Animal food intended for specific nutritional purposes tends to occupy an increasingly important place in the feeding of pet or production animals, whose process of digestion, absorption or metabolism may be temporarily altered or altered temporarily or irreversibly.

This importance requires the elaboration of a common definition of the products in question, having their presentation as such, and having a specific composition or are manufactured according to a special process.

Such foods should be clearly differentiated by their characteristics and their objective, both in current foods and in medicated feed.

Food producers for specific nutritional purposes should be able to indicate on the label certain useful data for the user.

It is also necessary to declare the content in analytical components that directly determine the quality of the food and which provide the dietary food characteristics.

Since it is not appropriate to make the provision of feedingstuffs for specific nutritional purposes subject to the presentation of a veterinary prescription, given that these products do not contain medicinal products, such as As defined in Law 25/1990, of 20 December, of the Medicamento, in order to ensure an appropriate use of the food of a very specific nature it is advisable to warn the user that before using them it is advisable to consult a specialist, or if any, a veterinarian.

The marketing of such foods should make their ingestion beneficial to animals, and should always be of commercial quality and present no danger to animal and human health or to the environment. They should be marketed in such a way that they cannot be misleading, providing the user with accurate and useful information, distinguishing them by means of a single, "dietetic" qualifier, which must accompany the denomination of these foods.

Furthermore, the placing on the market of food for animals intended for specific nutritional purposes which comply with the provisions of this Royal Decree should not be subject to any restriction as regards the composition, characteristics of manufacture, presentation or labelling of such foods, it is appropriate to provide for the possibility of informing the European Commission, in detail in the grounds, when a product presents a danger to the animal or human health or the environment, in order for the measures to be taken relevant.

With regard to the declaration of the energy value of these foods, even if the methods of calculating the energy value are not entirely satisfactory, a provisional method is established to permit the said declaration.

Finally, it is absolutely necessary to ensure effective control of food for animals intended for specific nutritional purposes. In certain circumstances, it is possible that the means normally available for control are not sufficient to check whether the food in question actually has the specific nutritional properties attributed to it, Therefore, it is necessary to establish that, in the event of suspicion, the person responsible for placing the product on the market will cooperate with the authority of the Autonomous Community competent for control in the exercise of its activities.

By this Royal Decree the Council Directive 93 /74/EEC of 13 September on food for animals intended for specific nutritional purposes is transposed into our legal order. Commission Directive 94 /39/EC of 25 July establishing a list of intended uses of food for animals intended for particular nutritional purposes, Commission Directive 95 /9/EC of 7 April 2000 on the protection of the health and safety of animals and the amending Directive 94 /39/EC establishing a list of intended uses of food for the purposes of animals intended for specific nutritional purposes and Directive 95 /10/EC of the Commission of 7 April laying down the method for the calculation of the energy value of food for dogs and cats intended for nutritional purposes specific.

This Royal Decree is dictated by Article 149.1.13. of the Constitution, which attributes to the State the competence in terms of bases and coordination of the general planning of economic activity; 149.1.16. The Committee on the Environment, Public Health and the Environment, Public Health and the Environment, Public Health and the Environment. DISPONGO:

Article 1. Object and scope of application.

1. This Royal Decree aims to regulate food for animals intended for specific nutritional purposes.

2. The provisions contained in this Royal Decree are applicable:

a) Food or compound feed for animals.

b) To additives used in animal feed.

c) Undesirable substances and products in animal feed.

d) To certain products used in animal feed.

Article 2. Definitions.

For the purposes of this Royal Decree, the following definitions shall

:

(a) "Food for animals" means products of plant or animal origin in a natural state, fresh or preserved and those derived from their industrial processing, as well as organic or inorganic substances, simple or in mixtures, contain or do not contain additives, intended for oral animal feeding.

(b) "animal feed or compound feed" means mixtures consisting of products of plant or animal origin in the natural state, fresh or preserved, or derived from their industrial or organic or organic substances inorganic, whether or not containing additives, intended for oral animal feed in the form of whole food or feed or complementary food or feed.

(c) "Food for animals intended for particular nutritional purposes" means animal feed or compound feed which, by virtue of its specific composition or having followed a special process in its manufacture, differs clearly both of the current animal feed and of the products defined in Royal Decree 157/1995 of 3 February 1995 laying down the conditions for the preparation, placing on the market and use of feedingstuffs medicines, and that they indicate that they are intended to meet nutritional needs specific.

(d) "Specific nutrition objective" means the objective to meet the specific nutritional needs of certain categories of pet or production animals whose digestion, absorption or processing process metabolism may be altered or altered temporarily or irreversibly and that, for that reason, may benefit from ingesting adequate food to your state.

Article 3. Nature or composition.

Animal food intended for specific nutritional purposes shall be of a nature or composition that makes them appropriate for the specific nutritional purpose to which they are intended.

Article 4. Labeling requirements.

In addition to the general labelling provisions laid down in the Order of 8 October 1992 concerning the placing on the market of compound feedingstuffs, the following shall be taken into account:

1. The following additional indications shall be given in the space reserved for this purpose in the package, container or food label for animals intended for particular nutritional purposes:

a) The "dietetic" qualifier next to the food denomination.

b) The specific nutritional purpose to which it is intended.

c) The indication of the essential nutritional characteristics of the food.

(d) The statements in column 4 of Part B of Annex I to this Royal Decree and which relate to the specific nutritional purpose.

e) The recommended duration of use of the food.

The indications referred to in paragraphs (a) to (e) shall be in accordance with the content of the list of intended uses referred to in Part B of Annex I.

2. Indications other than those referred to in paragraph 1 may be provided in the space reserved for that purpose provided that they are laid down in column 6 of Part B of Annex I.

3. Without prejudice to the general provisions concerning the labelling for the placing on the market of compound feedingstuffs, a state may be mentioned on the labelling of feedingstuffs intended for specific nutritional purposes. specific pathological condition when that state corresponds to the nutritional purpose defined in the list of intended uses of Annex I.

4. The label or mode of use of food for animals intended for specific nutritional purposes shall bear the words: 'It is recommended to consult a specialist before use'.

However, in the list of uses set out in Annex I, this declaration may be replaced, in the case of specific dietary foods, by a recommendation to seek the opinion of a veterinarian.

5. In the labelling of feedingstuffs intended for particular nutritional purposes, the presence or low content of one or more ingredients essential for the determination of the characteristics of the food may be highlighted. food. In this case, the minimum or maximum content expressed as a percentage by weight of the ingredient or ingredients considered essential shall be clearly indicated in one of the following three forms:

a) Out of the full ingredient relationship and in the face of the indication of the essential ingredients.

b) In the same ingredient relationship.

c) Outside the category relationship and in relation to the corresponding to the essential ingredients, mentioning their percentage by weight.

6. The labelling of feedingstuffs intended for specific nutritional purposes may also highlight the presence or the low content of one or more analytical constituents which characterise the food. In this case, the minimum or maximum content of the analytical component or components expressed as a percentage by weight of the food shall be clearly indicated in the list of declared analytical constituents.

7. The 'dietetic' label shall be reserved exclusively for food for animals intended for specific nutritional purposes.

In the labelling and presentation of such foods, any qualifier other than "dietary" will be prohibited.

8. The declaration of ingredients may be made by reference to categories grouping several ingredients, even where the declaration of certain ingredients by their specific name is necessary to justify the characteristics of the ingredients. nutrition of the food.

Article 5. Marketing.

1. Only food for animals intended for specific nutritional purposes may be placed on the market where they meet the following requirements:

a) That they comply with the provisions of Article 3 of this Royal Decree.

(b) Which are labelled in accordance with the provisions of Article 4 of this provision.

(c) The intended use is included in the list of intended uses set out in Part B of Annex I to this provision and complies with the other provisions laid down in that list.

(d) The general provisions contained in Part A of Annex I.

2. Such food for animals intended for particular nutritional purposes may not be subject, for reasons relating to the provisions of this Royal Decree, to restrictions on their marketing other than those provided for in this Regulation. set.

Article 6. Usage security.

If it is found that the use of an animal feed intended for specific nutritional purposes or its use under the conditions laid down presents a danger to animal or human health or to the environment, the The competent authority of the Autonomous Community shall immediately place this circumstance in the knowledge of the Ministry of Agriculture, Fisheries and Food, through a detailed reasoned report, informing the Ministry of Health and Consumer Affairs of the the case of danger to human health. Article 7. Official controls.

To enable effective official control of food for animals intended for specific nutritional purposes, the following specific provisions shall apply:

1. The Autonomous Communities shall adopt the relevant provisions and measures so that, during the manufacture or marketing, an official control is carried out of the observance of the conditions laid down in this Royal Decree, which shall be performed at least by sampling.

2. Where necessary, the competent authority of the Autonomous Community may request the person responsible for placing on the market to submit data and information attesting to the conformity of the food with the provisions of this Royal Decree.

If this data has been the subject of an easy-to-access publication, the reference to the publication shall be sufficient.

The method of calculating the energy value of food for dogs and cats for specific nutritional purposes set out in Annex II to this Royal Decree shall be valid until 30 June 1998.

PART A

General provisions

1. Where more than one group of nutritional characteristics for the same nutritional purpose is shown in column 2 of Part B, which shall be indicated by the 'and/or' conjunctions, the manufacturer shall have the option of using the characteristic groups. essential alternately or in combination to achieve the specific nutritional purpose defined in column 1. 3. 4. Where the declaration of a given substance is required in column 4 of Part B and is also authorised as an additive, accompanied by the indication 'total', the declared content shall, as appropriate, include the quantity of the substance naturally present in the product if there is no additive or, by derogation from the Order of 23 March 1988, the total quantity of the substance naturally present and the amount added as additive.

5. The declarations required in column 4 accompanied by the indication 'if added' shall be compulsory when the ingredient or additive has been incorporated or increased in particular to achieve the specific nutritional purpose.

6. The declarations required in column 4 of Part B on analytical components and additives shall be quantitative.

7. The recommended period of use set out in column 5 of Part B provides a time-frame in which, under normal conditions, nutrition objectives must have been achieved. Manufacturers may indicate more precise periods within the limits set.

8. Where an animal feed is intended for more than one specific nutritional purpose, it shall comply with the corresponding entries in Part B.

9. In the case of complementary feedingstuffs for animals with specific nutritional purposes, guidance on the balance of the daily ration shall be established in the manner of use of the label.
