The public employment offer is part of the comprehensive planning of human resources, where

operates as a residual instrument for the incorporation of new income personnel when the internal mechanisms of needs coverage are insufficient.

From this budget, the offer of public employment for 1997 accentuates the selective nature of new staff additions and the effort to contain public expenditure by way of staff expenditure, and it deepens in its character as an instrument of global planning by covering for the first time all non-business state public sector personnel.

According to this, the scope of the offer of public employment is extended to the health personnel, the State Security Forces and Corps, official staff at the service of the Administration of Justice and the staff of the entities. (a) the public sector, as referred to in Article 6.5 of the General Budget Law, which is not included in the offers of public employment for previous years.

The framework to which the additions of new staff will be referred to in 1997, in general for all personnel serving the non-business public sector, is defined in Article 17.4 of Law 12/1996, of 30 In December, the General Budget of the State for 1997, at the time that the calls for entry for new staff will be concentrated in the sectors, functions and professional categories that are considered, absolutely, priorities and that the number of places of new income must be less than 25 per 100 application of the rate of replacement of staff. However, the calculation of new entry places referred to in the preceding paragraph shall not apply to the staff at the service of the Administration of Justice, which shall be determined in accordance with the provisions of Law 38/1988 of 28 December 1988. Likewise, the Budget Law also excludes the Armed Forces, whose public offer of employment was approved by Royal Decree 292/1997 of 28 February.

This general principle is applied to collectives liable to be included in the offer of public employment of the non-business state public sector, in the third, third, transitional provision of the said Law of Budgets. It establishes that the Government may authorise, on a proposal from the Ministry of Public Administration and on the initiative of the departments, bodies or public bodies competent in the matter, and with the favourable report of the Ministry of Economy and Finance, the convocation of those vacancies which are considered to be liable to affect the functioning of the essential public services of any of the areas of the non-business state public sector, with the limits Article 17 (4) of that Law 12/1996.

This third transitional provision also indicates that 25 per 100 of the posts or places which, while being budgeted and included in the relations of jobs, may be called, may also be called Approved catalogues or templates, in accordance with the rules of application in each field, are either temporarily or temporarily performed.

On the other hand, the Administrative Agreement on Working Conditions in the Civil Service of 15 September 1994, in Chapter XIV, also provides for the selective nature of the offer of public employment, not only the needs of staff to be met by external candidates in the relevant financial year, but also the definition of policies to be developed in the field of public employment during the year.

In this context, it is up to the Government to authorize the public call for those places that cannot be covered with existing personnel, which are considered to be absolutely priority or essential for the the provision of public services, the coverage of which is urgent and non-deferred. All this in the overall context of budgetary restraint and no increase in staff at the service of the public administration.

Consequently, this Royal Decree approves certain Government forecasts regarding the management of public employment policies and an offer of limited places to very specific sectors or administrative areas.

In its virtue, on the proposal of the Minister of Public Administrations, with the favorable report of the Ministry of Economy and Finance and after deliberation of the Council of Ministers at its meeting of March 21, 1997,

D I S P O N G O:

Article 1. Approval of the offer of public employment.

In compliance with the provisions of Article 18 of Law 30/1984, of 2 August, of Measures for the Reform of the Civil Service, and of Article 17.4 of Law 12/1996, of December 30, of the General Budget of the State for 1997, the offer of public employment for 1997 is approved in the terms set out in this Royal Decree.

The calls for selective tests resulting from this offer of employment will be informed by the Directorate-General of the Civil Service and may only be published in the financial year to which it is referred, without prejudice to the provisions of Article 7.2.

Article 2. Quantification of the public employment offer.

The public employment offer includes human resource needs with budgetary allocation that cannot be met with existing personnel, according to the criteria and according to the composition that is details in the Single Annex.

Article 3. Human resource planning.

The Ministry of Public Administration will promote the implementation of employment plans as instruments for the planning and management of human resources and as means of rationalization of the structure, composition and distribution of the templates, from a comprehensive perspective of personnel policy.

Such plans may affect one or more specific ministries, agencies or administrative areas and will be approved by the Secretary of State for Public Administration, with a favorable report from the Ministry of Economy and Finance, after negotiation with the most representative trade union organizations in the terms laid down in Law 9/1987, of 12 June, of organs of representation, determination of the working conditions and participation of the staff service of public administrations.

The employment plans will give preference to the measures of relocation and vocational training of the existing staff, and it can be foreseen how many complementary measures are necessary in the framework of the same.

Article 4. Provision of posts and mobility.

1. The Secretariat of State for Public Administration may authorise the call for tenders for the provision of posts to cover, on a voluntary basis, vacant posts in units, departments and deficit bodies. staff with officials in the areas, sectors or departments in surplus to determine the basis for the call.

On the other hand, the employment plans will be able to determine the non-incorporation of new personnel in the Departments and agencies identified as surplus of personnel, as well as the possibility of convoking competitions for the provision of limited posts to staff in the fields to be determined.

2. Rereceipts to the active service, on the basis of provisional membership of staff in a situation which does not entail a reserve of work, shall, in general, be produced in the centres and bodies identified as loss-making personnel, when in The same shall exist for the Body or Scale to which the official applying for re-entry belongs. In any event, the provisional revenue shall be in accordance with the guidelines to be determined by the Ministry of Public Administration.

Article 5. Internal promotion.

In 1997, 80 places of internal promotion of group B to the A, 250 places of group C to B, 1,000 places of group D to C and 50 places of E to D, with the distribution that the Ministry of Public Administrations will determine.

Article 6. Labour staff.

The selective tests corresponding to the work staff set out in the Annex to this Royal Decree, will have to refer to posts which, in accordance with the provisions of Article 15 of Law 30/1984, of 2 August, in the Under Law 23/1988 of 28 July and Law 42/1994 of 30 December 1994, they may be carried out by labour staff.

Prior to the authorization by the Ministry of Public Administrations of the call for selective tests for admission to the places of work staff, which are listed in the annex of this Royal Decree, the agencies Proposers shall be required to prove the existence of an annual budget allocation.

Article 7. Temporary staff.

1. During 1997, no new temporary staff will be recruited or interim officials will be appointed, except in exceptional cases and to cover urgent and non-deferred needs, with joint authorization from the Ministries of Public and Economic and Finance Administrations and within the framework of the criteria established in personnel policy.

Teachers and administration staff may be appointed and services and services provided in public schools, with the joint authorization of the Ministries of Public and Economic Administrations and Finance.

Contracts to meet seasonal needs will automatically end when you beat your time limit.

2. The process of consolidation of temporary employment, of a structural and permanent nature, can be carried out, both within the framework of the corresponding employment plans and through calls for action, in the latter case the Authorization of the Ministry of Public Administration, prior to the favorable report of the Ministry of Economy and Finance, except in the consolidation processes expressly provided for in this Royal Decree.

The selective processes referred to in the preceding paragraph shall in any event respect the principles of equality, merit, capacity and publicity, and their initiative shall be the responsibility of the Departments or bodies to which they affect. The total number of job-consolidation processes to be initiated in 1997 shall be as high as 25 per 100 of the posts or places in global computation, which are budgeted or included in the employment relationship, Approved catalogs or templates are either temporarily or temporarily performed.

3. The employment relationships of those who temporarily perform the places to be fixed in the framework of a consolidation process, will be extended until the selective processes corresponding to the call for tenders are completed. the places of a fixed character. Article 8. Teaching staff.

In order to meet the needs of teaching staff, arising from the requirements of the development of the General Organic Law of the Educational System (LOGSE), the Ministry of Education and Culture is authorized to call for Selective entry into the Master's Corps up to a maximum of 2,000 places in 1997, currently covered by interim staff.

Article 9. Staff at the service of the Administration of Justice.

In the attention of the needs of personnel to the service of the Administration of Justice, derived from the requirements of the development of the Law of Demarcation and the Judicial Plant, the Ministry of Justice is authorized to call Selective tests for admission, in the Body of Judicial Secretaries up to 100 places, in the Corps of Medical Physicians up to 25 places, in the Body of Officers and Secretaries of Peace up to 700 places, in the Body of Auxiliary to 1,025 places and in the Body of Agents up to 1,100 places, as well as the call for 131 places of work staff, currently covered by interim staff.

According to Article 10 of the Order of March 1, 1996 on the selection, proposal and appointment of interim officials to fill vacant positions of the Corps of Forensic, Official, Auxiliary and Agents of Medical the Administration of Justice and those who provide services at the National Institute of Toxicology, the interim staff shall cease when the place they perform is covered by the official.

Article 10. Health personnel.

The National Institute of Health is authorized to call for selective testing for statutory staff of the Health Institutions for Social Security up to a maximum of 1,977 optional staff and 5,200 seats. non-sanitary staff, currently covered with interim staff.

According to the fourth additional provision of Royal Decree 118/1991 of 25 January on the selection of statutory staff and the provision of places in the Health Institutions of Social Security, temporary staff shall cease when there is a fixed statutory staff appointed to occupy those places.

Article 11. Reserve of seats for the Basic Scale of Cabos and Guards of the Civil Guard.

Of the total of 970 places called for the Basic Scale of the Cabos and Guards that are listed in the annex, 485 are reserved for the military of employment of the category of Troop and Marineria Professional of the Armed Forces that carry, to the less, three years of effective services as such. In the case of such a call, the arrangements for the accumulation of such places which are not covered by the employment military shall be provided for.

The call will be held at the joint initiative of the Ministries of Defense and Interior, with the favorable report of the General Administration of the Civil Service.

For the students of the College of Young Guards 240 places will be reserved. Those who are left unfilled will be cumulated with the quota of free places.

Article 12. Internal promotion in the Civil Guard.

The call for the following places for admission to the military training centers is authorized, through internal promotion:

(a) 145 seats on the Executive Scale and 266 on the Sub-Officer Scale for those who, not meeting the conditions set out in Articles 17.2.c) and 24.1 of Royal Decree 1951/1995 of 1 December 1995, for which it is approved The General Regulation of Income and Promotion in the Armed Forces and the Civil Guard, will apply to them the transitional provision of the same.

b) 145 places on the Executive Scale and 266 of the Subofficial Scale for those who meet the conditions set out in Articles 17 and 24 of the said Royal Decree 1951/1995 of 1 December 1995.

The places corresponding to paragraph (a), which are not covered, shall be accumulated in accordance with paragraph (b) for access to the respective Scales.

Article 13. People with disabilities.

In the selective processes for entry into Bodies and Escalations of officials and categories of labour personnel, including those for internal promotion, persons with disabilities on equal terms will be admitted. conditions with other applicants, reserving in the calls for the percentage of places corresponding to the access of applicants who have the legal status of a person with disabilities, in accordance with the rules applicable in each case.

Additional disposition first. Offer of employment of the Local Corporations.

Local corporations that approve their public employment offers must submit the agreements approving them to the State Administration, in accordance with the provisions of Article 56.1 of Law 7/1985, of 2 of April.

Additional provision second. Local Administration staff with national rating.

In order to address the needs of the Local Administration, the Ministry of Public Administration may call for selective testing for access to the Local Administration Officers ' Scale with a national character in the following subscales: 70 places for the Secretariat, category of Entry; 70 places for Intervention Treasury, Superior category for internal promotion shift, and 125 places for Interventional-Treasury, Entry category.

Additional provision third. Air traffic controller staff.

According to the procedure for the selection of the air traffic controller staff of the Public Airport Spanish Airports and Air Navigation, it is authorized to carry out 144 contracts in practice and 96 fixed contracts for personnel.

Additional provision fourth. Participation in selective testing courts.

They will not be able to form part of selection commissions or selective testing courts for entry into the Corps or Escalations of officials or categories of labor personnel, who have the highest office, according to the law. with the provisions of Law 12/1995, of 11 May, on Incompatibilities of the Members of the Government of the Nation and of the High Charges of the General Administration of the State.

Single end disposition. Entry into force.

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".
