The Royal Decree 2207 / 1994 of 16 November, which approves the list of substances permitted for the manufacture of plastic materials and articles intended to come into contact with foodstuffs and regulate certain test conditions, incorporated into national legislation Directive 93/8/EEC of the Commission of March 15, by which Council Directive 82/711/EEC amending that establishes core rules needed for the verification of the migration of the components of materials and plastic articles intended to come into contact with foodstuffs, as well as Directive 93/9/EEC of the Commission of March 15, amending Directive 90/128/EEC, concerning the plastic materials and articles intended to come into contact with food and food products.


Paragraph 2 of article 5 of the Royal Decree provides for the possibility that the list of monomers and other starting substances authorised for the manufacture of plastic materials and articles (section A of annex II) can be modified as a result of the contribution of fresh scientific data or a review of the existing ones.


The existence of new knowledge on certain substances has made necessary a new amendment to Directive 90/128/EEC, concerning the plastic materials and articles intended to come into contact with foodstuffs. This Royal Decree incorporates, as a result, to our legal system, the Directive 95/3/EC of 14 February 1995, the Commission is amending this directive, which responds to the mentioned need for adaptation of the regulations to new knowledge in the matter, adding through to section A of the annex II of Royal Decree 2207 / 1994 certain substances deleting others and introducing modifications in the content of the column 'Restrictions'. Also entering an incomplete list of additives which may be used in the manufacture of plastic materials and articles, in which are specified in addition to the name of the substance the reference number EEC packaging material of the substances in list (PM/REF number), number of registration of the Chemical Abstracts Service (CAS number) and use restrictions.


This is an incomplete list of additives that will be expanded in phases until a complete list, replaces in part to that contained in the resolution of 4 November 1982, of the Health Department, which approve the positive list of substances intended for the manufacturing of macromolecular compounds, the list of peak migration in evidence of transfer of some of them , the conditions for purity for the dyestuffs used in the same products and the list of polymeric materials suitable for the manufacturing of packaging and other utensils that may be in contact with food & food products («Official Gazette» of 24 November), modified by order of the Ministry of health and consumption of 3 July 1985 («Official Gazette» from 12) , so only will be valid that resolution, in relation to the positive list of substances can be used as additives for the manufacture of plastic materials and articles, which are not included in annex II of this Royal Decree.


This Royal Decree is issued in accordance with the provisions of article 40.2 and 40.4 of the law 14/1986 of 25 April, General health, and under cover of the provisions of article 149.1.16. ª of the Constitution. In its processing have been heard the sectors affected, having issued its mandatory report the Interministerial Commission for food management.


By virtue, on the proposal of the Ministers of health, industry and energy, agriculture, fisheries and food and of trade and tourism, according to the Council of State and after deliberation by the Council of Ministers at its meeting on March 15, 1996, D I S P O N G O: only article.


The Royal Decree 2207 / 1994, of 16 November, which approves the list of permitted substances for the manufacture of plastic materials and articles intended to come into contact with foodstuffs and regulate conditions of trial, is modified as follows: 1. Article 6, paragraph 1, is worded as follows: «article 6. Positive list of additives.


1 additives that can be used in the manufacture of plastic materials and articles, are those listed in annex V, as well as those included in the resolution of 4 November 1982, of the Secretariat of health («Official Gazette» of 24 November), and its modification by order of 3 July 1985 («Official Gazette» of July 12) are not contemplated in the present Royal Decree.


2. it replaces annex II, which shall be drafted in the following terms: ' annex II list of monomers and other starting substances authorised for use in the manufacture of plastic materials and articles general introduction 1.» This Annex establishes the list of monomers and other starting substances. This list contains: substances intended to be subjected to polymerization, which includes polycondensation, polyaddition or any other similar process, to produce macromolecules;


Natural or synthetic macromolecular substances used in the manufacture of modified macromolecules, if the monomers or the other starting substances required for the synthesis of those are not included in the list;


Substances used to modify existing natural or synthetic macromolecular substances.


2. the list does not include the salts (see double salts and acid salts), of aluminium, ammonium, calcium, iron, magnesium, potassium, sodium and zinc of the acids, phenols or alcohols which are also allowed; However appear in the list of names that contain the word acid (s), salt (s), in the event that the corresponding (s) (s) acid free (s) are not listed (n). In such cases the meaning of the term 'salts' is 'salts of aluminium, ammonium, calcium, iron, magnesium, potassium, sodium and zinc'.


3 the list also includes the following substances that could be found in the finished product: to) substances that may be encountered in the product completed as: 1st impurities in the substances used.


2nd intermediate reaction products.


3rd decomposition products.


(b) oligomers and natural or synthetic macromolecular substances as well as their mixtures, if the monomers or starting substances required to synthesise them are already included in the list.


(c) mixtures of the authorised substances.


Materials and articles which contain the substances referred to in paragraphs a), b), c) shall comply with the requirements established in the Royal Decree 1425 / 1988, of November 25, which approves the Reglamentación for processing, circulation and trade of plastic materials intended to come into contact with food.


4. the authorized substances shall be of good technical quality, in terms of the purity criteria.


5. the list contains the following data: column 1 (REF number / I): reference number EEC of the substance of the packaging material, from the list.


Column 2 (CAS number): the CAS (Chemical Abstracts Service) registry number.


Column 3 (name): the chemical name.


Column 4 (restrictions). These may include: a) the limits of specific migration (LME).


(b) maximum allowable number of «residual» substance in the material or object (CM).


(c) any other restriction specifically mentioned.


6. If a substance appearing in the list as compound isolated also is included in a generic name, the restrictions applicable to this substance shall be those corresponding to the isolated compound.


7. in case of disagreement between the number of CAS and the chemical name, the latter shall prevail against the first. If there is disagreement between the CAS number collected in EINECS and the CAS registry shall apply the latter.


8. in column 4 of the table are used a series of abbreviations whose meaning is as follows: LD = detection limit of the analytical method.


PT = Material or finished article.


SA = food simulant.


NCO = functional group isocyanate.


ND = not detectable.


For the purposes of the present Royal Decree, the expression "not detectable" means that the substance should not be detected by a validated analytical method, that it possessed a detection limit in accordance with required by their specific restriction. If there is no such method at the time of the analysis, you can use a reliable and reproducible analytical method that has the limit of detection required by their specific restriction, waiting for to develop a validated method.


CM = maximum permitted quantity of "the residual" substance in the material or object.


CM (T) = maximum amount allowed for "the residual" substance in the material or object, expressed as total of listed substances or groups. "CM (T)" means that the maximum allowable number of substance "residual" in the material or article shall be determined by an analytical method validated in the specified limit. If it did not exist at the moment such method, you can use an analytical method that possess the necessary sensitivity to reliably determine the specified limit, waiting for it to develop a validated method.


LME



= Limits of specific migration in food or food simulants, unless otherwise noted. For the purposes of the present Royal Decree "LME" means that the specific migration of the substance shall be determined by a validated method of analysis having a limit of detection in accordance with required by its LME. If there is no such method at the time of the analysis, you can use a reliable and reproducible analytical method that possess the sensitivity required by the LME, waiting for to develop a validated method.


SML(t) = specific migration in foods or in food simulants limit, expressed as total of listed substances or groups. "LME (T)" means that the substances specific migration limit shall be determined by an analytical method validated in the specified limit. If there is such a method at the moment, you can use an analytical method that possess the necessary sensitivity to reliably determine the specified limit, waiting for it to develop a validated method.

This Royal Decree is issued under cover of the provisions of article 149.1.16. ª of the Constitution and in accordance with the provisions of article 40.2 and 40.4 of the Act 14/1986 of 25 April, General health.


Sole transitional provision.


The marketing and use of plastic materials and articles intended to come into contact with foodstuffs which do not adapt to the provisions of this Royal Decree, but complying with the existing legislation on the date of its entry into force, may be done only until April 1, 1998.


Sole repeal provision.


Many provisions of equal or lower rank is contrary to the provisions of this Royal Decree are repealed.
