriculture, Fisheries and Food the information necessary for the fulfilment of the obligations of the Community institutions.

Single additional disposition.

The aid provided for in this Order will be extended in the same way to the holders of agricultural holdings and landowners of the future National Park of the Picos of Europe, once the corresponding Law is approved.

Single end disposition.

This Order shall enter into force on the day following that of its publication in the "Official State Gazette".
