Royal Decree 379/1993 of 12 March, for the Management of Official Publications, introduced important changes in the editorial activity of the General Administration of the State, which until that moment was regulated. by Royal Decree 1434/1985 of 1 August. Among these changes is the fact that the editorial programmes of the various ministerial departments will be half-yearly rather than annual, as well as the annual approval by the Government of a General Plan for Official Publications of the European Communities. the State Administration, with a view to the preparation of the editorial programmes of each Ministry.

On the other hand, and in order to adapt the system of assignment of the identification number of the official publications to the forecasts contained in the Royal Decree 379/1993, of March 12, the Order of the Ministry of the Presidency of 30 December 1993, of the identification number of official publications (NIPO).

It should also be taken into account that since the entry into force of the Order of 24 October 1991, the Publications Centre is regulated and the Publications Advisory Commission of the then Ministry of Works is established. Public and Transport, several Royal Decrees have been approved for restructuring the current Ministry of Public Works, Transport and the Environment.

For all of the above, it is necessary to approve a new Order that serves, on the one hand, to apply in the specific field of the Ministry of Public Works, Transport and Environment, the provisions of Royal Decree 379/1993, of 12 of In March, and by the Order of the Ministry of the Presidency of 30 December 1993, and, on the other hand, to adapt its content to the current organic structure of the Department.

In its virtue, with the report of the Board of Coordination of Official Publications and the approval of the Minister for Public Administrations, I have:

First. Publications Advisory Committee. -In application of the provisions of Article 6 of Royal Decree 379/1993 of 12 March, for the Management of Official Publications, the Advisory Committee for Publications of the Ministry of Public Works is hereby established. Transport and the Environment, the composition and functions of which are to be determined in the following paragraphs.

Second. Composition.

1. The Publications Advisory Commission of the Ministry of Public Works, Transport and the Environment is composed of the following members:

President: The Assistant Secretary of the Department, who will be able to delegate to the Vice President.

Vice President: The Technical Secretary General.

Vocals:

A representative, with an organic level of Deputy Director General, of each of the Secretaries of State and the Secretaries-General, of the Secretariat, of the Cabinet of the Minister, and of the autonomous agencies and entities of the Department.

A representative of the Budget Office.

The Deputy Director-General of the Publications Centre, who will act as secretary.

The Vowels of the Publications Advisory Commission shall be appointed by the holder of the body to which they represent.

2. The Advisory Committee may have delegates representing the different Directorates-General. These delegates shall coordinate the editorial work in their Directorates General and support in the elaboration of the part of the Editorial Program that corresponds to the voice of the Secretariat of State or General Secretariat in which it is framed. Directorate-General.

The delegates shall be appointed by the head of the Directorate-General to whom they represent and may attend, with a voice but without a vote, the plenary sessions and commissions to which they are expressly called.

3. The meetings of the Commission may be incorporated by a decision of its President, as advisers, officials of the Department deemed appropriate in accordance with the matters to be dealt with.

Third. Duties. -Corresponds to the Publications Advisory Commission:

a) Report the editing proposals to be integrated into the Department's Editorial Program.

b) Report, as appropriate, the proposal of the Department in relation to the General Plan for Official Publications.

c) Orienting the department's publishing and broadcasting activities, providing advice on all matters related to them.

d) To advise the General Secretariat on publications.

e) Report the Department's Annual Report Memory.

f) Report the draft rules affecting the Department in the field of official publications.

Fourth. Operation of the Publications Advisory Commission. The Advisory Commission may operate in plenary, in the Standing Committee and in Special Commissions, in accordance with the matters included in the agenda established by the President.

Fifth. Permanent Commission. The Permanent Commission, chaired by the Technical Secretary General, shall be appointed by the Plenary and shall exercise the functions delegated to it by the latter.

Sixth. Approval of the Editorial Program. -Under the Ministry's delegation, the Assistant Secretary will approve the Ministry's Editorial Program for each semester. The extraordinary amendments to the programme referred to in point 5 of the Order of the Ministry of the Presidency of 30 December 1993 governing the identification number of official publications shall be approved by the Commission. the Technical Secretary General, also by delegation of the Minister.

Seventh. Identification number of official publications.-Unitarian and periodic publications, audiovisual and computer equipment and brochures, maps, loose sheets and posters editing by the Department, will have to be printed identification of official publications (NIPO), in accordance with the provisions of Article 8 of Royal Decree 379/1993 of 12 March 1993 and the Order of the Ministry of the Presidency of 30 December 1993 governing the number of identification of official publications (NIPO).

For the purposes of the application of the NIPO, it is understood that a publication is official provided that a logo or identifying element of the Department appears in it, even if it does not involve processing of the expense file.

The Delegated Intervention will require that in any case of expenditure for the performance, editing and distribution of official publications, the concession card of the NIPO is incorporated.

Eighth. Regulatory standards.-Without prejudice to the peculiarities provided for in this Order, the Publications Advisory Committee shall be governed by the provisions of Chapter II of Title II of Law No 30/1992 of 26 November 1992 on the Legal Regime of Public administrations and the Common Administrative Procedure.

Ninth. The Publications Centre of the Ministry of Public Works, Transport and the Environment is the unit of the Technical General Secretariat responsible for carrying out the editorial and dissemination activity of the publications of the Department.

10th. Functions. The Publications Centre will perform the following functions:

a) Develop the Editorial Program from the proposals made by the management centers, entities and autonomous organizations assigned to the Department, with the expression of the forecasts contained in the article 2.1 of the Royal Decree 379/1993 of 12 March 1993 for the Management of Official Publications.

b) Develop, as appropriate, the proposal of the Department in relation to the General Plan for Official Publications of the State Administration.

c) Manage the editing, distribution and sale, if any, of the official publications and any other activities that, due to their connection with the editorial process, determine the Department.

(d) In particular and in the field of competence assigned to it by the Technical General Secretariat in this field:

To process the expenditure files, within the budget appropriations that each year are assigned to the Ministry's Editorial Program.

Administer and account for fixed cash advances and funds to be granted, in order to deal with immediate implementation actions such as emergency issues, franking, locomotion, acquisition of consumable and any other that is precise for the most effective editorial management and diffuser of the activities of the Department.

Manage and claim, where appropriate, the rights that occur as a result of the dissemination and sale of your own publications, of which other Departments, entities and public bodies, of the advertising, are deposited with you. inserted in the same, as well as the dimanants of any other activity that legally performs and its subsequent entry into the Public Treasury.

e) Coordinate the application of the Department's corporate image programs to publications. It will also be responsible for the design and layout of publications, promoting the consolidation of styles, series and collections of covers and interiors.

f) Propose to the Secretary-General Technical the sales prices to the public of the publications of the Department, by reasoned report, taking into account its cost of production and in accordance with the instructions on it, in its Case, of the Coordinating Board for Official Publications.

Publications that are sold to the public will be printed with the corresponding bar code.

11th. Elaboration of the Editorial Program.-The management centers, entities or autonomous agencies of the Department, will forward to the Technical General Secretariat, within the time indicated by this and for the purposes of the elaboration of the Editorial Program for semesters, the proposals relating to unitary, periodic and audiovisual and computer-based publications which, by reason of the dissemination of the activity and the objectives of the department, are deemed appropriate to be edited. The proposals will contain a reference to the content, the draft estimate and the planned publication schedule, in accordance with the information sheet for the editorial proposal.

The forecasts for editions of brochures, triptics, diptics, loose sheets, posters and other similar ones will be globalized in series or collections, according to their purpose.

12th. Entities governed by public law and autonomous organizations. -In accordance with Article 4 of Royal Decree 379/1993 of March 12, public law entities and autonomous organizations attached to the Department will have, in the field of publications, the The following functions:

a) Formulate your publications proposals for inclusion in the Department's semiannual Editorial Program project, as well as the editing proposals that arise after the Editorial Program is approved.

b) Edit your own publications, according to the Editorial Program.

c) Set the sales prices of your publications, in accordance with the instructions of the Official Publications Coordination Board.

d) Distribute and market your publications.

13th. The Order of 24 October 1991 for the Publications Centre is hereby repealed and the Publications Advisory Committee of the Ministry of Public Works and Transport is hereby established, as well as the provisions of the same or The lower range is opposed to what is established in this Order.

14th. Entry into force. -This Order shall enter into force on the day following that of its publication in the "Official State Gazette".
