By Royal Decree 115/1989 of 3 February, the Spanish Delegation was created in the Negotiations on Conventional Armed Forces in Europe and on Confidence-and Security-Building Measures, based in Vienna.

The negotiations on Conventional Armed Forces in Europe led to the signing, at the Paris Summit of 1990, of the Treaty on Conventional Armed Forces in Europe and the conclusion, on 6 July 1992, of a on the Limitations of Personnel of the Conventional Armed Forces in Europe, whose implementation and enforcement is controlled by the Joint Consultative Group, a body created for this purpose by the Treaty itself.

For their part, the negotiations on Confidence-and Security-Building Measures led to the adoption of the so-called Vienna document of 1992, revised and subsequently expanded at the summit of Heads of State and Government. of the Conference on Security and Cooperation in Europe (CSCE) in Budapest in December 1994.

The purpose for which the aforementioned Spanish delegation was created in 1989 can therefore be considered as reached, while on the contrary, the institutionalization of the Conference for Security and Cooperation in Europe and its transformation into an international organisation has so far lacked adequate response from the Spanish side in terms of diplomatic representation.

Therefore, it is necessary to replace the current Delegation with a Permanent Representation of Spain in the Organization for Security and Cooperation in Europe, based in Vienna.

In its virtue, at the initiative of the Minister of Foreign Affairs and on the proposal of the Minister for Public Administrations, after deliberation by the Council of Ministers at its meeting of the 15th of September 1995,

D I S P O N G O:

Article 1. Creation of the Permanent Representation.

The Permanent Representation of Spain to the Organization for Security and Cooperation in Europe, based in Vienna, is hereby established.

Article 2. Head of Representation.

The Head of the Permanent Representation corresponds to the Permanent Representative of Spain, who will be appointed by Royal Decree agreed in the Council of Ministers, on the proposal of the Minister of Foreign Affairs.

Article 3. Functions.

In addition to the functions inherent in the representation to the Organization for Security and Cooperation in Europe, the Permanent Representation will assume the representation of Spain to the Joint Consultative Group of the Treaty on Conventional Armed Forces in Europe and before the Consultative Commission on the Treaty of Open Skies.

Article 4. Appointment of Defence Directors.

By affecting the competences of the Organization for Security and Cooperation in Europe to issues concerning the field of defense, the Minister of Defense will propose to the Minister of Foreign Affairs the appointment of Defence advisers on a permanent basis.

These Counselors will be integrated into the Permanent Representation, acting under the Permanent Representative of the Permanent Representative.

Additional disposition first. Organic suppression.

The Spanish Delegation is abolished in the negotiations on Conventional Armed Forces in Europe and on Confidence-and Security-Building Measures.

Additional provision second. Situations pending settlement.

The Permanent Representation created by this Royal Decree will take care of the pending settlement situations for the Spanish Delegation that is deleted.

Additional provision third. Premises, material resources and personal resources.

The premises, material resources and personal resources with which the Spanish Delegation is currently deleted will be assigned to the Permanent Representation created by this Royal Decree.

Additional provision fourth. Budgetary changes.

The Minister of Economy and Finance will make the necessary budgetary changes for the fulfillment of what has been ordered in this Royal Decree.

Single repeal provision. Regulatory repeal.

The Royal Decree 115/1989, dated February 3, is hereby repealed, creating the Spanish Delegation in the Negotiations on Conventional Armed Forces in Europe and on Measures of Promotion and Confidence and Security.

Final disposition first. Regulatory development.

The Minister of Foreign Affairs, prior to the appropriate legal procedures, will dictate the necessary provisions for the development of the provisions of this Royal Decree and will promote the remaining measures for the application of the provisions of the same.

Final disposition second. Entry into force.

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".
