The Royal Decree 758/1996 of 5 May, restructuring of the Ministry of Labour and Social Affairs, creates the Ministry of Labour and Social Affairs, which corresponds to the powers conferred to the Ministry of Labour and Social security and the Ministry of Social Affairs.

Royal Decree 839/1996, of 10 May, establishes the basic organic structure of the Ministry of Labour and Social Affairs, proceeding to the deletion and recasting of certain organs of the Department, in application of criteria for rationalisation and simplification of structures, which are present in the Royal Decree.

For its part, in the final provision of the aforementioned standard, the three-month period was fixed to adapt the organization of the Department to its basic structure, so it is now, through this Royal Decree, to give compliance with this forecast, with the same rationalisation and simplification criteria followed by Royal Decree 839/1996.

In its virtue, at the initiative of the Minister of Labour and Social Affairs, on the proposal of the Minister of Public Administration and after deliberation of the Council of Ministers at its meeting of August 2, 1996,

D I S P O N G O:

Article 1. General organization of the Department.

1. The Ministry of Labour and Social Affairs is the body of the General Administration of the State responsible for the proposal and implementation of the Government's general guidelines on employment policy, employment policy, social security and social assistance.

2. The Ministry of Labour and Social Affairs, under the top leadership of the Department's head, develops the functions that legally correspond to him through the following higher bodies:

a) Secretary of State for Social Security.

b) Deputy Secretary for Labour and Social Affairs.

(c) General Secretariat for Employment.

(d) General Secretariat for Social Affairs.

3. As an immediate assistance body to the Minister, there is a Cabinet, with an organic level of general direction, with the structure set out in Article 12 of Royal Decree 839/1996 of 10 May.

4. Also, it is up to the head of the Department of the General Secretariat of the Royal Board of Prevention and Attention to Persons with Minusvalia, with organic level of general subdirection.

5. The Minister holds the effective presidency of the Royal Board of Prevention and Attention to Persons with Minusvalia and presides the collegiate bodies Inter-Ministerial Commission for Youth, the Council of the Protectorate of the State on the Organization National of the Spanish Blind, and the State Council of Older Persons.

6. The Youth Council of Spain relates to the General Administration of the State through the Ministry of Labour and Social Affairs.

7. In accordance with the provisions of Law 21/1991 of 17 June, the Economic and Social Council is attached to the Ministry of Labour and Social Affairs.

Article 2. Secretary of State for Social Security.

1. The Secretary of State for Social Security, under the top leadership of the Minister of Labour and Social Affairs, has the following functions:

(a) The superior management and control of the Gestoras and the General Treasury of Social Security, with the exception of the competencies attributed to other Departments.

b) The impetus and direction of the legal management of Social Security.

c) The direction and coordination of the management of financial resources and Social Security expenditure.

d) The planning, coordination and management of social benefits by the State and Social Security.

e) The protection and control of the management exercised by the Patron Mutuals of Occupational Accidents and Occupational Diseases, Collaborating Companies and Labor Foundations that act as complementary to the Social Security.

f) The representation of the Department by the Minister's express delegation, if any.

g) How many others have been attributed, legally or regulatively, and in particular those referred to in Article 9 of Royal Decree 2169/1984 of 28 November.

2. The Directorate-General for Social Security and the General Intervention of Social Security, without prejudice to the functional dependence of the latter of the General Intervention of Social Security, is dependent on the Secretary of State for Social Security. the State Administration.

3. As a body of immediate assistance to the Secretary of State, there is a Cabinet, with an organic level of sub-directorate general, with the structure set out in Article 12 of Royal Decree 839/1996 of 10 May.

4. The National Social Security Institute, the Social Institute of the Navy and the General Treasury of Social Security are assigned to the Secretary of State for Social Security.

Article 3. Directorate-General for the Management of Social Security.

1. It is for the Directorate-General for Social Security Management:

a) Develop the economic and financial functions of Social Security, which correspond to the Ministry of Labour and Social Affairs, carrying out its planning and carrying out economic and financial studies required.

b) Exercise control in the economic order of the Gestors and Collaborators of Social Security.

c) Carry out the functions of management and guardianship on the Social Security system, relating to the legal adequacy of the system, preparing and interpreting the rules and provisions that affect the system in the Security Social.

d) Develop the Social Security preliminary draft budget, in accordance with the social protection policy established by the Government.

e) To know and inform preceptively of how many measures have an impact on the funding and expenditure of Social Security.

f) Develop the economic information related to the Social Security system.

g) Issue how many legal reports and opinions are requested, as well as coordination in disputes in which Social Security is an interested party.

h) Coordinate and mentor the management of the Mutual Work and Occupational Accidents of Social Security and Collaborating Companies.

i) Participate in activities related to the international arena, both in social protection work groups, and in the elaboration of reports required by various international organizations or derivatives of membership of Spain to those bodies.

2. The Directorate-General for Social Security Management is made up of the following units, with an organic level of general sub-direction:

1. No. Social Security Subdirectorate General:

This is the responsibility of this General Subdirection:

(a) The formulation of the Social Security expenditure budget, in accordance with the policy of economic and welfare benefits to be developed in each financial year.

(b) The drawing up of the Social Security system's resources budget, by estimating the levy payable in the various schemes and the assessment of the other revenue.

c) The design of the criteria to be chaired by the multi-annual investment plans.

d) the carrying out of studies of new budgetary techniques and the establishment of methods for their use in the preparation of the budgets of the system.

e) The economic and budgetary management of part of the appropriations of the service "Secretariat of State of Social Security" integrated in the budget of the Ministry of Labour and Social Affairs.

f) Promote and quantify the contributions of the State budget required to protect the protection of social security attended by the State in each exercise.

2. " Social Security Budget Tracking Subdirectorate General:

This is the responsibility of this General Subdirection:

(a) The control and budgetary monitoring in administrative and program terms, of the Management Entities, the Common Services and the Collaborating Entities of the Social Security System.

b) The processing of the budgetary modification files and the updating of the budgets of the Management Entities, the Common Services and the Social Security Collaborating Entities.

c) The authorisation of the systems and procedures for monitoring objectives to be applied by the managing bodies in order to be able to assess the implementation of the programmes which have served as a basis for the resource allocation.

d) The formulation of states summarizing the economic and budgetary management of the Social Security System, as well as determining the scope, content and periodicity of the information on economic and budgetary management they must facilitate their Agents.

e) To analyze the numerical statements that make up the annual Social Security Monetary Budget, and to report the credit operations and cash advances needed to address the financial mismatches of the Social Security System Social Security.

3. Deputy Director General of Economic and Financial Planning and Analysis of Social Security:

This is the responsibility of this General Subdirection:

(a) Elaboration of economic and financial studies related to a permanent evaluation of the Social Security System. Reporting on the economic impact of any regulatory changes affecting the level of revenue or expenditure of the System.

b) Elaboration of reports and studies related to the demographic area, both of the Spanish population and its relation to the labour market, and of the specific population of Social Security.

(c) Realization of the medium-and long-term economic-actuarial studies, which will allow the assessment of the evaluation of income and expenditure of the Social Security System to be carried out and to control its economic-financial equilibrium.

d) Development of the economic-financial report for Social Security budgets.

e) Develop the economic information related to the Social Security System, to be carried out on a regular basis.

4. Deputy Director General of the Legal System of Social Security:

This is the responsibility of this General Subdirection:

a) The elaboration of the provisions of Social Security.

(b) The ordination and systematization of such legislation and the knowledge and opinion of the legal questions raised in relation to it.

c) The elaboration of the reports and memories that are required in relation to the application of international conventions and treaties in the field of Social Security, as well as the analysis of the incidence in the Security System Social initiatives of the European Union.

d) The report on provisions or actions with legal effect on Social Security.

e) The legal report on how many issues are requested.

5. Deputy Director General of Technical Legal Assistance for Social Security:

This is the responsibility of this General Subdirection:

(a) The analysis of the Social Security disputes and the coordination of their defense in judgment.

(b) Elaboration and processing of proposals for the resolution of sanctions arising from breaches in the field of social security.

c) The legal coordination of activities that require joint actions of several entities.

d) The relationship with the Management Entities of Special Regiments outside the Social Security budget.

6. Deputy General Management of Economic Management for Social Security:

This is the responsibility of this General Subdirection:

(a) The coordination of the economic management of the Social Security Management Entities attached to the Ministry of Labor and Social Affairs.

b) The follow-up in the economic and budgetary order, the transfer of social security services to the Autonomous Communities, as well as the examination and analysis of the data provided by them, promoting homogenization of the latter.

c) The coordination of the reports and studies necessary for the integration of the entities acting as replacement of the Social Security System, as well as of other collectives not currently framed in that one.

(d) The monitoring, coordination and financial adequacy of the management of the economic assistance services, not integrated in the social security system, the address of which corresponds to the Secretariat of State of Social Security.

e) The assessment of the situation of each of the Working and Occupational Accidents and Occupational Diseases of the Social Security and Occupational Centers, by monitoring and monitoring the management (a) technical and administrative procedures, proposing, where appropriate, the adoption of the measures resulting from them, in accordance with the provisions of the Partnership Regulation.

f) The evaluation and monitoring of the situation of the collaborating companies, implementing, in their case, the necessary controls on the protective management developed by the aforementioned companies.

Article 4. General intervention on social security.

The General Intervention Center for Social Security shall be governed by its specific legislation, in accordance with which it is structured in the Subdirectorates General of Control of Social Security Management Entities, Control of the Common Services of Social Security, Financial Control of the System of Social Security and Accounting.

Article 5. Deputy Secretary for Labour and Social Affairs.

1. Its holder holds the ordinary representation of the Ministry.

2. It is up to the Deputy Secretary for Labour and Social Affairs, under the authority of the Minister, to exercise the powers referred to in Article 15 of the Law of Legal Regime of the State Administration, as well as the address, promotion and supervision of management centres and units directly dependent on them.

3. In particular, the following functions are assigned to the Secretariat:

(a) Support and technical advice to the Minister in the elaboration and approval of the Department's action plans.

b) The elaboration of the annual preliminary draft budget of the Department and the coordination of the corresponding to the Autonomous Bodies and assigned entities, as well as the follow-up of the budget implementation and the processing, where appropriate, of the budgetary changes.

c) The study of the different organizational elements of the Department and the direction and implementation of organizational projects at ministerial level.

d) The management and administration of the human resources of the Department, the elaboration of the relations of jobs and the employment plans, the processing of the processes for the coverage of the jobs, the training of staff, trade union relations, social action and prevention, hygiene and safety at work.

e) The elaboration and implementation of the Department's IT plan, the management of the technical and communications infrastructure required by the various management centers and units of the Ministry, as well as the management of the information and communication systems.

f) Economic and financial management, wealth procurement and management, technical and maintenance services, library and publications, statistics for state purposes, internal rules and records and archives General in the Department's scope.

g) The elaboration and processing of draft general provisions, permanent legal advice to those responsible for administrative management, the formulation of proposals for the resolution of resources administrative action against the acts and provisions of the Department, as well as relations with the courts.

Also, it is up to you to inform the draft rules of other Ministries, coordinating, for such purposes, the corresponding actions within the Ministry, as well as in relation to the other Departments that have to intervene in the procedure.

h) External relations and institutional relations with other departments, public administrations and with social partners.

i) The coordination of the Labor Department, without prejudice to the competence of the Spanish Embassies or Diplomatic Missions abroad and the direct dependence of the holders of those in respect of the Head of Mission Diplomatic, international cooperation and action of the Department abroad, without prejudice to the competences of the Ministry of Foreign Affairs.

(j) The organisation of the control and inspection activities of the Department, carrying out those that allow the evaluation of the operation, effectiveness and performance of the Ministry's personnel and services, without prejudice to the actions that may be performed in these matters by the General Intervention of the State Administration, in accordance with the rules in force.

4. In so far as the above functions are not concentrated or delegated to other bodies of the Ministry, the Secretariat shall be responsible for its coordination and control, respectively.

5. The following management centres with general management level are directly dependent on the Under-Secretary for Labour and Social Affairs:

(a) The Technical General Secretariat.

b) The Directorate-General of the Labour and Social Security Inspectorate.

6. The following units with an organic level of general sub-management are assigned to the Under-Secretary for Labour and Social Affairs, without prejudice to their respective functional dependence on the Ministries of Justice and Economy and Finance:

(a) The Legal Service, which shall exercise its functions with the character and form provided for in the rules governing the State Legal Service.

b) The Delegated Intervention of the General Intervention of the State Administration, which will exercise its functions with the character and form provided for in the legislation in force.

7. The Ministerial Commission of Informatics is attached to the Secretariat.

8. The following units with organic level of general sub-direction are directly dependent on the Under-Secretary for Labour and Social Affairs:

1. Technical Cabinet: it is the organ of support and permanent assistance to the Undersecretary, and coordination and liaison with the different management centers of the area in the issues and terms that the Undersecretary points out, as well as with the other areas of the Department and with the Technical Cabinets of the Ministry and the other Departments.

2. Budget Office: it shall be responsible for drawing up the annual preliminary draft budget of the Ministry and for the coordination of the Ministry's self-employed and self-employed bodies, as well as the monitoring of the budgetary implementation and the authorisation or, where appropriate, the processing of its amendments. It will also coordinate the issues of its competence, with the other management centers of the Department and Budgetary Offices of the remaining Ministry Departments.

3. Major Official: Your competencies are as follows:

(a) Establish the internal system of general services and manage their intrend, operation and maintenance, as well as lead and manage communications and security and surveillance services.

b) To carry out the administrative procedures and actions for the maintenance of relations with the other Departments, the Official Gazette of the State and the Advisory Bodies of the State, without prejudice to the attributed to the Technical General ViceGeneral.

c) Manage the Ministry's General Register and coordinate protocol services.

d) Develop and maintain the inventory of movable property.

e) To deal with matters of a general or undetermined nature not attributed to other units.

4. th Human Resources Subdirectorate General:

Lies with this General Subdirection:

(a) The elaboration of the Ministry's personnel policy, including the employment plans.

b) The execution of performance improvement plans and personnel training.

(c) The application of the rules on remuneration.

d) The elaboration of the preliminary draft offer of employment.

e) The confection of the relations of jobs.

f) The recruitment of staff.

g) Rewards, sanctions and social action.

h) Collective bargaining and the relationship with the organs of representation.

i) In general, all the functions inherent in the administration of personnel that are the responsibility of the Undersecretary of the Department, on the personnel of the Ministry.

5. Deputy Director General for the Management and Development of Human Resources of Autonomous Bodies and Social Security:

Lies with this General Subdirection:

a) The elaboration of the personnel policy of the Management Entities and the Common Services of Social Security and the Autonomous Bodies of the Department, as well as the supervision and coordination of the proposals of plans of employment.

(b) The implementation of plans to improve the performance and training of human resources in the field of their functions.

(c) The preparation of the rules on the remuneration of staff, as well as their impetus and the monitoring of their implementation.

d) The elaboration of the preliminary draft offer of employment and the different calls for the provision of jobs, both by the Autonomous Bodies, as well as by the Social Security, the Gestoras and the Treasury.

e) Collective bargaining and the relationship with the representative bodies, in the field of their competences.

f) The study and processing of the relations of the staff of the staff of the Management Entities and the Common Services of Social Security and the Autonomous Bodies of the Department.

g) In general, the functions inherent in the administration of personnel and the surveillance and coordination of the functions of ordinary management that continue to be attributed to the units of personnel of the Gestoras and the General Treasury of Social Security, and of each Autonomous Body.

6. General Services Inspection:

The General Inspection of Services is responsible for the inspection of the organization and operation of all the management centers, Autonomous Bodies, the General Treasury of Social Security and the Management Entities of the Social security, dependent or attached to the Department, whatever its nature and territorial scope. It is also responsible for the planning, management, promotion and supervision of the operation of the internal inspection services of the agencies and entities of the Department, without prejudice to their own regulations.

7. No. General Subdirection of the Adscrito and Control Heritage of the Edifications:

It is the responsibility of the same entire control of the physical state of the real estate of the Subsecretariat, that is, of the members and the integrated ones in the Trade Union Heritage, both Historical and Accumulated.

This sub-direction is also attributed to the competition in the area of superior control and supervision of the patrimony, and projects related to its buildings, Autonomous Bodies and Social Security.

This Subdirection General is responsible for the following functions:

(a) The update of the inventory of the Heritage assigned to the Department, Autonomous Bodies and Social Security and the supervision and control of the physical state of the property assigned and of the Trade Union Heritage.

b) The annual forecast of the needs of the Department in order to the assigned real estate, the Trade Union Heritage and the Autonomous Bodies and the Social Security, as well as the determination of the instructions precise procedures for acting in order to acquire the real estate of the Autonomous Bodies and Entities of Social Security and on the allocations and modifications in the use or enjoyment of their real estate, and the elaboration of the technical and administrative documentation necessary for the execution of works in buildings attached to the Department and those of the Trade Union Heritage.

c) The determination of the precise instructions for coordinating the execution of works in buildings of the Autonomous Bodies and of the Entities of Social Security and the supervision of projects of the buildings attached, those of the Union Heritage and those of the Autonomous Bodies and the Social Security Entities.

d) The maintenance of the precise coordination with the Directorate General of State Heritage, in relation to the buildings attached.

8. No. General Subdirectorate of the Trade Union Heritage:

This Subdirectorate General has all the necessary powers for the management of the system of transfers in use to the Unions and Business Associations of the Union Heritage.

This Subdirection General is responsible for:

a) The updating and control of the Inventory of the Historical Trade Union Heritage and the Union Heritage.

b) The elaboration of the technical documentation aimed at the acquisition and disposal of any real estate of the accumulated trade union heritage, as well as the processing and proposal for the resolution of the files referred to the reintegration or compensation of the Historical Trade Union Heritage.

(c) The monitoring and control of the state of occupation of the Accumulated Union Heritage buildings.

(d) In general, the processing of the files on administration, management, assignment, alteration and revocation of the administrative acts referring to the goods of the accumulated trade union heritage.

e) To present the Secretariat of the Consultative Commission on the Trade Union Heritage in its breast.

9. No. General Financial Management Subdirectorate:

This is the competence of the:

a) Manage, from the economic-administrative perspective, the budget credits of the Ministry of Labor and Social Affairs and direct the General Enablement of the Ministry.

c) Coordinate and control grants and capital transfers.

10. Sub-directorate-General for Information Planning and Coordination:

Lies with this General Subdirection:

a) The design of the integrated information system of the Department and its monitoring.

b) The elaboration and control of methodologies, rules on analysis, programming, testing and documentation of applications.

c) The coordination and control of the information technology centers of the Department and the collaboration in the conduct of studies on issues affecting them.

d) Advice on the design and development of general utility and development applications, if any.

e) The elaboration of the general criteria for the evaluation and selection of computer equipment and the assessment of the acquisition of the same.

f) The establishment of guidelines and information plans for information and communications technologies.

g) The coordination and management of the measures provided for in the Organic Law 5/1992, of 29 October, of Regulation of Automated Treatment of Personal Data.

h) The coordination of the data model and the processes of the different management centers, Autonomous Bodies and Management Entities and the Common Services of Social Security.

i) The performance of the tasks of the Secretariat of the Information Ministerial Commission.

11. Data Processing General Subdirection:

Lies with this General Subdirection:

a) The address of the Information and Communications Technology Center of the Department.

b) The monitoring of the action plans in the field of information and communications technologies for central, peripheral, and central services, as well as those from the Salarial Guarantee Fund, National Institute for Safety and Hygiene at Work and the National Institute for the Promotion of Social Economy and, in general, those of all the department's management centers, with the exception of INEM and the dependents of the Secretariat of State of Social Security.

c) The processing before the Information and Communications Technologies Commission of the Department of proposals for the acquisition of goods and computer services corresponding to management centers and agencies referred to in the previous paragraph.

d) The implementation of the necessary telematic connections with the Management and Common Services of Social Security and INEM.

e) Support and collaboration with the General Planning and Information Coordination Subdirectorate in the elaboration of the information and communications technology plan of the Department and in the implementation of the approved general systems, carrying out the necessary design and development tasks.

Article 6. Technical General Secretariat.

1. The Technical General Secretariat is the steering centre to which the following tasks are to be developed:

(a) Technical assistance for the participation of the Department's authorities in the Council of Ministers, the Government's Delegation Committees, and the General Commission of Secretaries of State and Undersecretaries.

(b) Study and report of the general provisions of the Ministry, as well as, where appropriate, the elaboration of such rules or the participation therein.

c) Coordination of the Department's performance in relation to the Autonomous Communities.

d) Coordination of the Ministry's activities in the field of international relations, the elaboration of draft treaties, international agreements or agreements, and the promotion and coordination of international cooperation.

e) Processing of administrative resources in the face of the resolutions of the Ministry's authorities and relations with the Courts of Justice.

f) Realization of studies and management of national and international documentation on socioeconomic issues, as well as the direction of archives and libraries of the Department.

g) The development and coordination of the Department's administrative information activities.

h) Ordination, direction and coordination of the Ministry's statistical activity.

i) Ordination, direction and coordination of the department's editorial activity.

2. The Technical General Secretariat will have the following Subdirectorates General:

1. First Technical General ViceGeneral:

Corresponds to the Technical General ViceGeneral:

(a) Assistance to the Technical Secretary General in the performance of his duties.

b) Coordination and reporting of general and employment relations and employment relations.

(c) The preparation of documentation, the examination and report of the matters to be submitted to the Council of Ministers or to the General Commission of Secretaries of State and Undersecretaries.

d) In general, the exercise of the powers of the General Secretariat of the Technical Secretariat is not expressly attributed to other bodies of the management centre.

2. Deputy General Secretariat for Relations with Autonomous Communities and Reports on Social Security and Social Affairs:

A) In relation to relations with the Autonomous Communities:

(a) The coordination of the negotiations on transfers to the Autonomous Communities.

b) monitoring of the provisions and acts of the Autonomous Communities, in the field of employment and social affairs.

c) The coordination of the collaboration actions of the Department and its Autonomous Bodies and Management Entities with the Autonomous Administrations, both in terms of the subscription of agreements and the (a) calls for sectoral conferences and the setting of the criteria for the allocation of grants.

d) The preparation of documentation, the examination and report of the issues to be submitted to the Council of Ministers and the Government's Delegation for Autonomic Policy and which are related to the Autonomous Communities.

B) On reports on Social Security and Social Affairs:

(a) The proposal for the report of the draft general provisions on Social Security and Social Affairs, which is the subject of the Ministry's competence, as well as coordination and participation, in its case, in the preparation and processing of the same.

(b) You shall also issue a report on other projects in relation to the above matters when requested by the relevant organs of the Ministry.

c) The carrying out of studies and the analysis and management of legislation and documentation in these matters.

3. Deputy General Assistant for International Social Relations:

Corresponds to the Subdirectorate General of International Social Relations:

(a) The design, management, coordination and momentum of the Department's relations with international agencies and foreign authorities, without prejudice to the unit of representation and performance of the State abroad, which corresponds to the Ministry of Foreign Affairs.

b) Prepare international treaties, conventions and agreements in all areas of the Department's competence.

c) To promote and coordinate international technical cooperation in the Ministry's own areas.

d) Coordinate the activity of the Department with respect to the internal or external bodies related to the European Union.

e) The coordination and impetus of the Labor Department.

All agencies, management centers or units of the Department should channel any action in international affairs through the Subdirectorate General of International Social Relations.

4. General Resource Subdirection:

The General Resource Subdirection corresponds to:

(a) The study, processing and proposal for the resolution of the resources brought before any authority of the Department, regardless of the organ to be resolved.

(b) The study, processing and proposal for the resolution of the statements of lesivity in the procedures relating to the administration's property responsibilities.

(c) The processing of files relating to declarations of invalidity of the office of general administrative provisions as soon as they are the responsibility of the Department.

c) Direct assistance and guidance to the citizen in the field of administrative processing.

(d) Specific information on the organisation and functioning of the Social Security system, on the rights of members and beneficiaries, and on the functioning of employment services.

e) The dissemination of divulgative publications and institutional advertising.

f) Coordinate the Information and Attention Offices of the Public Law Entities linked to or dependent on the Department.

7. General Social and Labor Statistics Subdirectorate General:

Corresponds to the General Subdirection of Social and Labor Statistics:

b) The coordination, planning, direction and control of all the work that in the field of statistics are carried out by the central services as well as in the peripheral administration, Autonomous Bodies, Management Entities and General Treasury of Social Security.

c) Relations with the National Statistics Institute.

8. General Publications Subdirection:

Corresponds to the General Publications Subdirectorate:

a) Develop the annual editorial program on the basis of the projects formulated by the management centers, entities and Autonomous Bodies assigned to the Department.

b) Manage the editing, distribution and sale, if any, of official publications and any other activity related to the editorial process.

The Department's Publications Advisory Commission is attached to this Subdirectorate General.

Article 7. Directorate-General of the Labour and Social Security Inspectorate.

1. The Directorate-General of the Labour and Social Security Inspectorate is the management centre to which the management of the Labour and Social Security Inspection System is responsible, taking into account the organisation, planning, coordination and implementation of the (a) the role of the system in the field of industrial relations, the prevention of occupational risks, social security, employment and any other provisions or agreements with the Autonomous Communities.

2. The powers of planning for the activity of the System of Inspection of Labour and Social Security shall be exercised, without prejudice to those which correspond to the Autonomous Communities with powers in respect of the implementation of labour law, This Directorate-General must be promoted by the necessary mechanisms for the coordination of the schedules of the various competent administrations.

3. The Directorate-General of the Labour and Social Security Inspectorate is composed of the following Subdirectorates General:

1. Deputy General Secretariat for Coordination and Institutional Relations:

This Subdirection General is responsible for:

(a) The development of programmes for action and planning of the objectives of the Inspection System.

(b) Coordination with the Autonomous Communities in respect of the inspection of matters which have been the subject of transfer and which could have been entrusted to the Inspectorate by means of collaboration agreements.

c) Coordination of actions with the agencies of the Administration of Social Security and Employment for the development of the inspection activities in the field of Social Security and, in general, of the Systems of Protection Social.

d) Relations with other organs of the General Administration of the State.

e) The participation attributed to the Directorate-General in the institutions of the European Union, the ILO, and other international institutions, as well as in cooperation and technical assistance programmes with other countries.

f) The general coordination functions of this Directorate-General.

2. General Technical Assistance Subdirection:

This Subdirection General is responsible for:

(a) The elaboration of normative projects, reports and opinions on how many matters affect the scope of the Work and Social Security Inspectorate.

b) The elaboration of instructions, circulars and the setting of interpretative criteria on the performance of the System of Inspection of Work and Social Security.

c) The development of information and documentation to facilitate the development of the inspection function.

(d) The drawing up of reports on administrative or administrative resources requested from this Directorate-General and the knowledge of the sanctioning procedures whose resolution is attributed to this center directive.

This Subdirection General is responsible for:

(a) Relations with the Territorial Units of the Labour and Social Security Inspectorate.

4. Deputy General Affairs Subdirectorate General:

This Subdirection General is responsible for:

(a) The organization and management of the human and material resources of the System of Inspection of Labor and Social Security.

b) The organization and management of training programs for System officials.

c) The organization of the management center registry.

(d) The functions of the Secretariat and the handling of cases not attributed to the other Subdirectorates General.

e) The management and organization of the Information Unit of the Directorate-General, responsible for the IT system of the Labour and Social Security Inspectorate.

Article 8. General Secretariat for Employment.

1. The General Secretariat for Employment, under the top leadership of the Minister of Labour and Social Affairs, is responsible for the direction, impetus, general coordination and supervision of the management centres that are dependent on it.

2. Similarly, under the Minister's top management, it is for the exercise of the following functions:

(a) To promote and direct the management and development of individual and collective labour relations, working conditions and safety and hygiene at work.

b) To promote, direct and coordinate the management and regulation of employment, as well as the employment measures of reconversion.

c) To press and direct the Department's competences in relation to migratory movements, developing to this end the functions of assistance to emigrants and internal migrations, the work schedule of flows immigration and the planning of work permits.

d) Develop and implement policies and actions for the management and regulation of employment, unemployment protection, employment promotion, and occupational vocational training to be carried out in the field of administration General of the State.

e) Develop, promote and implement, in the field of the General Administration of the State, the political action attributed to the Department in the social economy sector.

(f) Propose and, where appropriate, process the draft general provisions on employment relations and employment.

(g) Promote, manage and deal with the European Social Fund with actions aimed at meeting the objectives of the policies in the field of employment, employment promotion and vocational training of the European Union.

(h) To provide, where appropriate, the representation of the Department when the Minister is expressly delegated by the Minister.

3. The Directorate-General for Employment and Migration is under the responsibility of the General Secretariat for Employment.

4. From the Secretary-General of Employment and with an organic level of Subdirectorate-General, they will depend:

(a) The Technical Cabinet, with functions of support and permanent assistance to the Secretary General. In addition to this task, the Cabinet will coordinate, without prejudice to the direct dependence of the General Secretariat of Employment, on the terms and issues mentioned by the Secretary General, the action of the Administrative Unit of the Social Fund. 5. Under the Department, through the General Secretariat of Employment, the Autonomous Bodies called the National Employment Institute, the Salarial Guarantee Fund, the National Institute of Safety and Hygiene at Work and the National Institute of Promotion of the Social Economy.

Article 9. Directorate-General for Work and Migration.

1. The Directorate-General for Work and Migration is the management centre responsible for the management and development of individual and collective labour relations, working conditions, safety and hygiene at work, the regulation of employment, the elaboration and interpretation of the employment rules and the competences of the Department in relation to migratory movements, exercising, for this purpose, the functions related to the programming and implementation of actions in favour of (a) migrants, without prejudice to the powers of the Ministry of Foreign Affairs in the field of protection, assistance and assistance to Spaniards abroad, assistance to internal migration, the scheduling of immigration flows, the planning of work permits for foreigners, as well as the other powers of In this matter, it attributes the Organic Law 7/1985, of July 1, and the Royal Decree 155/1996, of February 2, the promotion and social integration of immigrant collectives.

2. Deputy General Labor Relations Subdirectorate:

This Subdirection General corresponds to:

(a) Authorizing the employment measures of restructuring and employment regulation for economic, technical, organizational and production causes.

b) Develop the functions of the Department in the field of conciliation, mediation and arbitration in labor disputes.

c) Conduct the prospecting, analysis and monitoring of collective conflicts.

d) Manage and prepare the resolution of the

sanctioning procedures in the field of immigration, employment, employment and safety and hygiene at work in the alleged competence of the Directorate-General for Work and Migration, as well as preparing for the resolution of organs higher.

b) Elaboration of reports and consultations for International Organizations that, by reason of the matter, have aspects common to the Directorate General for Work and Migration.

(c) Coordination with the other Member States regarding the transposition of Community Directives into national law, the content of which affects matters of competence of the Directorate-General for Labour and Migration.

4. Deputy General Manager Of Migratory Movements:

This Subdirection General corresponds to:

(a) Programming, guidance and assistance to Spanish workers who move and reside abroad and family members in their care.

(b) The organisation and assistance of temporary, seasonal and qualified migration campaigns.

c) The promotion and support of the programs of free movement of workers.

d) The promotion and implementation of assistance programs in favor of emigrants, without prejudice to the competences of the Ministry of Foreign Affairs with respect to the Spanish abroad.

e) Develop actions for the social and professional promotion of Spanish emigrants.

f) To promote, in collaboration with other organizations, the educational and cultural promotion of emigrants.

g) Orientate and manage actions in favor of returned emigrants.

5. Deputy General Immigration Subdirectorate:

This Subdirection General corresponds to:

a) The determination of the needs of foreign labor.

b) The recruitment and channelling of immigration flows, within the framework of the Department's competences.

c) The management and management of foreign work, within the framework of the Department's competencies.

d) The monitoring of the labour aspects of immigration flows and their assessment.

e) Planning, routing and assistance to workers and their families participating in internal migration.

6. Subdirectorate General for Promotion and Social Integration:

This Subdirection General corresponds to:

a) The elaboration and follow-up of the annual program of implementation of the Plan for the Social Integration of Migrants.

b) The design and management of actions for the employment, social and cultural promotion of immigrants, in collaboration with other ministerial departments and public administrations.

c) The promotion and support of private initiatives in the field of inter-community relations.

d) The development of a centralized system of information and analysis of immigration.

Article 10. General Secretariat for Social Affairs.

1. The General Secretariat for Social Affairs, under the top leadership of the Minister of Labour and Social Affairs, is responsible for the direction, impetus, general coordination and supervision of the management centres that are dependent on it.

2. It is for the General Secretariat for Social Affairs to exercise the following

:

a) Management, planning, coordination and evaluation of social services, taking into account the state obligations in the areas of social welfare; promoting cooperation with non-governmental organisations of a character national in the field of social action; exercise of the guardianship of the State with respect to the care entities outside the Administration and the protectorate of the Government on the Foundation for the benefit-care.

b) Promotion and promotion of the conditions that enable the social equality of both sexes, and the participation of women in political, cultural, economic and social life.

Article 11. Directorate-General for Social, Minor and Family Action.

1. The Directorate-General for Social, Minor and Family Action is the executive centre to which it is responsible to carry out the following tasks:

(a) The analysis, the elaboration, the coordination and the follow-up of the action programmes in the field of social services and social welfare, in the framework of the State obligations and the cooperation with the Communities Autonomous.

b) The performance of the government protectorate on welfare-welfare foundations.

c) The analysis, elaboration, coordination and monitoring of the programs of action in the field of protection and promotion of the child and of the family and of prevention of the situations of social difficulty of these collectives.

d) The promotion of cooperation with non-governmental organizations in the fields related to social services programs and to foundations and tutored entities.

e) The exercise of the guardianship of the State in relation to the care entities outside the administration.

2. The Directorate-General for Social, Minor and Family Action is structured in the following Subdirectorates General:
