The automatic extension of the State General Budget, which is constitutionally provided for in Article 134.4 of the Constitution, affects both the states of expenditure and revenue, and the rules included in the Law of General Budget of the State for 1995, according to Royal Decree-Law 12/1995 of 28 December, on urgent measures in budgetary, tax and financial matters.

As a result, the framework to which the additions of new staff in 1996, in general for all staff at the service of the public sector, are to be referred to, is defined in Article 18.4 of Law 41/1994 of 30 June 1994. In December, the General Budget of the State for 1995, at the time that the calls for entry for new personnel will be concentrated in the sectors, functions and professional categories that are considered to be priorities and that the number of New entry places will be lower than that resulting from the application of the replacement rate of effective.

On the other hand, the Agreement on Working Conditions in the Civil Service, of 15 September 1994, in Chapter XIV, also provides for the selective nature of the offer of public employment, not only the needs of staff to be met by external candidates in the relevant financial year, but also the definition of policies to be developed in the field of public employment during the year.

In this context, it is up to the Government to authorise the public call for those places which cannot be covered with existing staff, which are considered to be priorities or essential for the provision of public services and whose coverage is urgent and non-deferred. All this in the overall context of budgetary restraint and no increase in staff at the service of the Public Administration.

This context also requires further progress in the implementation of human resource planning systems that allow for a closer assessment of staffing needs and better management of management processes. in the area of access, mobility and effective distribution. This will, in turn, make it possible to gradually link planning and management. The structure of employment in the teaching sector, the peculiarities of its role and its different mobility arrangements with regard to the other groups included in the offer of public employment advise their differentiated consideration.

According to these approaches, the present Royal Decree approves certain government forecasts regarding the management of public employment policies and a supply of limited places to sectors or administrative areas very specific, so that their quantity, the exception made of the teaching staff, is equivalent to that of the past exercise.

In its virtue, on the proposal of the Minister for Public Administrations, with the favorable report of the Ministry of Economy and Finance and after deliberation of the Council of Ministers at its meeting of February 2, 1996,

D I S P O N G O:

Article 1. Approval of the offer of public employment.

In compliance with the provisions of Article 18 of Law 30/1984, of 2 August, of Measures for the Reform of the Civil Service, the offer of public employment for 1996 is approved in the terms established in this Real Decree.

Without prejudice to Article 9.2, selective calls for evidence arising from this offer of employment may be published only in the financial year to which it relates.

Article 2. Quantification of the public employment offer.

The public employment offer includes human resource needs with budgetary allocation that cannot be met with existing personnel, according to the criteria and according to the composition that is details in the single Annex, without prejudice to Article 3.

Article 3. Teaching staff.

The needs of teaching staff, derived from the requirements of the development of the General Organic Law of the Educational System (LOGSE) and the uniqueness of the structure of employment in this field, make it appropriate to consider independent of their offer of employment.

For these reasons, the Ministry of Education and Science is authorized to call for selective testing for entry into the Secondary School Teachers ' Corps up to a maximum of 2,500 places in 1996.

Article 4. Human resource planning.

The Ministry for Public Administrations will promote the implementation of employment plans as an ordinary means of analysis and forecasting of personnel needs and rationalisation of the structure, composition and distribution of the templates, from a comprehensive perspective of personnel policy.

In this context, the satisfaction of personnel needs involving incorporation, mobility or redistribution of personnel, should be linked to human resources planning processes in the Departments or agencies where pose. In this planning, the needs of personnel will be considered globally, prioritizing them, and the measures to be undertaken to adapt the current workforce to the personnel structure that is necessary for the fulfillment of their objectives.

The employment plans will give preference to the measures of reordering, redistribution and professional training of existing personnel, in the face of measures involving the incorporation of new personnel.

Article 5. Provision of posts and mobility.

1. The preferred form of staff needs coverage among the different units in each department will be the change of positions between the units and the redistribution of personnel. These measures will be accompanied by the necessary training measures for the proper performance of the jobs.

2. Where the coverage of staffing needs is not possible under the measures set out in the preceding paragraph, inter-departmental reallocation of personnel and the reallocation of personnel from Departments and (a) surplus of staff to others of a deficit.

In the framework of the employment plans, it will be promoted the holding of competitions for the provision of posts aimed at filling vacant places in Departments and agencies identified as loss of staff, with officials from areas considered surplus.

On the other hand, the employment plans will be able to determine the non-incorporation of new personnel through competitions in the Departments and agencies identified as surplus of personnel, as well as the possibility of convening competitions closed to the staff of the relevant department or body.

3. Re-income to the active service of staff on leave shall be generally produced in the centres and bodies identified as loss-making personnel where there are vacancies of the Body or Scale to which the staff member belongs. the official requesting the entry. In any event, the provisional rereceipts shall be in accordance with the guidelines to be determined by the Ministry for Public Administrations.

4. At the joint initiative of the Ministries for Public Administrations and the Economy and Finance, the call for selective tests provided for in the offer of public employment, may be conditional on the prior redistribution of personnel, to through departmental or interdepartmental employment plans.

Article 6. Adaptation of the relationships of jobs and the catalogues of work staff.

The relations of jobs and the catalogues of workers in the ministries, autonomous bodies and management bodies and common services of social security, as instruments of management and management of the (a) public employment shall be amended in order to be in line with the budgetary allocations fixed and taking account of the number of staff at their disposal.

Article 7. Internal promotion.

In any case, in 1996, 1,000 places of internal promotion of group D to C will be convened, with the distribution to be determined by the Ministry for Public Administrations.

Article 8. Labour staff.

The selective tests corresponding to the work staff set out in the Annex to this Royal Decree, will have to refer to posts which, in accordance with the provisions of Article 15 of Law 30/1984, of 2 August, in the Under Law 23/1988 of 28 July and Law 42/1994 of 30 December 1994, they may be carried out by labour staff.

Prior to the authorization by the Ministry for Public Administrations of the call for selective tests for admission to the places of work staff listed in the annex of this Royal Decree, the agencies Proposers must present accreditation of the Ministry of Economy and Finance with respect to the existence of budgetary allocation in annual computation.

Article 9. Temporary staff.

1. During 1996, no new temporary staff will be recruited or interim officials will be appointed, except in exceptional cases and to cover urgent and non-deferred needs, with the joint authorization of the Ministries for the Public and Economic and Finance Administrations and within the framework of the criteria established in personnel policy.

Contracts to meet seasonal needs will automatically end when you beat your time limit.

2. The process of consolidation of employment which is carried out under the provisions of Chapter XV of the trade-union agreement of 15 September 1994 on working conditions in the civil service will require the approval of the corresponding employment plans, at the initiative of the departments or bodies to which they are concerned.

The selective processes derived from employment plans referred to in the preceding paragraph, which shall in any event respect the principles of equality, merit and capacity, as well as publicity, may be convened, up to the limit which establish the Council of Ministers, in the terms set out in each employment plan during the period of validity of the plan.

3. The employment relationships of those who temporarily perform the places to be fixed within the framework of an employment plan may be extended until the selective processes corresponding to the call for tenders are completed. fixed-character seats. To this end, the initial employment relationship may be transformed into an interim employment relationship, in accordance with the terms of Royal Decree 2546/1994 of 29 December 1994 or in the rules of public service.

Article 10. People with disabilities.

1. In the case of selective tests for entry into Bodies or Escalations of officials and categories of labour personnel, including those for internal promotion, persons with disabilities on equal terms with other persons shall be admitted. aspirants.

Calls will not establish exclusions for psychic and/or physical limitations, without prejudice to incompatibilities with the performance of the corresponding tasks or functions.

In selective testing, including training courses or traineeships, the possible adaptations of time and means for their realization will be established for people with disabilities who request it. This possibility should be expressly stated in the calls, as well as the need for the interested parties to make a specific request in the request for participation.

To this end, the courts or commissions of selection may require a report and, where appropriate, collaboration of the technical bodies of the Administration of Labour, Health or the competent bodies of the Ministry of Social Affairs.

2. The total number of places offered will be set aside for 3 per 100 to be covered by those who have the legal status of people with disabilities.

The distribution by Corps, Escalas or categories of work personnel will be carried out in the respective calls for selective tests heard by the Ministry of Social Affairs.

The option for reserved places shall be made in the request for participation in the calls, with the express declaration of the persons concerned to meet the condition required in this respect, which shall be credited, if the place is obtained, by certification of the competent bodies of the Ministry of Social Affairs and, where appropriate, the corresponding Autonomous Community.

The selective tests will be conducted on an equal basis with the applicants for free access, without prejudice to the adaptations provided for in this article.

If in the performance of the same doubts the court will be raised regarding the ability of the aspirant for the performance of the activities usually developed by the officials of the Body or Scale, or category of The competent authority may, in accordance with the third subparagraph of this paragraph, obtain the relevant opinion of the competent body.

In the initial allocation of the job, the competent authority or commission may require, in respect of persons entered by this reserve quota, the opinion of the body referred to in the third subparagraph of this paragraph on the compatibility of the candidate for the job or on the latter's adaptations.

Additional provision first.-Offer of employment of the Local Corporations.

Local corporations that approve their offers of public employment, in accordance with the basic legislation of the State on public service, will have to forward the agreements approving them to the State Administration, Article 56.1 of Law 7/1985 of 2 April.

Additional provision second. Local Administration Staff.

In order to meet the needs of the local administration, the Ministry for Public Administrations may convene selective tests for access to the Scale of Local Government Officials, with National qualification, depending on the vacancies existing on the various subscales.

Additional provision third.-Participation in selective testing courts.

They may not be part of Selection Commissions or selective testing courts for entry into the State Administration's Corps or Escalations, or categories of labor personnel, who are considered to be high. In accordance with the provisions of Law 12/1995, of 11 May, on Incompatibilities of the Members of the Government of the Nation and of the High Charges of the General Administration of the State.
