The Royal Decree 895/1989 of 14 July, which regulates the provision of jobs in public schools of pre-school, EGB and special education, enshrines the figure of the specialist teacher in a given area, with the The aim is to achieve a higher qualification for teachers, which will lead to an improvement in the quality of education.

To this end, it defines certain specialization requirements for the performance of some jobs of EGB, while establishing the possibility of performing specialization courses in different areas that enable the job performance of the relevant specialty.

Later, the Organic Law 1/1990, of 3 October, of General Ordination of the Educational System, establishes that Child Education and some areas of Primary Education will be taught by Masters with specialization In the first cycle of child education, the centres will also have other professionals with due qualifications for appropriate educational care for children of this age. Similarly, a similar forecast for the first cycle of compulsory secondary education is established, as a transitional measure, until the vacancies of this cycle are generally offered to Licensas.

These forecasts are made in the Royal Decree 1004/1991 of 14 June, laying down the minimum requirements for centres providing general non-university teaching.

Likewise, the transitional provision of the Organic Law 1/1990, of General Ordination of the Educational System, establishes that the qualification requirements that it requires for the delivery of the different educational levels will affect teachers who are serving in private schools under the provisions of the legislation then in force in relation to the places they are occupying.

In order to articulate the exercise of that right, the Orders of 11 October 1994 and 24 July 1995, for which the minimum qualifications to be held by the Teachers of the European Union, have been approved. the private schools of primary and primary education and of compulsory secondary education and baccalaureate.

Without prejudice to the right to be recognized by the Ordènes to non-specialist teachers to continue to perform the same places as they do, the possibility of current teachers being able to carry out training courses is introduced. specialization that enables them to perform the corresponding specialty in any teaching center.

On the other hand, Royal Decree 850/1993 of 4 June, which regulates the entry and acquisition of specialties in the Corps of Docent Officials, introduces, in its Article 40, the possibility that officials of the Body of Masters obtain the enablement for the exercise of new specialties, within the same Body, by carrying out a test. However, the same precept considers that this new procedure of acquisition of other specialties is compatible with the system of obtaining the specialty by the realization of courses, which established the Royal Decree 895/1989, of 14 of July.

Therefore, it seems necessary to approve the standard that allows, on the one hand, to continue the process of enabling the teaching staff of the Master's Corps, in different areas of specialty, by conducting courses of specialization, according to the provisions of Royal Decree 895/1989 and, on the other hand, to initiate a similar process with respect to the teacher of private teaching centers and the faculty of public teaching centers of Aymunities and Communities Autonomous regions without full competence in education.

The aforementioned process will allow for both the centers to have children's education, in primary education, in special education and in the first cycle of compulsory secondary education of the specialists that the Law of Ordination General of the Educational System and its rules of application establish, like that the Professor who, without being a specialist, comes teaching in private centers in a given matter, can pass on to impart it in another private teaching center different, after performing a specialization or enablement course.

In accordance with the above, the specialization or enablement courses that are regulated in this Order may be organized and convened. The design of these courses, where appropriate, must be based on the determination of their objectives, contents, credits and structure in which they are fixed for each specialty in Royal Decree 1440/1991 of 30 August, which establishes the official title of Master in his various specialties and the general guidelines of the plans of studies leading to his obtaining. The common core subjects of the Master's degree in all specialties and, on the other hand, the most specific of the subjects of the corresponding specialty, shall not be submitted. The number of credits assigned to the "practicum" is lower than that provided for in the general guidelines of the Master's degree study plans, because part of their contents, relating to " knowledge of the school system through knowledge of the "," and to the practices of the common core subjects and some of those of the specialty are known by the Masters in exercise.

Similarly, the design of the courses should take into consideration, in each case, the curricula established by the educational administrations for the areas and stages of Early Childhood Education and Primary Education.

In the case of courses of specialization in Music Education, Physical Education and Foreign Language, a prior test of aptitude is included, since these are specialties with a high practical content, (a) what is required to meet minimum capacity conditions by potential participants in the course of action, in order to ensure the training effects of such courses of specialisation.

For all of which, in accordance with the provisions of the sixth Royal Decree 895/1989, of 14 July 1989, and in the transitional provision of Royal Decree 1004/1991 of 14 June 1991, and after consulting the Autonomous Communities, I have arranged:

I. Common provisions

Also, the Autonomous Communities not in the full exercise of their educational competences, Local Corporations and professional organizations and representative of the education sector may call, subject to the authorization of the educational authorities referred to in the preceding paragraph, to convene specialization courses and to enable the teaching staff to provide or, where appropriate, to serve in the centres of which they are or those they represent.

To courses called or authorized by the Ministry of Education and Science and by the Autonomous Communities, they will be able to access, in their case, according to the bases of the corresponding call, in addition to the teaching staff service in the schools managed by each of the aforementioned administrations, the faculty of centres of ownership of the Local Corporations of the corresponding geographical scope, as well as other professionals who meet the requirements of appropriate qualifications, in accordance with the provisions set out in Annex II to this Order.

Second.-The courses called and authorized in accordance with the provisions of this Order will make it possible for the teachers to overcome them with positive evaluation to be able to carry out child education, Primary education, Special Education and the first cycle of compulsory secondary education for which, according to the current regulations, it is required to be a specialist.

The courses called and authorized in accordance with the provisions of this Order will enable professionals to overcome them with positive evaluation to fill jobs in the first cycle of Child Education.

Third.-The access requirements, content and duration of the courses that are to be called shall be in accordance with the requirements set out in the Annexes to this Order. Also, in the respective calls, aspects relating to the "practicum", such as the places for their realization, content, possible mentoring and certification of the activities, will be detailed.

For the assumption that a greater number of applications are submitted than the available places, the Convening Administration or, where appropriate, the organizing entity, may establish a scale, in order to select the students who will be able to access the course.

Fourth. -The courses that are regulated in this Order will be organized through a University. However, the course of specialization in Musical Education may be organized through another institution or entity of recognized competence and prestige in this field. In any event, the prior agreement between the administration or the convening entity of the course and the corresponding University, organizing institution, or Public Administration of which it depends will be necessary, which will be translated into an agreement between the two, where the organisation and funding of the courses are carried out. The Convention may cover a number of courses in one or more areas of specialisation.

The organizing university of the course or, in the case of an institution of prestige in the field of music, the Convener Administration or that authorizes the course, will issue an academic certificate to those students who pass it with a positive assessment. In this case, the administrative authority or body of the course, where appropriate, the educational administration which authorizes it under this Order, must be included in this case, as well as the mention that the said course will have the professional effects. provided for therein.

Fifth. Notwithstanding the provisions of the fourth paragraph, the courses provided for in this Order, which enable to exclusively impart the first cycle of Child Education, and which are called in accordance with the provisions of the The fourth paragraph of the Order of 11 October 1994 governing the minimum qualifications to be held by the teachers of the private and primary education institutions may also be carried out in secondary schools or in secondary schools. Sixth. -Specialization and enablement courses that, meeting the requirements set forth in this Order, have been called or, where appropriate, authorized by the competent educational administration under the auspices of the Order. (a) to be approved by the Ministry of Education and Science for the purposes laid down in the legislation in force.

Seventh.-The Ministry of Education and Science and the Autonomous Communities that are in full exercise of their educational competences shall determine, where appropriate, the conditions and procedure for authorization and convocation of the courses provided for in this Order.

At least annually, the Ministry of Education and Science and, where appropriate, the Autonomous Communities that are in full exercise of their educational competencies, will publish in their respective newsletters or newspapers. The relationship of courses called and authorized under the provisions of this Order, the organizations organizing them, as well as the relation of persons who overcome them with positive evaluation.

II. Courses for official teachers

Eighth. -According to the provisions of Royal Decree 895/1989 of 14 July, which regulates the provision of jobs in public schools of pre-school, EGB and Special Education, may be convened, under the conditions of established in the third, fourth and seventh points of this Order, the specialization courses described in Annex I to this Order, with the exception of the course provided for in the first cycle of the Early Childhood Education and the specialisation of a transitional nature. The performance of these courses will enable the teachers to overcome them with a positive evaluation for the performance of the corresponding jobs in the Child Education, in Primary Education, in Special Education, and in the first Compulsory Secondary Education, in accordance with the provisions of the transitional provision of the Organic Law 1/1990 of 3 October of General Ordination of the Educational System.

Ninth. -They will be able to conduct the courses that are called, according to the previous section, the career officials of the Corps of Teachers who are in active service, as well as the people who are serving as Interim official of the said Corps.

III. Courses for non-official teachers

Tenth. -In accordance with the provisions of the Order of 11 October 1994 governing the minimum qualifications to be held by the Teachers of the private and primary schools of Education, they may be convened in the the conditions set out in the third, fourth and seventh points of this Order, courses of specialisation in the different areas described in Annex I to this Order.

Similarly, and in accordance with the provisions of the fourth paragraph of the aforementioned Order, training courses may be convened for the professionals of the centers that provide the first cycle of Child Education.

The completion of the courses mentioned will make it possible for the professionals to overcome them with positive evaluation, to be able to carry out the corresponding jobs in Child Education, in Primary Education, in Special education and in the first cycle of compulsory secondary education, both in private schools and in public schools, provided that, in the latter case, the other requirements legally required to provide service at the appropriate job.

Eleventh. -They may be able to perform the courses that are called in accordance with the provisions of the 10th paragraph, the Teachers of public teaching centers not included in the ninth section of this Order, and the Teachers of Teaching Centers private persons who are in the situations provided for in the Order of 11 October 1994 and who, for each of the courses, are specified in Annex II-B. They may also carry out the courses referred to in the tenth paragraph of the Teachers in one of the situations referred to in the 19th paragraph of the Order of 11 October 1994.

Twelfth. -The competent bodies of the Ministry of Education and Science and the Autonomous Communities which are in full exercise of their educational competences may declare equivalent to the courses regulated in this Order those other than, having been organized through a University, and in the same areas of specialization here foreseen, or through an institution or entity of recognized competence and prestige in the field of Music Education and in this area of expertise has been called prior to the entry into force of the and meet the requirements set out in terms of access conditions and basic training content. Equivalence may be recognised for courses called by Autonomous Communities which were not in full exercise of their educational competence at the time of the call and which, however, meet the requirements now laid down. Equivalence shall be established by a timely resolution, upon request of the convening body. The said declaration of equivalence shall entail the approval of the courses completed.

13th.-The competent educational administrations will dictate how many provisions are necessary for the application of this Order.

14th. The entry into force of this Order will be repealed as many provisions of equal or lower rank are opposed to it.

15th. This Order shall enter into force on the day following that of its publication in the "Official Gazette of the State".

Relationship of courses to be convened

A) Courses for new specialties recognized in the Law of General Ordination of the Educational System:

1. Children's Education course, first and second cycles.

6. Course of Hearing and Language.

For official teachers only the courses related to this section may be convened.

B) Specialization courses of a transient nature:

1. Philology Course: Spanish Language.

2. Course of Mathematics and Nature Sciences.

3. Course in SocialSciences-Geography and History.

C) Enabling courses for professionals in the first cycle of Child Education:

1. Children's Education course, first cycle.

ANNEX II

Teacher requirements that you want to access courses that are called

A) In the course of courses directed to the official faculty of public teaching centers, dependent on the Ministry of Education and Science or an Autonomous Community that is in full exercise of its powers education:

(a) Courses for new specialties recognized in the Law on the General Management of the Educational System:

1. Children's Education course, first and second cycles.

Requirements:

Being Master, Diplomat in Basic General Teaching or First Teaching Teacher, or

To be a Master of Maternal and Parvulos Schools of the Catholic Church's Magisterium Schools and to be teaching Pre-School Education in a teaching center authorized for this educational level, at the date of implantation of the Child education in the centre in question, or

To be entitled as a university in teaching of a duration equal to or higher than that of Maestro and to be doing well in preschool education in a teaching center authorized for this educational level, at the date of implantation of Child Education in the centre concerned or the provision of service on an uninterrupted basis since the entry into force of the Law on the General Management of the Educational System in centres which, without being authorised as education centres Preschool, they were attending the school population of zero to six years according to the regulations prior to that Law (in Child Nurseries Authorised by the relevant City Council or dependent on a public body), or if they were teaching Basic General Teaching in a teaching centre approved for this level education, at the date of the implementation of Primary Education, or

Being taught Basic General Teaching in a teaching center authorized for this level of education, at the date of implementation of Primary Education and, likewise, to meet the conditions laid down in Article 6 of the Decree 1723/1960, of 7 September, and, moreover, having passed the examination provided for in that provision, in accordance with the provisions of the Order of 23 December 1980, or

To be in possession of the major degrees in Ecclesiastical Sciences by Faculties approved by the Holy See, in accordance with the provisions of the Order of 28 February 1980 ("Official State Gazette" of 25 March), on validity of academic qualifications for teaching in Catholic Church centres or having obtained, before 1970, the title of Auxiliary of Baccalaureate, or the title of Teacher of Primary Teaching issued by the Schools of the Magisterium of the Catholic Church (Plan of 1950), in accordance with the provisions of the Order of 23 December 1980 and, in addition, to be teaching Basic General Teaching in an approved centre for this level of education, at the date of implementation of Primary Education.

(The certificate that these people obtain only empowers them to teach Child Education in Catholic Church-dependent centers.)

2. Foreign Language Course.

Requirements:

Being Master, Diplomat in Basic General Teaching or First Teaching Teacher, or

Possess a degree that sanctioning university teachings of a duration equal to or higher than that of Master and coming imparting Basic General Teaching in an authorized teaching center for this educational level, on the date of implementation of Primary Education, or

Possess the complete studies of the priestly career and be teaching Basic General Teaching in an authorized teaching center for this educational level, at the date of implementation of Primary Education and, in addition, teaching in accordance with the Order of 23 December 1980 ('Official State Gazette ' of 3 January 1981), for which professional effects are recognised for certain qualifications,

Possess the complete studies of the priestly career and be teaching Basic General Teaching in an authorized teaching center for this educational level, at the date of implementation of the Primary Education, and be imparting teaching in accordance with the Order of 23 December 1980 (Official Gazette of the State of 3 January 1981), for which professional effects are recognised for certain qualifications

or

Being taught Basic General Teaching in a teaching centre approved for this level of education, at the date of the implementation of Primary Education and also to meet the conditions laid down in Article 6. Decree 1723/1960 of 7 September 1960 and, in addition, having passed the examination provided for in that provision, in accordance with the provisions of the Order of 23 December 1980, or

To be in possession of the major degrees in Ecclesiastical Sciences by faculties approved by the Holy See, in accordance with the provisions of the Order of 28 February 1980 ("Official State Gazette" of 23 March), on validity of academic degrees for teaching teaching in Catholic Church centres or having obtained the title of "Auxiliary of Baccalaureate" prior to 1970, or the title of Primary Teaching Teacher awarded by the Schools of the Magisterium of the Catholic Church (Plan of 1950), in accordance with the provisions of the Order of 23 December 1980 and, In addition, being taught Basic General Teaching in an approved centre for this level of education, at the date of implementation of Primary Education.

Possess the complete studies of the priestly career and be teaching Basic General Teaching in an authorized teaching center for this educational level, at the date of implementation of the Primary Education, and be imparting teaching, in accordance with the Order of 23 December 1980 (Official Gazette of the State of 3 January 1981), for which professional effects are recognised for certain qualifications

or

Being taught Basic General Teaching in a teaching center authorized for this educational level, at the date of the implementation of Primary Education and to meet the conditions laid down in Article 6 of the Decree 1723/1960, of 7 September, and, moreover, having passed the examination provided for in that provision, in accordance with the provisions of the Order of 23 December 1980, or

Being taught Basic General Education in a teaching center authorized for this level of education, at the date of implementation of Primary Education and to meet the conditions laid down in Article 6 of Decree 1723/1960, of 7 September and having passed the examination provided for in that provision, in accordance with the provisions of the Order of 23 December 1980,

To be in possession of the major degrees in Ecclesiastical Sciences by Faculties approved by the Holy See, in accordance with the provisions of the Order of 28 February 1980 ("Official State Gazette" of 25 March), on validity of academic qualifications for teaching teaching in Catholic Church centres or having obtained, before 1970, the title of Auxiliary of Baccalaureate, or the title of Primary Teaching Teacher awarded by the Schools of the Magisterium of the Catholic Church (Plan of 1950), in accordance with the provisions of the Order of 23 December 1980 and, imparting Basic General Education in an approved centre for this level of education, at the date of implementation of Primary Education.

6. Course of Hearing and Language.

Requirements:

Being Master, Diplomat in Basic General Education or First Teaching Teacher, or

Possess a degree that sanctioning university teachings of a duration equal to or higher than that of Master and coming imparting Basic General Education in an authorized teaching center for this educational level, on the date of implementation of Primary Education, or

Possess the complete studies of the priestly career and be imparting Basic General Education in an authorized teaching center for this educational level, at the date of implementation of Primary Education and, in addition, teaching, in accordance with the Order of 23 December 1980 (Official State Gazette of 3 January 1981), for the recognition of professional effects on certain qualifications,

Being taught Basic General Education in a teaching center authorized for this educational level, at the date of implementation of Primary Education, to meet the conditions set out in Article 6. of Decree 1723/1960, of 7 September and having passed the examination provided for in that draft, in accordance with the provisions of the Order of 23 December 1980,

b) Transitional specialization courses:

1. Philology Course: Spanish Language.

Requirements:

Being a Master, Diplomated in the Teacher of Basic General Education or Master of First Teaching and at the time of the implementation of the compulsory secondary education, being taught in an approved center of education Primary/Basic General Education, or

Possessing a degree that sanctioning university teaching of a duration equal to or greater than that of Master and at the time of the implementation of the compulsory secondary education, being taught in an approved center of Primary Education/Basic General Education,

2. Course of Mathematics and Nature Sciences.

Requirements:
