The accession of Spain, on 20 December 1978, to the Convention on the Registration of Objects Launched in the Area of the Ultratetre, adopted by the General Assembly of the United Nations on 12 November 1974 (Official Journal of the European Communities) State " number 25, of 29 January 1979), it makes it necessary to adopt the internal measures that are required for Spain to comply with the terms of this Convention, especially as regards the creation of a Registry of Objects Launched to Space This is the case for the United Nations Secretary-General.

The recent orbit of the Spanish satellites Hispasat 1A and 1B constitute a further reason and occasion not to delay the implementation of this Register.

In its virtue, on the proposal of the Ministers of Foreign Affairs and Industry and Energy, after approval of the Minister for Public Administrations, in agreement with the Council of State and after deliberation of the Council of Ministers at their meeting on 24 February 1995,

DISPONGO:

Article 1.

The Spanish Registry of Space Objects Launched into the Ultratetre Space is created, hereinafter "Spanish Registry".

Article 2.

The Spanish Register will be carried by the General Secretariat for Multilateral Economic Relations and Development, from the Directorate General for International Economic Relations of the Ministry of Foreign Affairs.

Article 3.

Access to the information contained in the Spanish Register shall be full and free and shall be governed by the provisions of Article 37 of Law 30/1992, of the Legal Regime of Public Administrations and of the Administrative Procedure Common and by the rules that will eventually be approved in development of this.

Article 4.

The concept of "space object" extends both to its component parts and to the propellant vehicle and to its.

Article 5.

The space objects that have been launched and the launch of which has been promoted by the Spanish State, or which have been launched from Spain or from Spanish installations, must be registered in the Spanish Register.

In the event that, in addition to Spain, there are one or more competent States, hereinafter "the State or States of the Launch", in order to register, it shall be done in accordance with the provisions of Article II.2 of the Convention on the Register of Objects Launched to the Ultratetre Space of November 12, 1974.

Article 6.

The enrollment of each spatial object must contain the following data:

a) Name of the State or the States of the launch.

b) An appropriate designation of the spatial object or its registration number.

c) Date and territory or place of launch.

d) Basic orbital parameters, including:

I) Nodal period.

II) Tilt.

III) Apogeo.

IV) Perigee.

e) General function of the spatial object.

Any other additional information that is considered useful may also be included.

Article 7.

The companies and institutions that are in possession of the data referred to in the previous article will be obliged to communicate them to the General Directorate of Industrial Technology of the Ministry of Industry and Energy, which may, in turn, obtain from such additional information as it considers necessary to carry out the registration and the mandatory communication to the Secretary-General of the United Nations, in accordance with the said Convention.

The Directorate-General for Industrial Technology of the Ministry of Industry and Energy will transmit to the Directorate-General for International Economic Relations of the Ministry of Foreign Affairs the data it receives, and the latter shall register them in the Spanish Register and shall promote their formal communication to the Secretary-General of the United Nations for inclusion in the Register of the United Nations.

The communications referred to in this Article shall also be extended to changes which may be made to the data relating to the spatial objects entered and, in particular, to the case that they are no longer in orbit. land. Such modifications shall be subject to prior registration in the Spanish Register in accordance with the provisions of the previous article.

Single additional disposition.

The Directorate General for International Economic Relations of the Ministry of Foreign Affairs will promote formal communication to the Secretary-General of the United Nations of the creation of the Spanish Registry.

Single transient disposition.

The Ministry of Foreign Affairs ' Directorate-General for International Economic Relations will promote the registration and subsequent formal communication to the Secretary-General of the United Nations of space objects. have been launched on the date prior to the creation of the Spanish Register and with respect to which Spain is the State of the launch.

First disposition first.

The Ministers of Foreign Affairs and Industry and Energy will be able to make the necessary provisions for the implementation and development of the provisions of this Royal Decree.

Final disposition second.

By Order of the Minister of the Presidency, delivered on a proposal from the Ministers of Foreign Affairs and Industry and Energy, the Spanish Registry may be entrusted to an organ of these Ministries other than the intended in Article 2 of this Royal Decree.

Third end disposition.

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".
